Today Show Follow-up…..Test Case To Stop The Smut Online?

On the Today show….a groundbreaking test case will take place in New Jersey…which may impact the anonymous web posts and who takes responsibility for them….

It will come from the angle of consumer fraud!

This case has an online forum similar the the Sun- Sentinel forum…Topix….

Like Topix this forum has rules that state it will moderate and remove inappropriate posts….

On Topix it states…. at the bottom of each post and page…….

Please note by clicking on “post comment” you acknowledge that you read the terms of service and the comment you are posting is in compliance with such terms. Be polite. Inappropriate posts may be removed by the moderator.

So far any posting I have seen on the infamous blog that fit this description have not been removed….

Note: In recent weeks the blog has returned to being substantive…. the few times a lone poster has tried to get “inappropriate” no one else took the bait and it died…kudos to the present posters for the turn around.

So, if the forum…paper does not moderate and remove anonymous postings ….are they violating the consumers rights?

A google search under New Jersey anonymity case…brings up both sides….from 2007.

Seems a simple solution is to follow the Miami Heral’s lead and require registration to post…takes the onus off the publication and puts it on the poster….and instead of not paying attention to the small print at the bottom of the posting page….the participants would be signing on …fully aware before that first click!
