Here’s The Scoop…3/24/09 LBTS Agenda…With Updates…
March 20, 2009 by Barbara
COPIES ….YOU WANT COPIES?….
Dear Readers…usually this writer goes to Town Hall on the Friday before the Commission meetings and the receptionist makes copies of the backup materials….No problem …It usually takes 10- 20 minutes…depending on how many ordinances there are….The staff has always been friendly…and I have always waited while they take care of any other people…..a pleasant experience…and I was most appreciative…paying the 15 cents per page…
Today, I had a “feeling” it would be different …First because the Town Manager was in the hall……and she is usually not there on Friday afternoons……Second because there were copies of the 3/20/09 Pompano Pelican with this front page story by Judy Vik… “Words like ‘ confidence ‘ and ‘blessed’ do not make for annual review say LBTS commissioners” “LBTS manager lashes out a commissioners for requesting review of her town job even though Charter demands one”…OUCH!……Included in the 2 page story this writer’s words at the podium and the manager’s own words…(both previously posted…LBTS agenda/meeting 3/10/09)….
After making the list of what I wanted copied….I handed it to Nikki (our Assistant Town Clerk ) who was filling in for our Town Receptionist, Karen at the front desk …..Town Clerk White came out after a few minutes and said it was too much and she had things for Nikki to do. She asked for time until Monday.. I replied it had never been a problem before, but of course it would be fine if that was what was required by the Town. I asked for the back-up book to jot down a few particulars…and then asked for the list…to remove what I had copied and add the following note…
‘3/20/09…Please Note; In the past copies were made while I waited with no problem. Clerk White said Nikki was busy today and asked if Monday would be alright. I said of course. I appreciate the copies and am cooperative for their receipt. Barbara Cole’…Why?…Just in case a certain “Vigilante” gets on his “high horse” and makes up what transpired…After all… at the 3/10/09 meeting and reported in the Pelican( same 3/20/09 story)….the Vice Mayor said…”One employee came to me in tears saying she was run into the ground with demands (for information) McIntee continued, “We can’t be burying them with requests for information, making outrageous demands, we can’t be talking down to them.”…..No doubt a request for copies of backup materials…which is the right of the public…would lead to more of the same!…
In the meantime I will cover what I can…and fill in the rest on Monday….whenever they call with the availability…Maybe someday soon we can join Coral Springs and provide the backup online…saving time…and money and being “green”…http://agenda.coralsprings.org/citizens/Detail_Meeting.aspx?ID=1052&Format=Agenda

a. Ordinance 2009-06 for 2nd Reading: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA, CREATING SECTION 17-16 OF THE CODE OF ORDINANCES TO PROVIDE A DEFINITION OF SWALES, TO IMPOSE THE REPONSIBILITY FOR MAINTAINING SWALES ON THE ADJOINING PROPERTY OWNER OR OWNERS, AND TO REGLUATE THE ITEMS THAT MAY BE PLACED OR PLANTED IN SWALE AREAS; PROVIDING FOR SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE (Tabled on 1st reading at the January 27, 2008 Commission meeting by Commissioner Dodd) Approved 1st reading at the February 24, 2009 Commission meeting
BC- This is the one folks…where the Town is going to put the responsibility of maintaining the Town’s property on the owner…even though in some neighborhoods the Town will pay for the watering …in some the Town will not……Your paved swale will be removed and you will be responsible to maintain what is replaced…Still no word on the constitutionality…HMMM…The Pier sign is in town property…so the Mc-Gang is saying …it belongs to the town…the town maintains it…but other property that belongs to the town well….”Pandora’s Box…VM?”….
b. Ordinance 2009-08 for 2nd Reading: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY- THE- SEA, FLORIDA, AMENDING SECTION 19-21 OF THE CODE OF ORDINANCES TO AMEND THE VESSEL PARKING AND STORAGE REGULATIONS FOR THOSE PROPERTIES THAT WERE ANNEXED INTO THE TOWN IN 2001, FOR SO LONG AS OWNERSHIP OF SAID PROPERTIES DOES NOT CHANGE; PROVIDING FOR SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE (Approved 1st reading at the January 27, 2009 Commission meeting as amended) Amended and Approved 1st reading at the February 24, 2009 Commission meeting

BC- the boats will be covered with nice tarps….but what boats will be left to cover?………
11. COMMISSIONER COMMENTS
12. CONSENT AGENDA
a. Commission approval of the Broward County Supervisor of Elections agreement for November 3, 2009 (Clerk White) Tabled at the March 10, 2009 Commission Meeting by Vice Mayor McIntee
BC- Commissioner Dodd thought there had to be a mistake…how could an election with poll workers be so close in price to a mail-in ballots election…SURPRISE…
Reg. Nov. election…$13,896/ Mail-in election…$13,088…broken down (somewhat vague)…Contract service…$2200/postage….$2119/ Printing…$3034/ Legal ads….$5,736…. WOW!
UPDATE- Comm. Dodd thought the legal ads were not correct in the poll costs…which would have brought that cost up $5000….without the back-up to check will need to check out if it was adjusted…or why it was so much higher for mail-in….
Looks like March 2010 would be the way to go….if we need this at all….Do we really need one at all?…You bet the CIC candidates need a cause to run on in 2010….And a 33 ft height limit….. that’s their “Baby” right there…Watch!
b. Royal Palm Tree Replacement on Commercial Blvd (227 Commercial Blvd) – waiving of Right-of-Way permit fees (Assistant Town Manager Olinzock)
BC- Dec.12,2008 a car hit some trees on Commercial Blvd…AIG (Yep that AIG) Insurance gave us a check for $3400…4 bids were done and McCall Nursery and Landscaping came in the lowest at….$3400…imagine that!…
c. Commission approval of Special Event application for the Commercial Boulevard Pavilion Ribbon Cutting Ceremony, a Town Sponsored Event, Monday, April 6, 2009, 5:00 PM till 9:00 PM – Commission approval of concept on March 10, 2009 – Cost $1,000 (Assistant Town Manager Olinzock)
d. Commission approval of Special Event application for “Cruisin with Aruba/Village Pump” Thursday, April 30, 2009, 2:30 PM to 11:00 PM (Assistant Town Manager Olinzock)
BC- backup says…”Paul and Young Ron Giveaway Party”…no more detail to what that means…
UPDATE….Guess I was showing my radio ignorance…these guys are radio personalities…http://www.browardpalmbeach.com/2008-07-31/news/the-paul-and-young-ron-experience/
e. Commission approval of Hold Harmless and Indemnification agreement for 223 Bombay Avenue (Assistant Town Manager Olinzock)
BC- To rectify the go ahead to put in a retaining wall…and make sure if anything happens the owners are responsible…no harm…no foul…
f. Commission approval for replacement trees at 4521 N. Seagrape Drive to be Canary Island Date Palms in the amount of $11,763.60 in lieu of the Royal Palms previously approved by Town Commission in the amount of $480.00 (Assistant Town Manager Olinzock)
BC- You may recall the homeowner Happy Vasil …who was one of the CIC “parade”public comment speakers…taking to the podium on 3/10/09…speaking about the Manager and then turning to Assist. Olinzock telling John …”What a man!”…Guess she wanted something…$11,000 dollars!…
A little history ..when the Seagrape Drive sidewalks were put in…the trees planted by this homeowner’s son were in the way…after being promised help by the “2 Hats” they did an about face and the tree were removed…The previous commission decided to allow $480 for new ones…Mrs. Vasil wants some special palm trees writing in a letter to the Administration and the commissioners Royal Palms just won’t do…instead she wants Canary Island Date Palms …for $11,763.60!…to be put on her private property…Guess she figures the Seagrape cul-de-sac being paved up to the homeowner’s garage door and the help offered to the Palm Club for the stimulus request…gives her a fighting chance! YIKES!…
g. Commission approval for placement of new AT&T fiber optic cabinet and to waive right-of-way permit fees – 2100 SE 15th St. (Assistant Town Manager Olinzock)

j. Commission approvalof $500 for Title search fo determination of ownership of pier sign (Manager Colon)
BC- For “God’s” sake…let the Marchelos brothers come up and speak…and stop letting the taxpayers foot the bill for “Vigilante” McIntee’s latest issue…with them…
13. RESOLUTION – “Public Comments”
a. Resolution 2009-12: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA AMENDING RESOLUTION 2009-05 ESTABLISHING FEES FOR PARKING IN METERED PARKING SPACES; TO ALLOW FOR BEACH PARKING; EFFECTIVE APRIL 1, 2009

14. QUASI JUDICIAL PUBLIC HEARINGS
15. OLD BUSINESS
a. Commission direction to Town Attorney regarding Rental Ordinances revision (Manager Colon)
BC- this was discussed some time ago varying types of rentals allowed…
b. Discussion and/or action regarding RFP 09-02-01, Waste Haulers (Manager Colon)
BC- Previously posted the RFPs went out ….the bids came in from 5 companies…calls were made by the Town to see what other municipalities thought of the companies…
All Service- 1 gave a 10/ 3 gave a scale of 8-9/ 2 would not rate them
Waste Management-4 gave them an 8/1 gave them a 10/1 gave them a 5/ 3 would not rate them but said they were excellent/5 would not rate them
For the other proposer 13 municipalities and/or housing authorities were surveyed-6 let us know who was their waste hauler and recycling provider-rated them on scale 1-10 and 2 used Choice/2 used Waste Pro/2 used Southern Waste System
Choice- 1 gave them a 8/1 gave them an 8.5/ no complaints indicated
Waste Pro- 1 gave them an 9/ 1 gave them a 9.5/ no complaints incdicated
Southern Waste Systems-1 gave them a 8.5/ 1 gave them a 9/ no complaints indicated
Scoring Criteria Res-Single/Duplex-30%/Res. multi-20%/Res.dumpster-10%/Comm. -10%/Commission selection-30%/=100%
Ranking 1 is the lowest bidder-2 second lowest and so on….
Scores without Commission-
Solid Waste –
Waste Management-
Res-single duplex-3/Res. multi-3/Res. dumpster-5/Commercial-5….Total 16/weighted score 2.500
All Service-
Res single-duplex-4/Res.multi-4/Res.dumpster-1/Commercial.-2…..Total 11/ weighted score 2.300
Waste Pro-
Res. single -duplex-5/Res.multi-2/Res.dumpster-2/Commercial.-1….Total 10/weighted score 2.200

Southern Waste-

BC- Now it will be up to the Commission…30% to decide…pay the extra and keep Waste Management or go for the lowest bidder Choice Environmental…save the money…and follow Fort Lauderdale……
16. NEW BUSINESS
a. Discussion and/or action concerning current placement of Public Comments in the agenda and the order of the speakers – requested by Liliana Pomareda (Commissioner Dodd)
BC- Comm. Dodd received a letter from a resident who came early to sign up and feels that comments should be taken in the order they are written…
As previously posted..(CIC Town Hall meeting)……”McIntee is God”- Joe Couriel asked for public comments to be moved up …and the Commissioners fell over themselves to accommodate…after presentations…look for this addition…to be brought up…
b. Discussion and/or action concerning permit fees charged to the Chamber of Commerce over the Taste of the Beach or other events (Commissioner Dodd)
BC- There was concern over permit costs and where they came from…the back-up said …Broward County…
c. Discussion and/or action to increase police beach patrols (Commissioner Silverstone)
BC-This too came from the CIC Town hall meeting…and CIC members…as they “went after” the BSO Police…We hear this is fallout for lack of strong BSO Police response after the “Cockroach” incident…..HMMM……..
d. Discussion and/or action to hold a Town meeting with an independent facilitator with the objective to work out Commissioner issues with Town staff and each other. The goal is to further increase the efficiency of Town government (Commissioner Silverstone)
BC- Let’s see on March 17th…Comm. Silverstone spent approx. an hour talking to Comm. Dodd….at the St. Patty’s Day party in the Village Grille….Comm. Silvertone’s Fiancee’ said she was glad they were talking…and at that very time …we now know……Comm. Silverstone put this item on the agenda…aimed squarely at Comm. Dodd…FLASHBACK…to Comm. Silverstone’s BFF VM McIntee who was buddy-buddy with Dodd in the summer of 2008…knowing that he ( McIntee) had “thrown Dodd under the bus” in Tallahassee with the Ethics commission on a possibility of conflict of interest being Chair of the CIC and a Commissioner…(probable cause was found…no action taken)…..YIKES!
e. Noise Ordinance: Music is very loud and neighbors are complaining. Should we be having weekend long event with music all afternoon and evening? (Commissioner Clottey)
BC- the back-up show the 2002 ordinances…Can’t we stop going after the Greeks and the businesses…Comm. Clottey did not want to table the electrical for the impact on the businesses…and then she introduces this…seems like a Mc-Furth action…Just go and enjoy the fun in town…instead…
