WHAT’S UP WITH THAT?….

We hear,  from an observant resident that the turtle eggs are being moved!…This resident said she saw it and asked and although it was stated at the recent LBTS Turtle Workshop, that this was no longer being advised…it is in fact happening here!…The response to this citizen on why…was it was due to the noise and the lights…The eggs are going back into the sand by Sea Ranch Club…HMMM…July 4th Fire Display from that area of the beach…thanks to the Mc-Furth Gang and the turtle eggs are suddenly being moved?…OOPS!…

We hear the VFD has been out two times this week spraying foam on the building at the SW corner of Commercial Blvd. and Bougainvilla…for bees…After visit number one they left it looking like Christmas …..with caution tape across the streets access onto Commercial…Day two brought them back for another round…and more foam…more caution tape around the front of the empty store….Questions being asked…what kind of foam was used…environmentally approved foam that will not cause problems for our water system?….OOPS!….

We hear the VFD once again chose to follow AMR on a medical call for a gentleman at the Beach Pavilion…who had chest pains…The firetruck was parked ion El Mar and crew was standing around…..We hear they were blocking the entry to the Pier parking lot and  were not too quick to move …that is until cameras starting clicking! OOPS!…We hear as first responders there is nothing the VFD could have done for this type medical call……So why take the truck out in the middle of the day to muck up traffic in the middle of town?…OOPS!

On that same day, last  Thursday the schools were out…the beach was packed and the water was choppy…this writer and daughter were at Aruba Beach Cafe’ for lunch and never observed any VFD- Beach Patrol on hand to cover such an active day…Despite reassurance from the VFD Fire Chief afterward upon picking up a public records request for the Beach Rescue incident reports (to be posted later) that they were out there…a look at the firehouse as we left showed the ATVs there…OOPS!…

The new canopy is now up for the firetrucks…and we hear now there is no room for the VFD boat that was stationed alongside?…OOPS!…

We hear there is to be a shade session at 6 pm on Tues. June 9th…in between the 5 pm budget workshop and the 7 pm Commission meeting…BUT…the Town is supposed to respond in filing a motion by June 8th!…So that means the Town is either filing a motion PRIOR to direction by the Commission or missing the deadline!…OOPS!…

Usually the Commission meeting backup is ready by 3 pm the Friday but yesterday, at 3 pm we were told they were just getting started due to an item being added late…HMMM…A big no no according to the agenda deadline rules…so no backup in Town Hall we were told…that afternoon before Town Hall closed at 4:30 pm……although it would be online shortly before or after close of business…(it was)…The item..it seems was Comm. Silverstone’s…new business…..while an item Comm. Dodd put on before the deadline was removed by the Manager without his consent……another  big no no…OOPS!…(Agenda/ commentary to be posted soon)…

The Hi-Riser this week (6/4/09) has an article about the “Totters” by Fallan Patterson…which looks at the “dismissed” item put back on the last agenda by Comm. Dodd looking for an Ordinance to prevent scavengers from taking the recyclables from the Right-Of-Ways thus keeping a certain element out of our neighborhoods..(leaving them able to “scout ou”t our homes) and keeping the recycle revenue percentages coming back to the Town…….The VP of Choice Environmental, Mike Savino said “LBTS is involved an Interlocal Agreement with 27 other cities in which the cities get a check for the recyclable materials they collect. The product [in the swale] belongs to the homeowners” ..(this was verified by the Town Atty. in the backup for the item)…”You can’t go rummaging through people’s stuff and making a mess, we try to deter it, report it if we see it.”…Comm. Sillverstone is quoted after these comments saying ‘he is not opposed to people collecting material from the recycling bins, but is concerned that if more people come around, their scavenging might affect the percentages the town receives.’ …”I can feel for those people. I’d rather them do this than less industrious things.”…UGHHH!…. Comm. Dodd said he wanted stop the risk right now by to ‘ give the police permission to tell “totters” who wish to pick up these materials “Not in this town. Why risk these types of people driving around our neighborhoods?”…(previous 5/26-27/09 Comm. meeting post)…An owner of a recycling center commented on collecting from the general public and the costs…saying ” In the last eight or nine months since things turned south, people are more aware they can be environmentally friendly and get a little money for it.”…OOPS!…

BC- From the article it clearly reaffirms the timliness and the necessity for the item Comm. Dodd put on, although it was hypocritically dismissed by the “Gang of 3″…OUCH!…

BC- Let’s see what is contained this go- round…this has been kicked around quite a few times…In this writer’s opinion it has been done under pressure from a few “chosen CIC members” and pushed through by the Commission CIC members on the dais….to benefit those “chosen few”…at the expense (pun intended) of the rest of the taxpayers in this town…

The rate originally decided on for residential parking annual permit was $50….Once voted on and then pulled to accommodate these CIC members…by Vice Mayor McIntee…Next time it was on to enact but  due to McIntee “being asleep at the wheel” … all residential parking was kept under the same  heading as it has long  been designated by signage and in the ordinance…Realizing he “blew it” after the vote…McIntee tried unsuccessfully to re-vote…and change this vote…neither worked…Next time this was on the agenda…It was brought back…only this time the special “benefit” to the “Chosen CIC members” was also a lower annual rate for beach parking to $20 annually!…It passed!…

Other towns charge upwards of $150 dollars annually for this type of prime parking…and we just gave it away…at a cost to the taxpayers of lower revenues for prime spots…that will be empty for a large part of the time…and now paying for new signage…designating the spaces for beach permits only…

The present residential spaces ….soon to be beach parking spaces  are already underutilized in the El Prado parking lot…with tourists moving their cars to keep from being ticketed on a regular basis……

Nothing like election time….with friends on the dais…

‘Sec. 4-30. Vicious dogs running at large prohibited.

(a) It shall be unlawful for any owner or keeper of any vicious dog to permit such dog to run at large or without the enclosure of the owner or keeper thereof within the corporate limits of the Town without being properly muzzled.
(b) Any dog known to have bitten any person is hereby defined as a “vicious dog” but the term “vicious dog” shall not be limited to only those dogs which are known to have bitten any person.

Dangerous Dogs: Section 4-12

A “Dangerous Dog” is a dog that has done the following:

  • A dog that when unprovoked approaches a person in a menacing fashion or with an attack attitude.
  • A dog that has killed or caused the death of a domestic animal in one incident, while off the owner’s or keeper’s property.
  • Has aggressively bitten, attacked, endangered, killed or inflicted severe injury on a human being on public or private property.
  • Has been used primarily or in part for the purpose of dog fighting.

If a dog – whether or not the dog has been classified as “dangerous” — causes severe injury or death to a person OR domestic animal while unprovoked and off the owner’s property, an Animal Care Officer will impound the dog. Written notice will be given to the owner and after ten (10) business days from the date of notification, the dog will be humanely euthanized.’

So once again we have spent money and time…on something that may have been needlessly pursued…with time spent in discussion on the dais…staff time and attorney time to draw up the Ordinance along with the Public Notice costs in the Sentinel…

This subject was brought to the podium a few months back by Comm. Clottey…some research was done and memos were sent to the Commissioners….then Vice Mayor McIntee put it on the agenda…and decided to grandstand…despite the assertion by the Mayor that BSO said we did not have a problem and the Ordinance was already on the books…

After reading the articles in the news yesterday, and going online to check out the Broward County Ordinances… she was correct, and we are covered just as all communities in Broward, thus there was no need to add this Town Ordinance and incur unnecessary costs to the town to duplicate this existing County Ordinance…just makes for more fodder ….for poor administrative action…and poor Commissioner due diligence by some who did not do their homework…too bad!

For Variance Review & Approval

Please be advised that Beach Ace Hardware, property owners, Theodore G Scharf and Janet N Scharf and the property owner’s representative Frank Tropepe of the property located within the B-1 Business Zoning District at 232 E Commercial Blvd.

The property owners are seeking a variance from the provision of the Towns Zoning Code 30-272 (c) (2) to allow the installation of a fire escape within the rear setback. This would enable egress from the second floor and compliance with the Fire Marshall order.

The Board of Adjustment hearing will be on Dec. 17,2008 at 11 am and the Town Commission will be on Jan. 7, 2009 at 7 pm in Jarvis Hall.

These meetings are open to the public to comment on…

BCbythesea….what is not known…is the hardware store is doing renovations that require an upgrade to the code?…If not…. is this the beginning of the LBTS town-wide sweep we hear is going to be done, by the new VFD Fire Inspector and the new Town Fire Marshall due to the Town Manager and the VFD becoming aware of a lack of inspections done over the past few years…as related to this writer by VFD Chief Perkins and others…

According to them…get ready local businesses…they will be arriving on your doorstep….according to the Chief when asked, the cost of the fees…. were not yet set , and unless set by the Commission would most likely be the same as they were for BSO….

We also hear that the pricing was inconsistent, requiring a set rate…for fairness…and of course for revenue…a steady stream of revenue that will come to the VFD and the town….for the inspections and the variances…etc…

If fire inspections are required yearly and the rate is set…fairly, that is acceptable …but, if for example the above applicant for this variance…has no renovations going on, and is being required to make such changes, especially in these precarious economic times…there is an issue that requires some attention…

Some will call it a “witch hunt”…because to do so is an easy way to divert the focus…and not respond to inquiry, but there are a series of disturbing acts that continue to occur in our little “Sea Side Village”…which include…the closing of the Pier Parking lot exit through the alley……an action, the former Development Director, himself did not want to do as he said he must…we are told…the town-wide shed sweep….the recent Walgreens/Laundromat loading problems…. Code Enforcement asking for tree lights to be removed from the right of way on Commercial……. and if we are now going to require our businesses to get variances…put in upgrades …that should be grandfathered in…unless asking for permits to renovate..it needs to be addressed…and maybe…it starts here …with this variance application…and before the town-wide fire inspections begin…

Seems they keep abreast of posts that involve their office…smart!…

One fascinating part of having a site is how far and wide it stretches…with links…and responses…such as this…where any subject that pertains to them is sent to them to be aware of…I have seen it before with subjects and companies….hotels…cities…museums…etc….this is a first with government…

The Dept. sent this writer a heads- up about the recent Commission approval to amend the Comprehensive Plan …2008-1….and that a public notice that would be in the 11/3/08 Sentinel public notices…

Ordinances…a repeat of the ordinances 2008-19 to 2008-24 having to do with fee structures for application fees and changes in who is in charge of recommendations…final decisions…for appeals…variances…

a look at the 9/12/08 LBTS agendas/meetings category will show the ordinances…

a follow-up later this week of the 10/14/08 agenda will show any amendments made to the ordinances covered at the commission meeting…

One item previously posted by this writer…Scoops category …the $350 fee for a variance..was passed by the full commission on March 11,2008… 5-0 for all types of property…at this base fee…Resolution 2008-03…with the following minutes inclusion of this exchange…

“Commissioner Silverstone thought the Commission voted to reduce fees for simple variances. He added the THIS VERSION RELATED TO COMMERCIAL AND RESIDENTIAL VARIANCES. MANAGER COLON SAID THE COMMISSION APPROVED ALL TYPES OF PROPERTY. She added anything over $453 (was changed to $350 at final vote…the only change made according to the minutes) such as review by an outside source would be an additional cost to the requester.

At the 9/12/08 meeting the Manager was representing two different base fees…$350 residential/$900 commercial…

It is this writer’s opinion that single base fee for all types of properties should be adhered to for variances and should extend to any kind of application fee for any department…

The Manager should be called on this insertion if it has not been amended in this new ordinance agenda item..
