We have not had a CIC meeting this month and with many of us away on
summer travel we will not be having an August meeting. However, we have
been busy working behind the scenes. I think you will agree that the ad
below does a great job of promoting the CIC and the values we stand for.
It will appear in the next issue of By the Sea Times, and is being paid

Campaigning for the March 2010 election is already underway and the CIC
has to be ready to work for candidates who support CIC values.

Dear Readers …the Coral Reef project …(previous posts) …a project “spearheaded” by Marc Furth…( along with former Mayor Wardlaw)…with the dais assist from BFF VM Mcintee….has received some good news….and some bad…Either we are about to embark on something to put us on the map or we have been duped…..Even this project is not without lack of backup …according to the article…..ARGHHHH…

‘Lauderdale-by-the-Sea – A proposal to install an electrified artificial reef on the ocean floor off Lauderdale-by-the-Sea has won approval from a key federal agency, making it more likely the high-tech conservation project will get built.

The Army Corps of Engineers issued a permit to the town to work with Global Coral Reef Alliance, of Cambridge, Mass., to install a cluster of metal structures that would use a low-voltage current to stimulate the growth of corals, creating habitat for fish and other marine creatures. The group has used the patented Biorock process to construct artificial reefs in several other countries, including Mexico, Jamaica and Indonesia.

Under the town’s $65,000 contract with the group, structures that resemble six-foot-long Quonset huts would be placed on the ocean floor in shallow water. Divers would collect pieces of living coral that had been broken off by storms or ship groundings and attach them to the metal structures. Two buoys equipped with solar panels would provide the electricity through insulated cables. The electrical current would draw dissolved minerals from the water, causing the minerals to build up on the metal structures. According to the group’s web site, corals grow three to five times faster under these conditions and stand a better chance of surviving stressful events such as increases in water temperature.

Thomas Goreau, president of Global Coral Reef Alliance, declined at first to discuss the project, saying he was unhappy with a previous Sun Sentinel article that quoted “people who didn’t know what they were talking about” questioning the value of the technology.

McManus said Goreau hasn’t published peer-reviewed studies comparing electrified reefs with identical structures in similar habitat without electricity, making it difficult to make a fair assessment of the technology. But he said the Biorock reefs do seed an area with coral, and said there is experimental evidence that the technology enhances the growth and survival of newly transplanted corals.

“It doesn’t seem to do much after the first four months, but the first four months are critical,” he said.

Goreau, in an e-mail, said neither Dodge nor McManus had first-hand knowledge of his work, although he considered them competent scientists. He said he had done comparative experiments but was focused now on saving corals at a time when they’re dying around the world.

“We have deliberately not published most of our results, because we are too busy getting results growing reefs full of corals and fish while there is still a dwindling window to do so, and don’t have the patience to play these academic games fiddling while Rome burns,” he wrote. “We prefer people to see for themselves what really works, because the results are so overwhelming.”

He said there have been “a dozen or more” peer-reviewed papers on the process, most of which he said were posted on his web page, which contains many papers on various coral topics, many of which lack any indication of where or if they were published.

Asked to take a look at the papers on the website, Dodge responded in an e-mail, “I looked at the website and didn’t find any peer-reviewed articles that demonstrate that organisms on Biorock reefs grow better, faster, are more healthy, etc. than others.”

It’s unclear when the project will get built. Goreau said the construction is probably several months off. Ken Banks, natural resource specialist with Broward County’s Environmental Protection and Growth Management Department, said they need a permit from the county. He said he couldn’t discuss whether they were likely to get one because they had not yet filed an application.

Lauderdale-by-the-Sea is known as one of the best spots for beach diving because the reefs are accessible from shore. Steve d’Oliveira, spokesman for Lauderdale-by-the-Sea, said the town supports the project.

“We want it done as soon as possible,” he said.’

The Definition of “yellow Journalism”…

‘Yellow journalism is a type of journalism that downplays legitimate news in favor of eye-catching headlines that sell more newspapers. It may feature exaggerations of news events, scandal-mongering, sensationalism, or unprofessional practices by news media organizations or journalists. Campbell (2001) defines Yellow Press newspapers as having daily multi-column front-page headlines covering a variety of topics, such as sports and scandal, using bold layouts (with large illustrations and perhaps color), heavy reliance on unnamed sources, and unabashed self-promotion. The term was extensively used to describe certain major New York City newspapers about 1900 as they battled for circulation. By extension the term is used today as a pejorative to decry any journalism that treats news in an unprofessional or unethical fashion, such as systematic political bias. Yellow Journalism can also be the practice of over-dramatizing events.

Frank Luther Mott (1941) defines Yellow Journalism in terms of five characteristics:[1]

1. scare headlines in huge print, often of minor news
2. lavish use of pictures, or imaginary drawings
3. use of faked interviews, misleading headlines, pseudo-science, and a parade of false learning from so-called experts
4. emphasis on full-color Sunday supplements, usually with comic strips (which is now normal in the U.S.)
5. dramatic sympathy with the “underdog” against the system.’

HMMMM….. Particularly like the last line….

A look at the June 19,2009 Edition…shows if the definition fits…and in this writer’s opinion …it does big time!…..

A flashy front page….buries the fact that the event is being put on as a Town of LBTS/CIC/VFD event on the special permit…(doing so laid down the gauntlet for the Town event to be problematic from the get-go )…Who approved a joint Town event with a PAC organization (CIC)  and a Town contracted private corporation (VFD) that is being paid for by the taxpayers?…(In the 6/23/09 backup material…link below)… ….In the Town Manager’s report for the 23rd…they are asking for an extension for the event setup …to begin on July 1st…( not enough help?)….instead of the morning of July 3rd….Particularly funny after the Editor Cristie Furth came to the podium at the last commission meeting to question the time listed on the special event permit for Athena’s  July 4th event which began at 8 am  (but Mc-Gang voted it down)  …(prev. post)…OOPS!…

The Editors Furth (CIC members) have a grand way of revising history…and unfortunately along with their BFFs McIntee a way to find yearly a new flock of unsuspecting followers…who get pulled in…put on the blinders and fall for the “little guy” charade…Believe me this writer knows of what she speaks….It’s much easier to feel included and get sucked in rather than do your own research of the facts…It is simpler to look the other way…that is until you can just no longer.stomach it……thus joining the long line that jumped ship ahead of you…and there is quite a line!…CONGA!….

The Editors are well aware …that both Vice Mayor McIntee (CIC member)and Comm. Silverstone  (CIC member)were found by both the Florida Ethics Commission and the Florida Elections Commission to have multiple counts of Probable Cause.. they did indeed do wrong!…The facts are available in prev.posts…GOOGLE online and by request to either commission….HMMM….Is there a “Journalism Commission” on Editorial Ethics?…..PROBABLE CAUSE FOUND!…

The Commission meeting highlights…are pure CIC- Administrative Mc-Furth spin…to see the real content …see previous posts or go online and see the video…( link below)…paints a very different picture…YEA FOR GRANICUS!…

The fireworks…….the Marc Furth version written by his wife…and a very different version than the FWC and DEP letters …(prev. posted)…Quite disturbing for the proponent of the Coral Reef project…( you know the LBTS reef project…the one that caused the major  riff between former Mayor Wardlaw…the originator of the plan and Furth when Furth no longer wanted Wardlaw’s input, according to my many Wardlaw e-mails )….Now, Cristie Furth writes  the July 4th Committee had a backup plan ready just in case of receiving a denial…HMMM….It was never discussed in the sunshine ..or with the commission…chalk it up to another case of mysterious telepathic planning by the Co-Chairs…( Will they headline the act on the 4th?)…No matter how you try, 3/4 plywood on the beach is still 3/4 plywood on the beach!…..By the way the 5 minute marathon on channel 78 says the donations (slim as they are…unless “boosted” (pun intended)  by a mysterious benefactor…… go towards the fireworks.. $15,000…so what happens to the rest…if they make it?…This  brings up the other non-transparent issue looming over this CIC/VFD co- production…Just how do these 2 organizations profitas a result?…..What about the food sales…The food was purchased for the town through Aruba…(prev. post)……So who gets the money collected?……We hear they ( CIC/VFD) will…and also from T-Shirts for sale (certainly not the one pictured above!)…$$$$$$….

The volunteers…we hear…. are the volunteer fire dept. members…(prev. posts)…who we are also told despite the Chief’s assurances of “no repercussions”when asked point blank by Comm. Dodd  are in receipt of a memo declaring 4 mandatory hours of “July 4th volunteer duty”…or kiss your job goodbye!…AND THE DEFINITION OF VOLUNTEER IS?….

Commissioner comments are the “Gang of 3″(all 3 CIC members)…… more of the same …Although it is amusing that Comm. Silverstone call those who question and oppose his “gang”…”Un-American”…Note to Jimmy-boy…This isn’t Chicago and it isn’t 1968!…Beside those you accuse of lies… are writing your jibberish verbatim!…YIKES…Comm. Clottey continues to blindly follow …. losing her constituent’s support……She’s become too painful to watchand listen to……And the VM/Dep. Chief….we all know his tired old song and dance…point the finger elsewhere …blame others for your own over reaching actions……For the many who  say the VM/Dep Chief is made of Teflon…another word for Teflon…Silvertone!..TOO FUNNY!…

The CIC member-Truth Detector…( Chair of July 4th volunteers) Moe McIntee…”slapps “out her ire over the Times local news competition……..But this writer did so enjoy the adjoining photo of a man strapped up to a lie-detector…It brought back the recollection of the police report she filed on her BSO Roach complaint..which proved to be much different than the remarks she made at the podium …(prev. post)…Perhaps the podium could have a lie-detector installed?……RFP?….

Political Decorum written by CIC-member/BFF Maryann Wardlaw…is truly disingenuous…Mrs. Wardlaw knows very well of the past CIC-VFD lack of decorum………Interesting she would include the fire assessment in her article…we hear…a double standard of practices may have been in play by the “2-Hats”…(more on that to come)….Also a look at the MPSC 6/16/09 meeting with member Wardlaw asking for businesses to be involved with beautification…which seems to conflict with her written accusations of a “few crude business owners” that own much of the property in town!…OOPS!…

The center “spread” is a birdseye view to the event that many  residents wish were anything but “bigger” than last year… ..wanting it more in- tune with the economic times…and more low key for the taxpayers who pay for  it all!…Surely the Times “Heritage Society” contributor (CIC member) could remind them how it was done!…LOOKING FOR THE POLAROIDS!…

Letters to the Editor…again Editor R.W. (BOB) Roberts …(Chair of the CIC)…purposely neglects to mention these “titles” as he writes to himself (the Editor) once more concerning the Hillsboro Inlet.and Comm. Dodd…..with further questions and accusations……Comm. Dodd was assured by the Hillsboro Inlet Chair and Atty. he acted properly and appropriately to the letters from Editor Roberts…and  Atty. Tolces from Goren, Cherof, Doody & Ezrol has responded to Bob Roberts with a letter dated June 18,2009 stating that at the June 15, 2009 Hillsboro Inlet meeting they directed counsel to forward a c document prepared in response to Robert’s May 20th correspondence to the Town of LBTS Mayor and Town Commissioners, as well as Robert’s June 8,2009 correspondence to Comm. Stuart Dodd….The 6 page correspondence includes the background of the Hillsboro Inlet operations from 1957…It consists of budgets, plans, equipment and the improvements made…Also the federal funds and the outside entities that partnered in the implementations of the projects throughout the years…Taxes with the millage are shown from 200-2008…Dredge replacement was addressed with explanations on the equipment…the “harsh environmental conditions” the “extensive repairs”…and the decision that it was time to replace the dredge with a new one with further explanation on the cost…the expected life of the dredge and its features…The new dredge started pumping the sand in May 2008…Also the document provided the same type of information and background on the workboats replacement…the Yard crane…the Sea Wall replacement….and Dredging volumes… As Editor Roberts was aware all the information he desired was public record and could have been asked for at anytime from the Hillsboro Inlet Commission..without the “theatrics” displayed in the “phony” “letters to the Editor” …DECEPTIVELY SHAMEFUL!…By the way all the Editors and the Mc-Gang are well aware that Comm. Dodd only receives his health insurance from the Hilsboro Inlet Commission…and not the Town…the Town health insurance “PERK”…that was for BFF Jimmy-Boy…(previous post)…Sorry Peggy but that was how it was “sold” by the then-Comm. McIntee…

Once again this writer is throwing a LIFE PRESERVER …(and it’s not from the infamous LBTS lifepole #7)…to byline contributors…Rev.George  Hunsaker….Judy Jones…and Shevaun Steward-Kuhn…to save yourselves from the content that surrounds your printed words…..it’s not going to change anytime soon…

Any doubt how far this publication will go?….Take a good  look at the Times ad placement of the Village Grille “AD”…only (we have heard) it is NOT a paid ad by the Grille……who have chosen not to advertise in either local paper anymore per Dave Gadsby (prev.post)…It seems the BTSTimes purposefully placed it to “appear” that the restaurant had continued on with them and not their competitor!…A look at the other advertisers shows this paper is basically being supported by the CIC and the VFD Booster club…( are their donators aware?)…along with two other contractors to the town……We hear new trash vendor Choice Environmental, who placed a full page ad will be placing a similar one in the other local paper…not wanting to fall victim to being seen as politically aligned…It is the opinion of this writer and many town residents who pay for the services of AMR and soon will pay for Choice…that advertising in the local papers …is as frustrating as seeing ads for FPL in the Sentinel…and the Herald!……BAD P.R.

The BTSFuture is out…and again, judging by their growing number of ads…their advertisers clearly think this is the paper of choice in LBTS…(full disclosure this site is on board coming to the same conclusion)….

This issue has Congressman Ron Klein, Mayor Minnet and Chamber President Paul Novak on the cover…

Front and center the Bert J. Harris lawsuits that have come to fruition…(as this paper repeatedly said they would) …3 years after the height referendum…from 4 properties in the north end of town…with a purported 5th to file separately (previous scoops post)… Future Editor Mark Brown is very concerned about the legal costs, especially with the change in terms the Town has chosen to continue to follow to employ our current law firm …We have no retainer…which was originally decided on because of some trepidation on the part of two Commissioners  ( Dood and Clottey) when the firm was hired… Editor Mark Brown previously wrote an editorial advising the Town to put out another RFP as their first year was coming to an end. He stated  Weiss, Serota could submit again for consideration. It fell on deaf ears and here we are today with VM McIntee and Town Manager Colon trying to do a “song and dance” of how much we have saved…(previously posted 5/26-27/09 Comm. meeting)…Apparently some thought the Florida League of Cities might be able to take this on …But according to the paper Town Manager Colon informed the Town ” I have been notified by the Florida League of Cities Insurance Trust that they will not be able to provide coverage or assist the Town with the (4 BJH claims) “…advising the Town to use “counsel of the Town’s own choosing”….Right now it looks like the Town is choosing our Town law firm…and the 2 attorneys we have seen on the dais…Dan Abbott and Susan Trevarthen…

BC- The combination brings forth some trepidation on the part of this writer…due to Mr Abbott’s previous representation on 2 cases in Hollywood…The first was former Hollywood Comm. Wasserstrom…previously posted when I wrote of my concerns when Mr. Abbott was approved by the dais…The second was a recent case where a case was not settled for $75,000 on the advice of counsel Abbott…according to the newspaper article, the town was left at the end of the day with an award to the plaintiff  in the millions…

I also questioned and posted many actions that were unsettling in this writer’s opinion…including the removal of the Town’s declaratory action not too long ago…as stated in the Plaintiff’s court documents…(previously posted)…’Shortly after the new Town Atty. ( Dan Abbott) took office, the Town voluntarily dismissed the Town’s Amended Complaint on June 9, 2008 and the Court entered in a Final Order of Dismissal of the Town’s Declaratory Action on June 11,2008’….

Atty. Trevarthen, we were told is an expert in land -use cases and that was why she was to take over…but again in this writer’s opinion her counsel on the dais has been “hit or miss”…although I will add one caveat, that perhaps due to no retainer being in place she may have been precluded from researching items as would be the case if that retainer was  in place….Also, Ms. Trevarthen has been noticeably gun-shy in answering any questions from this writer…informally or formally…..The fact that the first “shade session” for the Commissioners is set for a day after a legal response filing is due is hard to understand, it seems to me the meeting should have been held before the deadline to respond…HMMM….

Some other causes for concern come from who is representing the plaintiffs…Ruden McClosky (link previously posted)…a “top land-use” law firm in Florida says the Future’s….. At the  meeting where Weiss, Serota  were “handpicked” and installed in their position by the Town Manager…It was revealed that Weiss Serota was a firm that believes and fights for eminent domain…which at the time caused this writer to question the strong backing by the new Vice Mayor and his BFF Comm. Silverstone…So how that comes into play will be quite interesting to say the least…(Remember there is always the “Vested Rights” safety net )…Editor Brown reveals even more bad news with dropping yet another “bomb”..” ByTheSeaFuture has learned that at least three or four more properties are in the process of researching their legal rights and may file additional lawsuits against the town shortly.”…YIKES!…

BC-Now we can spend a lot of time going back and forth with theory and opinion, on what does and does not constitute an inordinate burden placed on the property owners…but in the end…it will come down to this…the law and what a jury decides after they are presented with all the facts by both sides. They will then be allowed to deliberate within certain set guidelines to make that decision as directed by the judge…That is if it gets that far…which it most likely will not…Why not? Precisely because of what I just stated and the gamble it will be to the Town……Most likely it will be settled out of court…but not without a large cost…depending on the time frame leading up to some agreement and if the recovery of legal fees is dropped as part of the agreement…

The BTSFutures and this site will keep on top of it all…without the 2006 &2010 Mc-Furth campaign “spin”…

Today we hear that Congressman Klein was “monopolized” by the Mc-Furth Gang….and once again a “gang” member has acted in the most unbecoming manner….

Recently we heard on the Scenic Highway Trolly Mc-Furth Gang member Comm. Clottey…commandeered the microphone from the Mayor…and today we hear the “Besotted” Commissioner’s “special Mentor” official McIntee photg. Marc Furth wanted the Mayor out of the way during a VFD photo-op…Calling Ms. Manners!

We hear Comm. Clottey was raked over the coals (pun intended) from a longtime resident…for listening to her “Mentor” yet again …and being on record on the dais Tuesday night bringing up the Pier lease to stop the Marchelos brothers from having their July 4th event….It’s a sure way we are told to put the Town in jeopardy for a lawsuit!….STAND IN LINE PLAINTIFF…You can be right after the vacation rental plaintiffs if Jimmy-boy changes his vote!…

We also hear the comment she made at the Tues. night meeting to BSO Chief Gooding about a “hand to hand drug deal” going down may have come from a high ranking member of the VFD…leading many upon hearing of her  “source” to respond was it HIS hand? OUCH!…No VFD official photog. at this call?

This writer thought we “dodged a bullet” last Sunday when the elevator got stuck on our floor in our building as we were set to enter it …..We laughed that it would have been just awful if the VFD was called and VM/Dep. Chief McIntee responded…Later we learned…the VFD did respond…WHEW!…It gets better…Yesterday we heard the young VFD member came …wearing sunglasses and holding the radio as he opened the elevator with the key…He proceeded to walk straight into  it…The Manager of the building..”saved” him…The floor of the elevator was at the top and he was about to enter the shaft!…Guess that won’t be in the VFD  Incident Report!…

The Town is abuzz…(after VM McIntee’s Commissioner comments…about going to “battle”  yet again)…Hot and heavy over  the Mc-Furths vs. the Marchelos…All agree the Mc-Furths are out to destroy the Marchelos livelihood…It may be a “He said-He said”…But we hear there were witnesses who saw  Marc Furth  “baiting” the Marchelos to “Hit me”…Sounds about right…and it gives one pause ….because it was said that CIC Vice-Chair “McIntee is GOD” Joe Couriel did the same “baiting” not long ago…Is this the new tactic coming from the shrinking CIC ?… Mc-Furth M.O. ALERT!…or another  “Roach Police Report?”…

We hear it was mighty lonely back at the CIC-VFD July 4th sign-up table in Jarvis Hall the other night…despite Co-Chair of July 4th Volunteers/newbie Moe McIntee BFF Gail Albohn’s time at the podium …..A select CIC/VFD  few allowed to participate in the planning…tends to lead to select CIC/VFD few giving a helping hand!…Not to worry we also hear the word from the VFD Dep. Chief…is the same as last year to his VFD troops…you better come or you’re fired!…The Donald Trump of LBTS!…

We hear the new Mc-Furth Times has come out today…many calls and e-mails…of the “advice” article from Jimmy-boy Silverstone…haven’t got a copy yet…(so will reserve comment on the content…or lack thereof!)…but the word on the street…His advice on politics is like his advice on finances…or better yet choosing your best friend…”It’s like trying to get blood from a turnip”…A remarkable resemblance we must admit!

SAY HELLO TO BERT J. HARRIS….

We hear that the Town of Lauderdale-By- The- Sea was served today with the long denied or long awaited (depending on your affiliation in this town) Bert J. Harris lawsuits!…

Four suits were filed…..

Sea Watch Restaurant,  Palm Club, El Dorado and Coastal Arms.  It is said all are using the same law firm but it is  believed they filed separate lawsuits, leaving the  town to do a lot more paperwork to defend against four suits instead of one.

Sea Colony is said to be using a different attorney.  We are told they will be filing separately.  Not known is the exact day that the lawsuits were filed with the court, but it is reported the summonses were served on the town today. ( Commissioners check your mailboxes!)….Not known yet, just how much they are seeking in compensation.  Previously, the five properties filed claims totaling $28 million.  Those figures may have been adjusted that figure up over the last two years, or they may have adjusted it down to reflect the declining economy.

We hear behind the scenes… there is a lot going on….from reporters, attorneys and of course the Town staff….Look for the Town Attorney to give an “overview” on the summons with a possible Shade Session with the Commissioners… at the 5/26/09 Commission meeting?…

Looks like Vice Mayor McIntee is on a roll for his latest inaccurate chest thumping declarations from the dais (previous post…LBTS agenda/meetings Comm.comments 5/12/09) ..including his assertions that the By The Sea Future Newspaper was wrong and was lying about the Bert. J. Harris lawsuits coming to Town!…OOPS!
