Dear Readers …This afternoon shortly after 3 pm this writer went to Town Hall to pick up some public records requests… as I awaited them I asked the Asst. Town Clerk Nikki Smith for a list of who qualified..Ms. Smith gave me a public records request…I said “Really, a public records request?”…Ms. Smith answered they needed to put it together…I said what there were only 3 positions…She lamely explained she needed to get more qualifiers than that…”I said “Really?”…Town Clerk White stuck her head out of her office and said they would call me by the end of the day..I said “Really?”…I asked if the P.I.O. (Steve D’Oliveira ) had notified the Sun-Sentinel?…The answer was they did not know….I said “Really?”…Then as I looked over my PRRs Town Clerk White came from her office and said “we’re going to just post them”…. (the candidates)… I said “Works for me!”…Then Town Clerk White put up the qualifying candidates…just as previously posted last night the list showed the following…. Mayor- Mayor Roseann Minnet vs Joe Couriel/ Dist 2 Comm. Jim Silverstone vs Chris Vincent/ Dist 1 Marjorie Evans vs Scot Sasser …

If you were looking for decorum and civility to return to the dais after McIntee was off…Forget about it!…The CIC is in bigger trouble than this writer ever imagined with it’s shrinking membership as a result of the McIntee- Furth disembowelment of this once proud organization… They chose their own Vice Chair of the last year Joe “McIntee is god!” Couriel for Mayor …A non- participating non- involved member who happens to be the wife of one of their former board secretary’s, Marjorie Evans, who we hear did not inform her boards and might have some explaining to do…Although her husband might be the only one that had a heads up since he sits on the board as well….She has, as far as we can find, never attended a Jarvis Hall meeting…And Jim (He’s not a nice guy and not a gentleman) Silverstone who cannot push aside his complicit bad acts over the last 4 years while joined at the hip with BFF McIntee!… While McIntee is saying he was not running due to his wife’s health sure looks like he ended up his only term as a commissioner to follow his old nemesis and new-found buddy former Mayor Oliver Parker in not being supported or encouraged to run by his own group!…As for Joe Couriel, today’s last official qualified candidate for the 2010 March 9th Municipal Election (as of this morning.)…readers are already sending in some of his “noteworthy” public comments from some prior meetings ….

Joe Couriel on 4-28 @- 1:15 – Special events for village and Athena permits should be for 3-4 months maximum. need to look at their violations they should pay a substantial fee paid by the users.
Couriel states ” he is a party guy” ” I like to party hard” parties so hard that he doesn’t remember what happened. He then states the businesses should not get a free ride on the permits and should pay a substantial fee for usage of the street. Also states, there should not be a workshop for noise ordinance and the city should give violations for the noise immediately.”


On the very first day of qualifying….Candidate for Mayor Joe Couriel is 100% behind Town Manager Esther Colon…..100% for premier beach parking at $20 annually….100% against the Downtown businesses….and don’t forget the CIC endorsed candidate was 100% behind the McIntee-Silverstone-Clottey vote of $56,000+ to repave his own street of N. Tradewinds after the Seagrape Drive beautification despite it not being worse than other streets in Silver Shores!…OUCH!…

In the weeks to come there will be years and years of classic- bombastic Joe Couriel…the CIC endorsed Mayoral Candidate with the short fuse!…POW!…

CIC  endorsed Marjorie Evans…the candidate for District 1 is so unknown that we hear those listed on her Broward Children’s Center Board and all the various boards connected to it do not know her very well at all…And they did not know she was running for LBTS Commission…We also hear that all around town there is a new game going on…Any woman with a short blond “bob”…slightly soft around the edges is assumed to be Candidate Marjorie Evans…Not even her neighbors can pick her out of a crowd and as far as her Bel Air Homeowners Assoc…she has been M.I.A. according some regulars…. So when we see her tomorrow night …Will the real Marjorie Evans Candidate for Dist. 2 step up to the podium or….will we really know?…OOPS!…

CIC endorsed Commissioner Jim (You all know what goes here by now!) Silverstone for District 2 has “unfinished business”…Well for once this writer can say his BFF McIntee, if we are to believe one of his excuses for not running,  did something right by putting his wife first…Jimmy-boy cannot say the same!…His Fiancee’ was very vocal over the last few months in voicing her strong opinion and desire that she did not want him to run again…..We hear their wedding was postponed due to his possible run for re-election…and we hear that on the very day he went in and filled out his qualifying paperwork for re-election as Commissioner, she was not aware he did!…So what does that say about the man’s character and priorities in life?…. That on top of his dismal 4 year record and his 100% support for Town Manager Colon…His voting with Vice Mayor McIntee and Former Mayor Parker for her $250,000 contract if terminated….(He is on record this year wanting to give her a raise!)…His conflict of interest votes… both as VFD and as a Pension Consultant … His findings of probable cause by both the Fl. Ethics Commission and the Fl. Elections Commission…His backing McIntee for VFD Dep. Chief and VFD Fire Chief…His vote for the $2 million dollar motel…His vote for using the Oriana Million for a few medians..His votes to go after Greenfest for a paltry $33 …His vote for allowing “anonymous letters”…His going into a Shade session while being fully engaged with the litigates as Chief of the VFD…His being the Registered Agent for the VFD and not properly filing for the correct tax deductible status leaving VFD supporters to date unknowingly in violation of the law if they took their donations as such…all the way up to the last VFD Booster Fund Drive a few months ago…(aside from the 501c3)….and so much more to come…Jimmy-boy should have chosen love over a big time loss!…OOPS!…

So the qualifying is over and the race is officially on…Now it is up to the voters to decide…to stick with the status quo from the CIC-endorsed bunch above……or change for some much needed decorum on the dais , individual accountability in voting while abiding by the rules ….with transparency due to no personal agendas being in play…and elected officials that are seated on the dais to serve all the people …. all of the time…no ifs …ands…or buts!….

Here’s The Scoop … LBTS Town Clerk White Blows Another Scheduled Meeting! …

Dear Readers …. June White the Town Clerk with more than 10 years under her belt….but still no Town Clerk certification…handpicked for her job by Town Manager Esther Colon…has struck again with botching up a commission meeting!…Readers may recall it was Town Clerk White that screwed up the final budget meeting in September by having it on Yom Kippur and then with an assist from the Town Manager and Commissioner Silverstone …she tried to wiggle out of her ineptness… only to be caught …and to lamely have to backtrack…This time, Town Clerk White was informed that the March 9th Regular Commission meeting falls on the Municipal Election…Town Clerk White put it on the new agenda under new business…and in the backup…Town Clerk White included a calendar from March 2010 that shows the Municipal election on the 9th and a mock agenda both with the date for the commission meeting on March 8, 2010!… Town Clerk White wants the commission to conduct a meeting the night before the election!…What is wrong with this Town Clerk?…. If this is still on the agenda tomorrow night and there is an actual vote and the vote is the usual 3-2 for a meeting in the waning hours of this very important commission race…Shame on the outgoing majority who will once again prove why there time is up after only 4 years!… As for Town Clerk White, no more scheduling commission meetings!…Hand it over to your Deputy Town Clerk, the one the Town Manager so happily supplied you with to make your job less complicated….OUCH!…

From the Town Minutes from April 24, 2007…

“Acting Town Manager Colon stated that for 11 weeks she has been doing five jobs, and the only
thing she is asking of the Commission is that they hire professional people in the Town. She
said it may take longer, but she’d rather have a decent staff that can all work together towards.”


Dear Readers… little did we know what “Acting” Town Manager Esther Colon  Commissioner Silverstone and then-Commissioner McIntee had in mind as the past commission fell all over each other to offer her the position of “Permanent” Town Manager ……


Apr. 24, 2007….

“Commissioner McIntee asked to withdraw his previous for acting, and wanted to amend it to permanent Town Manager.
Mayor Parker stated that he already made the motion.

Commissioner McIntee stated that his own motion was before Mayor Parker’s.
Attorney Cherof stated that there is no such position as permanent Town Manager, only Town Manager.
Commissioner McIntee amended his motion to Town Manager”


Acting Town Manager Colon, Comms. Silverstone and McIntee knew 2 years ahead of us along with former Mayor Oliver Parker (per his interview with Editor Mark Brown in the By-The-Sea-Future Newspaper) that Esther Colon would indeed be “permanent ” with a cost to the taxpayers of $250,000 if she is fired!… While we were kept in the dark until this past year that her contract was nothing like her predecessor’s despite the continuous “team” effort from the Manager, McIntee, Silverstone, Clottey and the Furths to keep it under wraps…”deny, deny, deny” until they could no longer  (prev. posts)… Just as underhanded was her request “the only thing she is asking of the Commission is that they hire professional people in the Town. She said it may take longer, but she’d rather have a decent staff that can all work together towards.” …This writer has obtained by public records request the “Offer of Employment” for two key staff employees Town Clerk June White and Assistant Town Manager John Olinzock … (Previously posted were their annual reviews) ……

Town Clerk White hired in July 31, 2007  was hired at an annual salary of $56,057.90 plus full health insurance benefits that kicked in after 31 days…she also received accrued vacation time 3.08 hours per 80 hours worked per pay period…and sick leave accrued 3.70 hours per 80 hours worked per pay period…The “At Will” appointment was the same as it was for the recently terminated Fire Marshall and unlike what Manager Colon drew up for herself…”This appointment may be terminated unilaterally, at any time by the Town Manager and need not reflect performance- related reasons.”…Also unlike the Manager’s sweetheart contract.”If this Appointment is terminated by unilateral action by the Town Manager, you shall be entitled only to base salary earned through the date of termination”…attached was  the description of the Town Clerk’s duties ” An employee in this class is appointed and directed by the Town Manager in accordance with the Town Charter. Responsibilities include organization, direction, and coordination of a wide variety of municipal activities, and providing assistance and service to Town officials and departments, as well as to the public. The incumbent is a Charter Officer, Secretary too the Corporation, Local Elections Official, and Custodian of Public Records. The Town Clerk has many and diverse duties and responsibilities. Duties include maintaining the Town Charter and Town Code Ordinances; overseeing the distribution of the Town Code. The employee records all Town ordinances and resolutions, attesting thereto and serves as custodian of the Town Seal and official Town records. Incumbent acts as a liaison between advisory boards and the Town Commission and is responsible for Town’s records retention program. Supervises subordinate employees through assignment of tasks and review of completed work for accomplishments of desired objectives. Responsibilities are defined by legal requirements although the employee works with considerable independence within these parameters.” …”Training and Experience Considerable professional level administrative experience, including reasonable related supervisory experience; graduation from an accredited college or university with a Bachelor’s degree.” and finally “Special Certifications ..Certified Municipal Clerk (CMC) designation is desirable or the ability to achieve certification within three (3) years of appointment to position…According to the September 2007 Town Topics …”White worked for Tamarac for more than 8 years before serving as the Town’s Chief Deputy Clerk from April 2005 through June 2006″… In the Town Manager’s review it was stated that Town Clerk White has not yet completed her certification to be a Town Clerk and TM Colon recommends she does……This past year Town Clerk White was given an assistant Town Clerk and is no longer sitting on the dais doing the minutes…In this past year Town Clerk White no longer takes the public records requests…Depending on who you are in town…the PRR go to Asst. Town Clerk Nikki Smith…PIO Steve D’Olivera or if you are especially close to the Town Manager such as Commissioners Silverstone, and Clottey or Vice Mayor McIntee and BTSTimes Editor Marc Furth your PRR goes through the Town Manager’s executive assistant!… It has taken months for the minutes to finally be up to date …a major problem with the previous administration’s Town Clerk…The Muni-Codes are still not on with the last one being codified in March, 24 2009  ord. 2009-17 (the recently failed ordinances for referendum were 32-34) … As we now face the municipal elections we find that the Town Clerk has not supplied the up to date form for no party affiliation…She cannot provide the voluntary ethics forms listed on the Town of LBTS Candidate Checklist and has been less than helpful in trying to remedy the situation to those who have already registered as candidates…

Assistant Town Manager John Olinzock has had a few “titles”… In the March 2007 Town Topics on page 2 was the announcement of his hiring…”Special Projects Coordinator John Olinzock “… “Olinzock, as the Town’s Project’s Coordinator, oversees capital improvement projects, grant projects, safety issues and the Citizen Contact Center. He will also be the Town liaison for the Broward County roadway projects and the Florida Department of Transportation. Olinzock started in January after working two years for the City of Tamarac as its projects manager. Prior to that he worked for the City of Key West for five years”… On May 19, 2007 he received an “Offer of Employment (Promotion)” … It went like this “Dear John Olinzock: I am pleased to offer you a promotion to the position of Assistant To The Town Manager for the Town of Lauderdale-By-The-Sea. The job description for the position is attached as Exhibit “A”, and you agree to provide the Town with the services included in that job description. By accepting this position you are representing to the Town that you have reviewed the job description for the position and that you possess the expertise and experience to perform the services to be provided by you pursuant to the terms of this appointment.”…He was also hired as an “At Will” employee at a salary of $65,884.52 full health benefits after 31 days same accrued 3.08 vacation/ 3.70 sick days as Town Clerk White and can be unilaterally terminated by the Town Manager at any time  again it need not reflect performance -related reasons…and he only leaves with base salary earned through date of termination…”Characteristics of the Class…Under the direction of the Town Manager, the assistant to the Town Manager position is a managerial employee who is responsible for assisting in the management of Town operations, and to serve as the Town Manager in the absence of the Town Manager. This position preforms a variety of administrative projects as assigned by the Town Manager.”… “Training and Experience …Possess Bachelor’s degree in Business Administration. Public Administration or related field; Master’s degree preferred; supplemented by two(2) years previous experience and/ field training that includes municipal administration; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skill, and abilities for this position. Must possess a Florida’s driver license.” …It was signed on May 30, 2007…so according to the beginning of the offer John Olinzock  represented that he possessed the expertise and the experience required…On July 2, 2008 he received another “Offer of Employment (Promotion)”…stating “Dear John Olinzock; I am pleased to offer you a promotion to the position of Assistant Town Manager for the Town of Lauderdale-By-The-Sea. ” same description as his prior promotion that job detail was attached and his acceptance represents that he possesses the expertise and experience…still he was to be an “At Will” employee…at a salary of $75,154.22 …same accrued sick/ vacation as before….termination the same …by the Town Manager and still only entitled to base salary earned through the date of termination. The “Characteristics of the Class” for the new position differed from the Assistant to…”Under limited supervision, assists Town Manager in daily city operations, administration, and activities in accordance with policies determined by the Town, to ensure the effective and efficient operation of the Town. Reviews work of staff for completeness and accuracy. Reports to the Town Manager.” No mention of “to serve as the Town Manager in the absence of the Town Manager.” any longer…… “Training and Experience…Must possess a Bachelor’s degree in business, marketing, accounting, or liberal arts. Requires five (5) years of progressively responsible experience in administration with ten (10) years experience preferred. Ability to establish and maintain effective working relationships with department officials, other employees, and the general public. Ability to express ideas clearly and concisely, both oral and in writing.”… For the promotion from Asst. TO …to Asst. Town Manager what is no longer in the experience required …”Possess Bachelor’s degree in Business Administration. Public Administration or related field; Master’s degree preferred”…Hmmm…but he does get approximately a $10,000 bump up in pay!… Assistant Town Manager Olinzock has been working out of the Development Office for some time now…He was put in there when the Town Manager was having trouble with the former Development Director and remained to oversee the Development office as Code Officer Jeff Bowman was elevated into that position…. It is often Olinzock who answers for the Development Dept…..relegating Bowman to a subordinate role… Mr Olinzock has come many times to the podium and been less than candid …The most recent episode was his disingenuous and less than truthful comments about the Townwide survey that was definitely the Wilton Manors survey with a few minor additions….( prev. post)…as well as copping an attitude toward certain dais members he sees as adversaries of the current administration… So the question still is, what education and experience did Asst. Olinzock possess …and why are the requirements less to be promoted to  full-fledged Asst. TM than they were for Asst. TO?…

In May …

“LBTS hires new Town Clerk
Tina Angelone, an adjunct
professor at Broward Community
College with considerable administrative
experience, was hired as the
new Town Clerk. Angelone started
April 9th.
Prior to working for the Town,
Angelone, who holds a Master’s
Degree in English from Florida
Atlantic University, worked as a
performing arts center department
head for a public school in Palm
Beach County. She was also part
of a team of four administrators who
headed up a steering committee for
the Southern Association of
Colleges and Schools (SACS),
overseeing work assignments
delegated to more than 30 people.
Angelone has transcribed and
summarized minutes for the Town
of Davie on a part-time basis.
Additionally, she has been a liaison
for various boards and assisted in
writing grant proposals. Angelone is
familiar with charter review, statutory
mandates and the placement of
notices for public forums.
She attended her first Town
Commission meeting on April 10th.
“I will perform my administrative
duties for the Town to the best of my
ability,” Angelone said.”

BC- It is said the new Town Clerk did not get along with the new Town Manager…and soon she was gone and TM Colon brought back June White… A look at the minutes while Tina was in charge in 2007…says it all!…

and code supervisor

The Town has hired Tatiana
Solovieva as its new Zoning and
Code Compliance Supervisor.
She began working here April 15.
Between October 2004 and April
2006, Solovieva was employed North
Lauderdale as a Community
Development Manager. Between
February 2000 and October 2004,
she worked for Margate as an
Associate Planner for the Department
of Environmental and
Engineering Services, where she
was completely involved in the City’s
planning process.
Originally a Russian Citizen, she
received her Master’s degree in
engineering management with a
specialization in land use management
from Moscow’s Institute of
Land Utilization Engineering in
1984. Solovieva moved to the United
States in 1997 and became a U.S.
Citizen in 2002.
She has completed Master’s
degree level courses in Urban
Planning, Statistics, Planning
Information System and Organization
Issues in GIS, Budgeting and
Communication for Public Managers.
She also completed English classes
as a non-degree student at the
University of Hawaii and Florida
Atlantic University. ”

BC- Tatiana was terminated before Development Director Rabinowitz and was the reason John Olinzock (we hear) was placed in the development office…

“Martin Sherwood is the Town’s
new Director of Finance and
Budget. He has 25 years experience
as a Certified Public Accountant
and Certified Government
Finance Officer.
He previously worked for
Aventura, Lauderdale Lakes and
Broward County, where he was in
charge of a $100 million operating
and capital budget. ”

BC- No idea what happened to him or how long he stayed….

In the Oct 2007 Town Topics…

“Town hires new

Frank Rabinowitz is the Town’s
new Development Services
Director. His employment record
includes six years with the City of
Plantation, where he served as the
Plan Review Manager and designated
Assistant Building Official.
Rabinowitz also worked as a
Building Inspector in Code Enforcement
with the City of Fort
He also worked as a Structural
Plans Examiner and Inspector with
Deerfield Beach/Lighthouse
Rabinowitz began working for the
Town on Sept. 17.”

BC- Director Rabinowitz we were told resigned … before he was terminated…”At Will”…

There are no other announcements in Town Topics from October 2007 to present of new employees…and the “hiring” practices after these were all done “in-house”… elevating those who were under-qualified for the positions  and doing it without publishing in the Sentinel or online (prev. posts)…

As we approach the next municipal election in March…..we are left with the more words spoken by Town Manager Colon at her April 24, 2007 …”Acting Town Manger Colon stated that she was tired of sitting second fiddle to everyone.” …

And with that she began to play “solo” …stringing us along with her $250,000 contract…that guaranteed new Town Manager Esther Colon could do anything and act anyway she pleased…. knowing full well the only way she was no longer the “headliner” would be on her own handwritten terms…plunk!..

Here’s The Scoop … Here We Go Again, Town Clerk … October 13, 2009 Consent Agenda … A/B/C ….

Dear Readers…The Agenda for Oct. 13, 2009 came online this afternoon…BEFORE it was available in Town Hall…(not out at 4 pm)…The Town had approximately 3 weeks to get ready…But a quick look at the Consent Agenda…a/b/c …shows 3 weeks was still not enough time to get it right!…Hot off  her major blunder of not doing her duty  and checking out religious holidays when presenting meeting dates to the Commission which resulted in the final adoption of the LBTS 2009/10 budget on Yom Kippur  and the less than satisfactory memo to “atone” for this offensive act…we again find that 5 year Jewish calendar received in 2007 after a Rosh Hashanah incident (included in the memo, prev. post) is still not being used or adhered to …(see below)….Speaking of calendars…it’s not just the Jewish calendar that’s still MIA …so to is the Broward County Supervisor of Elections calendar and the regular 2009 calendar with the month of December…….(see below)…YIKES!….

Here’s The Scoop …. A Parting Gift for the Town Clerk …

Dear Readers… This year the Town of Lauderdale-By-The-Sea held its final adoption of the budget on Yom Kippur …Day of Atonement … (prev. post)…It was brought to the Town’s attention by this writer and resident Yann Brandt. ( He addressed the issue at the podium at a prior meeting and in an e-mail to the Comm. and the Town)… The Town said it was unable to comply. The meeting began at 5:03 before sundown which prevented those who might have attended from participating. Vice Mayor McIntee was obscene in his “use” of the hall being sparse in attendance as a result of this conflict …something this writer pointed out. I also made reference to the fact that this should not occur again. The Town Manager and the Town Clerk along with Commissioner Silverstone said the Jewish Federation had supplied the Town with a calendar …and ultimately embarrassed themselves in their attempts to make the situation justifiable. This writer contacted the Jewish Federation the next day on September 29, 2009  (prev. post) …The Community Relations Director responded and said she had not spoken to the Town in a few years and that calendars had not been distributed in years due to budget constraints. She said she was going to contact the Town and ask for the Town to clarify their statements about any Jewish Federation involvement at the next Town meeting.

I went in and picked up the PRR….and this is what was received….WITH COMMENTARY…

“In August of of 2007, Ms Pepi Dunay of the Jewish Federation of Broward County sent a letter requesting the Town take into consideration certain holidays when scheduling meetings. On another occasion Ms. Dunay advised the preferred or most important holidays for consideration were Rosh Hashanah, Yom Kippur, Sukkot, Passover and Shavuot. Ms Dunay included a 5 year calendar at that time. Since that time meetings have been scheduled around those holy days.”

(BC- The August 28,2007 letter was to TM Colon (see below)…it contained BOTH the holidays of importance AND the “preferred or most important”…NOT “on another occasion”…Town Clerk White again falsely states… “Since that time meetings have been scheduled around those holy days.”…as we witnessed on Sept. 28,2009!)

“At the April 28,2009 Commission meeting a 2009 Millage & Trim & Budget Timetable was presented to the Commission with Monday, September 28,2009 5:01 PM timetable for the adoption of the Final Millage and Budget. Attached to that item was the Broward County Property Appraiser’s timetable regarding submission deadlines. The advertisement for the Final Budget Hearing had to be placed in the newspaper no later than September 23, 2009 and had to be within 5 days of the final millage and budget Hearing. The last day to deliver the approved final millage and budget to the Property Appraisers office was September 30th or within 3 days of adoption.”

(BC- The Town Clerk has admitted that she DID NOT include the conflict as she states in paragraph 1….If she had the meetings would have taken place as other municipalities  were on Sept. 23, 2009 )

” Yom Kippur began on September 27, 2009 at sundown and ended at nightfall on September 28,2009. It appears there was an oversight by both the Town and the public when discussion was made to set the date for the Final Public Hearing for September 28,2009. I had expressed this to Ms. Dunay when I spoke to her on September 29, 2009. She appeared to be ok with it as she stated that “everyone makes mistakes. Thank you.”

(BC-Yom Kippur is a different day each year …unlike Christmas…therefor only the most observant would know from the date alone. It was the Town Clerk’s responsibility to do what she said she does in paragraph 1 and not to pawn it off on the Commission or the public. I will send a copy of this post to Ms Dunay to see if she really said it was “ok”…with the added information that residents asked for a change.)…

Dear Readers… As expected the Town Administration is still playing with the RFPs… No surprise to this writer…but another unexpected surprise to the 6 out 9 companies who came to hear the bids for the Public Safety Building Renovation RFP for the BSO Police!…

The meeting was held in Jarvis Hall at 2 pm … All signed in….In attendance 6 companies/ Asst.TM  Olinzock/ Town Clerk White/ Chen & Assoc. Architect Ernie Ocampo ( who will making the big bucks this year according to the LBTS 2009-10 adopted budget )….After the Town Clerk sat down at the end of the conference table she immediately declared this was an “RFP” and she would NOT be reading the BIDS aloud…She proceeded to read the name of the company, the town and opened them…putting them in a pile…

Right afterward it happened again…the attendees asked them if they were going to read the bids… June White tersely replied she said they were “RFPs” and they would not be read aloud…The companies could see them in 10 days or they would cost 15 cents a page in 10 days……Again the company reps were shocked and puzzled …rightly so!…

This time the Town brought forward a “shield” …Town contracted Architect Ernie Ocampo who said he was going to “evaluate” the “cost of change orders”…and some gibberish about deciding on “bid one, bid two or no bids”…He then said he might follow-up with calls to see if the companies “submitted the bid or there was a substitution”…The Town Architect will be ranking the bids…and then they will go to the “Town”….. with Asst. Olinzock quickly adding by “Town” they mean the commissioners…(expect another song and dance from Colon and Olinzock about their “expertise” in procurement)…

One vendor asked the Asst. Town Manger and the Town Clerk if they realized the companies were required to send the information to the bond company within 10 days?…It did not faze either one (Olinzock/White) …what an inconvenience this decision would cause!…

I shook my head and said “Oh, boy”…and walked out upon the end of the meeting with the bidders… I asked them if they have ever had this happen in any other town…”NO!” was the universal response…. I asked the Rep. who spoke of the bond company requirement when he usually sends in his information from an “RFP-BID”…he answered “The same day!”… WOW!… He said they get the tabulation…(the price bids by each company)…call the bond company and inform them where they stood among the bids submitted…He said the “evaluation” comes afterward…(Just as it did BEFORE July 29, 2009!)…

The process took minutes…and to read the bid aloud would have added at the most…5 minutes…and everyone would have walked away happy…Instead the Town Manager and her staff have added another layer to the process…by using the Architect ($$$$)…and making the companies come back in 10 days, hoping they make their bond requirement in time!…

Commissioner Dodd at the last Commission meeting asked for a change to be made in the Town Purchasing Manual on page 19 Section D. FORMAL BIDDING PROCESS 4a. in that section it says “Each RFP shall contain the following standard provisions:

a. BIDS must be received by the LBTS Purchasing Administrator no later than the time and date identified in the RFP. BIDS received after this time for any reason shall be returned  unopened to the BIDDER. All timely-received BIDS shall be  … ( NEW 5-0 inclusion) ….

“All timely received bids shall be publicly opened, read aloud to include the name of the bidder, the town, the bid number and the bid value. Contractors present at the bid opening have the right to visually inspect the lowest bid if requested. The staff will announce that the bids have not been evaluated for mathematical errors and responsiveness.” … the time and place designated in the RFP!

It does NOT distinguish between an RFP and a BID!….

The Town Manager, Asst. Town Manager, Town Clerk and now the Town Architect are just plain wrong to continue this practice.

Next March, they all need to go!…

Dear Readers….Yesterday we saw the extent of ignorance with our Town Administration, staff and certain commission members………The final adoption of the 2009-10 budget was held on Yom Kippur before sundown…In public comments before the Commission addressed the budget this writer once more addressed this travesty…(I misspoke and said Rosh Hashanah, oops!) …The exchanges that came afterward made me sick to my stomach…that these are the people I as a taxpayer employ and I as a voter voted into office….It was a new low in LBTS politics……..

Commissioner Silverstone in his comments said the following……”The holiday ah, I believe we sent a note to the Jewish Federation or something like that Town Manager and they gave us a list of holidays that were, that they thought was applicable and unapplicable (Jimmy-boy verbage). Could you please refresh my memory for one.”

Town Manger Colon ” June, our Town Clerk when we were setting the dates she did get the list and she provided you some of the dates that they preferred you not to have any meetings and she also advised you if you had a meeting at what time it should cease out of respect and June is the one that had, that gave that last. I believe she’s also gonna ah, provide a memo to the Commission, although she did mention…”

CS-” We got a memo on that half a year ago.”

TM-” You got the calendar that was on the dais when we set these budget meetings. So she’ll clarify it again IF she needs to do that.”

BC- If she needs to do that? You bet the Town Clerk “needs” to do that!…The “explanation” from the Town Manager was completely disingenuous and ignorant…The Jewish Federation would never offer Yom Kippur as a “preferred” holiday to have a meeting on…and the time to “cease” the meeting out of respect is completely wrong!…Commissioner’s Silverstone’s handling of was inept, insensitive and  ignorant… for a guy who says he gets on the internet and always does his “homework” …he certainly failed this assignment!….

Later on Vice Mayor McIntee  seized on the opportunity this conflict brought forth in Jarvis Hall with many not in attendance due to their observance and did what he used to be able to get away with…He used his “bully-pulpit” to say only 2 people came to speak because everyone is happy with the lowered taxes (forget about the fees) and if the Town Manager or the “Gang” was doing anything wrong…”people would be here in droves”….”They’d be lined up out the door”…”They aren’t and that’s a barometer that has to be faced by all of us up here we accomplished the task.”…”And again, two people are here to discuss it, two. If there was a problem with our tax base they’d be lined out the door. …”They’d be lined out the door. They’d be screaming for heads from the flagpole.”

Well, those days of the “bully- pulpit are over for the Vice Mayor …From the dais (Mayor/Comm. Dodd )…from the this site……the local BTSFuture NEWSpaper…and at the podium from this writer…after his attempt…

BC- ” I also take a very big offense on this Jewish holiday. One of the most important Jewish holidays that there is. There’s no arguing about that, to say that there’s alot of people who would’ve been here if not for having , feeling that they needed to observe this holiday. And if you recall this room was packed a few meetings ago when people were not allowed to speak.So let’s not play up here and give out false information, thank you.”

A long time ago McIntee’s pal Marc Furth told this writer and husband about some not so nice facts concerning the Vice Mayor and his ethnic views….that was witnessed tonight in my opinion… just nauseating …more so than usual…

I have sent the following e-mails to Town…and will post the responses when they are received. I will also contact the Jewish Federation of Broward County to see what exchange took place with LBTS…and will post that as well… Also below…some information on Yom Kippur…from one single Google…ONE!….

“Yom Kippur is probably the most important holiday of the Jewish year. Many Jews who do not observe any other Jewish custom will refrain from work, fast and/or attend synagogue services on this day. Yom Kippur occurs on the 10th day of Tishri. The holiday is instituted at Leviticus 23:26 et seq.

The name “Yom Kippur” means “Day of Atonement,” and that pretty much explains what the holiday is. It is a day set aside to “afflict the soul,” to atone for the sins of the past year. In Days of Awe, I mentioned the “books” in which G-d inscribes all of our names. On Yom Kippur, the judgment entered in these books is sealed. This day is, essentially, your last appeal, your last chance to change the judgment, to demonstrate your repentance and make amends.

As I noted in Days of Awe, Yom Kippur atones only for sins between man and G-d, not for sins against another person. To atone for sins against another person, you must first seek reconciliation with that person, righting the wrongs you committed against them if possible. That must all be done before Yom Kippur.

Yom Kippur is a complete Sabbath; no work can be performed on that day. It is well-known that you are supposed to refrain from eating and drinking (even water) on Yom Kippur. It is a complete, 25-hour fast beginning before sunset on the evening before Yom Kippur and ending after nightfall on the day of Yom Kippur. The Talmud also specifies additional restrictions that are less well-known: washing and bathing, anointing one’s body (with cosmetics, deodorants, etc.), wearing leather shoes (Orthodox Jews routinely wear canvas sneakers under their dress clothes on Yom Kippur), and engaging in sexual relations are all prohibited on Yom Kippur.

As always, any of these restrictions can be lifted where a threat to life or health is involved. In fact, children under the age of nine and women in childbirth (from the time labor begins until three days after birth) are not permitted to fast, even if they want to. Older children and women from the third to the seventh day after childbirth are permitted to fast, but are permitted to break the fast if they feel the need to do so. People with other illnesses should consult a physician and a rabbi for advice.

Most of the holiday is spent in the synagogue, in prayer. In Orthodox synagogues, services begin early in the morning (8 or 9 AM) and continue until about 3 PM. People then usually go home for an afternoon nap and return around 5 or 6 PM for the afternoon and evening services, which continue until nightfall. The services end at nightfall, with the blowing of the tekiah gedolah, a long blast on the shofar. See Rosh Hashanah for more about the shofar and its characteristic blasts.”

I am writing to you to get verification that you contacted the Town Clerk of LBTS with a list of holidays that Commission meetings would be allowable on. The Town had the final budget meeting on Yom Kippur and the Town Clerk and Town Manager said on the dais the clerk was in contact with the Federation and was given preferred holidays, with the insinuation the Federation said Yom Kippur was not a preferred holiday to not have a meeting on! As a result we had few people and many angry residents who could not attend.
I would ask for a response on any communications with the Town to clear this up.

Dear Readers…Vice Mayor McIntee and the Town Administration are just like the energizer bunny…they keep going and going and going…First they make resident Yann Brandt wait well beyond the state statute regarding “a reasonable amount of time” for producing requested materials from June to September for his Public Records Request (PRR) for the Vice Mayor’s e-mails…Then the Vice Mayor makes a PRR as Vice Mayor via the Town Manager via the Town Clerk  for 3 months of emails from his “opposing” Commissioners (Mayor Minnet/Comm Dodd) for their personal computer “town business related e-mails” to retaliate and be vindictive all the while knowing that he deleted his own “Town business related” e-mails from his own personal computer …all 3 1/2 years worth!……And then in his Commissioner Comments he does his “my AOL ate my e-mail” tale showing absolutely no remorse for his actions…NAH, not him!…He’s chomping at the bit and rubbing his hands together in anticipation for HIS coveted PRR e-mails……Arrogantly  contacting the Florida State’s Atty. to ensure he gets what he, himself did not turn over!….And when you think there is nothing more he can do…..he does!..Vice Mayor McIntee and this Colon- led Town administration are indeed continuing to act badly……Last week, the Town Clerk advised Mr Brandt that she, the Town Clerk will no longer take his PRR for e-mails from the Vice Mayor, informing him the requests are to go to the Vice Mayor directly, contrary to the Florida state public records laws…And now they have changed the Town website contact category…….stating  “Vice Mayor Jerry McIntee  No e-mail is available”!!!!…(personal or Town!)….The ONLY Town official or employee to not have an e-mail address!!!!!…. WOW!…….

We hear the deletions of his e-mails constitute a “WILLFUL FAILURE”…. punishable with up to 1 year in jail and up to $1000 per the LBTS Town Attorneys. The State Attorney and other top officials are now in receipt of the PRRs from Yann Brandt…including the Vice Mayor’s admission that he deleted 3 1/2 years of “Town business related” e-mails….

For the overwhelming voters in town who have their heads in the upright position….we will be watching and waiting to see if the State of Florida will follow through on the Vice Mayor’s bad deeds or once again choose to slap him on the hand as we witnessed with the Florida Elections Commission and Florida Ethics Commission over the past 3 1/2 years when they found a number of “probable cause” charges…and gave him and his BFF Commissioner Silverstone a pass…This time there simply can be no 3rd “slap of the wrist” and  no 3rd “go forth and don’t do it again! …This time elected LBTS official Jerry McIntee must be held accountable for “willful failure” in HIS mass deletion of HIS  public records!….
