BC-  Readers know by now this writer is at a loss as to why we need to maintain $130 fire assessment for a town this size with a VFD that has a membership of 63 members (not the 2009/2010 LBTS budget number of 82 FFs…steady at 60 + or – a few for months now) and we now know cannot be used for VFD medical calls or VFD Beach Patrol …

We are told that there is $35,000.00 in an interest bearing acct. that is not shown in the budget (justification pages…no line item) to pay for Beach Patrol … The VFD has shown in its reports and its income and expense acct. reports thus far that Beach Patrol and medical calls were being paid from the fire assessment..(the only town fund funding the VFD)…We are told the VFD  decided recently to pay the members from their neverending Booster Fund for the 2nd 6 mos. of their 1st contracted year. ( after hush-hush confirmation the fire dept. funds from the town were used incorrectly in the 1st 6 mos. for these calls) The Manager at the 7/14/09 budget meeting said the medical calls were for “training” per Chief Perkins…but some of these medical calls are “code 3” and are in their report as “medical calls -assist “…OOPS!….The decision of the VFD to use the Booster Fund does not “jibe” with this special acct. (from ad valorem ) the Manager said is in-wait for a “bill” from the VFD for Beach Patrol hours…It seems “suspect” in light of the past payments and no line item last year or in the new budget!…

Fort Lauderdale is going to pay approx. $135 for their large professional fire dept…..Davie is at $104 and Pompano Beach is raising there assessment to $108…again for large professional fire services……We are slated to pay a 4% increase for year 2 per the contract…the amt….$887.875.00 (total with Fire Marshall…ins./ pensions/consultants/audit services…$1,025.776,00)..We have no control or oversight …due to the VFD being a contracted private non- profit corporation….We have watched as the dept. continues to become “bloated” with trucks …now at 5……The Manager’s early on assertions that the town must own all equipment for any future change in fire service providers … went by the wayside after the VFD purchased truck # 2 for the year… again with the purchase of the Jet Ski and the new Dep. Chief Command vehicle (title belongs to the VFD)…and the recent purchase of the $100,000 + 102″ ladder truck…(let’s see if the VFD asks for town funds on this one. It might happen at the 7 pm reg. Comm.meeting to follow during the VFD report per Chief Perkins…The Manager …we hear… has has said no)….With the last truck…the reason given for the purchase is the ISO rating…but a look at the ISO report already gives us credit for the ladder truck (prev. post. “kinder,gentler ISO”)….We hear that in the 1990’s a previous VFD Chief chose to pass on the truck because it “wasn’t worth it” in terms of servicing the town…OUCH!…

So here we taxpayers are…watching as one professional town public safety provider was decimated in retaliation  for “fiscal irresponsibility” and another volunteer public safety provider again in year 2 will be “flush with funds” and allowed to continue to spend like “drunken sailors”…courtesy of a fire assessment that is too high and a hands off policy from the Town Manager!…

Drop the fire assessment cost!…

Resolution 2009-19: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA, ADOPTING A PROPOSED MILLAGE RATE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2009, AND ENDING SEPTEMBER 30, 2010; STATING THE PERCENTAGE AMOUNT OF THE PROPOSED RATE DOES NOT EXCEED THE ROLLED BACK RATE; ANNOUNCING THE DATE, TIME AND PLACE OF THE FIRST PUBLIC HEARING TO CONSIDER THE PROPOSED MILLAGE RATE AND THE TENTATIVE BUDGET; PROVIDING FOR SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE

BC- It’s an election year…so this will be a fast the Commission will accept the proposed 4.4829 for the year in order to drop it at the Sept. 14th meeting (MONDAY..so it does not compete with Broward County’s Budget workshop) at 5:01 PM to 3.9990…It cannot be raised …thus the “reason” for the rate this evening…

Here’s The Scoop…. THE VFD’S …. OVER $100,000.00 Purchase ….

REALLY BIG EXPENDITURE….TO PLAY WITH….

We are hearing by way of searches on the net that the new 102′ VFD Ladder Truck was purchased for over $100,00.00 by the VFD…
We hear the Chief has said the VFD will be asking the Town to pay for it in full or part of it!…
We hear that the VFD thinks it will be called on to provide mutual aid to Pompano Beach and Hillsboro now that we have the truck…
We hear the VFD according to the Chief will now use it for “training” at highrises…
Below is am e-mal received after the purchase was posted by a faithful reader…
Barbara, the ladder truck was certified in February of this year according to the company. So, it meets the ISO standard of 5 years in that aspect and LBTS should receive credit. Platforms are inherently larger and les s Here is some ladder operation info to give you an idea of what should be considered on incident scenes.maneuverable. Most issues with aerial device access have to be addressed prior to building construction by Municipal Building Departments with foresight. You will never get the full-elevation vertically of any ladder truck unless it is basically parked with the turntable within twenty feet of the building you are trying to access. That is if what you are trying to access is directly overhead and not “set back.” Obviously, ladders do not bend around building corners or roofs and if this happens there are bigger issues that the fire personnel have to contend with then just the incident. They basically have brought their own emergency with them. (That’s fire department humor for you.)Regardless, there appears to be relatively low miles and hours on the vehicle so it may have been a good find. But, you never know what other issues may be involved with a twenty-year old truck. It is a fraction of a cost of a new rig but it is almost an antique when looked at as a motor vehicle. It is kind of funny where most people would have an issue with buying a twenty year old car for personal use. However, when it comes to the safety of the civilians and firefighters people will settle for less.

BC- Don’t hold your breath for Pompano/Hillsboro to call the VFD ….

BC- We were told that the ladder trucks of this size could not be used at most of our highrises due to the underground parking and the limited access to get close…

BC- This should be something…if the VFD actually come to the Town and asks us to pay for the truck…Right after we heard that the BSO Chief was “fiscally irresponsible”…The TM is on record from the outset of the VFD taking over informing the taxpayers that we must own all out equipment…justifying the payment for the 1st truck the VFD bought after Oct. 1st…She was mute when Mc-VFD bought the 2nd on…and sat back as McIntee told us all his favorite line…”It won’t cost the taxpayers a dime”…saying the VFD had voted to buy the second apparatus on their own….So what exactly will the the TM do with this white elephant after her admonishment and termination of Scott Gooding and withholding funding for the renovations of the BSO offices?…All eyes will be on her when this is put forth on the dais….How in the world can the VFD justify a purchase of this amount with no RFPs going out …no foresight to seek out other options such as grants and/or stimulus for a newer ladder truck being discussed ahead of this major purchase. This is the problem we find ourselves facing with dealing with a private contractor…( this comment coming from Comm. Dodd upon hearing of the purchase) who is in or out of our decision making arena  depending on sticking the proverbial finger in the wind!…Can you even imagine the “2-Hats” attempting to introduce a return of the McIntee referendum for a lifetime of VFD “purchases” like this?…If the information is correct and the VFD and the TM now want the Town to pay for the truck…will the “2-Hats” vote on it?…(Ethics Comm?) If they do not and the vote goes down 2-1 (Mayor/ Dodd – Clottey?) then the Town does not own the ladder truck…The CIC-Mc-Furth Gang will play up the vote for the next election as not backing the VFD but this election it will fall on deaf ears……. AND again why in the world are we to pay in 2009/2010 a $130 fire assessment (compared to Pompano / Davie…$108/$104) and paying the VFD a 4% increase when they are flush with monies?…YIKES!…

Here’s The Scoop….Holes In The LBTS Dam….Are Increasing At An Alarming Rate!…

YOU KNOW WHAT THEY SAY WHEN YOU TRY TO STOP THE LEAKS?….

They to tend to become gushers!….

It must be something to be the Town Manager of LBTS right now…when you’re in over your head… Your pockets appear full of I.O.U.s to the usual suspects…You get thin skinned and lash out when you are found to be floundering after unilaterally making decisions…on major Capital Improvement projects…Acting as Town Attorney in writing  garbage contracts…codes…ordinances and resolutions….Informing the Commission of a 3 year audit contract for approx. $200,000 that required their seeing the actual proposal for their commission approval …then falsely stating in a letter that approval was obtained….Looking the other way when serious charges have been made concerning  the Town’s fire safety contracted provider the VFD…Fighting with a sitting Commissioner on and off the dais and refusing to correspond with him when you feel threatened, although it is your duty to continue to do so…..calling to task those that ask for you to be reviewed annually as required in your contract (already in breach of said contract for missing the first annual review)…that you yourself proclaimed in 2007  to have written and produced with no input from others…and now the use of power to “reassign” the BSO Police Chief…WOW!…All those leaks…

Well not all….

We hear that there is more….Hold on to your hats taxpayers…LBTS residents and voters get out your raincoats and umbrellas…the flood is coming!…

First the exchange….

6/9/09 the first LBTS Budget Workshop….Fire Assessment…

Comm. Dodd- “The beach patrol is that anywhere, i that anywhere in this part or is it found in something separately?”

Town Manager- “The total contractual agreement that we have with VFD includes the beach patrol operations.”

CD- ” It does because are we therefore using the fire assessment to pay for EMS. Because the function of the beach patrol is EMS and I am concerned because that was the basis of a recall (former Mayor Parker) and we are not allowed to use a fire assessment to deal with EMS costs.”

TM- ” Commissioner Dodd if we would be funding the EMS. We’d be collecting a double fire assessment. EMS is an actual obligation, is separate and apart from the VFD. We’re only speakin’ fire.”

CD- ” That wasn’t my question, my question was the beach patrol, part of the VFD is essentially EMS.”

TM- ” No it is not sir! It is funded and operated under the VFD. If there’s another beach patrol managed by the AMR I guess you know something I don’t know.”

CD- ” No, I didn’t think that the beach patrol fought fires in the ATVs and we’ve been having discussions regarding lifeguards and all the rest of it. One of the primary functions within the that is EMS and I just want to make sure it doesn’t open this dais to any form of, that we’re doing something wrong, that we know and we’ve had a lot of situations and a lot of discussion. A fire assessment can only be used to pay for the fire department services. And this beach patrol is not essentially to fight fires.”

Comm. Silverstone- ” Point of information. Why can’t we ask the Town Attorney who would be more apt to answer that question?”

CD- ” Sure, sure.”

Town Attorney- ” I have not been asked to look at any aspect of this prior to tonight. I can certainly investigate and get back. That’s what I could do.”

CD- “I’m not trying to be a nitpicker or anything. I just want to make absolutely sure because we have a problem with fire assessments in the past. That’s all, I just wanted to clear the air on it.”

TM-” Commissioner Dodd, maybe if, I have no problem with your question. I do have a problem with the timing of your question. If this was a question that you had maybe you and I and Mike Burton (fire assess. co.Burton & Assoc.) could have talked about it. I could have had the Chief (Perkins) in the meeting and we could address those questions. But this is strictly the fire assessment. If you want to bring in budgeting in this, that’s not the, we’re talking about the fire assessment right now,”

CD- ” Okay, to me it’s part of the fire assessment. It’s what we spend the money on. We’re looking at this and we’ve got two scenarios and I totally agree scenario number two is the better option. Which is what I’m gonna come to in a minute. I’m just asking questions. You asked whether I had any questions on the information here.”

Comm. Silverstone-” I can answer that question if you’d like? Well, this question came up with a um, because of the insurance we have. The fire department needs to make sure that it’s ah, insured so we spoke to the ah, representative from the insurance company and he pacifically (specifically) said we are a fire rescue department. Rescues meaning rescuing people. After we rescue a person that’s where the EMT service come in place. Ah, same thing as rescuing somebody in a fire. It’s the same basic precedent. We provide basic ah, first aid, first responder service which is part of our state mandated um, um services that we provide. But that’s it, we don’t provide, we don’t perform EMT functions. The VFD does not perform any medical services besides basic first aid when needed other than rescuing the people.”

CD- “Okay, thank you. I just wanted to clarify the issue. To make sure that there’s no problems with it, that’s all.”

BC….WE HEAR THERE IS INDEED A PROBLEM WITH IT!!!!!

We hear that the Town Attorney found that indeed the VFD CANNOT use fire assessment funds for their medical call and beach patrol service!!!!! (Who directed her to look into it is not known, as no such direction was given on the dais June 9th.)….

The Manager was incorrect in allowing it…and we the taxpayers paid for the VFD to make the countless medical call since Oct. 1st…along with their ever growing beach patrol division!

We heat there was a VFD board meeting ant the VFD has decided in the next 6 months to continue the call and the beach patrol using the VFD Booster fund!…

So how will the Manager explain her actions?….She again owes Comm. Dodd an apology!…Will the taxpayers be refunded for the illegal use?….The 2nd 3 mos. income/expense report for the VFD…(posted soon) … shows no amt. balance in the Booster Fund…with no donation received/ no expenses from the fund…HMMM….We hear the Town Manager wanted to lower the VFD contract amount after receiving the news…but she cannot due to it being an agreement signed by both parties…OUCH!….

To add insult to injury with this latest abuse of authority on the part of the Town Manager and the VFD Deputy Chief …the De-facto VFD Chief….(as he spoke of all “tightening their belts”!) ….We hear the new Dep . Chief Command vehicle has been purchased and will be delivered any day…that lights and sirens have been purchased and installed on the beach patrol ATVs and the Jet Ski…with a second jet ski to be purchased (if not already done)!….

The audacity of it all ….The Town Manager and the Vice Mayor along with Comm. Clottey sat on the dais…June 23,2009 berating the BSO Police Chief for wanting to use confiscated funds for the BSO Public Safety Complex renovations!…

Is now the time to call for the Manager’s resignation?…Perhaps she is waiting to be fired?…Why?…A look at her May 22, 2007 employment agreement which  shows the following…

page 2- 5.0 Rights and Obligations Upon Unilateral Termination by TOWN

5.1 Unilateral termination shall be in writing following a vote by the TOWN Commission and need not reflect performance related reasons. If this Contract is terminated by unilateral action by the TOWN, TOWN MANAGER shall be entitled to:

5.1.1 three hundred and sixty-five (365) days of severance pay, less customary withholding.

5.1.2 reimbursement for as- yet unreimbursed expenses pursuant to this Contract:

5.1.3 an amount for all accrued and unused vacation leave.

5.1.4 an amount for accrued and unused sick leave.

VERSUS….

6.0 Mutual agreement by TOWN and Manager

6.1.1  severance benefits as mutually agreed to in writing by TOWN and TOWN MANAGER.

VERSUS….

8.0  RESIGNATION

8.1.1 base salary through the date of resignation or such other date as mutually agreed between TOWN MANAGER and the TOWN.

8.1.2. reimbursement for as-yet unreimbursed expenses pursuant to this Contract;

8.1.3 accrued and unused sick vacation leave

8.1.4. an amount for accrued compensatory time accrued prior to appointment as TOWN MANAGER

8.2 A resignation shall be submitted in writing to the Commission through the TOWN Clerk and shall provide for actual resignation date no later than thirty (30) days following the date of notice of resignation, or later with the consent of the TOWN Commission.

8.3 In the event of a resignation, the TOWN Commission may establish an earlier resignation date tha the date established by the TOWN MANAGER

BC- Perhaps this is why the Manager was “baiting” Comm. Dodd on the dais to fire her when he discussed the contract required Town Manager Review?…

The Vice Mayor/ Dep Chief and Comm. Silverstone should also be reprimanded and should resign for their roles in this illegal use of the fire assessment!…
