Faithful readers will remember a previous post asking what happened to Attorney Barry Richard…who played a huge part in the Florida recount…and was nowhere to be seen in the recent HBO movie recounting…pun intended…the whole event….
Well Barry is now involved with the Amendment 5 tax question…that may or may not make it on the ballot…due to the language from the legislature…for the ballot…that does not spell out the specifics ….
The amendment right now to replace the education funding dollar for dollar …. the tax swap….is actually for 1 year only….2010…..that’s it!
The Judge is concerned that it is “misrepresentation through omission”…
BCbythesea….. a huge omission….a huge concern….
The Attorney arguing for the Taxation and Budget Reform Committee….actually countered that they never claimed it was permanent….and with a 75 word ballot limit…they don’t have to include every ramification of the amendment!….
The Attorney talks of the “nuances”…well there is no “nuance” here….any uninformed voter will “assume” the funding is guaranteed for the schools…going forth…..every year….not for just 1 ….WOW!
Barry Richard is representing the Coalition to Protect Florida’s Economy…..
The judge is set to make a ruling….and both sides have already said they will appeal….
