5. Reports…Finance…Development with new interim Development Director Jeff Bowman…Municipal ….BSO- June/July…Chief Gooding was MIA for June….VFD….

BCbythesea….One concern with the VFD July report…the termination of 5 members for non- compliance with the minimum training requirements…including the President of the VFD…no name given….followed up by the Vice President Judson Hopping fulfilling the role in the interim….

BCbythesea…who was the President?…He or she was voted into the position….so why would the members vote in someone who would disregard the minimum training requirement?……

1. Ordinance 2008-19…Amending section 30-7 …Code of Ordinances to establish an application fee for appeals from administrative decisions…raising the fees to $900 /$350 for single family …and extra fees for any additional work…

2. Ordinance 2008-20….Amending Section 30-6 …Code of Ordinances to establish the application fee for applications involving jurisdiction of the Planning and Zoning Board, clarifying the procedure for making applications which are reviewable by the P &Z…deleted $500/deleted $200…new fee $900 …$350 for single family …and extra fees for any additional work…

3. Ordinance 2008-21…. Amending Section 30-8 …. Code of Ordinances to establish by Ordinance an application fee for variance requests….$900…

4. Ordinance 2008-22….Amending Section 30-7…. Code of Ordinances to establish that the Town Commission will be the final decision maker for appeals from Administrative decisions…The Board of Adjustment will no longer “render” a decision….but will “recommend”… to the Commission…

5. Ordinance 2008- 23 Amending section 2008-8 ….Code of Ordinances to modify the criteria governing variance requests….a change from….not approved unless and until it is found that…to …be evaluated by considering the following criteria…..

BCbythesea…the original intent for variance applicants was that it had to meet a “threshold of being a hardship”…depriving the applicant all use of the property as distinguished from mere inconvenience…basically almost all variances have not and will not meet this requirement…

6. Ordinance 2008-23 Ordinances to re-designate the personnel charged with providing recommendations to the Commission in connection with variances…from the Town Planner/Town Attorney to the Town Development Review Officials…with a check of the application for the criteria for consistency from the Town Engineer…

B. Ordinances 2nd Reading…public may comment…

1. Ordinance 2008-11….Ordinance to amend Section 5-34 …Code requiring beach equipment be moved each evening to the entire shoreline…eliminating the requirement that the location of beach equipment be restricted to specified beach areas….

2. Ordinance 2008-1 Ordinance to Amend certain text Amendments in the Comprehensive plan….

BCbythesea…most of the 5 year plan was kept…some updating with deletions of changes to the plan…most revisions have to do with water…and our neighboring towns who supply water and waste service for both sides of town…

BCbythesea…Comprehensive plan was once again put together by ex- Town Planner Walter Keller…the cost?….Is this his last time doing it?….New plan is needed for the next 5 years…

a. Storm drain cleaning of 163 structures piggybacking off Palm Beach county Board contact…amount $63,180.00….cleaning to be throughout the fiscal year…Assistant Olinzock…

Dodd who had a conflict with his Hillsboro Inlet duties…it was agreed upon with the MPSC members…but with the “Kennedy” like accusations of no individual Comm. input….wrongly asserted by the CIC Chair Furth…let’s see if her pals on the dais try to keep it from happening…

BCbythesea….Peanuts Wick informed this writer that Dr. Mark Caputo, the Medical Director of the Emergency Dept. at Holy Cross Hospital has offered as a community service to assign someone to oversee AMR to make sure AMR is educational and equipment standards are where they should be in line with the hospitals’….the Town and AMR should take him up on the offer…

a. Resolution 2008-18…repealing no. 1254 which provided rental fees to be charged for Jarvis Hall…instead a $100 security deposit will be required…going towards any cleaning/repair required after use…

b. Resolution 2008- 23 authorizing the execution of towing services agreement of Sals Towing and the Town…Assist. Olinzock…

BCbythesea…a little strange it would not just be a consent item for a contracted amount of time….

13. Quasi Judicial Public Hearings. … VARIANCES….THE FENCES…previous posts Board of Adjustment…last month…

a. variance 4329 El Mar Drive…to change existing fence to be within the code…5 ft. high around a swimming pool….

BCbythesea…passed by BOA 5-0…(should be required for new McIntee Public Safety Youth pool also)….

b. variance for 278 Miramar…. fence for a large in-ground spa…Comm Silverstone/Peggy Mohler…

BCbythesea…BOA….passed 2-1 with conditions…if front of the shrubbery…no wood fence……

This will be tricky…Comm. Silverstone will recuse himself…step down to answer questions from his fellow Commissioners as a property owner….

He is required to have a 5 ft. fence around the spa…he was asking at the BOA for a 4 ft. fence…BOA passed with a 5 ft. fence requirement…per LBTS code…

He asked for it to be in-between his foliage…BOA passed it with the fence behind the foliage further in on the property…

BOA also passed it with a no wood fence requirement… although LBTS does allow wood fences….

Whatever his fellow Commissioners decide will set a precedent for the many LBTS properties in town that do not have fences as required by state law around existing pools….

14. Old Business….

a Discussion and /or action on the bags on the Bougainvilla and Poinciana parking meters…for an Ordinance to pull the bags…tabled from 3/25//08 McIntee

BCbythesea…This was McIntee/Silverstone’s “baby” but the outcome …is up in the air if they will remain…

Discussion and/ or action Chamber of Commerce Agreement…previous posts…showdown…the Chamber met with all the Commissioners separately…..and have had a petition…and press with a letter from the President Paul Novak to the Chamber members…and a letter to the Town asking for continued funding and remaining in their longtime location…

BCbythesea…YES!…it is ridiculous that the Town Hall lot is full of poll workers cars…leaving elderly voters to park greater distances away…thereby possibly causing them to reconsider voting at all…

h. Discussion and/or action regarding electronic voting system Clerk White…

BCbythesea…at the start of taking office Comm. Dodd inquired about an electronic push button system rather than calling the roll…a simple system…not the expensive “Granicus” compatible system in the back-up…also why is it included 6 months later?…

Dodd’s last direction was for the the web…. for an interactive way from residents to poll on items relegated in the Town Topics…the doggy beach…youth pool …Aug/Sept. issue…

Perhaps the staff could have a bi-weekly progress report …a calendar showing what was directed by Commissioners…with updates…until completion…so many items directed are never brought back to the dais for a follow-up…or a result….

i. Discussion and/or action pertaining to referendum City of Cape Canaveral…Vice Mayor McIntee….

BCbythesea…once again the Commission should vote down any premature referendum for the VFD which has not proven itself.. …… after a year of tested service by the VFD…if the Commission puts it on again…it might have a chance to win….or it might not be needed at all……. What’s the hurry?….
