BCbythesea…it is time for the VFD to be instructed to get on board and next month submit a report like the AMR report that gives the pertinent information with the block of the incident…the present VFD report gives out medical information …a Hipaa violation for both the VFD and AMR…when looking at both reports…to compare…all is public record….

a. Ordinance 2008-25 Dangerous Dogs…see previous scoop category posts…Broward county…the LBTS Animal Control authority…already has the Dangerous Dog Ordinance that covers the town…

12. CONSENT AGENDA

c. Commission approval for the installation of the Town Logo on the flag poles by TW Signs at a cost of $350 (Assist. Manager Olinzock)…2 -wrap around aluminum signs w/ logo for bases on Commercial Blvd.

BCbythesea…has been told the small American flag..is due to wind load and the poles…with using 2 flags instead of one…a screw up it seems as Comm. Silverstone asked and requested from the get-go when it was voted on for 1 flag pole…in the median…both an American flag and a town flag…this small American flag looks bad…as a result…

14. Quasi Judicial Public Hearing…single family home on El Mar…site of the Courtyard Hotel  east side next to Oriana…tabled …will be at 12/17/08 BOA meeting 11 am for a revised plan up for review…details under board category-Nov…and Public Notice category- Oct….

15 OLD BUSINESS

a. Discussion and/or action concerning fire lane at By the Sea Laundry (Comm. Dodd) Tabled at the 11/10/08 Comm. meeting by VM McIntee…

included in the backup materials…a plethora of previous reports(10) dated from2003-2007 …but with one maintenance exception in 2004…..none are about the fire lane…they were for  Walgreens …fire inspections and a hearing…with inside building/alarm violations……

BCbythesea…while there may be a real issue with the fire lane or not…(see below)……to include so much paperwork that is not specific to the fire lane with the 1 lame exception of a 2004 citation for the painting the fire lane……looks bad for the staff supplying it……

Clottey…included in the backup as of 12/12/08 straw polls…3 only 3…and all 3 were to remove the bags…previous posts about the bags/straw poll…scoops/agenda categories..

c. same as above…to draft an Ordinance to pull the bags…on Bougainvilla/Poinciana….

BCbythesea…Hearing grumbling all around…when discussing the Straw Poll…it is time to talk about the end of the Town Topics…many disgruntled residents did not receive the antiquated publication until this weekend…it time for it to be a thing of the past….an unecessary taxpayer expense…

It is this writer’s opinion that all street parking should be metered…and the lots should be free…if possible and allowable by the State on Commercial Blvd….if not meter all…and put the resident/employee permits into action….

e. Town Commission approval Bel Air signage ( Assist. Manager Olinzock/Colon) was tabled from last meeting…see previous post LBTS agenda category Nov….same backup material provided with addition of plants …

f. Discussion and/or action to form an Oversight Committee for Public Safety (Mayor Minnet) Tabled 11/25/08 Comm. Clottey…see previous posts scoops/agendas…

BCbythesea…Comm. Clottey will still be the deciding vote…no matter how many times it is tabled…a look at the report above…shows that oversight is required…if Comm. Clottey will only vote for it covering all depts. …go for it…

g. Discussion and/or action to find funds to complete the Seagrape Drive Project (requested 11/10/08 commission meeting by VM McIntee) Tabled at 11/25/08 commission meeting by VM McIntee (Assist. Manager Olinzock)…backup shows with drainage this addition …will cost $65 thousand dollars…up from the previous $40 thousand…discussed last meeting…

BCbythesea…there is still some question where the plat shows what is private property…and the Commissioners better be real sure they do not do any taxpayer funded improvements on anything that proves to be private per the Broward property Appraiser…or it could blow up in their faces as the looming Palm Club court action appears in the near future!….Did anyone take a look and see about just applying asphalt…fixing the pitch up to the driveway…at a minimum cost…as suggested by a few familiar with the area?…This is way too expensive to divert the funds from the “no-go” bus stop covers…to add some “2 hat” new backers to  fall in for the depleting masses..

h. Discussion and/or action concerning the cost of hardship and other parking permits to be more in line with what other municipalities charge Tabled at 11/25/08 Commission meeting by Comm. Clottey… finally some backup…here is the links of what the Town provided for comparison…

i. Discussion and/or action regarding the formation of an Oversight Committee -explanation of ISO ratings and why the Town can not expect ISO to do the work of an Oversight Committee (Comm. Dodd…previous posts…VFD/Scoops/Agenda categories…including the links below…many feel ISO is not the correct answer to the de-facto  “real problem”…..in the department…

16. NEW BUSINESS

a. Discussion and?or action on a future agenda ordinance, as soon as possible after the Town Attorney has determined if it is permissible, to only allow contributions to any fund for election of a Town official, within Town limits unless they contribute equally to all registered candidates (Comm. Silverstone)…

BCbythesea…it is this writer’s opinion…this is an extension of the diversion of the Mc-CIC -Minnet-“Greengate” …and the reason behind this latest STOP THE MAYOR…tactic…the BSO and union contributions along with outside of town lawyer  donations  she received as she campaigned aloing with the former Commissioners….running along side her…

A look back will remind many of articles about the subject of vendors contributing to candidates in Pompano Beach…those who did not see a conflict…would not even recuse themselves if these vendors came in froont of them and those…including one that lost …that saw the conflict…plain as day…

It is said the vendor ordinance is being used in the City of Miami and the City of Adventura…and could be enacted here…but could be met with a challenge as the U S Supreme Court did find that it might impede freedom of speech…it’s a matter of freedom of speech VS fraud….and corruption…and it is the opinion of our Town Attorney that enacting this action would pass such a challenge due to the time factor built into the ordinances cited and the intentions put forth…

Although the impetus for this item is wrong…the ordinance is worth enacting…..no matter which side you are on….

b. Discussion and/or action regarding setting requirements for Town sponsored events regarding bills, income and donations (requested  at the 11/25/08 Commission meeting by VM McIntee)…

BCbythesea…more of the same Minnet-“Greengate” diversion..but a careful look could also be made into reimbursements made to fellow providers of other Town events prior to turning in paperwork to the town?…No accusations…just questions on how were they compensated…before or after?…Easter/Halloween…4th of July?….Were checks or cash receipts of any prior reimbursements for printing..film…items purchased included with all the paperwork the Town received?…

c. Discussion and/or action regarding legal advice during Quasi Judicial hearings, revisiting Coral Key development and why are we paying for an attorney if he can’t advise us during a hearing (Comm. Dodd)

BCbythesea…Comm. Dodd was disturbed that the Town Attorney could not advise from the dais before a vote on the Coral Key Appeal…and was further disturbed when another attorney disagreed with the assertion he could not….

The attorney for Mr. Arker at the BOA meeting raised his hand to also be allowed to testify…would that cover it?…Ot is there a need to have separate counsel for the Commission and Staff…to allow a response that  perhaps might have brought about a different result?…

d. Discussion and/or action regarding opening the pier access road (Mayor Minnet)…

A letter contained in the backup material shows how truly discriminatory and ridiculous it is that the pier parking is not allowed the same access as the Village Grille/Aruba are using a similar alleyway…across Commercial Blvd…..

In the letter with a recommendation from staff to not allow the use …the reasons given are lame…and easy to rectify by the pier owners…the 2 cited …the exiting fence will obstruct the line of sight for pedestrians and motorists…so change the fencing….and it could not be used for ingress into the lot due to a lack of adequate turn around radius…HUH?…Come on…the other alley has a turn around radius…no way…and that alley is being used all day for ingress to allow Arubas valet service to bring cars into their lot for patrons to leave on Commercial…a big plus for the restaurant under normal circumstances and a big bonus during the ongoing Pavilion construction…said to be ongoing until Feb/March 2009…also it is said the Right Of Way is to be used for emergency access to the beach and for beach cleaning equipment access along with pedestrians…word it the equipment cannot use the access as it is presently set up and the VFD Chief has related access into and out of the parking lot would be a benefit to the department…

BCbythesea…a definite double standard..being used…..too bad…

f. Discussion and/or action in reference to letter received from Master Plan Steering Committee and Planning and Zoning (Mayor Minnnet)…the backup provided only the original request copy dated 10/25/08…containing the 7 questions….nothing else!…

BCbythesea…the Committee and the Board are meeting this Thurs. 12/18/08 at 6:30 pm…with or without the answers…also of note members of both committees should be regularly informed of these meeting by the Town…to attend…per one member unaware of the meeting….

g. Discussion and/or action regarding parking a boat trailer in the front driveway in Bel Air (Mayor Minnet)…backup included a letter sent to the Town, Commissioners from a resident representing 16 neighbors on the subject…the backup also included the code of ordinances  Article 2…section 19-21 Parking and Motor Vehicles..from the Town website…

The land-use according to Assist. Manager Olinzock…is as it is in the south end of town…and unless changed…north end residents are not “grandfathered” in on boats…

BCbythesea…only out for these residents to keep their boats …if anyone can find documentation from the annexation or prior to ….allowing for boats in the unincorporated area… and an allowance for them to remain… or a change by the commission to the land use zoning….

i. Discussion and/or action for a round table meeting- promoting open discussion between Commissioners in 2009-5:00 pm January 13,2009 (Comm. Dodd)…

BCbythesea…word is Oriana is ready to make good on the $1 million in escrow…previous post…much input and planning is needed ..if this is a reality despite the developers not having their final C.O…..
