The Invocation..

Town Chaplain Rev. Hunsaker…”Let us be in an attitude of prayer all mighty God we gather for the business of our community after a holiday weekend which we remember those who have served our country and specifically those who have given their life that we might claim the freedom that we have. We ask almighty God that you guide us as we remember the shoulders upon whom we all stand as a nation, as a community and as individuals. Let us remember how our forefathers worked together to accomplish great things in spite of differences of opinion. They managed to put aside their personal agenda to deal with the need for the agenda for their community. We thank you almighty God for the young people who have worked to give us vision for the future. May we always remember that those who follow us look for guidance but also look for voice. And now almighty God we ask for your wisdom and your understanding as we do our business, Amen.”

BC- This writer thinks it’s important to hear the Town Chaplain’s words. Some on the commission seem to turn a deaf ear to his call for working together and putting aside personal agendas…It is also this writer’s opinion that the Reverend’s fine words in print are lost to many who cannot stomach the publication he is included in…HMMM….Maybe the “other” local paper could prevail upon him to join Doc Lawrence in jumping ship….along with former MPSC member Shevaun Steward-Kuhn (Realtor) and POA Board member/LBTS Decorating Class teacher/Decorator Judy Jones?…We know a lot of readers would agree…

The Mayor spoke of item 15 B the Art Institute student “winners”…asking the commission to write down their selections and hand them to the Clerk to address after the last presentation…

Presentations…VFD -previous post / EMS proclamation/ Jerry Sehl…spent some time giving P.R. to Marc Furth and presenting the first of many enlarged historical LBTS photos to the Town and the VFD…

BC-Unfortunately by allowing the VFD to self congratulate themselves yet again for doing their job…and letting Mr Sehl drone on..the commission “slighted ” the Art Institute students another time…How sad, first the pavilion was changed without letting the winning student know…then no signage was put up acknowledging the A.I. of Fort Lauderdale (despite it being asked for early on)…until the 11th hour!…Then the students of this project saw firsthand the substandard practices of the Town staff with the MPSC on having monetary awards for the winners…along with delays of being on the agenda and receiving the awards in a timely manner…This night with 5 students in the hall…their A.I. Instructor and his wife…and parents that traveled to finally see the awards being given to the winners…It was treated as an afterthought…a hodgepodge …a real let down and a “black eye” for the Town!…No fanfare…no photo-ops…no handshakes from the dais…and no awards handed out as Comm. Dodd had asked for…The priorities for presentations…this evening says it all!…Sorry, kids!…

Reports- Finance Report … previous post…Development Report- Comm. Clottey/VM asked Assist. TM Olinzock about zoning for vacation rentals in commercial areas per phone calls from a building owner who has property and called them from Georgia…It does not apply to commercial zoning…/ BSO Report- was where Comm. Clottey put her foot in her mouth and asked BSO Chief Gooding to tell the residents what to do when when they observe a “drug deal go down!”..previous post…Comm. Dodd asked about the red light cameras and safety following up on the public comments…Chief Gooding thought they were helpful with safety…The VM asked if the Sheriff’s office got any monies from it…Chief Gooding said no, but it could be mandated by the commission for training funds…The VM sucking up to his buddy Charlie Leachman (the annual /no increase/ no hour limit /beach parking CIC member who lives 4 blks from the beach) called it “Big Brother”…(perhaps finding it competition for his own Big Brother tactics?)…Comm. Silverstone followed up on Paul Novak’s inquiry for monitoring the beach for private fireworks on the 4th of July…Chief Gooding said the BSO would require a lot of assistance and are facing financial restraints…adding he (Gooding) had concerns about manning the area around the LBTS beach area for the July 4ht Beach Blast fireworks display…Comm. Silverstone asked for him to come up with a special budget for that day…VFD Report…previous post…Comm. Dodd brought up the ISO facts from the ISO Rep. countering the VFD claims made…no response from Chief Perkins (or the 2-Hats)…Dodd also acknowledged the drownings…asked again about the 88 medical calls …wondering if they might use them for training…such as hydrant maintenance ( a rate problem in the ISO report)…Perkins said they do fire hydrants 2 times a year…Comm. Clottey asked about the VFD insurance if something  went wrong..Chief Perkins replied it was $20 million…she went on to ask about keeping people out of the water in bad conditions like Ft. Laud….and the Town Atty. said it was a difference of life guards vs no lifeguards ..and it is a state owned beach (T. Atty. will bring this fact up again when addressing the kitesurfers)…Comm. Silverstone corrected the Chief on the insurance saying they had “lowered it” (to 7 million )…HUH?…/ AMR Report- Comm. Clottey asked about the ambulances…(previously posted)…that were on scene and why…The Vice Mayor did his usual “leading” AMR to boost the VFD …asking about co-training for the 2 departments…and taking the previously posted info on CPR workshops from this writer …funny aside this writer asked for an update from Lt. Liddle before the meeting began (the VM never has an original idea)…Comm. Silverstone thanked AMR for the hyperbaric incident…all reports passed 5-0

Town Manager Report… At&T cabinets in the ROW..(Ord. 1st reading 2009-23..passed no discussion 5-0)/ site plan color changes from Minto / citing code sec. 19-29 waivers to allow the Manager to grant parking in the Bougainvilla parking lot without coming to the commission asking for a resolution..passed 5-0

Ord. 2nd Reading …2009-20- to change notification to applicants for land development regulation…violations to be certified mail first (if not hand delivered) per a point made at P & Z by member Buzz Oldaker…

BC-This writer addressed it several time throughout the process …it should be added as a requirement for all Town notification which it is not at the present time)…passed 5-0

Ord. 2009-19-Vacation rentals…previous post…passed for 7 days 3-2 (Clottey/ McIntee dissenting)

BC- again watch to see if Jimmy-boy who voted on the prevailing side change his vote…

Ord. 2009-21-garbage discontinuation to be 30 days …no discussion…passes 5-0

Consent Agenda-Renewal of hurricane agreement with Tele-Vac/PB&J/Man-Con was approved 5-0 but that was after Comm. Dodd asked about any RFPs done…and the Town Manger visibly annoyed …gave him the response that the dollar amt. had not changed, these contractors were good in the past and there was no need…the “TM protector” VM McIntee jumped in to say Comm. Dodd was “nitpicking” …and to let the TM do her job…Word on the street from the taxpayers…”Keep it up Comm. Dodd, there should be RFPs for everything!’…/Bel Air entrance sign..The Mayor was still not for it, saying Bel Air should do what Terra Mar did and pay for it themselves…Many in the hall felt Comm. Clottey and VM McIntee should have recused themselves…Comm. Clottey said it was “restitution” for the wall being removed by the Town (still no word on who gave that order without consulting the commission) and the “harm” they (Bel Air) have received by the placing of the equipment for their sewers…and the VM “grandstanded” for “grass roots” not to be “discouraged” in neighborhoods..(The north still won’t vote for you again)…passes 4-1 (Mayor dissenting)/Draft policy on mitigation on code compliance fines and recorded liens…Comm. Dodd asked for this at a round table after the 1st time this was brought to public comments……2 examples were provided in the backup by Atty. Gordon Linn the LBTS Special Magistrate who is also the Pomp. Beach Town Atty….It is offered in Pompano…but the staff was not for it…so in their infinite wisdom (not!) the majority on the dais chose to listen to Assist. Town Manager Olinzock who when asked by Comm. Clottey and VM McIntee why the staff did not recommend this responded because their are rules…and no exceptions should be made!…WOW! talk about hypocrites on the dais…who each know of what this writer speaks of …enough said…Also hypocritical is for the VM to talk of helping out the “Totters” who are trying to pay their mortgage but offering no help to those in the situation as presented to them for a 2nd time by Ronald Rupp at public comments…(perhaps because he was not a LBTS voter?)…It died for lack of a 2nd…/median cut on El Mar for Marc Furth…no discussion passed 5-o/ 50 parking permits for coastal clean up Sat. 9/19/09…no discussion passed 5-0/Athena By The Sea special event…previous post went down 3-2 (Minnet/Dodd for it)…/ Wedding…on the beach…The hall erupted in laughter when VM McIntee asked 2 times about wedding of out of towners in Jarvis Hall…no matter that there have been none and Assist. TM Olinzock said as much and again these weddings were on the beach…and also when Comm. Clottey wanted to know if Aruba should approve it on the beach…(state beach!) ARGHHH….passed 5-0./Not done yet the last item was for the Lauren Katzenstein Celebration ride when Comm. Clottey asked Assist. TM Olinzock to inform the residents for the motorcycle noise coming…Assist. TM Olinzock told her it was bicycles and it had been done annually for years no problems…passed 5-0…

Began at 4:30 with Commissioner comments….previously posted…

Old Business- Kitesurfing done the evening before..previous post/ El Mar Design…evening before …see above/ Totters…previous post…/RFPs over $15,000 Comm. Dodd asked for more substantial information once again…to include all RFPs such as BSO/ Parking …and approx. values…sent back for the info…/Town Banners- Comm. gave their picks previously to Town Manager…(see agenda)…Comm. Clottey asked for “black frames and vivid colors”  for visibility due to her “expertise” in marketing…such a “billboards”…VM asked to expedite it…Assist. Olinzock wanted to know more specifics where, how many. one side or both sides…(we have both)…Mayor wanted the “T” area to be addressed (Commercial Blvd. A1A-El Mar Drive..Comm. Silverstone agree with the analysis being made for cost…and said it was “prudent” to wait until the next meeting…and asked for Chamber involvement…

New Business- Discussion and /or action regarding donations…Comm. Dodd spoke of the 4th of July and specified donations being collected for the fireworks…and the dilemma if collections exceed the amount stated by the Committee for use…He also addressed this writer’s situation on the pavilion Clock donation and the previous Sunshine education donation…This writer was allowed to speak on the lack of protocol and the need for some guidelines to be enacted (Town Manager said there are none)…so that people could participate in the future…The previous monies did in fact go towards Sunshine education as they were specified and a response was received this day after a public record request was made per the Asssist. Town Manager’s direction to see if it was enacted…/A single August Commission meeting…Comm. Dodd…He cited other towns that have one…and thought it should happen here to cut down on overload in Sept….It was not well received by the dais…The Mayor said maybe the following year due to her already making plans and she added that her research showed other towns that had one meeting in July and one in Aug….She did say if the dais chose to meet, she preferred early Aug…Comm. Silverstone didn’t care, but said it was harder for staff who were really busy with budget work…Vice Mayor McIntee said it was “not fair to staff” and spoke of the freedom of information that this writer asked about taking staff hours to find…( Give me a break!…I was directed by the Assist. TM to see if designated money went to what it was donated for…and if it took hours…something is very lacking in the Town staff…and again VM …staff has twice turned down additional staff saying it is not required!) The VM said an emergency meeting could be called if there was anything important in Aug.that to have a meeting in Aug “burdens the employees”…Comm. Clottey said maybe next year a lot of people have plans/ Outdoor seating…Comm. Silverstone…Quite a laughable situation after the Vice Mayor once again got it wrong as the representative for Pa DeGenaro said that on private property they should NOT need to be roped off as is required in the ordinance…McIntee said they wanted the rope!…Then after much discussion Comm. Dodd read the backup that showed the previous commission voted 5-0 for this ordinance that made no distinction for private vs public outdoor seating requirements…The “2-Hats” did not get the irony of their trying to correct something they were responsible for enacting!…Comm. Clottey thought they could just rearrange their parking lot to give room for the rope to be off the side walk (HUH?)…Assist. TM Olinzoock said there were code requirements for parking lots and spaces…incredibly in another example of hypocrisy  Comm. Clottey said “I’d like to see the Commission help them as much as possible”…HMMM……the Town Atty will work with Town staff for a solution …passed 5-0

BC-The “Gang of 3” want to do for this applicant what they will not for Athena…that says it all doesn’t it?…

The next 2 new business items were taken off…and then we went on to the last item Comm. Clottey and lifesaving awards…She wanted to know how to keep track of them all the VFD and others…that decisions need to be made …after all there are kitesurfers…so many…to award!…HUH?…The Vice Mayor said he gave this a lot of thought ( the hall not allowed this day to “erupt in laughter” merely shook their head!)…He wants a Award Day in December for recognition…giving the 3 types of honors that are typically bestowed…More discussion ensued on the Home Town Hero/ the CIC Citizen of the Year…and Comm. Dodd saying it should continue as is with employees and BSO with recognition by the Chiefs/Manager/ Dept. Heads at Reports…As is his M.O, the Vice Mayor took this item from Comm. Clottey and put in on the agenda for the 2nd meeting in July…Comm. Clottey’s face said it all…resigned to such actions from the VM…he has done this to her before…Comm. Dodd pointed the situation out to the oblivious- grandstanding re-election candidate (oops, VM) and Comm. Clottey sat forward saying “It doesn’t matter”…(Good “Gang” girl!)…

The Town Atty. finished up with reading that the Town was served with 4 Bert J. Harris suits…and that as required there would be shade sessions …
