VICE MAYOR MCINTEE “CHALLENGED” MAYOR MINNET……
IN the 5/8/09 BTSTimes VM McIntee wrote a “challenge” to Mayor Minnet…accusing her of not “controlling “the meetings…and telling her to “pass the gavel”!…
BC-Is it any wonder that the groundswell is growing to replace McIntee on the dais?….
Readers should watch closely to see who gets the gavel ….

6. REPORTS
7. PUBLIC SAFETY DISCUSSION
BC-Any public safety issues requiring answers …
8. TOWN MANAGER REPORT
a. Town Commission input regarding locations of Scenic Highway designation signage and areas of interest along SR A1A corridor in Lauderdale-By-The-Sea. Information will be presented during Broward A1A Scenic Highway Management Entity Trolley Tour on Thursday, May 21, 2009
BC- This is the Scenic Highway beautification project…just why this cannot be “tied in” with the desired signage for town businesses and hotels…the pier etc….should be addressed as we prepare to see a vote on spending more $$$$ to replace banners purchased last year to the tune of $12,000 old business item 15 B. with 7 submissions…
b. Clarification that the second reading of Ordinance 2009-14 amending Chapter 13 “Noise” will occur at the June 9, 2009 Town Commission meeting
BC- The ever changing “noise” ordinance..will be on June 9, 2009…due to the Sunshine posted “Field Trip” (previous post scoops cat.) with the Commission going out Friday/Sat….5/15/16-2009 to check out the decibel levels with a borrowed meter instrument from Fort Lauderdale (if available) and our Code Enforcer…who is described by Comm. Clottey as “an expert”…but is really certified …whether this certification can be categorized as being an expert is open for discussion…While on this 2-nigh foray to monitor the weekend events downtown…the Commission will veer off to also check out the darkness of El Mar Drive due to no lights on in turtle season…
c. Town Commission direction regarding the Streetscape design of El Mar Drive
BC- This writer received the following comment…
‘Hi Barbara,
Out son is one of the 5 finalists in the Art Institute of Ft. Lauderdale Students in designing the El Mar Project. We, as well as our son, would like to be informed about when the winner will be announced. Please advise us if you are aware of any updates regarding this matter.
Sincerely,
Mike and Pam’
As the Commission moves forth…we hope they are prepared to inform and bestow the 3 top awards to these students.. The students did their part in record time….Lack of a timely response from the Commission reflects poorly on our Town…
d. Town Commission direction regarding the reduction of Building Department permit fees for Town sponsored special events
BC-This was originally brought forward by Comm. Dodd who found it did not make sense to give money to a Town event whether put on by the Town or by the Chamber…only to have permit fees imposed coming back to the Town…(Broward County fees are off the table)…In the backup is perhaps a “tip off” that the Administration does not want to change the status quo…by presenting only the financial report for 10/1/2008-3/31/2009 (6 mos.) and comparing it to the full year report for 2007- 9/31/2008…rather than comparing the 1st 6 mos. of both…to see if they were in- line for revenue…we have the appearance that in the 1st 6 mos. of 2009 we are severely lacking in revenue…It may be so…but without the correct comparison..who knows…maybe the first 6 mos. were low in 2008 and doubled in the last 6 mos. which could again be the case in 2009?…
The 1st 6 mos. 2009…revenue was $31,959.45 …with a annual budget of $72,552.00/ in 2007-2008 the year end revenue was $94,125.19…with the annual budget being $84,682.00…but oddly the Unemcumbered balance was – 9,443.19 HMMM…
e. Clarification of Ordinance 2008-18 (3 hr. limit on beach meters) and (annual increases)
BC- The Ordinance in place calls for a 3 hour limit on both residential and beach permit parking…but does not include any annual rate increase…Witnesses a little “hair-pulling” in dealing with the new beach permits…in Town Hall
9. APPROVAL OF MINUTES
a. April 20, 2009 Regular Meeting Minutes
10. ORDINANCES
1. Ordinances 1st Reading – “Public Comments”
a. Ordinance 2009-22 (Ordinance 2008-17): AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA AMENDING THE TOWN CHARTER TO REQUIRE THE TOWN TO CONTRACT WITH LAUDERDALE-BY-THE-SEA VOLUNTEER FIRE DEPARTMENT, INC., FOR THE PROVISION OF FIRE PROTECTION SERVICES WITHIN THE TOWN; REQUIRING REFERENDUM APPROVAL OR A FOUR-FIFTHS VOTE OF THE TOWN COMMISSION FOR ANY ENTITY OTHER THAN LAUDERDALE-BY-THE-SEA VOLUNTEER FIRE DEPARTMENT, INC. TO PROVIDE PRIMARY FIRE PROTECTION SERVICES IN THE TOWN; PROVIDING FOR CONFLICTS WITH OTHER PROVISIONS OF THE TOWN CHARTER; CALLING FOR A REFERENDUM ELECTION; PROVIDING FOR THE FORM OF THE BALLOT; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE (FOR FIRST READING) (TABLED AT THE JULY 22, 2008 COMMISSION MEETING BY COMMISSIONER DODD) Tabled at the November 10, 2008 Commission meeting for 6 months by Vice Mayor McIntee
BC- THE CART BEFORE THE HORSE…YOU BET!…How in the world can only one item to be included on the Referendum…(the VFD cant fire em’ Referendum item) be put on prior to the Referendum Workshop (May 13,2009 Jarvis Hall)…with a change in the vote required…HMMM….
2. Ordinances 2nd Reading – “PUBLIC HEARING”
a. Ordinance 2009-10: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY THE SEA, FLORIDA, AMENDING CHAPTER 30 “UNIFIED LAND DEVELOPMENT REGULATIONS,” ARTICLE I “IN GENERAL,” SECTION 30-21 “NON-CONFORMING USES AND STRUCTURES” TO AMEND REQUIREMENTS FOR CONTINUATION OF NON-CONFORMING USES AND STRUCTURES; AMENDING ARTICLE IV “SITE PLAN PROCEDURES AND REQUIREMENTS,” SECTION 30-123 “APPLICATION FOR FINAL SITE PLAN APPROVAL” TO CLARIFY THE REQUIREMENTS FOR AN APPROVED SITE PLAN TO REMAIN EFFECTIVE; AMENDING ARTICLE V “ZONING,” DIVISION 2 “DISTRICTS,” SECTION 30-211“RS-5 DISTRICT—RESIDENCE” TO AMEND ROOF OVERHANG SETBACK REQUIREMENTS IN THE RS-5 DISTRICT; AMENDING ARTICLE V “ZONING,” DIVISION 2 “DISTRICTS,” SECTION 30-271 “B-1 DISTRICT- BUSINESS” IN ORDER TO PROVIDE THAT COOKING SCHOOLS, CATERING BUSINESSES, MOTORIZED SCOOTER OR MOPED SALES AND RENTALS ARE PERMITTED USES IN THE B-1 DISTRICT; AMENDING ARTICLE V “ZONING,” DIVISION 2 “DISTRICTS,” SECTION 30-313 “GENERAL PROVISIONS” IN ORDER TO AMEND THE REQUIREMENTS FOR FENCES, WALLS, AND HEDGES AND TO PROVIDE DEVELOPMENT STANDARDS FOR DRIVEWAYS, SWALES, AND GENERATORS; FURTHER AMENDING ARTICLE VIII “SIGN REGULATIONS,” SECTION 30-507 “DEFINITIONS AND RESTRICTIONS BY SIGN TYPE,” TO AMEND THE DEFINITIONS OF “SIGN,” “INFORMATIONAL, DIRECTIONAL OR TRAFFIC CONTROL SIGN,” AND “REAL ESTATE SIGN”; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE
BC- This is supposed to be the final step…BUT…a look into the backup still shows some input from the Commission at their workshop pertaining to this Ordinance has not been included and it is imperative that Commission members do their homework on this one…before it gets voted on…blindly…leaving non- conforming property owners in the lurch if more than 50% of their building is destroyed!…Other items are left to wither and die…..as well…
b. Ordinance 2009-13: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA, GRANTING AN EXCLUSIVE RIGHT, PRIVILEGE AND FRANCHISE TO CHOICE ENVIRONMENTAL SYSTEMS INC. TO OPERATE THE ONLY SOLID WASTE AND RECYCLABLE COLLECTION SYSTEM IN THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA; PROVIDING FOR THE TERMS, CONDITIONS, AND STANDARDS FOR SAID FRANCHISE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE.
c. Ordinance 2009-14: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA, AMENDING CHAPTER 13 “NOISE” OF THE CODE OF ORDINANCES TO PROVIDE FOR AMENDED NOISE REGULATIONS; AMENDING CHAPTER 17 “STREETS, SIDEWALKS AND OTHER PUBLIC PLACES,” ARTICLE VIII “SPECIAL EVENTS” TO AMEND THE REGULATIONS OF SPECIAL EVENT PERMITS TO PROVIDE GROUNDS FOR DENIAL OF A SPECIAL EVENT PERMIT FOR VIOLATION OF NOISE AND OTHER TOWN STANDARDS; PROVIDING FOR SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE.
BC- will be delayed until June 9,2009…per Manager’s Report..
11. COMMISSIONER COMMENTS
12. CONSENT AGENDA
a. Award of annual Tree Trimming Maintenance Agreement with Lawn Logic, LLC (Assistant Town Manager Olinzock)
BC- previously posted…see backup online…
b. Award of annual Landscape Maintenance Agreement with Green Haven (Assistant Town Manager Olinzock)
BC- previously posted …see backup online…How many employees do we have in town…why the need to contract out for this?…
c. Ratification by Town Commission of use of 2 parking spaces 12 hours per day for 8 days on Datura Avenue by Aron & Associates during repairs to balconies on Winter Colony Condominiums, 4300 El Mar Drive (Assistant Town Manager Olinzock)
13. RESOLUTION – “Public Comments”
14. QUASI JUDICIAL PUBLIC HEARINGS
15. OLD BUSINESS
a. Discussion and/or action regarding Town Manager review as required in the contract (Commissioner Dodd)
BC- Finally a little backup info showing the contract that say “at least annually” for review and a roundup of towns that do them…Coral Springs is done by the Commission/ Oakland Park & Pompano Beach do theirs annually in a public forum…MIA was the direction given for the content of how these towns did their reviews…
ALERT!….
BC- Look for the BCBTS post…( coming shortly)….which will provide further reason of why a Town Manager Review is required before the annual budget this September!….
b. Selection by Town Commission of design for custom banners in the Hospitality and Business District of Town (Assistant Town Manager Olinzock) (This item was deferred at the April 29, 2009 by Commissioner Dodd)
BC- There are 7 submissions included in the backup…Again, why the added expense…at this time…and why no follow-up on the 2007 5-0 vote for signage on Commercial…as was directed by the Commission a few meetings back. Assist. Olinzock says those signs are not allowed…This one needs a response on exactly what was asked for and accepted per previous Municipal Director Mason and Town Staff….from the FDOT after they are provided the 2007 paperwork….As stated above…. can’t it be coordinated with the Scenic Highway signage?…Also, still do not understand why not use the old Mack’s Grove sign for the parking lot?….suggested previously by a reader….. it’s a great idea!…
16. NEW BUSINESS
a. Discussion and/or action regarding the creation of a Resolution recognizing the “Building Citizenship in the Community: Back to Basics” Initiative of the Florida League of Cities (Mayor Minnet)
b. Discussion and/or action on the formation of a Budget Review Board (Commissioner Dodd)
BC- This was brought forward last year by resident Bod Eckblad and former resident John Thompson…as well as many others in prior years as budget time approached…
c. Discussion and/or action concerning the hiring of a part-time clerk to support the Town Commission. Providing each Commissioner with up to four hours of clerical support each month would relieve the other staff from these duties – $2,200 (Commissioner Clottey)
BC- TOO…TOO FUNNY!…Comm. Dodd is on record asking for this …and was met with the usual opposition from the Gang of 3…With one of their own on board…GO FOR IT!…
It seems to be a pattern for the “Gang” ….They wait a while and take items originally put on by the minority (Minnet/Dodd)…. shooting the item down…. then the majority (McIntte/ Silverstone/ Clottey)…and return those items to the agenda under their own names…Perhaps they think LBTS residents are akin to channel 7 news viewers…”short attention span” watchers…NOT!…
d. Discussion and/or action concerning the granting of special event permits when the Town or Chamber is sponsoring a special event (Commissioner Clottey)
BC- Continuing on her Crusade to Clobber the downtown businesses…”Clueless” Comm. Clottey wants to make it so no business can have an event that goes on at the same time as a Town/Chamber event or right after or before!…Again, where are the complainers…Comm. Clottey?…Readers will remeber that the last such “tandem” weekend event was a big success!…
e. Discussion and/or action concerning the role of the Town’s spokesperson (Public Information Officer) when dealing with the media during and after a crisis (Commissioner Clottey)
BC- previously posted this must have been a directive to Comm. Clottey after the BSO hyperbaric chamber Press Releases…and the lack of press for the VFD…It is not the fault of our PIO it is the lack of organized P.R. and timely reporting by the VFD itself…
17. TOWN ATTORNEY REPORT
18. ADJOURNMENT
BC- an overview will follow the meeting(s)….which will be televised on Comcast channel 78/ online at Town website…
more to come…
