15.0  PERFORMANCE EVALUATIONS…

Once again the Commission “Gang of 3″….decided to shirk their duties….and ignore the Town Manager’s Employment Agreement…

This writer believes that none of these 3 have read it…and if they have and have chosen to ignore their duty to honor the agreement…to do so is to dishonored their constituents…and the office to which they were elected…

A little background…(in previous posts…scoops category)…A look online at the news on neighboring towns…Pompano Beach and Deerfield Beach brought to my attention an Annual Town Manager Performance Review that was being asked for by the residents in those towns…After finding a few Commissioners did not know if this was contained in our Town Manager’s contract, I made a request. It was included and then all hell broke loose…

An orchestrated “parade” was put on of CIC members to give accolades to the Town Mananger…with subsequent commentaries from the Vice Mayor …Comm. Silverstone and Comm. Clottey that this Manager was “reviewed” everyday… an annual evaluation was a “witch hunt” …and demoralizing to the Manager and the Town staff. (We hear the Town staff is evaluated annually by the Manager.)…

The Manager lost it on the dais, and said she did not need a review. This is the same Manager that does everything by the book…when it comes to the residents…and the businesses…

The Mc-Furth Times did feature on how we love our Town Manager…

At the 4/20/09 continuation meeting when this came up for a vote after the item was put on under New Business by Comm. Dodd, (following up on discussion previously agreed upon at the last Round Table by a quorum  that was comprised of the Mayor, Comms. Dodd and Clottey)……to discuss how to put a  review together…again the “Gang of 3” disparaged the very idea of a review…and Comm. Dodd who is trying to honor the agreement….

The Manager’s Employment Agreement …dated May 22, 2007…states the following…

15.0 Performance Agreement

15.1 The Commission SHALL review and evaluate the performance or the Employee AT LEAST ANNUALLY in ADVANCE of the ADOPTION of the annual operating budget. Said review and evaluation SHALL be in accordance with SPECIFIC CRITERIA DEVELOPED JOINTLY by Employer and Employee. Said criteria may be added to or deleted from as the Commission may from time to time determine, in consultation with the employee. Further the Commission SHALL provide adequate opportunity for the Employee to discuss her/his evaluation with the Commission.

15.2  ANNUALLY, the Commission and the Employee SHALL define such goals and performance objectives that THEY determine necessary for the proper operation of the Town and in attainment of the Commission policy objectives and SHALL further establish a relative priority among those various goals and objectives, said goals and objectives to be reduced to writing. They SHALL generally be attainable within the limitations as specified and in the annual operating and capital budgets and appropriations provided.

This signed agreement does not say IF the Commission feels like it…It does not say they can IGNORE it…It does not say we NEVER DID IT BEFORE so we can go on not doing it….

It says…. it SHALL be done AT LEAST ANNUALLY!….

At the meeting no one on the dais knew where to come upon with the criteria…Comm. Clottey said it would be strange to ask the Manager to find the criteria, but in the agreement the Manager is supposed to JOINTLY develop the criteria with the Commission…HMMM….

Comm. Clottey said this should not be discussed on the dais, but in a Round Table meeting. She is wrong!…

With no Commission Round Table meeting date set, and the budget workshop dates to be scheduled at the next Commission meeting on 4/28/09…the Town Manager’s Performance Evaluation must be voted on by the Commissioners on the dais and a criteria must be agreed upon jointly…

To not do it is violating the agreement.

If the Manager did not want a Performance Evaluation in her contract, why did she leave it in?…She is on record in the minutes in 2007 saying she alone made changes to her agreement…She has stated she does annual evaluations on her own employees…and she will have plenty of company from neighboring towns doing their own evaluations this year to honor their agreements with their Town Managers…..

The only way this should not be done this year as required is for the Commission to draw up a new agreement taking out the Performance Evaluations portion.

If that comes to fruition, and passes  with the “new” majority in a 3-2 vote……the voters should take note and be very alarmed .. The voters will need to decide if they would want to re-elect 2 Commissioners who would rather re-write a contract than to follow an agreement  evaluating annually the person hired to run the Town….

Of Note…This writer upon a closer look at the agreement was incorrect in the previous post and at the podium..The agreement does not say the Manager may discuss her/his evaluation “of” the  Commission …it states for the Employee to discuss her/his evaluation  “with” the Commission …OOPS!…
