A VERY LONG POST…..(any typos…sorry…it was a very long year)…

Dear Readers…

Jerry McIntee became a FF1…on Nov. 28,2005…cert.#127669…a little over a month before being elected Deputy Chief of the VFD….the VFD held their elections …and as they ran for the LBTS Commission… Jim Silverstone and Jerry McIntee became the Chief and Deputy Chief of the LBTS-VFD…in January 2006…(as shown in the agenda minutes below)…following up with their election to the Town Commission in March of 2006….and as you will see from their 1st year in office…in dual leadership roles….an increasing crescendo of the VFD taking over the Commission agendas…and the Town is abundantly clear…
Full disclosure…a few months into their new posts…this writer became increasingly involved…and vocal…but a look back at these minutes…with a set of free and clear eyes…deprogrammed ….makes so much of what happened then…look entirely different…and all the more disturbing…

Commissioner Wessels…answering citizen Dodd who had concerns over BSO holding placards on election day…he pointed out no desire for outside influence becoming involved in the election…thought it was inappropriate for the VFD to get involved in the political election as well…Mr. Dodd agreed…
Vice Mayor Kennedy said the VFD were an excellent organization, but two individuals were using the organization for political gain and because the organization was brought into the political arena, they became fair game for discussion.

Comm. Silverstone…referenced VFD stating that he was current Chief…expressed belief that the department had fully changed in the last 5 years. …he stated he wanted to review costs and the possibilities of having the volunteers completely take over Town’s fire suppression….Comm Silverstone said he would pursue it aggressively…he was proud of volunteers and believed they could move much further…
Comm. McIntee….indicated that within the last month volunteer’s responses had been limited…he stated that there were approx. 70 FF in the dept. and the only way¬† he could train the personnel was hands- on …he said any changes to the contract needed to be in writing…the volunteers had not agreed to the change…he spoke of engine 36…his belief that Chief Lello did not understand the seriousness of the matter…he indicated that there were options and, if forced to take those options, the Volunteers will do just do just that…he referenced the annexation…and considered a referendum to ensure the Volunteers could continue to serve the south end of town…he said he preferred to work together with BSO but that BSO..was forcing “our” hand….he did not believe the Volunteers were provided a fair shake and stated he would do anything to keep the integrity as a foundation of the Town…

13 E Discussion/action regarding cancellation of contract between Town/BSO fire services…(Comm. McIntee)…wanted the Atty. to provide at a workshop a presentation on fire issues….bothered by SR Lakes paying $40 thousand for fire service/EMS…
BCbythesea…Vice Mayor McIntee…2008…wanted to offer a low-cost VFD fire /EMS service to SR Lakes to continue being “good neighbors”…
Manager Baldwin responded fees to SR Lakes came from BSO…Comm.McIntee thought it was criminal …against Town residents…stated he would send the State Atty. a complaint…he demanded the Battalion Chief answer the differences…in contracts for both towns…Comm Silverstone made a motion …2nd by Comm. McIntee for 3 more minutes to speak…he went on about the unfairness…felt BSO had violated the contract with LBTS by subsidizing SR Lakes… Atty.Cherof read into the record the BSO/SR Lakes acknowledged agreement…Comm.Clark said it was not a secret…and Jenne said it had been agreed to before Jenne took over….Comm. Clark was assured it would be renegotiated upon renewal…Comm Silverstone…stated that the item of discussion before the Commission was consideration of canceling the Town’s contract with BSO…indicating the Town had adopted a resolution the year before to support the VFD to become sole fire suppression provider in town….he said Volunteers worked hard and “we deserve” to see that resolution come to an end…Yanni said the VFD used to provide SR Lakes suppression $10,000.00…and when VFD raised it to $25 thou…SR Lakes switched to Ft. Lauderdale….Comm. Silverstone said the VFD could take over now…even after questioned about having all necessary equipment…when asked by Yanni about EMS services…it would be contracted out….Vice Mayor Yanni was concerned with McIntee/Silverstone wanting to cancel service…needed detailed info…fiscal …level of service…and was told service would be the same as BSO…Comm. Silverstone felt residents had been getting wrong info with regards to Volunteers…Yanni asked about a proper fire station…saying a savings in money could make that happen…Comm. Clark discussed scheduling workshops…Comm. McIntee wanted them immediately with bids collected in August…wanted to debate BSO…Yanni asked if any possibility of BSO/VFD working together….workshops to begin in Sept…Comm. McIntee wanted private ambulance services to be included in proposals…
14 D Discussion/action donation of fire apparatus from Plantation…(Comm. McIntee)…he said Plantation offered LBTS a Freightliner emergency vehicle…to VFD…described how it had been overhauled…said VFD did not have enough equipment…would be used for manpower squad…when VFD became sole provider…used to support ambulance…he promised any resident a ride to the hospital or home free of charge…VFD has such a good reputation he said that paid fire departments were offering us assistance…he said it was an honor and privilege to receive such acclaim from chiefs all over the county…VFD would sustain complete cost without using taxpayer dollars…wanted the Town to provide the fuel….Mayor Parker put a damper on it by reiterating VFD was a private organization…and Town could not accept donation…discussion on fuel was put on next agenda…

5 B. BSO ( Comm. Silverstone/Battalion Chief Padden)…gave brief history of VFD…contract with BSO…June 2004…VFD unhappy with treatment…command not providing …communication vehicles…lack of budget participation…VFD had 66 members…VFD was not given what they were told they would upon signing on ….BSO unions and management forcing problems…VFD found itself in position to become political to ensure the Town did not lose the Volunteers….Vice Mayor Yanni wanted VFD & BSO…Comm. McIntee said the VFD could not do the neighborly services long done by the….not allowed to use VFD trucks…were in violation of contract for using their own equipment…discussion about who owned equipment…Town/BSO….Parker asked about an agreement made with Fort Lauderdale for mutual aid…negotiated by Comm. Silverstone/McIntee…as VFD Chief/Deputy Chief…not in writing…and negotiating with Pompano for training…Mayor Parker went for the “2 hats” …when and where the Comms. /VFD Silverstone/McIntee were in attendance …they were at all VFD meetings…they established membership with Fire Chief Assoc. in June 2006…representatives included the “2 hats”…Commissioners…
9. Commissioner Comments…Comm. Silverstone clarified his roles as Comm./firefighter…stating if a fire broke out while he was on the dais he would leave to attend the fire…serving as Comm. was a public service…did not believe he should be held liable for being proud to serve as both…spoke of Plantation donation…said there were some errors in procedures…that the loss of the vehicle placed “us” in a very uncomfortable position as it was something”we” needed that would have been beneficial to the Town…
Mayor Parker on the Plantation donation said Comm. McIntee said the Town “could take it to the bank” that it was donated by Plantation …and the request for fuel …both issues needed to be on the next agenda…
14 B. Discussion/action regarding impartial review of VFD standard operating procedures/recommendations on fire suppression contract with Town…(Comm. McIntee)…wanted discussion on request for a study…recommended MGT Comm. Silverstone 2nd it…Comm. Clark nominated Chuck Lanza…Vice Mayor Yanni 2nd it…a 3rd person was present…lots of back and forth over BSO/Lanza/and bias by Comms. McIntee/Silverstone… aimed at the VFD…Parker/Yanni against MGT..past bad experience…Chief Lanza won 3-2…Comms. Silverstone/McIntee dissenting…also voted the same way for the $80,000.00 price tag…….

Comm. McIntee mentioned the fire workshop had been presented…more workshops in the future…Town Commission needs to send out proposals to other departments…to compare cost…benefits…for service….talked of signing contracts…some getting signed immediately others languishing ….he wanted to let all present know he will not be pushed into signing any contracts until he feels they are in the best interest of the town…
Comm. Silverstone…spoke of the Commission getting the facts out about the fire workshop….people needing to be educated regarding what is available to the public…such as search and rescue…failed to get the word out…the Commission will begin taking a very proactive stance educating the public…
Comm. Clark…gave his take on the fire workshop…feels there needs to be many workshops…homework…for both VFD/BSO…documentation requests…for proper analysis…

Regular Commission Meeting….Commissioner Comments…
Comm. Silverstone..he was shocked by the Mayor’s conduct relative to the Fire Dept./EMS discussions….expressed disappointment…
Comm. McIntee….remembered a workshop set up with the Broward Fire Dept…..said Mayor Parker/Clark set up the rules…they were reasonable…fair…and VFD did everything they were asked to….provided all info…when they began the project someone walked up to Comm. McIntee and handed him the BSO report that they were supposed to prepare….the reports he asserts were to be passed on the same day so each dept. could respond in a fair and reasonable manner….when the report was delivered 5 minutes before the workshop…that is not going to happen….Comm.Clark came to the front of the table and called them on it…and it will be put off until tomorrow…this is what is wrong with the fire system in this town…LBTS is taken for granted….BSO Chief and Deputy assured both Mayor Parker and Clark they would have it…McIntee said Mr Lanza the person hired by the Commission assured he would get it all done…had been away….and the Commission was supposed to meet with him…switch things…and Lanza went to Italy and never told us…he’s a no show at the meeting…Town is paying him $80 thousand…in his hand McIntee had a $526 requisition for first aid equipment…then McIntee described what the VFD needs on their truck…a scenario of consequences if BSO is out of service and a “mass casualty” occurs…that the VFD took a vote and will pay for it themselves…
Mayor Parker…reminded the clerk…on the fire budget…the vote was 5-0..all agreed…the EMS budget…was 3-2…Comms. McIntee/Silverstone dissenting…when it comes to protecting the safety off the town, three commissioners are willing to spend the money to do it and two are not because they don’t get any money from it…

Regular Commission Meeting….Commissioner comments…
Comm. McIntee addressed the VFD issue…stating as Deputy Chief ….referencing an incident during Hurricane Wilma…where the Volunteers had gone to assist an elderly person…expressing no “paid” firefighter would do that….
Comm. Silverstone….referenced questions concerning what would happen to vehicles that were transferred to BSO from the VFD stating the contract provided they be returned to the Town upon cancellation of the agreement….
Comm. Clark…addressed Dodd’s comments regarding the VFD stated he continued to support resolution adopted by the Commission….however, that ‘that support was bound by a criteria that had to be met, which included; total accountability to the Town Manager and the Commission; a level of expertise that was documented and acceptable to the Commission; as well as, fiscal responsibility and procedures to be in place to provide consistency to ensure the ability to respond to calls seven days a week,24 hours a day. He stated unless he had completely misunderstood recent discussions, the current leadership agreed with this criteria…

5 B. Report on Nov. 10,2006 meeting…the clerk advised a special meeting was held on 11/10/08… motion made by Comm. Silverstone/McIntee…to terminate BSO contract for breach of contract with the Town and to put the VFD back in service….much procedural discussion over tabling and who voted when…refusal to vote…and if the meeting was actually adjourned…McIntee demanded everyone stay so discussions could be held and a resolution obtained….McIntee asked for a ruling on Sunshine…Town Atty. would not render an opinion…and that any member of Commission or public could take it to the state to decide if there was…and seek recourse…Mayor Parker stated the Town had an ordinance …special meetings may be called by the Mayor, the Manager,or 2 commissioners….he felt the ordinance was open for abuse…wanting to amend that ordinance…it was put for 1st reading on the next agenda…adding 1 more Commissioner would be needed to call a special meeting…
10. Special Business…Discussion/action regarding fire services and public safety….options include but are not limited to…BSO alone/VFD alone/Maintaining status quo/scheduling more workshops….prior to this item on the agenda Sheriff Jenne notified Town Manager that Sheriff’s agreement with VFD was terminated immediately and requested the Town’s consent…this request is included in option 1….also repeated was the motion above by Comm. Silverstone/McIntee to terminate BSO….
Comm. McIntee stated he wished to offer a sign of peace that may begin to mend this tremendous problem….he requested the keys to the fire station to be returned to the VFD in good faith…that the trucks not be removed…and the Volunteers would not respond to emergency calls…if this could not be agreed to there would be ramifications with the entire County realizing that “Goliath, Broward Fire Department, had stepped on ‘David’ and David’s fighting back.’….McIntee stated the members of his department would maintain the station…assure no one would respond to calls…use equipment…for training….he stated communication was key and there was a way to work this out….returning the keys would show BSO was acting reasonably…he stated the Volunteers could live with this arrangement while the battles were decided….the longer the Volunteers were made to wait, the more “young guys” he would lose….in the long run if BSO did not make this concession its personnel would be “booed or their thumbs would go down”
Chief Lello stated the fire station was Town property…not the Volunteers….he offered to have BSO/VFD leadership meet within 2 weeks…to see what kind of agreement could be obtained…and this issue resolved…Comm. McIntee stated it was reasonable…he indicated he would resign with Chief Silverstone in January when VFD has elections…and McIntee stated “turning over the department to new leaders could not be done overnight.”….Lello was given commitment by McIntee to negotiate…
Comm. Silverstone…asked for the keys now…Chief Lello said no…there would be discussion with VFD leadership…and McIntee dsaid foor the keys to be returned…”we will sit down with you in the middle of Broward headquarters’….Lello was to give an answer in 48 hours….the item was tabled …Comm. McIntee said agreed upon negotiations did not mean the VFD were stopping their legal action….he stated that “we had invested a great deal of money in them” and the attorneys would not cease, going full speed to obtain a court order….

Reports…
5 E. Report by BSO on progress of VFD negotiations….discussion/action…(Mayor Parker)….BSO Rep. was present…said they met 11/14/06…after the meeting had a phone call from VFD attorney…to schedule a meeting to negotiate resolution of differences…due to a BSO tragic event…vacation of Chief Lello…Thanksgiving…will meet this week…offered to meet with VFD this week…response from VFD Atty. one week later suggested an ultimatum rather than a meeting….he went on about receiving further response from VFD Atty. requesting response or litigation would commence….BSO Rep…sent letter suggesting negotiations…and availability to do so with VFD….no further response had been received by BSO….
Comm. Clark asked about communications…much a repeat of the above….and then stated the “business of the Town had been placed on the back burner and this issue had gone on for too long”…Clark made a motion…Vice Mayor Yanni 2nd it…to grant consent to the Sheriff for permission for having terminated the contract with the Volunteers…
Comm. Silverstone questioned if Clark could make such a motion…as he already voted on the matter…Mayor Parker reminded him there was no prevailing side …2-2 tie….Town Atty said it could come back…and Silverstone further questioned the Mayor’s ability to motion…as he did not vote…prior…resulting in th tie…the Town Atty. said he could…the BSO Rep. was asked by Silverstone if there was consent from BSO for the termination…there was …in a letter dated 11/7/2006….
Comm. McIntee…asked with the consent if BSO would be closing and locking up the fire department…BSO would proceed in providing fire protection to the Town…McIntee asked about the Volunteers being locked out…the Rep. did not see any reason to do that unless the VFD did anything contrary to the termination contract…McIntee stated if consent was granted the the Sheriff’s relationship with the VFD would cease to exist…he indicated it was the Sheriff’s indication that the Sheriff’s office owned or ran that building….the Rep. said the contract with the Town gave occupancy to the BSO….the VFD could make arrangements to remove their stuff…and that the equipment paid for with public funds would be turned over to BSO…he explained there was no reason for VFD to remain in building…
Comm. McIntee asked Comm. Clark if he was accepting action to terminate VFD…Clark said yes…saying the issue needed closure…
MciIntee left dais to confer with member of the audience…returned …came back asking for a time table for VFD removal from station…the McIntee asked if all the internal investigations would continue….BSO Rep. thought they would…Comm. McIntee asked if he could submit a complaint regarding a potential crime regarding the fire department…asking if BSO would act on it….the Rep said no…and directed McIntee to submit the complaint to the Inspector General off BSO… McIntee said this was a set up…stating “the Sheriff doesn’t know the hornet’s nest he just stirred up”…the BSO Rep…asked if this was a threat…McIntee said no threats in the comment…just absolute fact….he stated the the Sheriff’s office had destroyed the VFD….
They voted…made it retroactive to 11/7/08…the BSO letter to terminate….gave the VFD until 5pm on Fri. to get out of the fire station…as McIntee stated BSO was being “covered from the dais”…
Mayor Parker expressed concern over a VFD lawsuit…the the McIntee grilling went to questioning the BSO Rep. on speaking to the Mayor prior to the meeting…and was told he had…and again they spoke during a break…asked if they discussed the vote…the Rep. said no…with more inquiry coming from McIntee the BSO Rep. refused to discuss anymore…McIntee went on to tell his recollection of the time prior to this meeting…and added that this was not over and ” your little Volunteer Fire Department will rise from the ashes” because of the residents.he started the tough days ahead…the fire assessment…that he would monitor the BSO..and their funds…
Comm. Silverstone was shocked…and said it was unacceptable as long as BSO remained in Town…he brought up Chief Padden to recount the VFD side of what transpired….Silverstone stated the VFD already spent $30 thousand in legal fees…and were not participating in Town events…
Comm Clark asked for copies of communications from BSO…and VFD….to be entered into the record…
Comm. McIntee said those letters meant nothing…and reiterated this was a set up…McIntee went on to recount seeing BSO have lunch at Village Grille…and accusing them of getting a reduced for BSO bill…half price…and he filed a complaint…which the BSO Police Chief said McIntee had done….however when McIntee was questioned if the VFD received the same courtesy he confirmed they did…McIntee went on to claim file cabinets had been broken into…stating” the gloves were off now”…and BSO had broken all the rules and regulations….
Comm. Silverstone went over the BSO Rep’s letter …and challenged the claim of the Sheriff’s Office to obtain the Town’s consent prior to termination….the BSO Rep. responded he would not argue the law in this forum…back and forth they went on who would and would not negotiate…
The roll was called 3-2…Comms. McIntee/Silverstone dissenting…afterwards there was discussion with the Town Manager about the fire station…and vacating it….
9. Commissioner Comments….
Comm McIntee continued on about BSO….the files in the station…and all sorts of other stuff that “was just stolen from the Town’….Comm. McIntee stated the Town was in trouble because people”up here and they are abusing their authority and their power.’….
Vice mayor Yanni…said he couldn’t help but to think if the VFD negotiated as hard as they fought the BSO the Town would never have had to make the decision they made today…he went on to explain he had no conflict of interest …with working for BSO…and was not paid by BSO fire department…he said with the VFD gone…Comms. McIntee/Silverstone
Mayor Parker…said no one had voted to eliminate the VFD …but eliminate its current leadership….he then went into allegations against that leadership and asked if it was being investigated…BSO Chief Gooding said it was….Comm. McIntee said the Mayor should resign…

Public comments…
Maureen McIntee spoke in opposition of having BSO terminate the contract with VFD …she felt it was in direct violation with their contract….she spoke in opposition to the Town’s actions ….spoke against the prior VFD leadership ….stating that it was not the present leadership that was causing the problem….she questioned the motives of those residents that agreed with the termination of the VFD…
Commissioner Comments….
Comm. McIntee indicated he was upset with BSO fire/EMS….and law enforcement…questioned why there were 4 firefighters sleeping in Town Hall….stating there were too many vehicles in the parking lot….he referenced the fire station…asking about equipment….he stated BSO should be aware he was watching and that permits better have been obtained for any work being done…he questioned the location of the VFD vehicle that was assigned to the VFD Chief…he said he thought the VFD equipment was “scooped up and dumped in the local canal”…stating that if “we” came back and went to get the equipment it would all be gone…he stated the equipment had better be returned as they were purchased for the Volunteers…he stated the BSO was “stealing our equipment”…and felt if the equipment were placed as part of the fleet, it would serve other communities….he did not feel the termination gave BSO the right to the equipment….he questioned the BSO “Reserve” volunteer dept…..read from a list of information he was requesting from BSO….stated he was serious ensuring BSO follow the Town’s regulations….he asked for discussion/action at the next meeting regarding forming an individual police dept…..he felt it was time to remove BSO entirely from the Town…..
Comm. Silverstone…referenced the VFD…and the promises at the time of annexation…said they were binding…said the Volunteers had met their goals…and stated this was the reason he had run for the Commission seat….he again questioned Mayor Parker’s vote….and the Town Atty. again stood by his opinion…he said it was unfair that the VFD attorney had not been present…talked of a Town Topics that had BSO front and center for Halloween and left out residents who had volunteered including the Furths…unbalanced reporting…he finished by stating he would do anything possible to get the Volunteers back,expressing his belief that the Volunteers had earned the right to serve the Town…

Silverstone….Joe Padden of the VFD came forward to provide information on equipment purchased to perform water rescues….Mr Padden stated the VFD had several qualified life guards and felt this was a service the VFD could provide….Padden relayed VFD events….and said VFD would meet and continue to train….the Town Atty. said the Town would need to supplement or sponsor the VFD to do the proposed idea….saying it needed to be formalized …explaining it went back to an issue of liability….the item was tabled …with the VFD providing a written proposal to the Town ….for review…and Clark said the Town Manager would be in control of it…a vote of 3-2…Comms McIntee/Silverstone dissenting…McIntee asked for it to be on the next agenda…Mayor Parker said it would be on the agenda after the proposal was reviewed by the Manager….
14 D. Discussion/action recovering equipment bought by LBTS taxpayers for the VFD…(Comm. McIntee)…One more time…McIntee went over the equipment…who purchased it… where it should be secured….that it should be returned…asking for a letter to the Sheriff be sent asking for it back…2nd by Comm. Silverstone…Clark stated that part of the contract indicated the Sheriff was entitled to the equipment…and if or when the contract was severed it would be returned in the same condition….the Town Atty. confirmed Clark’s statement…Comm. Silverstone.stated if BSO was not going to use the equipment it should be returned immediately…Comm. McIntee the Sheriff took it to make it harder for the VFD to return…and a rehash continued….with a motion from Parker …2nd by Clark to see what the status of the equipment was for the next meeting…with Comm. Silverstone amending it to say the equipment could not be used until the report was provided…failed 1-4…Silverstone voting in favor…a vote was taken to get a report…4-1…Silverstone dissenting…
That’s it for 2006….long…and time consuming…which is this writer’s point….
BCbythesea…yes …it was a very different time…different elected majority…BSO in charge….but the tactics…are the same…the verbage is the same….the increasing amount of time spent on only VFD with no distinction between the roles of VFD Chief/Deputy Chief and Commissioners…brought us where we are today….2 years later…
It is the Town Manager and the Commission’s place to know what is going on in the VFD…as Comm. Clark stated…on Oct. 10,2006…when the Vice Mayor and Comm. Silverstone were in the VFD leadership roles….not de-facto as it is today…….. the expectations of what should happen with the Pointu VFD resignation letter and the fallout…should be the same as the Vice Mayor called for repeatedly…from BSO throughout 2006….
It is this writer/resident and taxpayer of LBTS’ opinion….that a member of the dais simply can no longer wear 2 hats…as the last 2 years have shown…that time honored tradition is over….it just cannot work….and it should be introduced on this dais to enact a policy forbidding it going forward in this Town….
