Dear Readers…today was a non-sleep day for 7 week old Lilly…seems sleeping through the night is enough… So before the Round Table wrap up…a few  “Scene and Heard”…

IN THE PARADE AGAIN THIS YEAR?….

We are hearing about the 2010 POA Hometown Hero ….It was due in to the POA by June 9th….

Word is…Marc and Cristie Furth, Campaign Managers to the losing CIC slate for Commission in 2010 and Publishers of the defunct 2nd incarnation of the By The Sea Times have been nominated along with their nemesis By The Sea Future Michael Arker, Publisher of the only local newspaper left standing after the March election in Town…Also we hear Windjammer Manager Diane Boutin…By The Sea Future Distribution Manager/Chamber of Commerce Distribution Manager  Ron Piersante …and Buster Celestino a resident from Ocean Colony … This will be something to watch for…. Every vote will count this year….for POA members….

NOT SMILING SO MUCH THESE DAYS?…..

We hear that in the letter sent to the Town Manager by former TM Esther Colon was hardly an “in-kind”  response letter to justify her payout and counter the findings of the Int. TM and the TAttys or send back the funds …. It is said it goes off into areas of defamation of character and may even offer up charges of accusing Colon of nefarious and criminal acts along with character assassination… How so?… A look at the letter from Int. TM Hoffman (prev. post- June 2, 2010-scoops cat.) is in no way accusatory of any of the above and neither was the Commission nor this site in that regard to Ms. Colon’s payout …The questioning arose due the Colon’s sidekicks JohnO as Int. TM and KathyO HR/Risk Mgr. day of termination calculations being right at their fingertips for a swift payout and how in the world 10 years of service could be added up without some additional days of researching the huge payout …Being ready to go as it was the very night she was let go for no longer “serving at the pleasure of the Commission” …it was and is not a stretch of anyone’s imagination to believe that Colon would have been involved in the calculations prior to her termination due to her comments on the dais over the past almost 3 years ( on DVD/Town website videos Reg Comm./Spec. mtgs) declaring she had the same contract as her predecessor without the 10 weeks off to consult or day to day basis (prev. posts)…only to find she received a 1 year severance payout Baldwin did not have in his agreement …and once found…. she still would not affirm that it was a major difference…That she stated she took things out on her own but not what she added in and who assisted her….She never spoke of the first attempt at an agreement (prev. post) that asked for a 5 year severance…which according to the notes in the margin indicates it was done on her former boss Bob Baldwin’s advice …The times on the dais she stated she was in charge and proud to be the beancounter puts making those assumptions of involvement a no-brainer … Also, the inquiry from this Commission came after JohnO refused to stop payment of a $296,000+ payout after he was asked to do so by all five Commissioners and the Town’s Law firm, the very firm Colon herself championed and wanted hired …despite not divulging her history with them until the middle of that meeting…(prev. post and also on the Town website Aug.2009-spec mtg.) …It seems unlikely that either the new Int. TM, TAtty. Trevarthen  or Atty. Richard Weiss would have any reason to slight or slam Colon in the manner her response letter is said to contain …..  Colon’s old friend Atty. Weiss was quite adamant at the April 26, 2010 special meeting when he stated at the podium he had never seen anything like what had happened and that none of the candidates in Jarvis Hall for the Int. TM position would have acted in such a manner as JohnO and staff …not Ms. Colon….. (prev. post-Town website online video 4/26/10 spec. mtg.)….

I hear the letter claims Ms. Colon might be harmed in future job opportunities …as a result of the Town’s inquiry into her payout…. (Wasn’t she retiring ?…What happened to the retirement resubmittal request?) …..

To this writer the Commission were carrying out their duty to the taxpayers of LBTS to see that the correct monies were or were not distributed to the former Town employee… Once they were advised by the Town’s new Int. TM and TAttys. (prev. post-Town  website online video Comm. mtg.5/25/10) there was indeed an overpayment of $69,000+ the Commission on the recommendation of Ms. Hoffmann and Ms. Trevarthen  directed them to have the overpayment reimbursed to the Town….It would appear if indeed a letter from Attys. for the former TM accuses the Town’s Commission of any or all of the above for carrying out  their duty …what would give any other municipality pause …would not the Town’s inquiry and letter to Colon…but the one sent on Colon’s behalf…to the Interim Town Manager!…

What happens now ?…. We see if cooler heads prevail between opposing law firms…and their clients…in order to compare the numbers… and the justifications for them….from both sides…to see if there is any “gray area”…..

What it will come down to in a court of law?… This writer opines,….what the contract states in black and white …..and if there can be any plausible interpretation that allows for any or all of the monies to either be retained or returned by the former Town Manager….It matters not what is said on the dais…off the dais …in print or online… that’s all white noise when it comes to contract law…..

FUNDRAISER LOCATION …AND A 2ND BIG WIN ?….

Athena By The Sea …had a fundraiser for Candidate David Maymon tonight… http://www.davidmaymon.com/……He is running for Representative for District 91 …Since the new Commissioners Sasser and Vincent and Mayor Minnet also had their fundraiser at Athena…and won by a landslide…celebrated at Athena…perhaps Candidate Maymon should book Athena for his election night celebration now… to enjoy a landslide of his own?….
