BC- In Backup… a memo Chief Perkins asking Town to pay for truck…the 102 ft. $150,000 malfunctioning truck…response from Town Manager Colon that the Town Vehicle Equipment Reserve Account has $181, 538.00/ The Town Manager said on the dais we were not buying the truck!…

a. Ordinance 2009-27: AN ORDINANCE OF THE TOWN OF LAUDERDALE-BY-THE SEA AMENDING CHAPTER 5, BEACHES AND WATERWAYS, TO ALLOW AND REGULATE FISHING AND SURF CASTING ON THE PUBLIC BEACH; PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE.

BC- A resident came forward at public comments in July after contacting the town and then this writer…the discussion was to put it on the next agenda…no discussion of a  1st reading ordinance… done without commission direction…But what else is new in the present Unilateral  Town Manager run town…

2. Ordinances 2nd Reading – “PUBLIC HEARING”
a. BC- this one is interesting…it is the VFD pension board…VFD Captain Joe Padden stepped down as Chairman, Mark Conn was reassigned to that role, and a replacement has already been chose for one board member…so why exactly is this on the agenda for the Commission?…

b. Commission selection of contractor and award of RFP 09-06-02 – IT Services (Manager Colon)

BC- Here we go…batter up…the 1st RFP under the the new Town Manager rules of no RFPs “read aloud” on July 29,2009 (prev. post)…a “comparative grid ” is provided by the Finance Director …but it is not an “evaluation”…

c. Commission selection of contractor and award of RFP 09-07-01 – Commercial Blvd Drainage Improvements (Assistant Town Manager Olinzock)
d. Commission selection of contractor and award of RFP 09-07-02 – Parking Citation Processing Services (Assistant Town Manager Olinzock)

BC- same story…none of these RFPs were “read aloud” when they were “publicly opened”…all include a “comparative grid” of the amounts…per the Finance Director…

f. Discussion and/or action regarding Citizen Contact Forms for drainage $15,188 (Assistant Town Manager Olinzock)
1. Harbour Drive – $160,000 estimated construction
2. 4400 El Mar Drive – $61,250 estimated construction

BC- the above are cost estimates…included in backup is 3 Citizen Contact Forms…Harbour Drive says “Anonymous” /El Mar is the Sea Foam Apts/ Terra Mar says “Resident”…..

Vice Mayor McIntee made a request for Citizen Contact Forms to compare they said “Resident” just like his…BUT…problem is…VM McIntee insisted on the dais he wrote his own form…and from the forms he requested …it again proves he did not!…The writer is the same staff member…OOPS!…

g. Discussion and/or action for amendment to Ordinance 2009-19 – Vacation Rentals (Commissioner Silverstone)

BC- No backup of what the Comm. is looking to change….a call to those who came to the Hall in support…to come back!

h. Discussion and/or action to limit commission members to a total of (3) times, (3) minutes each, on each agenda item (Mayor Minnet)

BC- Great move by the Mayor!…

i. Discussion and/or action to review Ordinance Chapter 10:

1. Garbage and Refuse (Mayor Minnet)

BC- hopefully to rectify the “exception” and decrease the fees coming from a can per dwelling!

2. Review the Ordinance for garbage enclosures in all districts (Mayor Minnet)

j. Discussion and/or action to review Chapter 30:

1. The ordinance on corner lots (Mayor Minnet)

BC- Mayor Minnet …true to her word…to put the cart before the horse ….

2. Amend Section 3.13 #29, pertaining to the insulation of pools on corner lots (Commissioner Silverstone)

BC- Too funny…the Town Clerk must have put Jimmy-boys actual “Norm Crosby” language on…”INSULATION’ of the pool …OOPS!….

k. Discussion and/or action to support staff’s request and reset the bond to its original value – Minto (Commissioner Dodd)

BC- Comm. Dodd was away when Minto came to the Town, and found out after the vote 2nd time round…it meant no 8′ pink sidewalks in the near future by reducing the bond…and it went against the staff’s recommendation…Hmmmm…”Broom Boys” voted against the staff …..

l. Discussion on Bid opening procedures – change purchasing manual section 4 (a) to read – All timely – received bids shall be publically opened and read aloud in the presence of witnesses at the place and time designated in the RFP. Town staff shall warn all present the bids have not been checked for responsiveness or mathematics (Commissioner Dodd)

BC- Comm. Dodd needs to get a vote on returning the Town’s policy to reading RFPs “aloud” at “publicly opened” time and date …prior to July 29,2009…by directing the Town Manager to reword the LBTS Purchasing Manual to reflect it….What a waste of the taxpayers money by the Town Manager getting even!….

m. Discussion and/or action regarding Board of Adjustment, P & Z and MPSC sub committee recommendations, functions and raison0d’etre of a variance and code enforcement penalties when a variance is denied (Commissioner Dodd)

BC- Comm. Dodd was dismayed by certain dais members disregarding the BOA recommendations on a variance after prior dais statements made by the “2-Hats” they follow the board recommendations….

n. Discussion and/or action on the Law Enforcement Trust Fund (Commissioner Dodd)

BC- Comm. Dodd wants clarification of the LETF use per state statute and the LBTS Purchasing Manual….

o. Discussion and/or action concerning Public Information Requests:

BC- Comm. Dodd is quite concerned about great discrepancies in PRR  responses…lack of responses…and responses required to be received in a”reasonable” time…by constituents…

1. Vice Mayor’s request for copies of Mayor Minnet’s emails and Commissioner Dodd’s emails (Commissioner Dodd)

BC- Comm. Dodd is concerned by the action taken by the Vice Mayor of 2 members on the dais/ recent post that VM deleted his personal e-mails…a violation per Sunshine Laws…Hmmmmm…… State Atty. perhaps needs notification of these actions?….

2. The costs of Public Information requests (Commissioner Dodd)

BC- Comm. Dodd is concerned with the inequity of charges to constituents for PRRs….

p. Explanation of function of Town Government (Commissioner Silverstone)

BC This should be more of the same…must have come from those daily Town Manager office visits…RAH…RAH…RAH….GO TEAM!….

q. Discussion and/or action regarding the November 10th & 24th Commission meetings and the December 8 and 22 Commission Meetings (Mayor Minnet)

r. Discussion and/or action regard the clarification of the ordinance pertaining to the storage of boats, boat trailers, boat enclosures and boat covers in the Town (Mayor Minnet)

BC- no backup to why?….Boat People may need to return to the hall……

s. Discussion and/or action: Faced with record numbers of foreclosures, some Florida communities are using more innovative ways of maintaining foreclosed properties than fines and liens. Some communities in Florida have programs where the municipality takes over the maintenance of a deteriorating property and adds these expenses to the tax bills of these respective properties. This way the Town will get reimbursed for its services and neighbors do not have to deal with deteriorating properties and overgrown lawns, green swimming pools, etc (Commissioner Clottey)

BC- Wasn’t Comm. Clottey on the dais when the Asst. Town Manager and Development Director responded that we have no big problem in town after a positive article in the Sentinel…(prev. post)…or were they not accurate?…

t. Cost study for police services $2,500 (Commissioner Silverstone)

BC- The Commission was given a memo on a study done with 14 towns on BSO services vs. town police…The study states the population of LBTS is 2800!…OOPS!…The cost per the memo and in the backup $2800…not $2500…OOPS!…This should take up until Dec. 2010 to get results…leading up to a similar study as was done in Pompano…who it seems will remain with BSO after paying out the bucks!….

u. Discussion and/or action regarding draft Resolution #2009-23 concerning street names in Bel Air (Commissioner Clottey)

BC- When was there any talk of a Bel Air Resolution…we paid the Town Atty. time before it was brought to the dais?…

v. Discussion and/or action regarding code compliance for turtle lighting (Commissioner Dodd)

BC- Comm. Dodd has been contacted by a turtle organization with concerns of compliance by buildings and Town personnel..

In Conclusion…when looking at the backup in Town Hall on Friday, this writer was most disturbed by the unprofessional treatment Comm. Dodd received when going to pick up his computer backup for the meeting…He entered the office to face insubordinate staff giving him comments about the lengthy agenda “being ridiculous”..The Commissioner responded he had wanted an August meeting…the staff member said “that’s our time off”…HUH?…Commissioner Dodd spoke of round tables to alleviate the items…and the staff member chided him..”then you would need all the backup”…I was in the reception area…This was not proper …The staff member went on to tell Commissioner Dodd to look at the backup book…it’s “ridiculous” she said…He came out in the reception area and I told him most of it was the 5 RFPs …(see above)…. I also said there needed to be “decorum in Town Hall”…

The only explanation for such blatant disregard of how to address a Commissioner is the climate that surrounds the staff from their superiors…I do not care how they feel about a Commissioner or a resident…keep it on the lunchroom…comments should be silenced and employees should be accommodating to those they work for in nothing less than a professional manner at all times!…It was disgraceful!…

The Town Manager needs to direct her staff about proper protocol and Commissioner Dodd is owed an apology!…

This agenda…and the length…is due to no August meeting/ The Town staff upon seeing the New Business items should cut down the presentations/ The added New Business items put on by Comm. Dodd are a direct result to the bad acts done by the Town Administration in August!….
