Here’s The Scoop … July 13, 2010 Lauderdale-By-The-Sea Commission Meeting … Only Time For “Starters”…

MEETING TIME 1 HOUR AND 11 MINUTES!…

Dear Readers… It was a kumbaya gathering tonight in Jarvis Hall…all participating parties were most agreeable and complimentary to each other … Back in the hall we hear were some CIC members…but none came up to make Public Comments… Kumbaya … http://www.youtube.com/watch?v=vo9AH4vG2wA&feature=related

The meeting began with the usual ….items…the Pledge of Allegiance …Town Chaplain Hunsaker’s invocation … followed by any additions, deletions,deferrals on tonight’s agenda…The Mayor asked for an excused absence for Vice Mayor Dodd…voted 4-0/Defer signing Code of Conduct per prior notice to staff from Comm. Sasser…will be on 7/27/10/ Mayor Minnet wanted Oct. 12, 2009 minutes deferred for VM Dodd to approve …later Comm. Clottey and Sasser added they felt all minutes should be deferred for VM Dodd to review as well…deferred to 7/27/10 and the Int. TM wanted more detail in the Oct. 2009 minutes as well…passed 4-0 /NB item 15a. selection of event chairpersons for the next year was also deferred to 7/27/10 for VM Dodd and will be discussed tomorrow night at roundtable per Comm. Sasser having questions needing discussion … Presentations were for the Census minus Brow. Comm. Lieberman …the Int. TM stepped to the podium to give certificates to Mayor Minnet/Dir. Development Jeff Bowman (not in attendance)/ Asst. TClerk Nikki Smith who had a photo-op… Next was the Supervisor of Elections presentation..lack of funds and low turnout …is the reason no early voting at the Pompano Library..Broward Main Library is closest location…or get absentee..available now and can be used in the primary as well as General election by anyone… http://www.browardsoe.org/ …..The Mayor stated info will also be on Comcast Ch. 78 …

Public Comments were short but started a little awkwardly with Henry Overton from the Palm Club stating the meetings have become pleasurable but there is one issue that needs addressing ..the lawsuit the Palm Club filed which “forestalled” taxing the Palm Club members $50,000 for sewers…He stated “the time has come to drop the lawsuit and have civil discussion”…He wanted the Commission to come to the Palm Club Board meeting…WOW!… Did he clear this with their Attys. from Ruden-McClosky?… Last we hear they were amending the decision!… The Commission cannot come and talk while the suit is still in the works…As much as I like many of the members in the Palm Club and believe they got a raw deal from former Mayor Parker now candidate for Broward Judge …Palm Club voting for him?… It is still a private property and this last election did not cancel out or change the overwhelming number of voters and taxpayers who do not want to pay for sewers on private property which is illegal… Promise were made that should not have been ..and Sunset should not have received the sewers either….The Town Atty. in her report addressed the issue stating we are in litigation and she will speak to counsel…

Frank Hermann was next with his usual stab at humor complete with hits and misses…including July 4th…dogs…celebrations…and cancellation of celebrations…and his age…He brought up districts being removed in 2012…DISTRICTS REMAIN IN PLACE 2012 people……as long as the Commission and Administration see that the FAU report is updated…This was addressed early on after the election and is on the Town Manager’s list..Frank wants the voters to only vote for those in their district and all vote for Mayor…This writer’s opinion…keep it the way it is…Diane Boutin came to thank all for the4th of July..ask for bathrooms to be installed as is on tomorrow night’s Roundtable…and monies found for the Coral Reef Project to continue…Diana Kugler also gave thanks to the Mayor..businesses …volunteers …etc…for an “awesome event” and being fiscal as well…Bathrooms are wanted but she wants a survey for location…nearer perhaps to the downtown…Looks like bathroom on the beach is a NIMBY (not in my back yard) agenda item …cannot blame Minto/ Oriana for not wanting them behind their complexes…but the same goes for the businesses…so where ho where will the outdoor lavatories go?…

On to Ordinance 2010-03 and the change for departments from an ordinance by the Comm. to the Town Manager …Comm. Sasser asked for some additions after there was no public comments…safeguards for the Commission to have input..no problem with the suggestions from the TM or the TAtty….Comm. Sasser also included that the duties for the Town Clerk include assisting candidates with election materials…OUCH!…..and it was approved with the changes for 2nd reading in one month 4-0… Comm. Sasser also asked about the procedural date stamping agreed upon on the backup materials…It was addressed as a procedural item agreed upon..BUT…where are the stamps?…Have not seen them on any backup since it was agreed on by this Commission… Readers will remember Town Clerk White and the former TM stated they were stamped on the back…When this writer made a follow-up req. for Colon’s contract stamped on the back to prove or disprove she supplied it in the backup in May of 2007…the response back…they did not stamp back then!…

Resolution 2010-15 to rename the Senior Center the Community Center …No public comment …motion made by Vincent/ Clottey ..They should have offered it to Comm. Sasser…passed 4-0…(prev. posts)…

Commissioner Comments …

Comm. Vincent…gave a thank you to the Mayor etc…for the 4th…Added the proclamation to the USO visiting Naval Officer Lang  made on the 4th … Although, he sounded a  little McIntee- like with the “They did a bang up job” comment made before it…..He also gave a happy birthday greeting to Sea Ranch Lakes North resident Betty Pagano …who is 104!…

Commissioner Sasser  …. thanked all for July 4th as well…and then showed why he is “THE CONTRACT GUY”… as he spoke of the success he as the liaison and the Town have had in negotiating with Choice Environmental Services …

” long pole (noun) : The most important issue or problem that prevents or slows progress, especially on a project. The factor that must be addressed before all others or that has the most far-reaching effects. [Expression comes from “long pole in the tent” which refers to the pole holding up the roof of the tent]”- (see below)….
“I am pleased tonight to let you know we have had some real success with our Choice negotiations. We have reached a solution on two issues and are working on our third and final hurdle. More specifically, we have resolved the issue of multi-use properties by allowing multi-use properties under 6,000 square feet to utilize the residential rate and container with residential bulk pick-up not to exceed 2 yards per month. Multi-use properties over 6,000 square feet can share a commercial container at the commercial rate and not have to utilize both residential and commercial containers. Residential bulk less than 2 yards per month will be allowed for these multi-use properties as well.
We have also resolved single family residential suspension of service starting on cycle date. Single family residential will now be able to suspend and resume service on specific dates rather than on cycle date only as long as 31 days notice is given to suspend and 15 days to resume.
The long pole in the tent, so to speak, remains multi-family usage. The Town Attorney, the Assistant Town Manager and I met today to formulate a recommendation to Choice regarding this portion and will continue to try and come up with a solution that is acceptable for all involved.
We plan to propose Ordinance changes quickly to address the resolutions I have just mentioned. I would like to request that these changes be included on the Roundtable agenda for tomorrow so we can get these to 1st reading at the next Regular Commission for the quickest resolution possible.”

Comm. Clottey …. Thanked “Roseann Minnet”.. Mayor Minnet ..stating the July 4th event was a success despite the weather…and ran down the list as well including the Chamber and businesses and the VFD and police…stating the BSO Chief and Lt. put in long hours…She said it was “a good marketing tool” …She went on to speak about orange fencing left around the pier and that the Town dodged being fined and no turtles got caught in it.. She too spoke of the shortage of monies now for the Coral Reef Project stating she was asking for donations and and appealed for people to dig in their pockets to donate …She stated they needed 2 buoys before Sept. to be completed or they faced a dangerous time …. Hmmmm. …This is on tomorrow night’s round table…the contract is in default…and this writer’s question…why weren’t they built already..to be ready for the permits…This first started in 2006…approved in Feb 2007 …and now one permit has already expired… more on this to come…

Mayor Minnet …Thanked all for their kind words…and tanked all who participated …stating she could not have done it without them and especially in such a short time…She has made a “guideline” for the next event chair…”helpful hints”…She spoke of the soccer program’s success and again stated the Tues. schedule she has each month for Town Hall and the Pelican Hopper … and encouraged all to vote…. She also gave a birthday greeting to 104 yr. old Betty Pagano as well….

Old Business ….the Valet License Agreement and the 90 day trial period… Int. Asst. TM Bentley came to the podium and answered questions from Comm. Sasser on what was not included or needed some cleaning up for the pilot program… The changes will be for the licensing agreement to be between 101 Ocean and the valet service instead of with the Town and valet service…but the Town will still be additionally insured…Changed during the pilot will not need to be in writing so “it can be done on the fly”…The alleyway is a Public Right- of- Way…and for right now it will still be used…Bentley pointed out to come down El Mar  Drive for return cars would tie up the travel lane as those cars wait to cut in the stack line … Comm. Vincent stated we (Comm.) are “not giving exact direction”…while in the pilot phase… and then followed up with exact direction on who would be responsible for the garbage from the valet…That was included in the backup and the agreement…Bentley answered…”they will”…The Mayor thanked staff and the applicants…after no one followed through on Comm. Clottey’s call to table for the VM to vote ….Mayor Minnet stated they needed to move forward after a synopsis of the questions and answers discussed as well as the changes… Talk ensued from Sasser and then Comm. Clottey with each other through the Chair and with Mr. Bentley over the fees and when those will increase or change…In the end it was decided staff will have a report  for the Commission in 60 days…passed 4-0…

The Chamber Roof was next…brought to the Commission just to follow-up that it would return…Municipal Dir. Don Prince was able to extend the warranty on the lowest bidder from 7 to 10 years…passed 4-0

Town Manager Report…Int. TM Hoffmann thanked some Comms. for asking the staff to try and get a longer warranty for the Chamber roof which worked out… She also stated that Minot will be coming back with significant site plan changes for their remaining 2 properties…Hmmm… This Commission and Administration should remember Minto was to cut through a median and never did…Minto did not widen the sidewalks and the previous Comm. dropped the ball and lowered their bond …make sure it gets done asap…and hopefully the “horseshoe” development plans are not what they are still striving for…We heard the previous Comm. was adamantly against those plans…

Town Atty…as posted above briefly addressed litigation with Palm Club…most likely a gentle warning to both parties to maintain silence at this time…
