All 5 commission members met separately yesterday in Town Hall with the Town Attorney and the Town Manager….
A meeting to get to know the new counsel and to talk about the Palm Club….
Palm Club is on the meeting agenda tonight…5/13/08… put on by Mayor Minnet..item 15 N..New Business…
The meeting…the Mayor’s agenda item…the announcement of De-annexation research committee who are NBCA members…
Will the Palm Club be given a final thumbs down?….
Odds are …YES!…
Public monies cannot be used for private property….simple…
erroneous septic tank…. environmental concerns….were a stretch… legally…
Who is responsible for the agreement…
the NBCA….
Now where is the money?
The sewer monies…are they in one of the many funds the town has?…. (possibly 7 of them)
Are they included in the 2008 budget?
Will they be addressed by the commission to pay down the debt?
They should…the debt was incurred specifically for the sewers in the north through a loan….
Will Palm Club sue?…..
Anyone can sue….
Can they succeed?…..
BCbythesea humble opinion….
1st… the costs of attorney fees might turn some Palm Club residents off…after hearing that many were not happy with doling out the bucks for the Bert J Harris legal fees… (which is still ongoing)…
2nd….If the contract reads as the former Mayor said…and the sewer line is ONLY to be brought up to the private property….and LBTS has already complied with such…as it is on A1A currently…. (up to the Palm Club co-op private property) ….LBTS will have honored that contract…
3rd….It would make more sense for Palm Club owners to either find the consensus to see if their septic is compliant with keeping it…or work with the city…to obtain a bond or line of credit…to move forth with the sewers at their own expense…
Will the room be packed tonight with Palm Club residents?….stay tuned….
