a. 2009-10….An ordinance of the Town of LBTS, Florida Amending Chapter 30 “unified Land Use Development Regulations”…

This one was before the Commission in the past…in a workshop…..(previous LBTS agenda/meetings…and board categories)…and then went to Planning and Zoning on March 10,2009…..It  is now up for 1st reading …public comments…with the discussion and direction offered by the P & Z board concerning non-conforming uses and structures…a biggie…because as it reads right now with no changes made…a non-conforming structure lost in a catastrophe…with more than 50% damage would not be able to be rebuilt as it stands today…and would use the Broward County Property Appraiser’s assessed value at the time of destruction rather than replacement cost!…

Right now without any changes…chain fences would be allowed once again…and holiday lights would only be allowed up for a certain amount of days before code violations would be handed out by the Town…….add to that…property owners that abut town property would be left holding the bag…the money bag for any damage done…

Make sure to take a look at the backup material …and see if it will impact you and yours…and come to speak…e-mail…or call your Commissioner if you want to be heard…before it’s too late…

This writer’s opinion the Commission should listen to the P&Z…and also make sure the non-conforming structures in town can rebuild no matter how much destruction there is within the original footprint and the original height…even if it exceeds the current 33 foot height limit!… Final reading in May…
