WAR OF THE SIGNS ….

There is a war going on in LBTS this election season…The war of the signs for candidates for Town commission… Some are giving equal time…by putting up all 6…and some are playing tricks on one side …Feeling strong-armed and not up to drama… drama-queens…or cheerleaders showing up on their doorsteps…..they are putting signs up…that do not reflect their allegiance  to certain candidates!…OUCH!… Neighbors vs neighbors…We hear one such incident happened yesterday…when a neighbor with the CIC-Furth- Guard endorsed candidates went into the yard of supporters of the  No-Guard candidates and BSO was called it to smooth things out!…So what trumps what in the commercial areas with opposing signs on or around businesses in town?… Guess the Town’s code enforcement was told to stand down….now that the CIC- Furth- Guard endorsed candidates have put so many signs out in violation of the Town code!… Someone is still throwing out signs and moving signs after hours in the dead of night…Sad…to see the ongoing attempts to thwart a fair election process!…..

“OH NO!” is the response we are hearing loud and clear…another “clueless” Commissioner coming out of Bel Air !…Especially after her “clueless” statements made about the MPSC (prev. post)…One is quite enough and we are stuck with her for 2 more years…The Furths sure can pick-em’….Tonight will Candidate Evans go for strike 3 when and if she decides to make her 3rd visit to Jarvis Hall for the 6 pm Special events meeting for the businesses?….

A SPECIAL MEETING IN JARVIS HALL ON JAN.21, 2010  at 6 pm!….

Taped onto the counter in front of the receptionist in Town Hall today a memo for a special meeting to discuss “recurring special events which close town streets and its effect on adjacent businesses”…WOW!….

Readers may recall at the commission meeting on the 12th the exchange that went on with an attorney who was insulted by the Vice Mayor when he called her “A big girl”…And that was after the poor woman came to realize that her clients who rent 2 stores in town neglected to tell her their objection to the re-up of the 3 month special event permit for the Village Grille’s Friday night Jazz on the Square was extending an established Friday night event that has been going on for the last 7 years…(not counting the weeks it went dark due to the Town Manager unilaterally shutting  it down after finding a snafu ….Hmmm..reminiscent of her recent actions with the Senior Center )…Athena has also been a Saturday night standard for some years now…

Commissioner Silverstone and Vice Mayor McIntee looked pretty glib as they found another way to stick it to the Athena owners when the attorney said her client’s businesses were facing a loss of revenue on nights these events take place…..Suddenly here we are less than 2 weeks later with a special meeting called …You can tell it’s election season!…

There was no special meeting called for the pavilion!…There was no meeting called for the pavilion and street floods!…There was no special meeting called for the termination of BSO Chief Scott Gooding this fast!… But for two businesses that according to the Town never contacted them prior to this podium visit by their attorney…. Two businesses never contacted Village Grille or Athena according to statements at the podium …And two businesses who  did not show up to accompany the attorney in Jarvis Hall to speak…a special meeting was put together at record speed…YIKES!…

This could be the noise ordinance all over again…Do residents want music in the square on Fridays and Saturday nights?…  Then come and show your support… Send an e-mail…or call your commissioners …This meeting on top of the ridiculous requirement put in place by Commissioners Silverstone and Clottey and Vice Mayor McIntee for Dave Gadsby and the Marchelos brothers to re-apply for these permits every 2 months followed by a night of coming to Jarvis Hall the following month to receive the commission’s consent to continue the events for another 3 months is enough to make anybody throw up their arms and throw in the towel…and that would truly be a shame!…

Dave Gadsby reminded us all the other evening what it was like in town when the music was gone…It’s time for residents to say enough before that happens again…. and time for voters to say enough to elected officials making it so hard for those businesses to do something good for the town!

IT’S A WRAP …

Dear Readers …As we countdown the days til Christmas and New Years Eve..it appears to be the calm before the storm… The town as of Sunday…was a little too quiet with patrons, diners and tourists … At Town Hall…the sign on the Senior Center is still in place…and the disdain over it is  far from growing old… The more residents in the south part of town that hear of the McIntee-Silverstone-Clottey vote for the Oriana million for those few south-end medians…are not expected to remain quiet come election time in March … The car burglaries have moved north…last night it was Silver Shores…LOCK  EM’ UP…call BSO and check if anyone has cameras that record ….The renovations are in the works for the BSO portion of the Public Safety Building… Mr. “never met a change order he did not use.”…Walter Keller, the former Town Planner is back with the Broward County Planning Council letter to our Town…and is to address the re-certification process …Thought he was done in this town per McIntee -Silverstone and Colon?… The last day for the commission to put anything on the Jan.12, 2010 agenda is Dec. 30th… In the Dec. 10, 2009 Sentinel was what we too might see in the future with the new VFD leadership in place …an RFP for Pembroke Pines  for “Fire Department Rescue Truck RFP# Fl-09-10…Yep, that’s how it’s done…Public notices in the papers show on Dec. 13th in the Sentinel Request For Qualifications RFQ 09-12-01 for a qualified engineering firm or individuals to submit letters of interest/statement of qualifications for consideration to provide general civil engineering and landscaping services for the design of the FDOT program for the enhancement project FM-418022-1 on SRA1A from Pine Ave to Terra Mar Drive. They have until Jan. 14, 2010 at 2pm at which time they will be publicly opened in Town/Jarvis Hall … but not read aloud …Looks like we have company for March 9, 2010…with Pompano Beach having municipal elections for 3 commissioners  Districts 1,2 and 3…to serve for 2 yr. terms and a Mayor- At Large who serves 3 yr term…In the Dec. 20, 2009 Public Notices in the Sentinel LBTS has 3 …(Invitation To Bid ) ITB 09-12-04 sealed bids for plumbing services agreement 2010 “to be publicly opened and read soon thereafter” on Jan 21st at 2 pm Town/Jarvis  Hall… The second ITB 09-12-03 same as the plumbing…same time to be opened and read…and the 3rd is a RFQ 09-12-02 (Thanks to Commissioner Dodd-to hopefully replace the longtime company we have -prev. posts…and the $200,000 TM unilateral 3 yr. contract) for “proposals from certified public accountants to conduct the Town’s annual audit and its statements and the annual audit and financial statements of the Volunteer Firefighters Pension Fund  notification of interest no later than Jan 7, 2010…sealed bids opened publicly and of course again, not to be read aloud at 2pm Town/Jarvis Hall…This one should be out on the internet as well….BSO arresting a man behind Sea Ranch Club this afternoon…on beach patrol with 2 officers that came from the front of the building…BSO keeping our beaches safe!…In the new Town Topics-AGANDA …Putting a Mc-Silverstone Colon-Furth “spin” on the dismal response to the Townwide survey they actually say by a margin of 2-1 the people are happy with the Town…get real!…They must have used the Comm. Silverstone-(Not a nice guy or a CPA) spread sheet!….The League of Women Voters request for all candidate questions to go directly to them was followed through on [email protected] (prev. post) SORT OF …they still allow them to Town  but…they cannot be anonymous…so therefore the Town will know what your question is !…… The TM went ahead and got a second date for the debates…The 2 dates February 16th and 25th at Jarvis Hall…She did it without the candidates (who do not qualify until Jan 4-11, 2010) input or agreement!..YIKES!…Here’s another question being asked …what has happened to the McIntee memorabilia hung up as an homage to the man in charge in the Public Safety building now that he is down for the count but not completely out?…Was it taken down?…Another one that follows suit……the $1000  Dep Chief ATV sign. has been out of sight…..Perhaps a bon-fire on a cold and chilly night?….Brrrrr..And finally…putting out the fire…with a call today to Pompano Beach Fire Department to the Asst. Fire Chief John Jurgle to ask about the Mc-Truth Deflector led- rumor ( we hear) of a “fear” by Pompano Beach to offer LBTS “mutual aid” now that McIntee has been dethroned …He gave a chuckle and emphatically stated it is not so! …They offer mutual aid to anyone unless they cannot due to being too stacked…and it matters not to them who is in charge of the VFD!… He added I can say I got that straight from the horses mouth!..and that dear readers is a wrap!…

Dear Readers … in the Saturday Sentinel… The Development office is going mobile…The Town has put it out for a surplus ITB (Invitation To Bid) with a minimum bid price of $ 44,527.00….Really!… The bids will be open and yep, these will be read aloud …on Dec 18, 209 at Town or Jarvis Hall depending on the crowd…Hmmm…Is there a big market out there for a 1999 “as is” trailer?…Or will this “puppy” join the dented discarded municipal trucks that also were listed as surplus ITBs some months back…and are now  sitting outside the still unsold ..never talked about  warehouse west off off Dixie…Perhaps that’s where the Silverstone-Furth pavilion Clock is housed as well?..We’ve only been awaiting that Silverstone-Furth never talked about project since April…OOPS!…

So it look like an empty lot will be awaiting the guaranteed $3 million dollar “VFD-Fire Garage”….that according to the Town Manager will sleep the VFD firefighters…But insists it’s not a fire “House”… Take her word for it!…Nahhhh…Doesn’t matter though, if the status quo is in place after the election.. it’s a done deal!….

The “same “powers that be” until March 9th …..will continue with their “mantra”…it’s necessary to remove ASAP …due to no trailers being allowed in LBTS…Hmmm…. Not so fast…We still have the trailers right across the road from this one..Minto’s construction trailers, the construction site with the magical dirt that doesn’t fly around…(as compared to the Garden Ct. variety due west!)…. and the double wide sales center on the oceanfront…time table for those…no end in site!…  pun intended!…..OUCH!…

Here’s The Scoop … Get The Straitjacket …

ONE SIZE FITS ALL ….

Dear Readers … Hot off her senseless browbeating of Mr. Hood from IyeTek …(red light tickets, red light tickets, red light tickets)…and her sudden interest in rotating the appointment on the Hillsboro Inlet, Clueless Commissioner Clottey has truly gone awry in her items placed on the November 10, 2009 Regular Commission meeting…

First up under the Consent Agenda …12a. is the award of the newly named Lauderdale-By-The-Sea Recreational and Senior Center Services…which went out for RFP due to Comm. Clottey (prev. post)… We are left after this colossal waste of time and money with the same well liked and appreciated Director we have had in charge of the Senior Center Service being the only respondent…The Director thanks to Clottey-Colon was treated very badly…He was put in the position of  putting together the RFP, after he was asked by the Town for a “job description” ..basically, the Town “lifted” it to look for his potential replacement!… Also the Director is now  left with running the  additional recreational program with no extra pay!…. Not only was the Director put through this stressful and demeaning situation for no reason (excuses made of RFPs required  for everything are just a  “payback to Comm. Dodd”  ploy)… …The last time Commissioner Clottey spoke about this she said the center was supposed to be for those 65 and older, with a certain percentage to be in need, economically  and there is supposed to be field trips…One resident in the hall was astonished at her declarations and said…”She’s going to kill the Senior Center!”… The Director has a Broward County audit each year and is following the guidelines…The dual funding allows for 62 and younger and there is no wrongdoing of any sort…except …what he has endured!…

Next comes Consent Agenda item 12c.  “Place an announcement on the website and channel 78 requesting residents who are interested in serving on the Hillsboro Inlet Commission to submit their application by December 1, 2009 (Commissioner Clottey)”…A look at her opening  comments on Oct. 27th show Comm. Clottey saying she has heard from a couple of people who are interested in the position!… She  said this position should be “rotated” …..comparing it to the AMR/ Broward County League  of Cities positions……something that has not been done with the Hillsboro appointment in the past!… It looks like Clottey is having more of those loony BSO -like calls when she said people were afraid to call the police!… We hear even her supporters have called her on this action of “payback” on behalf of  the Mc-Furths… OUCH!… Comm. Clottey chose to use this embarrassing item to further embarrass herself with a new business item….

New Business item 16h. “Discussion and or action regarding: At the last Commission meeting when I was speaking on the last item, Mrs Barbara Cole called me “inappropriate words”. This goes way beyond a person’s freedom of speech rights. People acting like this should be removed from the meeting immediately and asked not to return to the next meeting”. (Commissioner Clottey).. OY VEY!…I suppose she is speaking of the Hillsboro Inlet Appointee…. I never said anything “inappropriate”…No profanity …NOPE!.. I shook my head in disbelief… I did say  “shameful”…and “despicable”…but in light of Comm. Clottey’s treatment of  Mr. Hood, Mr Smith and Mr. Dodd…in this writer’s opinion, I would say the responses were well within my “freedom of speech” and 100% “appropriate”!… Hmmm…..I feel like Fox News to the Obama Administration….. I must be doing something right!… And the Commissioner must be getting some of that Colon thin skin!…In 2007 former Town Atty. Cherof advised Commissioners are to put on agenda items that are dealing with Town business…Why no such advice from the present Town Atty.?…

Old Business items brought back by Commissioner Clottey …encroachments on public property…Comm. Clottey, last go round thought it was ok for the planter in front of the news stand business but the table and chair in the breezeway on Commercial…nah, they should have to pay!… Now thanks to the business code sweeps it will be a pick and choose for who is allowed the “privilege” of “encroaching” on town property… “Shades” of who you gonna vote for in 2010 comes to mind as a criteria…YIKES!…Up  in front of the Commission again is Garden Court and Shore Court ( a look at the archives shows these developments  have  been going in front of the town commission since 2007)….Also making a return Atty. Grant Smith…who as many noticed in the Sentinel was front and center in the Rothstein case sitting with Rothstein’s Partner in the Broward County courtroom… One can only imagine the tone to come from Clottey  and Vice Mayor McIntee… Ear plugs may be required…and for this writer I’ll bring my neck brace to keep from “inappropriately” having whiplash!…

New Business item 16g…”Discussion and/ or action regarding homeless people in our beach access areas, especially in Washintonia Beach Park. LBTS should have posted signs indicating how long and when people can linger a each of the portals and Pavilion. No sleeping should be allowed on the benches (commissioner Clottey)”… WOW!… Someone should contact the advocates for the Broward’s homeless… It was only last month when discussing the fishing on the beach ordinance that Comm. Clottey said she had nearly “tripped over one of THOSE people” when speaking of the homeless…and now she says they’re sleeping in our town!… Great P.R. Comm. that’s gotta help our tourism!… Wait a minute though, Hmmm…. At the last commission meeting Town Manager Colon told us all of the new 10 hour shifts for the BSO Police and how the town was successfully being covered…Hmmm… Perhaps Comm. Clottey is going for another round of LBTS-BSO bashing.. WHACK-O!…. One reader had a great idea… I shall pass on…How about putting parking meters in the parks and in the portals…timed and ticketed!…LOVE IT!…

New Business item 16 i “Discussion and/or action regarding a contest for a new slogan (Commisioner Clottey)… Yet another Furth -induced item on this agenda……This past year the BTSTimes tried to get this “LBTS Slogan contest” off the ground in their “Flashback” newspaper… those who are not so easily besotted…in the wee hours of the night at Town Hall East…were not amused!… The Town has a slogan…But  listen folks…perhaps Comm. Clottey inadvertently came up with perfect new slogan without even knowing it from her NB item g…..new LBTS slogan for LBTS in 2010….”LAUDERDALE-BY-THE-SEA, WHERE PEOPLE COME TO LINGER”!…or….”LINGER -BY-THE-SEA”!…

Boy, do I wish I could go back in time…I ‘m wishing for a do-over….We could have changed history..Yep, we could have… If only… we (Candidate Stuart Dodd and I ) had listened to MacMillan  et al….and followed through with their directives to tell Birute Clottey, she needed to step aside for Bob Eckblad… If we had and she had walked away… after Mr. Eckblad had his change of heart…and the reality of not having a CIC member in sight to run from the north end of town….It would have been an uncontested win for former Commissioner Clark… If only I knew then what I knew now….it could have been so different……

2 more years of this Commissioner…without a new majority on the dais…Somebody get the straitjackets, one size fits all!…

Here’s The Scoop … Time To Put A “Lid” On It …

THE SAD STATE OF AFFAIRS IN TOWN HALL….

Dear Readers … I made a trip into Town Hall today to take a look at the back-up materials for the November 10th Regular Commission meeting… I received an e-mail prior to my arrival from PIO D’Olivera that one of my public records requests was ready for pick-up…Upon arriving I asked for it, and found a few others were ready as well… One was the request shown below for the “Cone of Silence” (prev. post)… I made it after the Town Manager accused the commission of not following the “Cone of Silence” she said they were presented with in documents received in January… She was quite forceful in her admonishment toward them for their total disregard of following this rule…In fact Jimmy-boy Silverstone followed suit like a good puppy dog.. … I was told the next day that no “Cone of Silence” was included in this Parking Citation Processing RFP… and found it did not…I then went on to see it did not exist in the Town purchasing manual and we had no ordinance on the books as other municipalities did for enacting it into their bid process…Thus the e-mail below…

Steve, I am making a public records request for the “cone of silence” the Town Manager spoke about at the 10/27/09 commission meeting.
She said it was given to the commission in documents on ethics in Jan. 2009.
I can find no such item in the minutes for either Jan. meeting.
I can find no Town Ordinance online at the Town website.
I can find no “cone of silence” provision in our RFP bid packages.
I can find no “cone of silence” in the Town Purchasing Manual definitions or RFP procedures.
Please acknowledge this request.
Please let me know if the cost will be more than $20.

Asst. Town Clerk Nikki Smith gave me the “Cone of Silence” request …and after I paid for it I looked at before going through the back-up notebook…Imagine my surprise when what I received was a Feb. 24, 2009 agenda item backup 16f. from Comm. Dodd “Discussion and /or action concerning the Miami-Dade code of ethics ordinance”… Well, it was the same ethics ordinance denounced by the “Gang”…and as it states in the minutes “There was no more discussion. No action was taken.”…In the Miami -Dade ethics ordinance is contained the “Cone of Silence”… (pgs 13-15) …BUT… we never adopted it, we never discussed the “Cone of Silence” and it had no bearing on the ethics item at hand!… What a joke!… The Town Manager chastised the commission on Oct. 27th for something buried within another town’s backup!… I asked Nikki Smith, employee of the town, why she would give me this?..She answered I wanted something on the “Cone of Silence” and that was all she had. I replied that I was looking for the Town’s “Cone of Silence” I said I know what the “Cone of Silence” is…. I said to Nikki Smith, Town employee, but we [town] have no such “Cone of Silence” in our purchasing manual. She said no. I said WOW!… I then said I guess I’ll just keep writing about this stuff….And Nikki Smith, Town employee said as she walked away “I guess you will, you’ve go nothing better to do.” I replied that her response was unacceptable. [for a town employee to a taxpaying resident]….I’ll just chalk it up to trickle down from the Manager!…

Will the Town Manager be called on yet another “dressing down” of the commission on the dais?…

Why does Jimmy-boy Silverstone follow her so blindly…and why does he say he does his homework when it’s so obvious he does not!…

Will Comm. Clottey still say she does her job very well despite all the “constrictions”?…

Still rating her a 5 Vice Mayor?….

Watching  the “Gang” justify this latest action of the Town Manager …. Outstanding!…

It’s clearly time to put a lid on it…

I’M RAISING IT….

Dear Readers….at the   9/22/09 Commission meeting … Comm. Dodd -“Motion to change the purchasing manual section 4 (a) to now read – All timely received bids shall be publicly opened, read aloud to include the name of the bidder, the town, the bid number. This came after yet more discussion concerning the Town Manager’s changing the way the town opened RFPs on July 29, 2009 …(prev. post)… This go round through the Town Clerk (obviously coached by the Manager) the change was admitted …Town Clerk White said ” The RFP for the trash was the first one we got that had several amounts on it which was very complicated and it was from then on that we decided that it would not be done like that anymore because it was too complicated and too time consuming and by law we don’t need to do that. It is exempt from public record for that particular reason. (The Town did not know this until well after the garbage RFP…not until the Town Atty. sent out the memo in response to the Town stoppage of reading RFP bids  aloud when opened as they continued to say they would do in their bids and ads)….Comm. Dodd rightly added that he sat in the garbage RFP (as did this writer)…it was not complicated and it went well as previously posted …so this was again another Colon debacle in not following what most municipalities do….. The Town Manager put forth more garbage to dig her heels in…”As I informed the commission who have asked my opinion (the Gang…hook, line & sinker) and the opinion of staff we will continue to read bids out loud and give the amount as we have done in the past. If you look on the survey most cities do not read the RFPs” (the survey actually showed otherwise) ….”We want to continue to do the process that use to be done and we have been successful. We have never had any issues until recently over this issue.” (Because they were all read aloud and when the vendors who are sending their Reps. find otherwise, there”s an issue) ” The Town Clerk has been doing the job, the Finance Director, all staff members have been doing their job, but by law they don’t have to do it and we have agreed to continue to give the price for the bid but we would appreciate if we’re allowed to follow the process that’s in place that’s a process followed by many municipalities in this state and THE RECORD WILL BE AVAILABLE BY LAW I BELIEVE IN 8 to 10 DAYS” (June said 10 days…The problem with this latest  TM hogwash is again most municipalities do open RFPs and ITBs…and the opened BY LAW in 10 days was not done with the police renovation RFP approved  on Oct. 27th…the Town using Ocampo  missed the 10 day BY LAW requirement by 4 days and it was not out until almost close of business on a Friday!…This writer prev. posted of the bid bond required for the contractors within thew 10 days and the 6 of 9 companies that came to the opening saying the RFPs are opened in all the other towns they bid in!)

The ridiculous “out” then used by Comm. Clottey and the Manager…was we do not have a “procurement officer”…again…it was lame!…

Comm. Dodd’s motion was made again with the Mayor’s 2nd…it was passed 5-0

Page 19. 4a.-(1st paragraph last sentence) “All timely-received bids shall be publicly opened in the presence of witnesses at the place and time designated in the RFP.”

What the Town Manager (with the Town Atty. ?) did …. She changed the whole paragraph…used different terminology and distinguished between ITBs and RFPs …She (and the Town Atty.?) also changed the 3rd paragraph …and in the lower corner the revised dates are altered..In the purchasing manual the revised date is 02/17/09 on the PRR page I received last week read “Revised 10/15/05 ” which was crossed out “Revised 10/12/09” … NOT revised from 02/17/09 …Extensive changes were made although she was not directed to by the Commission to do so!…

4. Each RFP shall contain the following standard provisions:

4a. Paragraph 1.- “Bids must be received by the LBTS Purchasing  Administrator no later than the time and date identified in the RFP. BC-Note- Readers might recall from prev. post the TM found that the purch. manual did not specify “read aloud” as the Town bid and Town ITBs/RFPs did…thus her decision to stop doing so in “payback to Comm. Dodd’s discovery on the preceding page (18)  when he caught her with the required on-line bids source..

If it indeed turns out that not only were major changes and deletions made in the Town’s purchasing manual without the Commission’s direction or input…but that the Town Manager and the Town Atty. have gone ahead and removed the ability for the public to attend future bid meetings and openings …and removed advanced notice of the meetings and openings…thus, further taking away transparency in  LBTS Town government….

Is there really any possible chance that those 75 words on the ballot for the March 9, 2010 referendum on the heights and ethics will be on the up and up?…

Here’s The Scoop … Puttin’ Him Through The Wringer …

HE WAS WRUNG OUT TO DRY ….

Dear Readers …after all was said and “done”…to the Director of Senior Center Services…..He was the only bidder for ITB 09-09-02…the newly created “Recreational” and Senior Center Services Dept….And he will take on the additional recreation department work for “Zilch”…He bid the same amount 57,750.00 that was budgeted for just the Senior Center in 2009-10 …with no additional charges for the additional burden of managing the Mc-Recreational activities…such as swimming..tennis…karate…(unless the Town Clerk did not read it aloud today in Town Hall at 2 pm)… The 2009-10 budget included 34,000.00 for those programs …Will the Director receive some deserved compensation from these funds for his additional responsibilities or will it become “unencumbered funds” in the last 3 months of the year?

It is on tonight’s continuation meeting at 6 pm for the regular commission meeting of Oct.13, 2009…under Old Business item e. …put on by VM McIntee…Look for the VM and his “gang” to say they “had” to go through the RFP process…Don’t fall for it…it’s just empty words and pre-election dribble …When all that really happened is they took a long-time highly regarded gentleman and put him through the “wringer”…courtesy of the Town Manager…Commissioner Clottey and the Mc-Furths…

TOWN OF LAUDERDALE-BY-THE-SEA

Dear Readers…you may recall the Public Safety Complex needed to be renovated ….and though it will not be the “Star Wars” version…(maybe the “Star Wars” reference was the impetus for former Chief Scott Gooding’s demise?…just joking)…it was put out for bid after the LETF ponied up $150,000 (the previous price around $400,ooo+)…There was a pre-bid meeting at the Complex and a large turnout (prev. post)…On Sept. 30, 2009 there was a RFP date and time…but the sealed bids were sliced open and stacked..no reading them “aloud”…this despite 6 of the 9 companies sent representatives to hear them…The companies also made clear they were required by the bond companies to respond within 10 days of this opening …the staff could not have cared less…that being said the bid package was not ready in the required 10 days (10/12/09) for the companies to see and contact the bid bond companies within their required time… …This writer was contacted last Friday (10/16/09) and contacted Town Hall and was told they did not receive it from Ocampo until the day before …but it was being put out by the 2nd call back approximately 3 pm…

Today I went in and looked at the RFP from Ocampo…It was contained in a white notebook with an opening cover letter to Town Manager Colon dated 10/13/09 (1 day after the 10 days per RFPs in the LBTS Purchasing Manual)…There were 2 bids #1/#2 and a total bid…

Ocampo stated that the lowest bidder for bid #1 was Boran Craig Barber Engle at 60,000.00/ 2nd lowest bid #1 Acme 73,350.00…a difference of 14,690.00

Ocampo stated the lowest bidder for bid #2 was LHP General Contracting 10,678.00/ 2nd lowest bid #2 West Construction 11,669.00 …difference of 991.00

Ocampo stated the lowest bidder of #1 &#2 was Boran Craig Engle 73,660.00/ 2nd lowest bid #1 & #2 LHP General Construction 94,519.00…difference of 20, 859.00

Included analysis…

Based on the results there is a large numerical difference between lowest bidder Boran and the other bidders. The other concern this bidder is home based in Naples area (west Fl.) – travel distance  question should be addressed at contract negotiations and response evaluated.

Note: no other abnormalities in the rest of the bids provided in this package.

Important item per change order range 5-15%. Percentage important since the “fee” value that each contractor with change in the scope contract and the reason we added some contingency into the budget. May wish to negotiate during contract negotiations.

Commissioner Dodd again sent in an e-mail after hearing the bids were not opened for this RFP…below is the response back from the Town Manager…she basically repeats that RFPs are more involved…and again this writer says…open them all…ITB (Invitation To Bid) and RFP (Request For Proposal) …in front of the bidders…clarify the parameters and either read them aloud or put them out on the tables for the companies to take the information and go back to their companies and bid bond issuers…as is done by many municipalities (info was provided at a prev. commission meeting verifying both are opened)… It will alleviate the time lapse and the extra cost we found in this latest “exercise” in bad government…Why have “sealed bids”…if not opened and read aloud at the time and date they are opened?… Time to stop the nonsense..and the black eyes…

Here’s The Scoop … If There’s Any Browbeating To Be Done In This Town …..

THE TOWN MANAGER WILL DO IT … HERSELF….

Dear Readers…at  a commission meeting when Comm. Dodd wanted some information from TM Colon’s “right arm” aka Asst. TM Olinzock…she made the statement from the dais that she would not allow anyone to “browbeat” her staff ….SHE will “browbeat” her staff!… Well, first let’s get one thing straight…there was no “browbeating” from the Comm. … He was asking questions of the Asst. TM …knowing full well Olinzock could not answer them…(no big surprise)… TM Colon did her all too familiar “song and dance”…It’s very clever …She simply begins by making statements such as “And you will recall”…”And you will remember”…it makes those listening think they”should remember or recall”…no matter that there is nothing to remember or recall because it is all a  ruse!…

While the TM talks of her staff and their “professionalism” and hard work…She and her staff are anything but “professional”..”creative”…or “innovative” …in this writer’s opinion…

Case in point at the present time… the Town wide survey…This writer asked about it in Town Hall and was told by Asst. Town Clerk Nikki Smith that the “staff” put it together…Comm. Dodd requested information about the survey and was also informed  it was “staff” that put it together…This writer made out a PRR asking for more specifics …knowing that is a major requirement with this present administration…And low and behold I found out it was a copy of a Wilton Manors survey received by Asst. TM Olinzock as a resident of Wilton Manors…with only 2 additions..the misleading and inaccurate question #12 “current town wide maximum height of 33′ ” and the question of the bond issue…(prev. post)…We hear after the receipt and posting…another resident received the same “staff” response as I had originally received along with Comm. Dodd…Hmmm……

We find the same thing has happened with the “Invitation To Bid” for the newly combined “Lauderdale-By-The-Sea Recreational And Senior Center Service…ITB NO. 09-09-02″…

We hear the current  and longtime Director/ contractor of the Senior Center (w/o Recreation Services) was asked in May to write up his job description and he did so… We also hear that he was unaware and quite surprised and obviously dismayed and disheartened to find it had been used for the Town’s Invitation To Bid! ….Essentially what this Town Manager and her administration did was to use the man’s 9 years of building up the LBTS Senior Center to what it is today…in order to help replace him!…Now that is first class “browbeating”!…

We also see from the contract of Armilio Bien-Aime  with the Town that his contract ended on Sept. 23, 2009…So at present, he  is working without a contract with just a verbal extension……Does the County know we have a Senior Center Program funded in part by them is currently without the contracted company in place?…Does that put the grant in jeopardy?…

Does the Town Manager have the authority to combine the program with the recreation without the input of the commission/ County?….

Both the contract from Sept. 2008 and the Invitation To Bid…include the ridiculous clause…”The Town shall be reimbursed by “Bien-Aime, Inc. when provided Town resources to assist with the production and distribution of promotional advertisements in “Town Topics”…A publication paid for by the very taxpayers who pay for the Senior Center……

This has got to be removed…To have charged Armilio $400 per Town Topics issue to put on the Senior calendar is outrageous and underhanded…..He should be refunded!..ASAP!…

Adding the recreation duties to the Senior Center duties is nothing but a “hand-off” from what was originally a McIntee -VFD promoted swim program…It has to date no takers…and the VFD who was to provide the service originally could not get the insurance required itself……Now the TM is expecting the current provider of services to the Senior Center to take it on!…

Not only the insurance…but according to the Invitation To Bid…the Senior Center contractor is to “supervise instructors and volunteers DURING activities.(Senior Center, Swimming, Tennis and Martial Arts.)…A look at the attached “Exhibit B”…in the Bid from June 2009 shows the current Senior program runs 5 days a week from approx. 10 am to 4 pm or later… So when and how could this Director possibly comply?…The Recreational programs will be going on during the Senior Center activities… as well as after school and weekends extending the contractor’s hours and days…The Tennis program for Oct. 2009 is 3 classes on Thursdays from 4:30 pm – 8:00 pm…What amount of additional funds to the provider?…That information is not in the bid…

The 2009/10 justification sheet shows…Senior Center Services…$57,750 …Armilio per mo. $4,812.50 (County provides $24,275)…Recreation Tennis $12,000./ Swimming $12,000/ Other recreation activities $10,000…

Right now the Senior Center is a one man operation…no assistants…and no paid teachers…We hear all the instructors are resident volunteers who were brought into the program by Armilio and remain in it in large part because of him and what he created…

This Invitation To Bid was put in the Sentinel on Sunday Oct. 4th (prev. post)…with the bids being opened on Oct. 20th at 2 pm…While hardly enough time for the bidders…..it’s more than enough to contact your commissioners and the Town Manager…

MCINTEE  “RE-ELECTIONEERING” ALERT……below….

And one final kicker hot off the heels of Comm. Clottey’s e-mail to a town resident (prev. post) “If the current provider submits the best RFP package in terms of promised service and price, that will be great. Even if it is not as good as a competitors, he would get the contract because he is a known and liked.”….We heard today that Vice Mayor McIntee walked into see Armilio yesterday and told him he [Armilio] wasn’t going anywhere…he [Armilio] was going to keep his job…he [ Armilio] could tell everyone that McIntee said so…It’s just they [the Town] had to go through this!… WOW!!!!…..

The Town did NOT need to do this!…The Town was not instructed by the FULL Commission to do this!…The Town did NOT include the Senior Center on the RFP list produced per Comm. Dodd’s request!… The Town never agreed to combined the Senior Center with Recreation Services!…. The Town spent thousands to pay for the Town Atty, Bid notice ads and staff time for an RFP exercise!….

MCINTEE “COOKIES ARE IN” ALERT…..

The Vice Mayor has now joined Comm. Clottey in telling all other bidders the “Fix is in” on this ITB 09-09-02!… It’s unbelievable …this Mc-Furth-Colon “Gang” …think they mess with peoples lives. [Armilio and the Seniors who are reeling from this action]…and the voters will still give them 4 more years!…..That wouldn’t happen in Mayberry and it won’t happen here!…

Will the Town Manager’s Performance Review on Monday Oct. 12th at 4 pm include an evaluation for “borrowing”…and “browbeating”…if not…it certainly should!…
