Saturday the the LBTS Chamber of Commerce started its once a month beach clean-up…( 1st Saturday of each month) and what a turnout!….50+  volunteers came at 9 am and made their way up and down the beach lending a hand to make the beach a nicer place to visit!…

Among the volunteers were Mayor Minnet, Commissioner Dodd, Commissioner Silverstone, and 4 new candidates for Commission in 2010… Edmund Malkoon …( north end of town, announced and filed)….. John Oughten….. Ben Freeny…… Christopher Vincent …(all 3 south end of town, not yet filed/ officially announced)…This was a kick-off to the 4 going door- to- door to meet with residents to find out first hand what’s really on the mind of the voters…Look for them and let them know what’s on your mind…after all the March is not that far away!…..

Also at the clean-up …Chamber President Paul Novak, Dave Gadsby, Peggy Mohler, Guy Contrada, Ann Mann, Adam and Cindy Geesey, Gary and Sharon from Frame n’Art, and whole host of other volunteers….Aruba supplied pastries and water…and it was really a success…

ADD UP…ADD DOWN ….AD-LIB! …

Dear Readers…Yep, finally… here it is, the 2009/10 LBTS Adopted Budget brought to you live on Yom Kippur from Jarvis Hall at 5:03 pm…At the bottom is a link to the Town website and the video to view from start to finish……This writer intends to shake it up a little… with Town Manager Colon’s remarks… the numbers per her “power point”……..then the commentary I found of interest … from the commission ….(part 1)…

Town Manager Colon -”And this is a statement I give every year. It’s part of my um, budget message. I will read it so the audience and residents can hear it. (read from the power point) The Town needs to continue its town’s code revisions and ensure compliance in order to move forward with high- quality redevelopment, improved infrastructure, increased beautification, and a healthy and economically viable community that contributes to a healthy municipality. When done properly, the Town residents taxes will remain low and services high. Otherwise there is no redevelopment, lower taxes and reduced quality of life will prevail. Therefore, the Master Plan needs to be updated which requires a forward moving commission and citizen participation in order to ensure a healthy environment that is fiscally sound and a taxable base that in the future will rebound and increase.”

BC- What is troublesome to this writer is the underlying truth behind this “yearly statement”…WE WASTED THE PAST YEAR!…This writer and Comm. Dodd repeatedly asked for the MPSC and the P&Z to be supplied with all the past Master Plans and given the whole year to do just what the TM is again putting up on the wall!…The P&Z met maybe 3 times…the MPSC was thwarted from any such participation…and here we are…with a repeat performance..

Also what the Manager is really saying is with more code revisions…comes more FEES…and more FEEs …and the millage stays the same and it looks like people are paying less…they are not!…Between the garbage, occupational licenses, code sweeps, fire inspection fees, vacation rental fees…..both residents and businesses are reeling!…Any reduction found in our taxes are from loss in property values and being lucky enough to live in the coastal area we do which took less of a hit……..

TM Colon- from her power point presentation-” I put this organizational chart up, I wish I could just blow it up and cover the whole wall with this! And the reason I wrote this, I did this is as you’ve noticed back five, six years ago our uh, total budget was 25 million dollars, our millage rates were up to 4.7 and alot of residents need to understand that we do NOT have a Human Resource Department, we do not have and let me start again, we do not a full time  Human Resource Department, a full time Procurement Department or Purchasing Department, a full time Financial Adviser, Money Manager, Debt Management Department, a Finance Department. We have one administration that runs with all staff members who I think we’re DOWN to four people who now work 30 hours we used to have six if these approve the ah, salary adjustment gets, we’ve just instead of six now we have four. We have dedicated employees who continue to do more with less. I myself if I have to move boxes and I have done record management. I am the first one to assist my department heads. That’s my nature. So when this Town or this staff gets compared to other cities it’s not a fair comparison. We don’t have full departments.Every staff member here and I mean every staff member and every department starting with VFD,AMR,BSO we all work together. And we all try to do the best with the resources we can. And I include public safety because public safety is a very important component of this town and we all work very well together. Honestly I sometimes rely on BSO for my  emergency plan because they take the lead on those issues. Um, we get I get criticized. I have no problem with constructive criticism. I know I do my job and I know my staff members do more than they have to do. I just wanted the residents to see that we don’t have one person for every task in this town. It’s usually one person wearin’ two or three hats. We have no regrets, we took the challenge to come work for this town and we’ll continue to do that for this town. Whether you thank us or whether you don’t. I thank my staff. With that Id like to thank the commission for their support.” ” ….”I take nothing personal, I’m a public servant and I will continue to be one. Thank you.”

BC- ONLY VM MCINTEE APPLAUDED!….We now have 1- Town Manager/ 1-Town Mgr.- Executive Sec./1-Asst. Town Manager/ 1-Town Clerk/1- Deputy Town Clerk/ 1-Finance Director (4 employees in Finance per the 9/22/09 meeting-Mgr. report)/1-Director of Development/1= Zoning -Code Supervisor/1- Contracted Town Planner/2 Code Enforcement Officers/1-Municipal  Services Director /1- Asst. Municipal Services Director/1-Municipal Senior Office Specialist/1-Maint. Supervisor/ 4-Maint. workers I/ 5- Maint. workers -II/1-Parking Enforcement Supervisor/ 2-Parking Enforcement Officers /1- Parking Repair Technician/  1-Human Resources Department -Risk Management/ 1-Community Standards Supervisor/ 1-Contracted Town Engineer/1-Town Attorney ( pg. 13-14 2009-10 budget book)  in a town of approx. 5,852 residents (pg. 1 2009-10 budget book) ….. “No full time Financial Adviser, Money Manager, Debt Management Department”…well, we just had our Rep. from Sun Trust bank and listed on the Town website  is our 3 yr contracted auditors,Rachlin, Cohen & Holtz, LLP…As far as hands on with her Dept. Heads…as previously posted that’s because the TM did not properly advertise or hire Dept. Heads with the proper qualifications who would not need her micro-managing…Her staff that she says are “professional”…some of their actions in just the last few weeks…Her Asst. TM hung up the phone on a resident, TM & Asst. TM did not bring townwide survey to Comm./ Asst. TM told resident from Bel Air to petition to stop signage in Bel Air/ Deputy Town Clerk was disrespectful to Comm. and residents/ Town Clerk will no longer take PRR from resident (not this writer)/ Staff member was rude 2x to Plantation Police Dept.when calling and requesting information for the parking RFP.. ….(more on these to come)…. BSO,VFD, AMR and Town working well together …that’s not what we hear from those behind the scenes…..no where near the truth… lot’s of scared workers wanting to hold onto their positions…especially with the TM’s ” at will” contracts…previous terminations…and the latest RFP on the Senior Center…No one is safe…

Town Clerk & Finance Staff to add 10 hrs. 16,240

TM Colon  9/28/09 – ” One Commissioner said it was like 30,000. It’s not 30 something thousand. It is 16,240. It happens to be the clerical staff, the lowest paid clerical staff. So that 16,000 covers the 2 positions and will cover the ten hours.”

TM Colon 9/22/09  TM Report -” The first item is staff discussion. As you know the directive of paying off the loan last, the loans , the General Fund and the Capital loan were paid the following morning. With the elimination of debt service I am requesting that the Town Commission consider approving 16,238 dollars so that the receptionist in the Town Hall, the front desk clerk can go back to 40 hours. She currently works 30. AND I AM ALSO requesting that one of the employees from Finance, WE HAVE 4 that work 30 hours, one of them be allowed to go back to 40 and THAT equates to 16,238  for salary, fica and retirement.”

BC- From the Manager’s statement on the 22nd it was easy to think it was for 16, 238 for each employee…and again “no debt”?..we have a 3rd promissory not for parking (penalty clause as well?)…Throughout the evening there will be NO discussion about the $300,000+ penalty paid on top of the debt due to the Town Manager as Finance Director CHOOSING to take a penalty clause attached to the notes!)…

BC- The Vice Mayor wanted to make a motion to pay off the 3rd promissory note  and the TM addressed it….

TM Colon- “We don’t have sufficient funds to pay off the parking promissory note. But as you know we borrowed, the Parking Fund borrowed some funds from General Fund so they could complete the parking lot, Bougainvilla parking lot. What I would recommend which is something that’s historical in this town is that if there’s any excess funds or available end of the year fund balance from the Parkin’ Fund that the Parkin’ Fund does pay some of those fees as an extra $100,000, an extra $200,000. Right now the Parkin’ Fund owes the General Fund about $500,000.So maybe that debt from parking into general can be accomplished, but you don’t have enough funds to pay the entire promissory note.”

BC- Why would we not pay off some of the loan?…Is there another penalty clause attached to this one too?…

COMMISSIONER COMMENTS (part 1)

Commissioner Silverstone’s opening comments…

CS- ” Thank you, um pretty much mirror what Commissioner Clottey was saying um, again I don’t know , we’re not robots up here. For the last meetings I can go back for I’ve been taking notes and answering everybody’s comments up there so I don’t know ho anybody could feel that I’m not paying attention for one. I don’t know where that comes from, but again we’re not robots up here, when we get attacked and we have to correct some misinformation we’re not  at least for myself at least. I’m emotional, I’m passionate I,I believe in what I believe in and if it seems like I’m attacking somebody well, lets reverse that. When somebody stands up here in front, in front of that um, podium and starts saying that I’m using misinformation um, and they feel they are correct and they’re passionate and they’re hateful, it goes both ways here. We’re human up here. So when we get attacked it’s , it’s hard not to, it’s hard to act like a robot and not, not take this without any feelings whatsoever….”

BC-Later after asking about the budget changes being online…the TM said they were (power point…unreadable) Comm. Silverstone continued…

CS- ” So there’s no backroom deals here no, there’s no playing games here everything is, I mean I can’t imagine a more transparent than that.”

BC- I spoke of people making Public Records Requests for information and Comm. Silverstone said the following…

CS- ” Okay and regarding Public Records Requests, the simple issue with that would be if I got a phone call requesting  certain information I would then call the Town Manager up. We’re a representative form of government up here that’s how we work. If you have an issue call us, we’ll try to resolve it. If we don’t resolve it then you make a public STATEMENT. I think that works, it’s alot more efficient that way. If you have any issues pick up the phone give me a call um, If I don’t meet your desires or your what you think is right with your request then maybe it will be worthwhile to make it public up here and voice a complaint. At least go through the process. I think that’s important. A simple phone call I think would ease a lot of the problems in this town. Um that’s it I yield”

BC- What part of a PRR does this first term Commissioner not understand?….EVERY PART!… Why in the world would anyone call him for him to ask the Town Manager?…How could he think calling him is the efficient way to handle a PRR?… And for the rest of his statement …it speaks volumes why he should ONLY be a 1 term commissioner …YIKES!…

BC- Commissioner Silverstone comments after the Town Manager’s presentation said the following…

CS-” A big thumbs up and a big thank you to the staff and also to the Town Manager and all of us up here. I know it doesn’t seem like we work together sometimes, but I think this budget and these numbers prove that!”

BC- so true Jimmy-boy so true!…

BC- Commissioner Silverstone’s last comments…

CS- “Thank you Town Manager, One last comment before I close up here. One of the funnest , this is directed at you Town Manager, one of the joys I have being a commissioner up here is the moments I spend at the Town Manager’s office just kicking around ideas about how to, for the betterment of the Town. And once in a while we get some good ones out there, so just on a personal note, I just want to thank you for those moments and I think it really helped the Town alot.”

BC- Yep, these two came up with the Public Safety Building acquisition…great moments …just great! NOT!…

Vice Mayor McIntee…. first comments  (1st part were in previous Yom Kippur post…scoops cat.) …

VM-”The Town Manager took 30% off ah, 30 hours a week our people are working. Doing the work of 40 hour employees. Why don’t people sit back and say thank you to these people? I do it all the time, all the time.There’s an attack mentality in this community which is sad, I think it’s beginning to, to backfire and I’m sort of sitting back watching it. ”

BC- This is the tactic the Mc-Furths “Broom Boys” are going to run on…they are being “attacked” and the administration is “attacked” by anyone who calls them on their bad acts…BUT while it worked well in the last 2 elections (2006/2008)…It is doomed this go round…why?…Facts and accountability on their record…through minutes and video …OUCH!…. Please Readers…go online and read the minutes from 2006-2007 and get the DVDs…make a PRR and see the real Mc-Furth”attacks”… eye opening…

BC- Vice Mayor McIntee after the Town Manager spoke to (not answered) Comm. Dodds questions concerning the debt..and the finances…

VM-” A couple of questions for the Town Manager ah, a year ago from today how much was the total town debt in a round figure, if you could give me that?”

TM Colon- ” Um, let me see. We just paid 6.1 and parking I believe is 1,6 so it’s 7.8.”

VM- ” So a year ago today there was a 7 million debt hanging over the heads of every citizen in this town. Today there is NO DEBT, NO DEBT IT’S GONE. Except for the parking which we’re gonna work on aggressively very shortly. Let’s take another step, we are one of the few towns and I hope the Sun Sentinel picks up on this because it was very sad to see.”

BC- The Mayor made a point of order to clarify the VM’s statements thus far…concerning paying down the parking …which was not going to be paid down…but transferred into the General Fund.”…The TM agreed with the Mayor that was what the M was proposing…

VM- ” I didn’t say that, we’re gonna work on it aggressively. And that’s exactly what we’re gonna work on Mayor. But let’s go another step now. Now we’re one of the few towns, with a 10.8% tax reduction. Everybody else is going up the halls are full,I watched the same things as all the commissioners have watched throughout the county. We have done a miracle here. In 2006  a 25 million dollar budget . We jumped down to a 15 million dollar budget. The Town has never looked better. They’ve done a great job. The bushes,the streets, the spirit and, and they just hold their heads up and keep going. How do you. those 3 points alone say to me this Town Manager and the staff and this dais has done a heck of a job. Again paid off 7 million dollars in debt in one year. Reduced the Town’s taxes 10.8% and finally brought a budget in 2006 25 million dollars down to 15 million dollars that’s almost miraculous. When every other community in this area, not everybody bu 99% of the communities in Broward County and Southern Florida are all in the hole. running on debt, having to borrow money, have to sell bonds. That’s not us. We’re a tight little community that’s done a great job. (….spoke of Beach Patrol repeat speech of many past Comm. comments)… People don’t like success in this town. They want to condemn and throw stones and it’s sad. But nobody can argue with the facts,the facts are the facts and we’ve done and I’m proud to sit up here and I’m very proud to support the Town staff led by the Town Manager that has proved her weight in gold, I yield.”

BC- What the Vice Mayor neglected to get straight on the payback in loans was addressed by Comm. Dodd…setting it straight…The VM’s famous re-writing of history to invent “his “facts…his M.O. …The 25 million went to 15 million by not paying for the Palm Club sewers and paying back that money last year…The promissory notes would NOT have been paid off  now if Comm. Dodd and Resident Yann Brandt had not been persistent with the Town Manager and her staff to get the bank statements and get the complete list of accounts showing funds, reserves and debt….The promissory note would NOT have been paid off  if VM McIntee had stuck by his statements at 2 meetings where he did NOT want to pay the loan off…and the VM and the Town Manager never address the $300,000+ penalty we paid due then- Finance Director Colon choosing to take out the debt with it attached to the loan……Add to that the apparent 3rd penalty clause on the Parkin’ promissory note of 1.6 million…

BC- Comm. Dodd had the last word…

Commissioner Dodd….

CD- ” Um, can I just have some clarification from the Town Manager. This business about we paid off 7.8 million sounds like we conjured up 7.8 million from somewhere. But what I think I was understanding you said earlier was we had 6 million sitting there in an account ready and allocated if we needed to use it for that purpose for which was actually raised or we could use it to pay off the loan we took out that created the 6 million. So we haven’t conjured up 7.8 million as the Vice Mayor would try to have us believe. That we had the money in the first place. Is that correct?

TM Colon- ” The loan proceeds and lets start with the 10 million because we restructured 3 times um, we had um, I believe it was 6.1 million dollars we paid off and since you did not do any capital improvement project, we took the 6.1 million we designated as reserve because you only had, you had an intent to use these funds and we, the same same 6.1 million dollars we paid back.”

BC- along with the $300,000+ penalty…

CD-” But in effect we didn’t just suddenly conjure up and pay off a 7 million dollar debt overnight because the funds we borrowed in the first place and we had them allocated so we could use them for that particular project. We decided not to do that project or pay it back and I appreciate we have 1,6 million on the parking situation, a different situation. But I just wanted to clarify it for anybody out there that um, we didn’t suddenly conjure up 7.8 million to pay off overnight. Thank you.”

BC- What it really means is that this Town Manager and her staff decided to keep the Town in the dark for almost 2 years on what we had available to us for capital improvements…Her actions ….have left us with a 2 million dollar crappy hotel on an adjacent property…which cannot sleep the VFD which was its purpose…..cannot house the BSO as they required and they deserved… is housing AMR in sad surroundings that mimic a room at the Holiday Inn…But we have heard  it does provide the Town Manager with a room for herself!…(WHY?) …. If she had been straight with the commission and the residents…we might have been able to begin the process of a whole new Town Hall Complex…This unilateral action of keeping mute on our financial picture might even usurp her unilateral building of the Beach Pavilion …which we recently heard was approved by the County only after the Engineer of record signed off due to the Pavilion when completed was not the same as the Pavilion plans submitted…shades of Oriana!…OUCH!…

Here’s The Scoop …. GOT YOUR HEAD BURIED IN THE SAND ?

THEN YOU’RE VICE MAYOR MCINTEE’S KIND OF MARCH 2010 VOTER… NO “HATS” REQUIRED!….

Dear Readers…Vice Mayor McIntee and the Town Administration are just like the energizer bunny…they keep going and going and going…First they make resident Yann Brandt wait well beyond the state statute regarding “a reasonable amount of time” for producing requested materials from June to September for his Public Records Request (PRR) for the Vice Mayor’s e-mails…Then the Vice Mayor makes a PRR as Vice Mayor via the Town Manager via the Town Clerk  for 3 months of emails from his “opposing” Commissioners (Mayor Minnet/Comm Dodd) for their personal computer “town business related e-mails” to retaliate and be vindictive all the while knowing that he deleted his own “Town business related” e-mails from his own personal computer …all 3 1/2 years worth!……And then in his Commissioner Comments he does his “my AOL ate my e-mail” tale showing absolutely no remorse for his actions…NAH, not him!…He’s chomping at the bit and rubbing his hands together in anticipation for HIS coveted PRR e-mails……Arrogantly  contacting the Florida State’s Atty. to ensure he gets what he, himself did not turn over!….And when you think there is nothing more he can do…..he does!..Vice Mayor McIntee and this Colon- led Town administration are indeed continuing to act badly……Last week, the Town Clerk advised Mr Brandt that she, the Town Clerk will no longer take his PRR for e-mails from the Vice Mayor, informing him the requests are to go to the Vice Mayor directly, contrary to the Florida state public records laws…And now they have changed the Town website contact category…….stating  “Vice Mayor Jerry McIntee  No e-mail is available”!!!!…(personal or Town!)….The ONLY Town official or employee to not have an e-mail address!!!!!…. WOW!…….

We hear the deletions of his e-mails constitute a “WILLFUL FAILURE”…. punishable with up to 1 year in jail and up to $1000 per the LBTS Town Attorneys. The State Attorney and other top officials are now in receipt of the PRRs from Yann Brandt…including the Vice Mayor’s admission that he deleted 3 1/2 years of “Town business related” e-mails….

For the overwhelming voters in town who have their heads in the upright position….we will be watching and waiting to see if the State of Florida will follow through on the Vice Mayor’s bad deeds or once again choose to slap him on the hand as we witnessed with the Florida Elections Commission and Florida Ethics Commission over the past 3 1/2 years when they found a number of “probable cause” charges…and gave him and his BFF Commissioner Silverstone a pass…This time there simply can be no 3rd “slap of the wrist” and  no 3rd “go forth and don’t do it again! …This time elected LBTS official Jerry McIntee must be held accountable for “willful failure” in HIS mass deletion of HIS  public records!….

Here’s The Scoop …. Did You Get “THE” Phone Call Yet ?

HE DID WHAT??!!!!!………

Dear Readers ….Did any of you, your friends and your neighbors receive “THE” phone call yet from Mayor Minnet or Commissioner Dodd?…

Because Vice Mayor Jerry McIntee has “decided to turn the tables” according to the Mc-Furth Times Tidbits …after the Vice Mayor received a public records request (PRR)  from  resident Yann Brandt for e-mails (prev. post… concerning prior knowledge in the BSO Chief Scott Gooding termination …and to see if there was a conflict/ Sunshine Law violation as is his right as a constituent)…Vice Mayor McIntee decided to ask for 3 months of Town related business e-mails as Vice Mayor McIntee (not resident McIntee ) from Mayor Minnet and Comm. Dodd …for pure retaliation!… On top of that he revealed on the dais that he has deleted all of his Town business related e-mails from his personal e-mail account (his primary e-mail account) for the last 3 1/2 years!…It’s a clear violation of his “custodial” duties as an elected official under the Sunshine Laws!…. As previously posted the e-mails the Vice Mayor wants to see e-mails primarily between this writer and Comm. Dodd as stated in the Times (“There is a God!”)….. That’s quite interesting and amusing due to the FACT there is nothing there and quite sickening in the FACT that there can be and he knows full well, there can be absolutely no conflict of interest/Sunshine Law violations due to my not being on a board, or having a company that would come before the Commission presenting any conflict of interest…Nope the Vice Mayor is just plain nosey!… (Think Pinocchio nose-y!)

Now he has ramped it up and he contacted the Florida State’s Attorney to get the e-mails according to a call to Commissioner Dodd from the LBTS Town Attorney last week!….Can you believe it?…The Vice Mayor deleted all his e-mails and he still goes to the State Attorney for the e-mails from the Mayor and Commissioner Dodd!…WOW!….

We hear this week the Florida State Attorney knows what the Vice Mayor has done with his deleted e-mails!…”RE-turning the tables, Yes there is a God!”….

In the meantime…residents,taxpayers and more importantly VOTERS ….have been receiving phone calls from the Mayor and will be receiving phone calls from Commissioner Dodd to inform them that their e-mails will be among those turned over to the Vice Mayor (and his Gang)… and to assure them it is not of their [Mayor/ Comm. Dodd] doing ….it’s  the Vice Mayor’s!….And it’s because Mayor Minnet and Commissioner Dodd will need to comply and they did not break the law like the Vice Mayor did and delete them!…

For those whoof you who do get “THE” phone call, be prepared…It’s a given ….the Mc-Furth Gang will be reading your e-mail correspondence with your chosen elected official at the Furth Motel on El Mar Drive aka Town Hall East …So you can expect retaliation in many Mc-Furth Gang forms…and perhaps a little late night vandal call from those that “take the Mc-Tour” throughout the town each night…..fully refreshed after their daily “siestas”….

But more importantly  LBTS VOTERS….remember this…thanks to Vice Mayor McIntee ….you no longer have the freedom of using your e-mail to contact your chosen Commissioner without fear that your e-mails will be read by him and his Gang…….

Also remember that Vice Mayor McIntee…his BFF (best friends forever) Commissioner Silverstone and their Mc-Furth Gang want you to vote them back in for 4 more years…which will now mean 4 more years of no ability to e-mail your chosen LBTS Commissioner without that fear continuing…Do you really want that?… NAH!..

So when you get the “OTHER” phone call…from the CIC for their CIC- “Broom Boys” re-election… HANG UP!…. maybe they’ll get the message!

Here’s The Scoop … LBTS-VFD Inc. Beach Patrol … Keeping An Eye Out …. On and Off The Beach…

Dear Readers ….The LBTS-VFD Inc. Beach Patrol …. What are we actually paying for?….

On April 8, 2008 there was discussion while the VFD was in transition during an item put on by Commissioner Dodd  (New Bus. k. pg 12/13) “Discussion and/or action of safety equipment at Portals”…Commissioner Dodd “feared” there could be a lawsuit if the Town “did nothing to provide safety”…leaving us open to a lawsuit…He “believed that an Ordinance would be required and he wanted to forward quickly. He hoped the VFD would be trained and help the Town rather than spend $4 million on lifeguard services. He suggested a workshop on the issue.” Then- Lieutenants Patrick Pontu and Scot Fowler (both left the VFD after confrontations with Vice Mayor/Dep. Chief McIntee…prev. posts…VFD cat.) along with Chief Perkins “talked about lifeguard services and/or preventive actions. Lieutenant Fowler discussed ATV’s, rescue vehicles, and flotation devices as options the Town could provide. Chief Perkins said a class would be required to use the ATV and no one would be able to use the ATV without taking the class.” ( that requirement went by the wayside…with the departure of Fowler)…”Discussion followed regarding beach protection and procedures that would need to be in place, along with the costs for buoys, and ATV’s. Commissioner Clottey asked about the liability and Attorney Richard Weiss said it would cost approximately $200,000. Mayor Minnet was in favor of beach safety and believed the Commission needed time to look at all the issues, including liability and budget figures. Commissioner Dodd made a motion to approve $12,000. Vice Mayor (a VFD member) Jerry McIntee seconded the motion.”

“MANAGER COLON BELIEVED THE TOWN WOULD HAVE TO ENTER INTO AN AGREEMENT WITH THE VFD AND NOT AN ORDINANCE”  (the LBTS-VFD Inc./Town of LBTS contract shows no clause for separate beach patrol funds, just the services…to be paid from the annual contract amount…see below)…

“Commissioner Dodd believed an Ordinance was needed to cover the Town and to warn people that if they mess around with the safety equipment that was provided there would be appropriate penalties. At this time, Commissioner Dodd asked the Town Attorney to look at what other municipalities have done in order to make an Ordinance for the Town of Lauderdale-By-The-Sea to cover the safety equipment at beach openings. Manager Colon said a  hold harmless agreement was needed and believed everyone needed to get together. Commissioner Dodd amended his motion to propose a budget of $20,000 in conjunction with the Volunteer Fire Department for the purchase of 2 ATV’s to monitor the beach: pending proper liability insurance is established. Commissioner Silverstone (a VFD member) seconded the motion. Mayor Minnet believed the Commission needed more time to make sure everything was in order and avoid the loss of life. She felt the Commission needed to work with the staff and the Town Attorney to make sure the entire package was in proper order. In a roll call, the motion carried 4-1. Mayor Minnet voted no.”

From the above it appears the Taxpayer actually paid for the safety poles and life preservers from the allotted $20,000 and it was not the LBTS-VFD Inc. as touted in the Mc-Furth Times!…

According to the September 2008 LBTS-VFD Inc. Monthly Meeting Minutes … “Beach Patrol has only been  budgeted for 20 paid hours a week. Personnel on ATV exceeding the 2 hours will be credited for station watch.” ….

According to the “Agreement By And Between The Town Of Lauderdale-By-The-Sea, Florida And Lauderdale-By-The-Sea Fire Department, Inc.” entered into on Sept. 25, 2008……

On page 2 /Article 2 “General Operating Conditions” “2.2.5 The VFD shall provide a beach patrol division, operating on a part time basis to promote safety and fire prevention and provide surveillance of the public beaches of the Town” and continues on from 2.2.5.1-2.2.5.4 covering their duties….

On page 4 /Article 6 “Town Contribution” “6.1 During the Term of this Agreement, the Town will make an annual contribution (the “Town Contribution”) to the VFD in order to offset the cost of providing fire  prevention and protection services to the Town. The Town Contribution shall be made payable to the VFD in equal monthly installments beginning October 1, 2008 and due by the 15th of each month thereafter. The Town Contribution for the first year of this Agreement shall be Eight-Hundred and Forty-Four Thousand Dollars ($844,000). Town Contribution shall increase 4% each subsequent year for the duration of the Agreement.

Despite the contract Town Manager Colon opened an account called the “Town Of Lauderdale By The Sea Fire Assessment Reserve ” and it is classified a “Business Checking” account…with a current balance (7/31/09) of $35,000 …it was opened on 7/14/09 …well after the Oct. 1, 2008 start of the LBTS-VFD Inc. contract….E-mails sent between the Town Manager and Commissioner Dodd (after he inquired about Beach Patrol funding…after the 1st Fire Assess. meeting when the Town Manager and the VFD found medical calls and beach patrol could not come from the fire assessment ) contain the Town Manager’s assertion this was for payment of the beach patrol services and she was awaiting a “bill” from the VFD… Quite curious…and disturbing …due to the Manager opening up the account 10 months after the start of the VFD contract….It appears the $35,000 should not be separate or fire assessment funds…When Commissioner Dodd asked if the VFD would receive less than that amount distributed monthly he was told no…HUH?…So will the VFD receive an extra $35,000 beyond the agreement?…..Is the money from the extra fire assessment monies collected over and beyond the allotted  LBTS-VFD Inc. contracted amount?…….

The first 3 quarterly reports show payments received from the Town per the contract…

10/1/08- 12/31 2008… contract revenue 213,219.54/other LBTS payments 3,953.46

1/1/09- 3/31/2009 ….contract revenue 211,205.51

4/1/09- 6/30 2009….contract revenue 211,005.50/ other LBTS contract revenue 10,976.21

The Beach Patrol was paid patrol incentives per the reports…1st quart. 445.00/ 2nd quart. 1,675.00/ 3rd quarter 2,270.00

Totals  (NOT including incentives) for Beach Rescue service per the reports….1st quarter 2,157.44/ 2nd quarter 14,785.74/ 3rd quarter 18,727.72

Total LBTS- VFD Inc. Beach Patrol Rescue Service as of 6/30/ 09 $40,060.90 with 3 months to go!….

According to the July 2009 LBTS-VFD Inc. Monthly Report…ATV 1 had 32.25 hours/ATV 2 had 35 hours /72.25 total hours (including July 4th holiday) with 19.25 hours non-paid volunteer hours….

When the Commission decided 4-1 to go ahead with the LBTS-VFD Inc. Beach Patrol Rescue Service in April 2008…did they ever think we would end up with the minimal hours of ATV patrolling shown above by VFD members that are not trained in the classes the Chief said would be required, riding around in souped up ATVs with lights and sirens…while wearing no shirt or shoes……Did they ponder any thought that the VFD would be purchasing a Sea Doo that the Dep. Chief admitted on the dais was unable to assist in the succession of near drownings as seen in the power point Furth “training” photos in an effort to tout the VFD service…… It too has been “souped up” with lights and sirens seen by all who watched as the Sea Doo made the once around on 4th of July before the fireworks……….Did the 4 Commissioners know we would be paying for the VFD fire boat to be detailed, housed at a new extended dock and outfitted with a $6,000 pumper when the chances are slim to none it would ever be called for…. Would they have faltered in their vote if they knew it is used for “joyrides” with “Mc-buddies and loyal members” up and down the Intracoastal and afternoon trips to the ocean for diving…Could they have fathomed the LBTS-VFD Inc. Beach Patrol Rescue Service would top off the gluttony of its first year Beach Patrol “Rescue Services” with the recently approved Diving Rescue Team…although we hear there has been absolutely no call for such a “team” in the past 20 years!….

The 2009-2010 Fire Assessment is to be discussed on September 14, 2009 at 5:01 pm…in Jarvis Hall….the Taxpayers will once again be paying  $130 for the annual fire assessment…totaling $1,025776.00….the LBTS-VFD Inc. will receive a 4% increase…that will pay them $877,783.00…The Town Fire Marshall has been terminated and the Town Manager plans to contract the service out paying hourly …most likely from the County…she decreased the budget for his services from $100,000  last year to $83,895.00… Unless there is a change of the majority on the dais in March 2010….no accountability will continue in year 2…of their 5 year agreement ……. Flush with funds…for fun…fun…fun….Beach Rescue Services included?…..

Taxpayers, you will finally be allowed to publicly comment at this meeting….SPEAK UP ….or forever hold your “piece” of the $3 million dollar fire house that is waiting in the wings…..

DA VICE MAYOR IS “FISHING” ….. FOR E-MAILS FROM MAYOR MINNET & COMMISSIONER DODD…

Dear Readers…. DA VICE MAYOR is selective in his desired”catch”…not asking for e-mails from his fellow “gang” members Jimmy-boy and Clueless Clottey…Hmmmm…. A memo (see below) came to the Commission from the Vice Mayor on August 13,2009  (Vice Mayor McIntee was supposed to be out of town on 8/13/09…FLOC convention Orlando) VIA the Town Manager …FROM Town Clerk White.. to his fellow Commissioners and the Town Atty….Why the VIA…because a Commissioner may not direct staff…so Vice Mayor McIntee was asking for the e-mails from the Mayor/Comm. Dodd as the Vice Mayor not as resident McIntee!…He made a Public Records Request for “all Town business related e-mails sent and received from your stu4boats@bellsouth.net e-mail account between May 1, 2009 and August 1, 2009.”…The second paragraph of the memo “Florida Statute Chapter 119 requires you produce the requested e-mails. Please forward to my attention. Thank you (No signature…for the Town Clerk)…What’s the deal…It’s gotta be payback!…

After Scott Gooding was “reassigned” LBTS resident Yann Brandt sent e-mails to the Commissioners, including the Vice Mayor (see below) as did many other residents outraged over the Town Manager’s actions…He like and his fellow citizens received responses back from the “Gang of 3″ that were not to their satisfaction…Mr. Brandt then made a Public Records Request to the Town (see below) and asked for e-mails between the dates of June 1 thru June 29, 2009 to see if there was correspondence concerning the Gooding termination…His request included e-mails from Vice Mayor McIntee’s personal aol e-mail address…This was because the response he received back from McIntee came from the VM’s personal aol. e-mail (see below)…After waiting a month, Mr. Brandt paid $129.44 for the PRR and did not receive all the information he had asked for….He sent in a further request (see below) asking for what was missing and questioning what he had received…including no e-mails from the VM’s personal aol. account….Sometime after this e-mail from Mr. Brandt the Commission’s personal e-mail addresses on the Town website were removed……..The Town Clerk responded (see below) and produced further information…adding the Vice Mayor would be out of town until September 4, 2009 to comply with his personal aol. e-mails…(Hmmm…Aug. 13, 2009 the Vice Mayor made his request for the e-mails for the Mayor/Dodd )…The Vice Mayor is in town this week as many including Mr. Brandt have observed….leading Mr. Brandt to send an e-mail to the Town (see below) stating this fact…The following day August 14, 2009 the Town Manager called the Commissioners to inform them that any “Town related e-mails” received or sent from their personal e-mail accounts should now be forwarded to their Town e-mails….

Well, Readers this follow-up request from resident Brandt appears to have “set” Vice Mayor McIntee off on his own selective “fishing” expedition …Though, there is a one big difference between the one from resident Brandt and this one from Vice Mayor McIntee!

It stems from the fact that it is a Commissioner who is asking for “ALL TOWN RELATED E-MAILS” from  just two of his fellow Commissioners …and the bigger picture…SUNSHINE LAWS & CONSTITUENTS PRIVACY!..

Comm. Dodd was concerned that much of what he is being asked for could violate the sunshine laws and sent an e-mail into the Town asking for the Town Atty. to look into this (see below)…His constituents may feel their privacy has been breached by the action taken by Vice Mayor McIntee….He put it on the Sept. 9, 2009 Commission meeting agenda…Many of the PRR “Town related e-mails” are on topics that have come before the dais…. are still in front of the dais…or will most likely return to the dais…( quite common in LBTS) ….You would think this would constitute a Sunshine Law violation and consequences for the Commissioners if enacted…We hear the Town Attorney disagrees ….and will supply an opinion before the Commission meeting after receiving Commissioner Dodd’s request for an opinion…..

This apparent “payback” action from the Vice Mayor may turn out to be one whale of a tale……..for the upcoming March election!

What trumps what?……

Members  of the LBTS Town Commission,

I am seriously concerned regarding the  dismissal of Chief Gooding LATE
Friday afternoon.  In this  obvious pre-meditated move by the Town
administration, the public safety in  our town is without a leader.

This move also is reminiscent of when our  Volunteer Fire Department was
attacked.

I have spoken to Commissioner  Clottey and attempted to call Commissioner
Silverstone.  There seems to  be a great lack of concern coming from the dais.

My understanding at  this point is that no member of the commission had any
knowledge or input in  this matter.  If you, as a Town Commission member,
accept that our Town  Manager (who lives outside of our Town) control our
public safety without  going through the clauses, without public input, and
without getting Town  Commission input, unilaterally fires our long time police
chief, then I  graciously request your resignation.

As a Town resident, I adamantly  request the following.

- A special meeting regarding this matter as  early as Monday or as late as
Tuesday.
- A vote supporting the Town  Manager’s decision to remove Chief Gooding
- A sworn testimony under oath  by the Town Manager regarding the matter
including: steps taken to remove  Chief Gooding as well as a sworn statement
that NO commission  member was involved in the decision or notified of the
possibility.

It  is not acceptable to me what occured on Friday.  I demand to hear
answers  and see action by the Town Commission.  I will not stand by
and let the
Town Manager run this town as a dictatorship.  If the Town Commission
supports the Town Manager on this, make it reflect as such in a vote on  record.

This is an obvious first attack on our Town police department  by the
administration.  The residents do not support unilateral action of  this
magnitude without ANY public input.

I will  stay aware of any special meeting called on this matter.  I repeat,
THIS IS THE SAME ACTION TAKEN AGAINST US AND OUR VFD.

The police department surrounded the VFD station with no notice and locked
all the doors and took all the equipment, shutting the VFD down
completely.. The  situation with the Chief is not anywhere near this
type of action.
The Sheriff  has the situation under control the department is covered by
supervisors and no  one is in any jeopardy in out town.  I support the actions
of the Town  Manager and have faith in her actions.  VM McIntee

• A sworn statement by each member of the Town Commission that no notice or discussion took place prior the Town Manager’s reassignment of Chief Scott Gooding.
• A sworn statement by the Town Manager that she alone took the action to reassign Chief Scott Gooding without public input and input from any member of the Town Commission; including the fact that no member of the Town Commission was notified or aware of the Town Manager’s actions regarding the reassignment of Chief Scott Gooding.
I look forward to hearing your response. It is of utmost importance the members of the Town Commission make it clear that this action was taken unilaterally by the Town Manager.

Attached is a copy of my original request of the Town from June 29th. I am concerned with what my month of waiting and $129.44 has given me in form of information. It is the obligation of the Town of Lauderdale-By-The-Sea to be transparent and comply with Public Records Request fully and not choose which items should be responded to. Specifically I am referring to items: 5,6,7, and 8.

For items 5 and 6; Is it the position of the Town that zero (0) emails were sent to/from the Town Manager to/from Commissioner Silverstone and Vice-Mayor McIntee between June 1st and June 29th, 2009? All copies sent to me were e-mails either from Ms. Smith or Ms. White.

For items 7 and 8; My request was specific for ALL emails sent and received by jerrymcintee@lauderdalebythesea-fl.gov and jmcintee@aol.com. I received zero (0) sent or received emails by jerrymcintee@lauderdalebythesea-fl.gov and only the items sent in item 5 for the received portion. The Town advertises the Vice-Mayor’s personal email address and the Vice-Mayor uses this address for replies to the public. As such, those emails are public record. Also, any emails sent to jerrymcintee@lauderdalebythesea-fl.gov must be kept by the Town’s servers for release to the public.

I request for the immediate release of all emails sent and received by jerrymcintee@lauderdalebythesea-fl.gov which I will accept in either paper or digital copy. In the effort of conservation, I prefer digital.

Also, it is imperative that the Vice-Mayor release ALL town related emails from his personal email, not only those that he wishes to have viewed by the Public to you in order to comply with State Statutes. I will continue to pursue full release of records through any avenues available to me by law.

The Town of LBTS must continue to comply with State Statutes on public records and cannot attempt to hide or keep information from taxpaying residents. The cost of the initial request in my opinion was exorbitant and I hope that the Town does not attempt to price residents out of transparency.

I copy all members of the Commission on this email due to the severity of the situation.

emails, and 7 miscellaneous documents. No emails were found between the
Town Manager and Commissioner Silverstone and/or Vice Mayor McIntee
between June 1st and June 29, 2009. **

received by jerrymcintee@lauderdalebythesea-fl.gov and jmcintee@aol.com.

It appears the Vice Mayor has made a public information request for Mayor Minnet’s e-mails and my own. This on the surface appears as retaliation for the request made by Mr. Yan Brandt for the Vice Mayor’s own e-mails. Mr. Brandt was very specific in his request to minimize any inconvenience to the Vice Mayor. On the Surface the Vice Mayor’s request appears to be a “fishing expedition” over a three and a half month period which is unreasonable. I have received over twelve hundred e-mails at this address during that period. I am also surprised that there has been no request for copies of any e-mails sent or received at my Lauderdale-by-the-sea-fl.gov address or for Commissioner’s Clottey’s or Commissioner Silverstone’s e-mails from their computers.

I believe there is a conflict of interest and the Vice Mayor is asking for something illegal. I am unable to release a large number of these e-mails since any information would fall under the “sunshine laws” and could not be released to a fellow commissioner. Town business e-mails for the most part relate to items that will be on the current agenda or could be on a future agenda and voted on by the commission. I have received e-mails regarding Kite Surfing, Trash collection and variance requests to name but three subjects all of which may be on some future agenda.
