Here’s The Scoop … Stand By Your Man Part 2 …

WAS IT WORTH $34.20?…..

Dear Readers…every so often this writer does a Google to see where my posts go…If they have been copied elsewhere…(they are copyrighted)…and so forth…. It’s always interesting…and always provides some surprises…Sometimes it’s where they have traveled throughout the world…and sometimes it’s pure fodder…Last night it was the both… Take a look…(link below for verification)…and you will see if Candidate Commissioner Jim Silverstone was really a nice guy…he would have chosen to “stand by his woman”…who told everyone and anyone prior to his filing on day 1 of the qualifying that she did not want him to run…and their wedding was on hold…This included those he would be opposing for his seat on the dais……Jim “He’s not a nice guy” chose to run again…His Fiancee’ has chosen in this writer’s opinion,  to put anger elsewhere and it looks like she thought it was worth $34.20 to go online to see if they could sue this writer for posting his record…his actions and my opinion….. She received her answer…She cannot..Freedom of Speech…..”Stand by Freedom of Speech”….(Can’t you see Tammy singing that one?)…..

I “stand by my posts” …and ask voters if you want to see what is what…go to a post…such as the commission meetings …or the ethic charges of probable cause…and then either go to the Town website and go to the videos and watch…  http://lbts.granicus.com/ViewPublisher.php?view_id=2 ….Go to Google and put in James Silverstone Florida Ethics Commission…and so and so forth…

Why do I do it…because I too was an uninformed voter who was told alot of stories…told a lot of promises and was hoodwinked ….It has not changed  in campaign 2010 ….Just the other night this writer watched in horror as Candidate Jim Silverstone “stood” and told SRClub residents we had an ordinance for kitesurfing…His pal Peanuts Wick tried to say it was tabled…This writer said it was not…Jerry McIntee incarnate Bob Dickman turned to scream at me to “Shut up” and followed that up with a nasty and sarcastic “It’s a good thing we have you.”.. I responded “Yes it is”… I told the residents the kitesurfing “died” because not enough people were there to address the 2nd day…A memo was received by the Commissioners  shortly after that visit..and it verified that the kitesurfing did indeed die after VM McIntee let it go…no table…no ordinance…no bull…”Stand by no bull”….

Just a reminder to the Fiancee’ I could have saved you $34.20……..This writer will stop writing about the “husband to be” after the “husband to be” is off the dais…and it is of course this writer’s hope that will be on March 9, 2010!… “Stand by voting him out”….

In the meantime…I will continue to call Candidate Commissioner Jim “He’s not a nice guy” Silverstone on all of his actions..his claims…and his McIntee -like record!… “Stand by your record”…

CANDIDATE-COMMISSIONER SILVERSTONE DOESN’T DO HIS HOMEWORK …

While Comm. Jim (He’s not a nice guy) Silverstone is being portrayed by his camapaign manager’s Furth as “Coach Jim”…and Santa Clause…Many see him as the “Pillsbury Dough Boy” or Norm Crosby…a man who “Pecifically”…saw “Udder”…. ways to enact a code of “Ethnics” for the Town Commission… Voters need to remember…Silverstone is no “harmless ” Commissioner…worth a vote in 2010 now that his BFF McIntee will not be on the dais to lead him by the nose in how to vote ( a look at their records over the last 4 years show they were identical )… There is no such thing as a “harmless elected official”… Not when that elected official is “armed” with a vote that impacts their constituents!… Jimmy-boy also has a problem with details and following election rules…as seen from his site…”For Commissioner COMMITTEE”…Hmmm….something new he has in mind for LBTS if he returns?….OOPS…(this writer printed it out to retain proof before he can fix it)…

From what you posted, most of it is protected speech. Since your husband is a “public figure”, so long as the information is not false and is opinion, it is considered protected speech. For example, if your husband does have an identical record, then it is not defamation or slander as it is true.

If such information is not true, however, you can consider filing a defamation suit against the person. This is not a class action suit, as all parties have different injuries–all have to file separately. You will need a civil litigation attorney who has experience with first amendment rights to help you.”

Here’s The Scoop … A Big Red Flag … On The Day Of Qualifying For LBTS Commission Seat …

YOU CAN’T HAVE IT BOTH WAYS …

Dear Readers …since  late yesterday afternoon my phone has been ringing  non-stop…my Blackberry is on overload and my e-mails are growing at an alarming rate …All because a new candidate has thrown her hat in the ring for the LBTS commission seat on District 1… Marjorie Evans as previously posted is a real unknown within town…BUT, not so in Broward County…She is the Broward Children’s Center chief executive officer receiving government funding to the tune of about 8 + million a year and she receives a salary over $140,000 …. I have been sent the links and looked it over…While her resume looks impressive …I received another link to a devastating story that occurred on her watch. ….And while we can all debate the two- sides of the story…. it is her responses that caused a “big red flag” …… for this writer…

Readers may recall as I did upon receiving the link, this sad story that happened in the mid- ninety’s in Lighthouse Point … A little girl playing on the local playing field and was suddenly struck by lightning…I recall it because my own children were in school in Lighthouse Point and we parents all felt this family’s pain….Over the next years we would hear little updates…and then of course over time we all went on with our lives… So it was quite something to see that the link I received was involving that same little girl along with another and the new commission candidate from District 1 ….

Before you scroll down to the excerpts and the link…remember this…The story is written by Bob Norman in the New Times, the same Bob Norman who wrote the “Cuckoo For Coconuts” story about then Commissioner Jerry McIntee , Commissioner Silverstone and former Mayor Oliver Parker… http://www.browardpalmbeach.com/2006-12-21/news/cuckoo-for-coconuts/….so  McIntee/ Silverstone/Furth cannot have it both ways and shoot the author down after revering him so highly in the past…And Commissioner Clottey should see a red flag in the lack of training under the new candidate for commission from her side of town…She cannot have it both ways when she is on record from the dais calling attention to her observations of the dispatch training for 911 calls soon after she was elected……. For me though, long disgusted with the lack of correct responses coming from the dais from the Town Manager, Commissioner Silverstone, Commissioner Clottey and Vice Mayor McIntee…it is the responses shown in the deposition by the new candidate for commission in District 1 to the grieving mother, her lack of knowledge to answer questions about the child’s abilities, that she herself did not possess any medical training whatsoever, and especially the all to familiar stubborn behavior that showed no capacity of concern or regret … in this writer’s opinion…..It raises a “big red flag” of what we may see up on the dais over the next 4 years!… The very behavior that needs to be replaced!…

Why in the world would candidate Marjorie Evans jump into the LBTS Municipal election just 8 weeks prior? She will have to explain her decision to the voters ….How and when she explains it will tell us all if more “big red flags” are going to wave a warning…

“Inhospitable and in Denial
The parents of two little girls placed them in the Broward Children’s Center hoping their daughters would be cured. Something went wrong.

“Cristal was one of the most promising kids in the main facility. According to records kept by Broward Children’s Center, Cristal could sit up on her own, pull herself up to a stand, and crawl. She liked to play with toys and watch people go by her crib. When she got agitated, center staffers knew what to get her: “She loved her chocolate milk,” said Broward Children’s Center staffer Robin Sargent in a deposition.

According to a reputable pediatric doctor from San Diego who was hired as an expert witness by Cristal’s attorney, she had a good chance at a relatively normal, happy life, free from life-support machines. By June, in fact, she was being weaned off the ventilator. She breathed on her own through a tracheostomy tube in her neck during the day but still needed a ventilator at night to ensure that she wouldn’t stop breathing while sleeping in the center’s nursery, where 14 other babies connected to life-support machines slept, too.

On the morning of June 19, 1994, something tragic happened in the nursery that stripped Cristal of all of her hard-won physical advancements.

According to civil court depositions, the nursery was being supervised that morning by a respiratory therapist and a licensed practical nurse. Also on duty was a “floating” respiratory therapist, Chackocan Vadakkel, who helped in the nursery as well as in other wings.

Vadakkel, an Indian immigrant with limited English and a heavy accent, in a sworn deposition told Gary Cohen, a medical malpractice attorney hired by Cristal’s family, that employees were concerned that staffing levels were too low:

Cohen: Were you ever concerned that there wasn’t enough help in the nursery? Fifteen babies is a lot of babies.

Vadakkel: Lot of babies.
C: For two people to handle.
V: So, that is why floating therapist — for helping them.

C: Was there ever any talk at the center that you know of about getting more help?

V: They were asking for more help. Everybody asking for more help.
C: Everybody thought they were in need of more help?
V: Yes.

Shortly after 5 a.m. on June 19, Cristal remained connected to the ventilator, which literally breathed for her, though she was also able to take spontaneous breaths on her own. The ventilator was set on 12 compressions — or breaths — a minute. The oxygen went through a ventilator tube, which connected directly to her tracheostomy tube.

Dawn Jackson, the nurse in charge of the babies, instructed Vadakkel to take Cristal off her ventilator. That was the first mistake.

To become a respiratory therapist, Vadakkel had to complete a 15-month course and pass a state test, which he did six months prior to the incident. When he was hired by the center in March 1995, however, he had had no training or experience working with children. More important, he’d never before in his life unhooked a ventilator from a patient when Jackson asked him to unhook Cristal’s.”

EXCERPTS from the candidate for LBTS commission from Dist. 1

When it began an investigation into Cristal’s death, the Florida Department of Health and Rehabilitative Services (now the Department of Children and Families), forbade Vadakkel from dealing directly with patients, Broward Children’s Center chief executive officer Marjorie Evans said in a deposition. Vadakkel’s boss at the time, Robin Sargent, said in a deposition that it was the center’s decision to bar Vadakkel from looking after patients.

The center also took other action: Robbie Harris was demoted, and a new procedure was instituted to deal with cardiac arrests. The results of the state investigation are confidential, said Lynnette Beal, the spokesperson for the Department of Children and Families.

After learning that her daughter was suddenly brain-damaged and in critical condition, Tanganicka Edwards, Cristal’s mother, drove from her Miramar home to the center, where she met with Evans. The meeting was a volatile one, with a mother furious about her daughter’s sudden and unexpected turn for the worse and an administrator who didn’t have a good explanation for it:

Cohen: That is not an inappropriate response is it, [for the mother] to be angry under these circumstances?

Evans: I think what was done for Cristal was appropriate.
C: Was she given an answer as to what happened?
E: Yes… by me she was. I explained what happened as I understood it…. I told her that Cristal was on a ventilator, and that her trache came out, and CPR was initiated. And I also said to her that, “You do understand that Cristal is a very sick child?” and she became absolutely outraged…. She wouldn’t hear anything. We were getting nowhere. I said to her, “I told you everything I know, what do you want?”

Evans went on to say that Edwards was so furious that she refused to leave until Pompano Beach police came to the center and took a report.

Evans, who testified that she has no medical training, seemed unable to accept the fact that Cristal had been well on her way to a near-normal life. For instance, she insisted that Cristal was “respirator-dependent” rather than “respirator-assisted,” apparently unaware that her own nurse, Jackson, had already testified to the fact that Cristal was technically “respirator-assisted.”

Cohen, who sued for Tanganicka Edwards on the grounds of negligence by center staff, also questioned Evans about things the center’s own social worker had noted in reports about Cristal — before June 19.

Back to her deposition:

Evans: Everything Cristal was doing she was doing with assistance. She was not, you know, doing anything without physical assistance.

Cohen: OK. Were you aware that she was able to pull herself up?
E: No.
C: … able to hold objects in her hand?
E: No.
C: … able to play with toys?
E: No.
C: Were you aware that she was able to sit up?
E: I know she was not –
C: Unassisted?
E: — able to sit up.

The day after the incident, the Miami Herald ran a news brief — which didn’t include Cristal’s name and was marred by factual errors — about the incident. The last line reads: “Center administrator Marjorie Evans said her staff was not to blame.” The brief was the only article ever published about the case.”

MCINTEE VS BSO ….

Dear Readers …At the Tuesday night Commission meeting in Jarvis Hall was the reporter for the Sentinel that covers our town……She must have decided that McIntee had opened the door for the paper to do a story now that McIntee had gone on the record in this open Town Hall meeting and proceeded to all but outright accuse the BSO of not doing their job in the May 4, 2009 suicide investigation, questioning  BSO on the statements written in the BSO investigative report for not telling the actual  sequence of events in interviews with both the widow and McIntee himself…. There are a some very important details left out of the reporter’s story though … perhaps due to space… I will add them below…..(also-prev. post scoops cat.)…

‘”LAUDERDALE-BY-THE-SEA – The Broward Sheriff’s Office has reopened its investigation into a suicide, in response to a request from Vice Mayor Jerry McIntee.”

(BC- Actually McIntee only asked for the investigation to be reopened for the widow…not him…Will BSO do a full investigation?…Make sure to investigate McIntee…Chief Perkins…AMR….and the neighbors…as well as the widow and the daughter to see which version was truthful BSO’s or McIntee’s.)

“On May 4, a 45-year-old man with health and financial problems shot himself in the head at his residence on Southeast 15th Court, according to Broward Sheriff’s Office reports.”

“McIntee, a former Buffalo, N.Y., police officer and currently deputy chief of the town’s firefighting contractor, said he received a page about the emergency and drove to the house where the victim lived with his wife and eight-year-old daughter. McIntee went in before Broward Sheriff Office deputies arrived, even though the fire department’s rules prohibit entering a crime scene until police secure the location.”

(BC- According to McIntee’s statement to BSO …version #1…on the day of the incident and in his “interview” as “Witness #3″ he states he heard it on his fire radio not his pager…that change was made in McIntee version #2…. He admits entering in both version #1 and #2… despite the VFD- SOP [Standard Operating Procedure] prohibiting this action)

“I would do it again,” McIntee said, “when you have a woman and baby screaming.”

(BC- The “baby was 7 years old…and McIntee admits he would again break the VFD -SOP spelled out in the VFD By-laws)

“He raised the discussion at Tuesday’s commission meeting because, he said, the widow asked him to discuss the events after the bi-weekly By The Sea Future newspaper published a story on Sept. 25. McIntee said he wanted the investigation reopened to counter the newspaper’s account.”

(BC-The By The Sea Future wrote their story using the all the BSO reports…along with the VFD  and AMR Reports..6 reports in all…containing version #1….McIntee on the dais Oct. 13, 2009 never says his version #1 was wrong ..He sidesteps by saying it is the widow who says it was wrong…He tells version #2 on the dais …but never says outright version 1 as “Witness #3″ was inaccurate…and never demands that BSO to retract his version #1 statement )

“Fire Chief Robert Perkins said McIntee was not penalized for not following the rules.”

“He did go against our procedures,” Perkins said, “but I found he was justified.”

(BC- A Public Records Request made by this writer on 10/14/09 to the VFD for the “internal inquiry” the Chief said he did in answer to Comm. Dodd on 10/13/09 was never done. A response from the Executive Secretary of the VFD said the VFD only had the CAD report on the incident.)

“The night of the shooting, McIntee said he entered the couple’s bedroom, saw what had happened and moved mother and child to the living room.”

(BC- in version #1 McIntee says the mother and child followed him into the bedroom…In version #2 McIntee says the mother and child were already in the bedroom..in version #2 McIntee says he “swooped up the mother and the child…then “consoled” them in the living room)

“There was no chance of recovery,” McIntee said. “I looked at him briefly — maybe five, 10 seconds — and sensed there was no hope.”

(BC- The above statement was McIntee version #2)

“When deputies arrived, the victim’s arms were trembling, according to a Sheriff deputy’s report. McIntee is a training officer for the fire department but said he did not perform first aid.”:

(BC- This was in the BSO Police event report from the night of by the officer … McIntee is listed as having basic CPR only on the VFD Roster.)

“McIntee told Broward Sheriff Det. Raymond Carmody that he knew the victim was dead because of his color. McIntee also said he never checked for vital signs, according to Carmody’s report.

(BC- This was in the BSO investigative report done at the fire department…version #1.)

“When Mayor Roseann Minnet read from the report and asked McIntee about it during Tuesday’s commission meeting, he said, “That came from a homicide detective who did not take any tape or any notes and who didn’t generate this report for three months.”

“So you’re calling this report a lie?” Minnet said.”

(BC- McIntee never says it was a lie…he was careful not to say that …using the above description of the detective and adding the detective was now sick…and then expanding into the interview being at the firehouse and stories of what McIntee did by putting his feet on the desk…but never saying it was inaccurate.)

“Asked again Wednesday about this part of Carmody’s report, McIntee said, “I don’t know where they got that.”

(BC- WOW!… Talk about throwing down the gauntlet….McIntee the day after the Public Safety Discussion says he doesn’t know where BSO got his version #1 statement?…BSO better get this detective back from sick leave to answer McIntee’s response  to the reporter!)

“Carmody’s report also says that according to an EMT with the town’s ambulance contractor American Medical Response, the victim had intermittent vital signs and was treated and transported to North Broward Medical Center, where he was pronounced dead.”

(BC- This was contained in the AMR and BSO reports.)

“The shooting victim’s widow did not return several telephone messages and did not appear at Tuesday night’s commission meeting when McIntee asked the Broward Sheriff’s Office to reopen the case.”If there is any doubt as to what circumstances were at that event,’ McIntee said, “the widow can corroborate what happened.”‘

(BC- We hear McIntee tried unsuccessfully for the widow to appear…and again he ONLY wanted BSO to reopen the case for the widows version #1…not his!)

BC- What was also left out of this article was McIntee’s previous definition of defamation statement made the evening before at the LBTS  Town Manager Performance Review and his threats to the Editor of the By- The- Sea- Future for “slander”… Mr Brown and his newspaper have nothing to fear from the Vice Mayor……They used the 6 reports generated by the departments involved and can back up everything that was published… as McIntee well knows…Those reports became backup for the Public Safety Discussion item put on by Vice Mayor McIntee  http://www.lauderdalebythesea-fl.gov/town/backup2009.htm scroll down to item 7 a.
