November 24, 2009 by Barbara

HE TOOK A GREAT FALL  ….

Dear Readers…Let’s get this one out of the way…looks can be deceiving…and though Commissioner Jim Silverstone looks like the  “nice guy” voters thought he was in 2006….He is NOT a nice guy anymore in 2009!….. He is a “complicit guy ” who “willfully” joined forces becoming  “fully engaged” in all thing McIntee-Furth and Colon … And those who voted for McIntee…a man they knew nothing about, because he was “nice guy” Jim Silverstone’s pal…. say they are not going to make that mistake again… Those who voted for these “2-Hats”  in 2006 have seen the despicable antics on and off the dais in their first  ( and only) term…The decline in decorum accelerated in 2008 when Jim’s BFF McIntee was installed as the Vice Mayor (despite Jimmy’s post election-pre-Vice Mayor nomination “promise” to the new commissioners of “a kindlier, gentler Jerry, once he became Vice Mayor”) and in 2009 when McIntee again became VFD Deputy Chief ( with a big Jimmy-boy assist )…going against the VFD By-laws and the 2007  promises they both made ….

It is painful to watch the befuddled speech of “pacific ethnics”…”udder”…and the disjointed repetitious commentary that comes from his time at the microphone… His “statistics” are seriously flawed and lack any validity for why he would spend time on them in the first place…His uneven, unfathomable attempts made for trying to reconcile the bad acts taken by his “gang” further prove ….this is no “nice guy”…

The 7 minutes of Commissioner Comments made by Commissioner Silverstone on Nov. 10, 2009 again spell out what is wrong with having him as an elected official in this town…And as in previous posts…by using his own words…there is no way he can accuse anybody of attacking him, not being honest …no calling foul, Coach Jim! ….

CS- “Thank you, I don’t know where to begin at this point. Um, as I’ve been trying to do for the last ah, since I can remember. I’ve been trying to write down the ah, the ah, responses from the public during public comments and answering them as best I could and now I’m getting accused of attacking people by doing that which I think is funny.”

“There seems to be a sporting event, a new sporting event in town. Because we’re public servants up here I think people have the idea that you can just throw stuff at us and say things to us and we have to sit up here and we can’t respond back. When I do respond back it doesn’t do any good cause I hear the same thing over and over again and it becomes a sporting, thanks for acknowledging that. It becomes like a sporting event up here. It’s absolute torture to sit up here and not having to directly respond. But when I do get a chance to respond it still doesn’t make any difference. So logically the conclusion I can make is that this is pre-planned and this group of people are getting together and doing this! And ah, it’s, it’s anti- American! It’s anti- Town to do something like that!”

“Having said that I will go through the comments again like I always try to do.”

“Accountability, that works both sides and also I would appreciate it if the people in charge of information that the public reads in whatever forum, there’s a standard of “ethnics” regarding that too. If you go online pull up blogger or press ethics you will read that to yourself a favor ah, you will find that there’s a lot of contradictions here.”

He went on to speak of “Chrissie” Furth and Halloween… and perpetrated the ruse of “saving” the Town $1200 dollars by spending only $1800 of the $4000 dollars budgeted for the Halloween event…He knows from all his years of participating as “Dracula” that the years of purchases the Furths made …reimbursed by the Town (taxpayers) are in the thousands…and are kept in the still unsold west side warehouse…so spending less was just the same as the false claims made for 4th of July when the Mc-Furths claimed less used for the very same ploy…re-use of the items purchased on the previous year’s event!…OOPS!… (A PRR is expected of the event and will be posted)…He went on to say…

CS- ” I worked maybe ten percent of the time Marc and Crissie Furth worked . They wore me out and I , it took me two days to recover and I lost my voice like I do every year playing Dracula. I’m in the back in the room there scaring the adults more than the kids. It’s my little payback! It’s a lot of fun, it’s a lot of work and again I shouldn’t say this.”….

BC- IF YOU DON’T READ ANYTHING ELSE THIS ELECTION SEASON ABOUT COMMISSIONER SILVERSTONE…….. READ THIS!!!!!….

Commissioner Silverstone ” If I run again, I don’t want anybody to vote for me that hasn’t participated in doing something for this town other than criticize us. If you don’t give your time back to the community, I don’t want you to vote for me. I hope I make that clear. I don’t want to represent that!”

………………………………………………………….

“Cause that’s just, when people attack me up here, that’s kind of like what you call somebody who can’t defend themselves and so who’s that person that attacks them? They’re a bully. Again, you guys, some people out there have turned into the same thing you’re trying to, to, to defend this town with but you don’t, but we’ll see what happens next election.”

“As Abraham Lincoln wrote during the Civil War, at the end of the day he had faith in the American people that they would wise up and, and know that what the truth is, and what honesty is and I think the same thing is gonna happen this election.”

Most in the audience were snickering of course…thinking of all the votes he just said he did not want…along with thoughts of Abraham Lincoln saying “wise up”… and then the follow-up after  his “Honest Abe”fairytale …was to repeat the “gang’s”misleading pre-payment payoff  explanation…of “saving ” the Town a million by paying it off … instead of being “honest” and telling the constituents that the Town Manager held on to the loans too long…costing the town $300,000 !…

He spoke to Mark Brown, who stood at public comments about the poor response to skewed townwide survey with the deceptive maximum height limit question and recounted the Vice Mayor’s negative actions toward him on a past north side survey that was sent to members of the SBCA organization in comparison to this one…Commissioner Silverstone…CIC- endorsed member, Commissioner Silverstone…told Mr Brown ” but you also said in your talk that it was only members that you gave this response to. Well I think that says it all right there. You can’t do a ah, statistical analysis that’s jaded like that!”

Comm. Silverstone tried to ask about Candidate Scot Sasser’s well researched questions concerning the county plan for garbage…and was precluded from any further embarrassment when the manager said she was looking into it and would confer with the Mayor and the resident (Scot Sasser)…

It would not be Commissioner comments without including the VFD… “2-Hats”…don’t ya know…

CS-” VFD is properly trained and properly managed and accused, being brought up again and again and again. Let’s look at all the vendors in this town. It seems to be focused only on the VFD for whatever reason.”

CS- ” Pension benefit, I thought I explained this pretty clearly the last time. The benefit, you have to derive from the town. That’s state money. That’s pennies. But it’s not benefiting, it’s not coming from the town contract. You know that’s from the state and well that’s, that’s…”…(In the background it appears Vice Mayor McInee can be heard from his chair at the other end to say “stop talking”…OUCH!…

Commissioner Silverstone after being “slapped down”?…by his BFF over the pension went on to thank his supporters…such as Renee’ O’Neal…CIC-board member- recipient of the $20 annual beach parking pass reduction…and “Rosie” the CIC- member-Tomato lady…who came to the podium and tried to disparage Silverstone and McIntee’s  opponents in her best Roseann Rosannadana …persona…saying fondly ” She brings a lot of wisdom to her talk and it’s always nice hearing her.”…Last time at the podium, the Tomato lady said she did not want to hear about history…she just wanted her annual hardship permits lowered!… This time she did not want any candidates to come prepared and read their words…she wanted them to come like her and speak..YIKES!… By the way “Rosie’s” son…is the highest paid non- officer VFD member in the department from his fire and medical call responses…as well as being employed by the town as a parking officer…that’s called a “patronage” supporter…and as a native of Chicago, Commissioner Silverstone understands that!…Honest Abe,he does…

Commisioner Silverstone.. in his own words.. is NOT a nice guy!…”Wise up!” LBTS voters…

“As Abraham Lincoln wrote during the Civil War, at the end of the day he had faith in the American people that they would wise up and, and know that what the truth is, and what honesty is and I think the same thing is gonna happen this election.”…

There’s always basketball…Coach Jim!…..It’s a McIntee Free Zone!

BC- Fishing ordinance… fast tracked for the election with a lot of drama that made this writer sorry to have assisted with the applicant  from the get-go… of how to proceed to get help (prev. posts)…
11. COMMISSIONER COMMENTS
12. CONSENT AGENDA

BC- Line em’ up….extensions…Hmmm. Comm. Dodd sent in an e-mail asking for extension info after meeting with Minto reps…as each commissioner did…we hear Minto is looking for some changes and could face some challenges…with the scrapped Overlay Districts…the impending lowering of heights per the Mc-Furths…Does Minto realize they gave the “keys” to the VFD “drill site” (Minto construction site on west side of El Mar) to the very group that will keep them boxed in with new height restrictions if they get their way?…Also conflict of Interest should arise if the “2-Hats” vote on any changes after using the Minto sites for the VFD…Hmmmm….. As for the applicants on the agenda today……”Who ya gonna vote for in March, Baby?”….

a. Commission to approve an extension until April 30, 2010 for the completion

CODE OF ORDINANCES.
14. QUASI JUDICIAL PUBLIC HEARINGS

15. OLD BUSINESS

a. Commission selection of contractor and award of RFP 09-07-02 -Parking
Citation Processing Services (Assistant Town Manager Olinzock) Deferred at
the September 10, 2009 Commission meeting by Commissioner Clottey
BC- This is the 1st RFP to watch to find out  why it was ludicrous for the Town Manager to stop opening up the sealed bids…as was done prior to July 29 2009… Despite the uninformed “Gang of 3″ and the Vice Mayor’s Oct. 23rd assertions showing once again his medications must be impairing his ability to retain information, or perhaps it’s his usual  aversion to doing his homework rearin’ it’s head again…We had the staff themselves produce the fact that most towns open both ITB/RFPs …and since an overwhelming number of companies send their reps to these opening you know it is standard…again staff doesn’t want to read “all the numbers”…lay the sheets out on the table for the bidders to get the info they need…10/23/09 Sentinel 2 RFPs for Deerfield Beach both will be “opened and read aloud.”… A look at the backup on this one shows some interesting comparisons…check out backup page 110…

b. Discussion and/or action regarding draft Resolution 2009-23 concerning
street names in Bel Air (Commissioner Clottey) Deferred at the September
10, 2009 Commission meeting by Commissioner Clottey Deferred at the
September 22, 2009 Commission meeting by Vice Mayor Mclntee

BC- in the backup the Bel Air Civic Assoc. went around ..222 homes in Bel Air…Directors visited 156 homes…14 no +6%…142 voted yes +64%…30% unavailable or unreachable…70% of neighborhood homes polled / names offered up…Coral Reef Dr/ Blue Water Dr north & south/ Waters Edge/ Ocean Mist  Dr/ Sailfish Lane/ Windward Place/ Coco Palm Court/ Tropic Isle/ Bel Air Dr…signed by all director except candidate Edmund Malkoon and Maureen McIntee and Virginia Holder on 9/7/09…
16. NEW BUSINESS
a. Commission approval of six (6) Hardship Permit Applications (Clerk White)
• Coral Key Inn
• Gemini
• Basin Drive LLC
• 4344 LLC (4344 E. Tradewinds Ave)
• 4244 LLC (4346 E. Tradewinds Ave)
• Windjammer Resort and Beach Club

BC- last time the commission wanted to drop the cost of the hardship permits for CIC emebers in the audience at the 10/13/09 meeting…will they now that opponents will get the decrease as well?…
b. Discussion and/or action regarding the price of Employee Parking Permits

(Vice Mayor Mclntee)

BC- no backup except for the approval and list of charges…This writer still has a PRR for when the commission voted on lowering the residential annual pass to be the same as the beach …and now we are going to what further reduce parking fees across the board?…Anybody see what the ord. changes are costing us?… On this one with a 17.50 chg. it has to be location the VM is addressing…
c. Discussion and/or action -Bike riders riding in packs on A1A and interfering
with traffic flow (Commissioner Clottey)

BC- we had a resident speaking on this last meeting..too many bikers across the road in the morning riding “packs”…a new BSO sign with a warning has shown up around town…and who’s gonna go after the morning clubs?…
d. Discussion and/or action -Hillsboro Inlet (Commissioner Clottey)

BC- What’s with Comm. Clottey..she too have trouble with meds…she’s no longer just a “pawn” for the Mc-Furths…she’s an active willing participant…just watch her go after Comm. Dodd at the Oct. 23, 2009 Manager review…at last night’s Referendum workshop about the ethics being VFD only…and now the Hillsboro Inlet…Comm. Dodd gets his ins. only… a pointy brought up when Mayor Parker was reinstated shortly before he stepped down. It was VM McIntee who promoted Dodd for the position…since then CIC Pres. Boib Roberts has been a regular PRR gatherer on all things Hillsboro Inlet and then acted in his own BTSTimes (he’s an Editor) as just a resident “letter writer” on his ongoing quest… If the “Gang” replace Comm. Dodd on Hillsboro…he will join Comm. Silverstone and Comm. Clottey in getting his health ins. from the Town!…OOPS!… We hear that Comm Clottey has been approaching new candidates and telling them to run…Hmmm…careful …not all are “clueless”…
e. Town Commission authorization to short list the three (3) lowest responsive
proposers for the Public Safety Complex -Police Office Improvements, RFP
# 09-08-01, and to allow Town Manager to negotiate contract agreement for
construction of work (Assistant Town Manager Olinzock)

BC- RFP #2 that was a travesty…it was late  in being available to the companies and id not allow them to turn in their  bond bids within 10 days…(prev. post) …It was handed over at an additional cost for our contracted engineer to do the work and for the “expert” response back…that the lowest bidder is from Naples and might be too far away for the job/ and the change orders run 5-15% per (actually one was 17.5%)…and need some negotiation….thus the request for the TM to “negotiate”… another “fallout ” from TMbeing so obstinent!…

A grandmother and her grandson were critically injured when an explosion ignited a hyperbaric chamber they were in just before noon on Friday.

At 11:28 a.m., Broward Sheriff’s Office deputies responded to a reported explosion at the Ocean Hyperbaric Oxygen Neurologic Center at 4001 N. Ocean Dr. in Lauderdale-By-The-Sea. In less than two minutes after the call was received, BSO Deputy John Melbourne arrived at the scene. Without hesitation, he entered the building and fought his way through heavy smoke to rescue Franchesco Martinizi, 4, who was on fire, with his grandmother, Vincenza Pesce, 61, inside a hyperbaric chamber. Additional deputies responded and assisted with evacuations and traffic control in the area.

Pesce was holding her grandson inside the tube-like chamber while he was receiving treatment for a medical condition. Initial investigation by BSO homicide detectives and the State Fire Marshal’s Office indicate that there was a blast that dislodged a tube attached to the chamber, resulting in an explosion and flash fire. The medical facility staff was present at the time, as were other patients in the treatment area, which consisted of a room filled with approximately a dozen of the oxygen-enriched chambers just inside the first-floor entrance to the building. Nobody else was injured.

A BSO helicopter landed across the street, and a team of Broward Sheriff Fire Rescue flight medics treated the two victims. Both sustained serious burns over 90% of their bodies. Pesce was transported to Broward General Medical Center by ground ambulance, accompanied by one of the flight medics. Martinizi was flown to the same hospital by BSO Air Rescue. The two were stabilized at that facility and later flown by BSO Air Rescue to Jackson Memorial Hospital’s Burn Unit in Miami.

Late Friday night, three of the hyperbaric chambers were taken as evidence and will be examined by experts to assist in determining the cause of the blast. Crews emptied a 1,500 lb. underground liquid oxygen tank that supplied the gas to the units inside the facility. The State Department of Health and Agency for Health Care Administration were also notified of the incident. The investigation is ongoing.

INVESTIGATORS: D-13, D-11, RID, Homicide, Crime Scene, OHS, Bomb Squad, Sgt. Bukata, State Fire Marshal, FLDOH, AHCA, Chief Gooding, Lt. Cedeno, LBTS Fire Inspector

Here’s The Scoop….”New Broom Sweeps Like The Old One”…

February 3, 2009 by Barbara

“NEW BROOM SWEEPS LIKE THE OLD ONE”…..

http://www.brooms.it/images/Articoli/181%20Spring%20broom%204%20stitches.jpg

This writer heard this was a quote in a N.Y. Times Washington story about the “backing” being done…the “excuses” being made for those nominees President Obama wants…despite their bad acts…of tax evasion….

The double standard being used by the majority party in “mistakes” being made…but are not to be addressed…”There is important work to be done…time to move on”…

HMMM…where have we heard this before…closer to home perhaps…AHHHH…that’s it…right here in LBTS…we have the new majority that came into power almost 1 year ago and ….

we find…the “new broom sweeps like the old one”….

Behind the scenes decisions…are swept aside…so what if “mistakes” were made…”Move on”…say the “Broom Boys”….

Look the other way ….so what if flag poles came about…without a vote for them…they are up…move on…

The bases below…passed on the consent agenda…you know that pesky agenda item…where “sweeping” passed items are made…unless taken “off for discussion”…those left..passed…usually 5-0… never to be seen again…unless you watch the video…”swept” from the minutes…never to be seen again …unless that is some sort of explanation is finally made for how we ended up with something no one remembers voting for…and even then the votes…were on items not fully disclosed…”move on”…

The bases were blank…with a sprucing up called for…the consent agenda item was indeed discussed…but the result…caught at least 2 Commissioners by surprise…not what they thought was directed…and even though they were offered no final look before installed…never mind…..”move on”….

Flag poles at entryways north and south…when did that come up?…Don’t recall…”move on”….

Sweeps of code enforcement…from north to south…finding no input on the revisions..the staff forged ahead…..although a few do not recall ever being asked for direction…then getting the codes  for revision just a few days before…lacking backup…lacking reason…bringing forth a few days of intense “catch up”..still hearing …”move on”…don’t” micro manage”… definitions of duties legislative VS administrative……just  asking for “courtesy” from staff to better have an opportunity to serve constituents…is asking too much…”move on”….

Some on the dais get the info…if they are lucky to be everyday “visitors’ within the Town Manager’s sanctum…others are left in the dark…too many questions…”move on”…

Look at the awards…the financial awards…the books look good…never mind what is lost in the reality of running the town… if the books look good…”move on”….

Wearing “hats” is something the administration and staff do as well as  their “ardent 2-Hats” supporters….we have an Assistant to the Town Manager…who morphed into a “full-fledged” Assistant Town Manager…who acts as the Development Director…over the Code Enforcement  long time employee who was “elevated” to that role…neither meet the criteria for heading that department…separately or together…but…”move on”…and we saved money on placing ads in the right venues……”move on”….

We have loopholes being used for Jarvis Hall use…after changing the original intent of that hall……but …”move on”…

We have a fire department…with no oversight…no accountability….with the Town Manager…turning a blind eye….to repeated “red flags”…”move on”…

The pavilion…may look great in the end…but that’s not the problem…the pavilion changed …and the Administration knows when it did…they made the change without going back to the Commission to show it to them……to ask for any input…….but we’re told “if mistakes were made”…”so what”…”move on”….

This writer hears one of those “Broom Boys”…now recalls stubbing out for plumbing…but never mind…”move on”…

The Public Safety Complex is open…was it necessary to do …many are not so sure…it’s still an old hotel…The reasons for it…don’t quite add up…For AMR…a look yesterday at 2 small rooms and a bathroom…temporary accommodations could have been found for the first year…The VFD could have gone back to their old digs…for at least a year…The BSO…still needs much additional work…and could have been kept the status quo…..For housing Town records… ..$2 million to move the records closer…(another excuse used for the purchase)…why?…they are never produced anyway…and the development office in the trailer…if we knew we were going to be running it under the Assistant Town Manager…why not use Town Hall?…but as the Mc-gang group says…”move on”…

Dear readers…..in the recent past….with that different majority…with that Manager named Baldwin…that Clerk named Alina…if the above was going  on… all those who are now calling these acts “mistakes”…saying to “move on”…would instead  be calling it all a golden opportunity for a “platform” to run against…in the next election…” a clean sweep”…for change!….ARGHHHH….

We hear the CIC met last night…a “cheer leading” of sorts…of all the great things that have come about over the last year in charge…the room was full with  a smattering of old die- hards…3 commission members…those in the “cycle” of “us vs them”…..unaware of the truth…some who remain to still be on the inside…and new members of which half were VFD ….

We also hear letters and responses to re-up calls have given the CIC leadership quite  an earful…of what has happened since last February…..and decisions to not remain members…

So perhaps a new tact will be used…a “wolves in sheep clothing”…to try and make amends…..with election 2010 “looming”….

But alas keep your eyes on the issues…not the personalities…for it should not matter who is in charge the rules still need to apply….accountability is required…

more to come…for this writer…is not easily “swept away”….

“if it walks like a duck…..” or now we might say….

“a broom is a broom is a broom!”…….

10. Ordinances

1. Ordinances 1st reading-public comments…

previously posted before the 1/13/09 meeting under 1/13/09 agenda…

a. 2009-06…ordinance discussed at the 1/13/09 workshop…to get rid of all “paved” swales”…per Vice mayor…alert to residents on Poinciana/Bougainvilla…Seagrape etc…where parked cars are not on the “paved” swales”…better show up or contact your Commissioners…your fellow residents with “green” swales will get a “reprieve” by way of leaving their swales..alone until new development or major reconstruction…or sidewalks….

b.2009-07…ordinance for heights of hedges/fences-10 feet is the highest allowed without the need for a variance … change to the spacing needed between the fencing…and chain link change…

(missing number…should be c)….2009-08…HOT BUTTON ITEM….BOATS and VEHICLES on property…a snafu…the Commission followed the motion of Vice Mayor McIntee…voting 4-1 Comm. Dodd dissenting…for “grandfathering in” the boats (approx. 8)…that can prove they were in place in the north end at time of annexation…OOPS…the Commission did  not re-vote after the Vice Mayor got his dander up…following Beverly Kennedy’s assertion if boats are allowed she would take action against the Town…when he sat forward and changed his mind…to say all boats in the north at present can stay…BUT…no re-vote and this ordinance state the 4-1 vote…

BC……. the Mc-Furth Times reported this one WRONG….

BC…while they are at it fix the gravel driveway vote..”grandfathering in” just 6 residents homes….before that comes back in an ordinance next meeting….

At the follow-up workshop meeting…the Commission voted no boats and vehicles across from the condos in  the north between 17-19th street on A1A…cannot have selective ordinances…they should be allowed to keep their boats too….

c.  (should be d.)…2009-09ordinance for inoperable boats…NOT BOATS IN YARDS…that’s above…this is just a time limit 3 months…covered with nice tarps…per Comm. Dodd……..

2. Ordinances 2nd Reading…public hearing…

a. Ordinance 2009-01…parking meters….the details previously posted…

BC still need to deal with the late night return to residential spaces in town….per McIntee for some CIC members…

b. Ordinance 2009-02…HOT BUTTON ISSUE…Commissioners are being e-mailed big time..by condos who feel they will pay for a service already done yearly by alarm companies…and condos are concerned with the calculations…they want this tabled…details previously posted

c. Ordinance2009-03..Campaign Finance Restrictions…previously posted…should re-vote on amount…state allows $500 limit/Commission voted for $300…those in the know..know…it can be played with…anyhow to get around it…previously posted..

e. Ordinance 2009-05….Tennis Courts…HOT BUTTON ITEM…mucho calls of complaint from the “regulars” not wanting to share the 2 courts with non-residents…including a video made…balls in your court Commissioners!…

12 Consent Agenda…

a. 4 liens against 2 properties…on Poinciana & Bougainvilla

b. Aruba…sidewalk cafe amending their plan to include 4 tables…that are over the approved 10/10/06 plan…

UPDAET:…per e-mail…the tables in question are on private property as are Athena’s

BC…… fallout from the McIntee/”Athna Boys” vendetta…

c. Athena By The Sea…same thing to allow the extra tables…only these tables are on private property…not the town’s sidewalks…as a result of the “Midnight Code Enforcer”…protector of small children and sidewalk spaces everywhere in town…with hissss trusty sidekick out on patrol nightly by Cadillac or VFD-SUV..depending on the hat!…placing bets here…4-1 …Vice Mayor dissenting…

d. Request for minor site plan changes wings site plan…upstairs..a “tea house” and apartment 6…HMMM

BC…the Commission just passed that all condos needed to stick with the code for 2 parking places required per condo…denying the staff revision for 1.5…the Wings “deal” for parking permits in perpetuity..(previous post scoops category…”sweetheart deal”)…is this why the change was initiated?…unless this was a typo and there are really 5…

e. 90 day extension on Waste Management agreement….using same terms and conditions..

f. Emergency repair for Chamber roof repair..$2,751.00…

13. Resolution…public comments…

a. Resolution 2009-04 lowering the fees by 10%…

BC…not sure why we are doing this now…when the commission approved a consent item on 1/23/09…for approx. $30 thousand…maybe the fees could be lowered further after the report?…

14. Quasi Judicial Public Hearings…

a. Single Family Home…on El Mar…beach side…owners of the Buena Vista…passed BOA…was tabled …for owner to be in town…previous posts in Nov./Dec./Jan…
