KEEPING IT UNDER WRAPS ? ….

Dear Readers …The latest on the sure to be discussed sewer “subsidy” (tonight’s Budget Meeting) kept under wraps in Town Hall from 1997 to 2010 is this… All of LBTS uses Pompano Beach for their sewer service …All …north/south and the condos… All residential customers are charged a rate per thousand gallons along with a surcharge…The Condos are also charged an “availability charge” for service to each unit …The puzzle is now coming together ….

SRC asked for their rates to be the same as LBTS once annexed in and to no longer pay the “flat fee” …”surcharge”…which is really the “availability charge” that was attached to the sewer bill per a fixed-long term contract with Pompano Beach…The Commission at their Feb 3, 1997 Special Commission meeting (prev. post) came to consensus with a 5-0 vote to offer that rate change and to have the Town Atty. go to Pompano Beach once the annexation was complete and ask them to agree to end that contract …Failure to do so would result in a declaratory judgment action from the Town …. It was then -Vice- Mayor Parker who asked about the Town being “exposed” to any  litigation arising from temporarily paying a”blended sewer rate during litigation of the contract ” that had been suggested by Town Manager Baldwin…Town Atty. Cherof is on the record for stating he did not think the Town would be….Later on Parker made it clear he did not want any offer of an aggregate rate to be in the agreement so as not to “weaken the Town’s position in court”…and again stated the Town’s “willingness” to renegotiate the rate… On Feb 4th, former Town Manager Bob Baldwin sent SRC a letter …(prev. post)…reiterating this…”The Town Commission approved several item, as follows 3. Agreed to take necessary action to reduce the condominium resident’s sewer bills to a rate charged by the City of Pompano Beach to Town residents.”…TM Bob Baldwin followed up with a Feb 19, 1997 Q & A (prev. post) which further stated ….”The Town Commission has agreed to lower the condominium resident’s sewer fees. The Town intends to bring the condominiums under the Town’s master sewer agreement wit the City of Pompano beach. This would decrease your rates (based on current rates) from $1.81/per one thousand gallons plus the additional flat fee to $1.51/per one thousand gallons with no flat fee. If neither the City of Pompano Beach nor the courts allow this change, the Town will explore other options. The Town Commission is committed to making the sewer rates the same for all residents. That means your rates will be lowered.”…

Readers recall from the previous posts this came up in 2007 from then- Comm. Silverstone and ended when comparisons were made by John Thompson showing SRC was paying their sewer bills and Jim Silverstone informed this writer they had been looking in the wrong place…(Pompano Beach when SRC paid Fort Lauderdale)… It came up again a week ago Monday…On Friday, Mark Brown wrote about it in the latest edition of his newspaper and this writer posted on it last Friday as well with a followup posted yesterday…

Now it appears that once SRC annexed in they paid their sewer bills to the Town…and continued until Fort Lauderdale took over the billing for the Town because the Town was doing a poor job of collecting… SRC never heard anything else after annexation …They just paid their bills…until they heard something when a phone call was made from the Town a few months ago…SRC reiterated where they paid there bill…They heard from this writer yesterday (prev. post) …as well as from the Town once again…The Town we hear has the files from the former Town Atty. and the issue grows cold from the time of annexation to now…

It appears that there was no contract discussions with Pompano Beach and no declaratory judgment action… It also appears that it never came back to the Commission for any action to take place or option to vote on to honor or not honor the consensus of the Commission at the Feb 3, 1997 meeting… It appears that a few people inside Town Hall made the decision to find an option to cover the “availability charges” for SRC and keep it quiet for all these years!…

The north end annexed into LBTS in 2001 and as far as we can tell never asked and were never offered a rate equity or to rid them of the “availability charges” for the condominiums …we are told…

As of this year and the latest sewer bill payments made by SRC the condominium of 722 units pays Fort Lauderdale $3 per thousand gallons while the Town’s rate to residents is $2.85 (I was informed)…and also pays the Town $190 “availability charge” for meters …of which SRC has three …for an additional payment of $570 dollars…

If SRC was charged the “availability charge” that would amount to $14.47 per unit …or $10,447.34 a month … which equals $125,368.08 per year…close to the $127,000 Mark Brown quoted in his article …Hmmmm….

So, who made the decision to not go back to Commission and go forward as planned?… Who made the decision not to go back to SRC and explain they needed to continue to pay an “availability charge” per unit as all other condominiums were required to have (we are told)?…Does anyone believe doing so would have been a deal breaker in the annexation?…

Most importantly, we do know that the Town Attorney was  Jim Cherof…The Town Manager was Bob Baldwin…and the Vice-Mayor was Oliver Parker…who then became the Mayor…along with Finance Director Esther Colon who became the Town Manager and they had to have paid Pompano Beach a check that was much more than the check received from SRC to them and then from Fort Lauderdale for SRC  just as Interim TM Hoffmann did upon her appointment in April 2010… but they kept it under wraps!…

How to go forward….It is this writer’s opinion that the Town cannot expect or receive payment from an unknowing SRC ….As previously posted the Commission per TAtty. Cheroff also voted 5-0 to defend SRC from any litigation resulting from the annexation… Not being a lawyer…I would think although it almost 13 years after the fact…the Town will now need to go to SRC and explain SRC they need to start paying the “availability charge” per unit going forward…and figure out the “meter” charges and what that is all about…

Repercussions for those that carried out this “option” behind the scenes for all these years…that’s something supporters and voters may want to consider very carefully going forward….

POINT THAT FINGER FURTHER SOUTH DOWN A1A …MY FRIENDS ….

Dear Readers…This writer spoke this morning to SRC and it is as I recalled…In 2007 when then-Commissioner Silverstone came to me and thought he had something “big” concerning SRC sewers…(prev. post) …when all was said and done (pun intended) ….it ended with Silverstone stating they were looking in the wrong place…They were looking at Pompano Beach and they discoverd SRC paid its bills to Fort Lauderdale…THE END…or so we thought…

I thought with this latest revelation of a possible subsidy being paid I may not have remembered that part correctly  and decided to call and check …In the conversation I had this morning with SRC I was correct….I was informed again as previously posted …SRC only asked for an equitable sewer bill  rate upon annexation and that after annexation up until a certain point SRC paid their sewer bills to the Town of LBTS and the Town paid Pompano Beach… At some point the Town stopped billing for sewer and water and SRC along with LBTS residents in the south began paying Fort Lauderdale… SRC has been paying Fort Lauderdale ….($3 per 1000 gals. as of May this year) …..

What the checks were that the Int. Town Manager paid to Pompano Beach should be from monies turned over to the Town from Fort Lauderdale to pay Pompano Beach for the sewers after Fort Lauderdale took over the Town’s billing…

If there was any subsidy added onto that…or if the Town never went to Pompano Beach after the SRC/SRLN annexation as the Commission decided 5-0 they would at the Feb 3, 1997 Special Commission Meeting (prev. post) is the big question…If they did …there should not be a subsidy…If they went to court there should have been an item on the agenda and perhaps a shade session ….and if the Town decided to subsidize temporarily or aggregate the sewer surcharges from Pompano Beach as either a result of not going for a declaratory judgment or losing a judgment that too should have come in front of the Commission…No one this writer can find can recall either a court case or a return of the SRC sewers on a subsequent  agenda to be voted on…Also Pompano Beach needs to be brought into the picture as well as the annexation with the north end in 2001 and what occurred when they (unincorporated Broward county just as SRC/SRLN was) became LBTS residents and if they too had a surcharge …was that contract taken care of…if so and SRC’s was not…how so?…If not…why not?… And as previously posted who knew about a subsidy if indeed there is one?…

In any event SRC has nothing to worry about in this writer’s opinion… They (I did not own or live in SRC at that time bought in 1999) only asked for the LBTS resident rate and the Town Commission under the advice of the Town Atty. at that time stated the Town would not indemnify SRC but would defend them in any litigation arising from the annexation…

The Town needs to get to the bottom of this one…as it was not only brought up in the Town’s sole local newspaper BTSFuture … and this site, but is contained in the new LBTS 2010/11 budget under the Sewer Enterprise Fund on page 15… and because we are hearing that just as this writer feared in 2007 …some are already pointing fingers at SRC already demanding repayment and stating they were the “pot calling the kettle black” in the 2008 election…  Again, this writer states…not so!…

PALM CLUB  V. SEA RANCH CLUB CONDOMINIUMS …

Dear Readers… below is an excerpt from the latest edition of the BTSFuture in which Editor Mark Brown addresses the LBTS “Sewer Subsidies” and states the Town has subsidized sewers bills for Sea Ranch Club  and Sea Ranch Lakes North Condominiums over the last 12+ years since annexation into the Town … While I wholeheartedly agree with Mr. Brown on his stance that former Town Manager Colon should have made it known that the Town was doing this as a practice …Sea Ranch Club and Sea Ranch Lakes North Condominiums did not ask for that to be done and did not require it to benefit them as  private properties when annexing into LBTS… What SRClub did ask for was to to be “whole” with LBTS residents in paying their Pompano Beach sewer bills at the same rate as LBTS residents once they annexed into the Town…At the time of discussion over the annexation SRC pointed out to former Town Manager Bob Baldwin that they were being charged more and were also charged a surcharge from Pompano Beach.. The Town’s Commission in 1997 held a Special Commission Meeting and voted 5-0 to go ahead with the annexation of all four SR Condominiums and after that vote to approve various items SRC wanted such as police, buoys, zoning protection,indemnification and the sewer rate …It was a meeting held in the Sunshine… unlike the annexation items wanted or promised when the north side of Town was annexed in….

Excerpt from Mark Brown Article BTSF July 23, 2010 publication ..page 5…

“Sewer Subsidies: As part of the annexation agreement of 2001, the commission
promised to extend municipal sewer service into four neighborhoods in the north end
of town, including the Palm Club. The first three projects were built as planned, but
the commission reversed course in 2007 and killed the Palm Club sewers, saying it
was wrong to spend public money to benefit private property.
As it turns out, the town has been doing just that for the past 12 years, by using public
funds to subsidize the sewer bills at the four condos which make up the Sea Ranch
Club. This was part of a deal which the town made with Sea Ranch when it agreed to
be annexed into LBTS in 1998. So far the town has paid more than $1 million worth
of sewer bills at the Sea Ranch Club, including $127,000 last year alone. The town
has been subsidizing the sewer bills at other private properties as well, but not nearly
as much as at the Sea Ranch Club.
Colon knew about these subsidies because she approved the checks each month, but
she never said a word about them when the commission debated and voted to kill the
Palm Club sewers. Similarly, she blindsided the town attorney by not sharing this information
with her after the Palm Club sued the town and the case went to court. Her
silence on the sewer subsidies has left the town and the commission in a very difficult
position which now has to be addressed.”

NOT THIS AGAIN!…..

In 2007 during the campaign for the LBTS Municipal election this writer was contacted by Comm. Jim Silverstone who said he had found something that would make the Palm Club Sewers issue look like peanuts in comparison … He asked me for a copy of the SRC end -of- the- year budget (I live in SRC) and explained that it looked like the Town had been paying for our sewer bills for years… I gave him my copy and made a call to my friend John Thompson…I will admit as the co-campaign manager for the CIC- candidates running for the 2008 LBTS Commission I was more than a little concerned about Silverstone’s  request and the possible ramifications that could come from this issue being raised at this point in the campaign no matter if there was any validity to it or not…

Readers will recall the CIC candidates were not for the sewers being put into the Palm Club after Mayor Oliver Parker “let the cat out of the bag” and informed his constituents of the Palm Club’s status as a private property … He stated he had been in the Palm Club looking at property and that was how he found out the status…claiming he did not know prior…Many PClub residents came forward after his declaration of ignorance and countered his assertion stating he knew full well… John Thompson, who was also a campaign committee member for the CIC slate coined the phrase it was “a horizontal co-op”… Sea Ranch Club residents overwhelmingly, along with other condominiums and LBTS taxpayers adamantly voiced their outrage over taxpayer monies going to put sewers in on a private property …We knew that it was a winner not to support the move no matter that the Town had already expended funds (over $200,000) already in preparation…now that Parker let everyone in on this very well kept secret… John MacMillan and Comm. Jerry McIntee along with Comm. Jim  Silverstone wanted to persuade our candidates at the start of the campaign to support the sewers in PClub…We were told behind the scene that MacMillan and wife were the #1  real estate agents in PClub and wanted to keep it that way… As for the “Broom Boys” they felt we should hold onto the 90 votes we would get if we backed the sewers…The only candidate that signed onto the M&M plan was Peanuts Wick who was running for Mayor …after a meeting was put together by MacMillan with two of the candidates in his real estate office building on Commercial …(Birute Clottey was not invited or included)… John Thompson and our campaign committee along with candidates Dodd and Clottey countered and held steadfast to the facts that taxpayers cannot legally pay for improvements on private properties and the big win would come from those in SRClub that opposed the sewers… We were always careful to state that PClub got a raw deal and while we felt for them, we could not support their stance… John Thompson after hearing my recounting of Jim Silverstone’s “investigation” stated he was on the board for SRC at the time of annexation and SRC did not ask for the Town to pay for the condominiums sewer bills…only for an equitable sewer bill rate once joining LBTS…He too took a copy of my 2007 budget from SRC which every owner may obtain each year upon request…After looking it over and comparing it to my costs for sewer on my house on Washingtonia along with another resident in Silver Shores, the amounts appeared to be the same…He also found that the amount paid by SRC had increased rom Bldg. “B” which is only 2/3 as large as Bldg. “A” and “C” from approx. $14,000 in 1998 after annexation to $33,000 in 2007 …He added that nowhere in past or current budgets could he find any indication of payments directly from the Town to SRC which would have to be reflected if the Town were subsidizing SRC… He added also a letter dated Feb 4, 1997 from former Manager Bob Baldwin to SRC after a Special Commission Meeting held on Feb. 3, 1997 at noon in Jarvis Hall…and a  Q &A sent to SRC concerning the annexation on Feb 19, 2007 (excerpts below) ….At that time in 2007, Mr. Thompson ended with the following statement …

“I have given all the attached data to a certain Commissioner  and told him I think it would be a big mistake to suggest any shenanigans on the part of SRC. If, perchance, the Town had been paying more than it should have been (for which I find no evidence), I think it could only reflect poorly on the former Finance Director, and that the excuse “only following orders” has been ruled out since Nuremberg, and could not excuse any irregular payments by a responsible town official. IMHO!”

Readers obviously know that Commissioner Silverstone and whomever he was working with in Town Hall (Town Manager/former Finance Director Colon?) did not move forward with their investigation and/or reveal it… A little over a month ago this writer heard from another resident that it appears that LBTS has been paying for SRC sewer bills…I reminded this person of the above incident in 2007 and after that heard nothing until Monday…. I could not believe it was back on the front burner albeit being on the front burner behind the scenes …that is until yesterday’s BTSF came out… On Monday I went back through my archived materials and found the above letter and an attachment from John Thompson and contacted a few people … I also contacted John and told him this was back in play once more… He again reiterated what SRC had asked for …an equitable sewer bill rate ….nothing more …and sent me some of what he had from his vast archives… including the minutes from that 1997 Special Commission meeting …which presents a real eye opener and opens the door for some very heavy questioning about who participated in that Commission meeting…that unanimous Commission vote to agree to annex in SRC and SRLN and what appears to be a conflict of interest both in not disclosing a conflict and perhaps benefiting from any subsidy the Town has been providing  in the last 12+ years without the knowledge of the taxpayers including SRC taxpayers!… OUCH and GULP!…

Excerpts from the Feb 3, 1997 Special Commission Meeting …Noon….

The Mayor was Thomas D. McKane III….Vice Mayor Parker….Commissioners Jim Pollock/Ernie Fontaine/John Yanni…the meeting began at 12:05 pm and also in attendance were Town Manager Bob Baldwin and Town Attorney Jim Cherof…The meeting was to discuss “New Business “Request for Commission direction on points of negotiation for the Annexation proposal”….TM Baldwin stated he originally planned to discuss this item at the last Commission meeting and that he had been “giving presentations to the residents of four Sea Ranch Condominiums”…Baldwin also told the Commission “he attended the meeting of the Annexation Committee of the Broward County Legislative Delegation on January 15, 1997. At that meeting, the committee approved unanimously the Town’s bill to annex the four condominiums and present it to the full delegation. Mr Baldwin added, the Chairman of the Delegation indicated he would like the Town to negotiate the terms of the annexation with the residents of the condominiums prior to the final Delegation hearing.  Mr Baldwin stated two people spoke in favor of the annexation from the condominiums. One of the residents thought the Town could negotiate better terms.”

“Protection of zoning and quality of life- the condominiums are concerned with zoning and height restrictions. ” Baldwin said the condos wanted to make sure if there was a hurricane they could rebuild and wanted their current zoning protected.

“Indemnification from litigation arising from annexation – Mr. Baldwin explained residents of the condominiums are concerned they would need indemnification from any litigation arising from the annexation because of language in the Pompano Sewer Agreements.”

“The effect on the Condominiums water rates”…Baldwin said the residents were concerned about the water rates “but his understanding is they have the same rates as Town residents, so there would be no change.”

“The effect on the Condominiums sewer rates- Mr. Baldwin stated the City of Pompano Beach has indicated they would not be willing to renegotiate the sewer agreements with the condominiums and bring them into the Town’s master sewer agreement. Mr. Baldwin commented his information was obtained by word of mouth, and he is not sure what would actually happen. He added, he thought the Commission would be amenable to coming up with an aggregate sewer rate, in case the condominiums could not be included in the Town’s master sewer agreement.”

“The effect on the condominiums garbage service.”…Baldwin said the service to the condos was provided currently by Southern Sanitation and they would continue until the annexation took place or their contract expired.

“Mr Baldwin told the Commission he would need direction on these items.”…He went on to say he scheduled a meeting with the condominiums a few weeks prior but it was canceled and that he was then invited with the City of Ft. Lauderdale to a Jan 27, 1997 meeting …He attended and there were 30 people who indicated they wanted to delay the bill…After hearing that mayor McKane added the 3 condos had established an annexation committee and the chairman had attended all of the Town’s annexation presentations and the committee would be going in front of the Delegation to request the annexation bill be tabled …wanting more time to look it over… He added he told them he was in favor of tabling and only spoke for himself but would let the commission know…”He added more information has emerged that the City of Fort Lauderdale is actively soliciting the condominiums.”…McKane went on to express his concern over Ft. Lauderdale “creating much of this havoc” and stated he would actively seek the support of SRLakes to stop Ft. Lauderdale from annexing in the four condos… Commissioner Pollock stated the millage rate could possibly be lowered to 3.5000 if annexation occurred and stated the lack of registered voters in SRC and the accuracy of a vote …He was also for annexation .. Vice- Mayor Oliver Parker  stated  he disagreed with tabling the annexation and it was the logical choice to annex into LBTS due to a “two minute response time” from the police vs. Ft. Lauds’s 20 minutes….He agreed the millage could go down to 3.6 or 3.5 and stated the condo boards teamed together for this and something happened blaming Ft. Laud….

TM Baldwin told the Comm. Ft. Laud. “indicated” they were not interested but they came to that meeting to hear they were not only interested but “desirous” to annex in the four condos contrary to what he was originally told…Baldwin stated “he has been dealing in good faith with the condominiums. He told the Commission representatives from the condominiums came to the Town originally, the Town did not go to them.” He went on to say at his 2nd meeting at SRC over 100 people were present and appeared in favor of annexation adding the Town had not received any phone calls against it only calls for it…He added the fourth condo SRLakes Condominium seemed in favor of it…

VM Parker stated it “would be a win-win” and a delay would mean 14 months…He added the Town’s legislative consultant opinion was not to table the bill…and he said the Town should take that position with a “fall back position” of a referendum but he did not want it to go for a vote unless it was necessary

“Vice -Mayor Parker asked Town Attorney Cherof if the contract the Town has with the City of Pompano requires them to dispose of Lauderdale-By-The-Sea wastewater at a particular rate?”

“Town Attorney Cherof responded that was correct.”

“Vice-Mayor Parker questioned whether the City of Pompano would be bound to that rate if the four condominiums came into the Town.”

“Town Attorney Cherof stated it would appear so, except there is another contract that the city of Pompano has with the four condominiums which predates the one with the Town and requires those four condo’s to pay a surcharge to the City of Pompano.”

“Vice-Mayo Parker asked Town Attorney Cherof if the contracts he referenced have a lifespan?”

“Town Attorney Cherof responded that they do have fixed terms.”

“Vice-Mayor Parker asked what the terms were.”

“Town Attorney Cherof told Vice-Mayor Parker he did not have either one of them with him, but the terms were long term.”

Vice -Mayor Parker asked if the contract with the Town would take precedent over the contract with the condominiums?”

“Town Attorney Cherof responded that it would seem to take precedent, but the only way the Town would find out the answer to that question would be through a court proceeding.”

“Vice-Mayor Parker asked if that would be a declaratory judgment action.”

“Town Attorney Cherof responded that was correct.”

“Vice-Mayor Parker commented it would not be terribly expensive.”

“Town Attorney agreed.”

“Vice- Mayor Parker  asked if the Town would be exposed to any litigation if the Commission agreed to the Town Manager’s suggestion of paying a blended sewer rate temporarily, or subsidizing their rate to bring it down to the rate of the Town during litigation of the contract issue.”

“Town Attorney Cherof replied that he did not think the Town would be. He said the nature of the Legislatures deals with these issues would resolve an issue of this type. Mr. Cherof added they have the power through special act to anticipate problems that would arise through annexation and resolve them in the process.”

“Town Attorney Cherof said it would seem to him that a court would be persuaded if the State Legislature decided these four condominiums were to be in the Town of Lauderdale-By-The-Sea that decision would bear greater weight over an old sewer contract where another municipality was charging a surcharge.”

“Vice-Mayor Parker told the Commission he thought the Town should continue with the bill.”

“Vice-Mayor moved to continue with the annexation as is.”

“The motion was seconded by Commissioner Yanni.”

Commissioner Fontaine was also in favor of continuing the bill and added if the delegation wanted a referendum vote the Town should abide by it stating he was against forcing annexation but adding the Town was not doing that…

“Vice-Mayor Parker clarified his motion that it continue with the bill as filed without requiring a vote, but if it became necessary to have a vote, the Town have a fall back position ti agree and put it to referendum.”

“Town Manager Baldwin told the Commission this annexation proposal has always been above board, nothing unethical ha been done. He said the condominiums would agree and never accuse the Town of doing anything that was not upfront. “… He spoke of  two opposing groups with a larger group undecided…”Town Manager Baldwin asked the Commission if they could frame the motion in such a manner so that the bill would continue as suggested by the Vice-mayor, and leave it up to the Delegation as to whether it would go to a referendum.”

“Vice-Mayor Parker stated his motion to instruct the Town’s legislative consultant to continue with the bill as written without a referendum attached to it unless it becomes necessary.”

“Town Manager Baldwin stated the Broward Legislative Delegation has asked for an expression from the Commission as to how they want to proceed with the bill. Mr. Baldwin added the Condominiums  have also asked for an expression from the Commission.”

“Vice-Mayor Parker stated he thought the Commission should proceed with the bill as is.”

“Town Manager Baldwin stated it is really up to the Delegation to decide how the annexation occurs.”

Commissioner Fontaine stated the Commission needed give Baldwin and the legislative consultant “a vote of confidence on the original plan.”

“Mayor McKane asked the Clerk to call the question. The motion made by Vice-Mayor Parker  and seconded by Commissioner Yanni passed unanimously.”

“Town Manager Baldwin asked the Commission if they would address the points outlined in his memorandum.”

“Town Manager Baldwin asked if the Commission would be inclined to attach something to the bill to insure that their zoning would be protected.”

“It was the consensus of the Commission to attach a stipulation to the bill that would protect the zoning of the four condominiums.”

“Town Manager asked Town Attorney Cherof to address the indemnification issue.”

“Town Attorney Cherof told the Commission as he understands it, some people in the condos have asked the Town to indemnify them if they are sued as a result of the annexation.”

“Vice-Mayor Parker pointed out if the Florida Legislature makes them part of the Town without a vote there would be no grounds for anyone to sue them.”

“Town Attorney Cherof told the Commission his recommendation is not to indemnify the condominiums because there is no need to do so. He added it is too broad of a statement to make. He said it would be different if the Commission authorized hum to file a lawsuit for a declaratory judgment.”

“Town Manager asked if the Town would defend them if they were to become citizens of this Town.”

“Vice-Mayor Parker stated he would move if in the event a lawsuit is brought the Town would intervene to defend, but the Town would not indemnify.”

“Town Attorney Cherof stated the Commission should indicate they are not going to indemnify at this time, but you are prepared to take all action necessary to intervene in a lawsuit arising from the annexation.”

“It was the consensus of the Commission to follow the recommendation of Town Attorney Cherof regarding indemnification of the condominiums.”

“Town Manager Baldwin asked the Commission if in the event the condominiums cannot be brought into the Town’s Master sewer agreement would they be willing to have an aggregate sewer rate to distribute the sewer rates.”

“Vice-Mayor Parker stated if the Annexation were to go through the Commission should authorize the Town Attorney to file a declaratory judgment action to bring them under our sewer rate. Vice-mayor Parker said only if the judgment failed should the Commission authorize an aggregate sewer rate.”

“Vice-Mayor Parker asked Town Attorney Cherof if it would hurt the Town’s position if they went on the record stating they would be willing to create an aggregate sewer rate now.”

“Town Manager Baldwin replied the condominiums are concerned they would have a higher sewer rate than other Town residents.”

“Vice-Mayor Parker stated the Town’s response should be the Town will file a lawsuit, a declaratory judgment action to bring the condominiums into the Town’s contract with the City of Pompano Beach. He said they will fall under the Town’s contract rate for wastewater disposal.”

“Vice-Mayor Parker told the Commission if the Commission went on record in advance and say the Town would be willing to have an aggregate rate it would weaken the Town’s position in court. He said it would indicate a willingness on the Town’s part to renegotiate the sewer rate.”

“Town Manager Baldwin stated he believed it was the consensus of the Commission that if the annexation took place there would be some type of reduction of the millage rate based. He said that is essentially based on revenue projections he had.”

“Town Manager Baldwin told the Commission the Police Chief has prepared a proposal for hiring tow new police officers. He stated they would add one new shift, a beach patrol.”

“Mr Baldwin told the Commission the Chief is proposing to add to the  buoy enforcement by buying a Zodiac watercraft. He wanted to make sure the Commission is amenable to some kind of increase in police service in the beach area in the event the condominiums thought it was desirable.”

“It was the consensus of the Commission to increase police services in the beach area if it was desirous of the condominiums.”

“With no further business the meeting adjourned at 1:50 pm”

The Feb. 4, 1997 Letter to John Thompson…

It stated the Commission met the day before…discussed the annexation and they approved several items as follows…

“1. Supported an amendment to the annexation bill, protecting the zoning and quality of life of the condominiums. The Commission committed that the current zoning and land use of the condominiums would be maintained.”

“2. Agreed to defend the Condominiums in the unlikely event of litigation resulting from annexation.”

“3. Agree to take the necessary action to reduce the condominium resident’s sewer bills to a rate charged by the City of Pompano Beach to Town residents.”

“4. Agreed to reduce property taxes following annexation.”

“5. Agreed to add an additional 8-hour, 7 days-per-week police shift to increase patrols on the beach. This would include hiring two additional officers, and buying an additional watercraft to better enforce our buoy project, keeping boats of condos beaches. (cost:$115,000)

He went on to state the Commission decided to direct the administration to proceed with the annexation bill as originally files and if necessary for it to go to referendum the Commission would support that as well…He ended his “sales pitch” ..

“I assure you that the annexation into Lauderdale-By-The-Sea is in the best interest of your residents and the Town. “…..offering LBTS to “continue to strive to be your good neighbors.” if the annexation fell through…

The Feb 19, 1997 Q & A …

It answered the questions on EMS changes …stating it would be the same/Police protection …the above additions/cleaning the beaches and who’s responsible…LBTS would take over/ garbage rates…. explained the above stay with service currently used until annexation then join LBTS same “uniform rate negotiated for all the Town’s residents”

“WILL OUR SEWER RATES DECREASE?”

“YES. The Town Commission has agreed to lower the condominium resident’s sewer fees. The Town intends to bring the condominiums under the Town’s master sewer agreement wit the City of Pompano beach. This would decrease your rates (based on current rates) from $1.81/per one thousand gallons plus the additional flat fee to $1.51/per one thousand gallons with no flat fee. If neither the City of Pompano Beach nor the courts allow this change, the Town will exp[lore other options. The Town Commission is committed to making the sewer rates the same for all residents. That means your rates will be lowered.”

The next question dealt with the Towns FD handling high-rise fires…answer VFD receives extensive training and has 2 new trucks and 25 firefighters…and ISO rating of 4…Pompano has a 4/Ft. Laud has a 3 and mutual aid/ Recreational facilities..tennis courts…shuffleboard..boccie ball..basketball and social hall/voice in local affairs…yes/ zoning of building protected…yes… as stated above/ where to apply for building permits..Broward County / property taxes …lower if annexed in/ annex delayed…could be annexed elsewhere by legislature

BC- Now the questions of what happened…and what happens now….

First of all how was it possible for former VM Parker to not disclose in the minutes he owned property in SRC?…

How was then-VM Parker allowed to vote on this issue?…

If indeed the Town dropped the ball and never made an attempt to end the contract between Pompano and SRC/SRLN or never followed through with a declaratory judgment after the annexation if Pompano was still unwilling to stop the surcharges and the Town is found to have been subsiding SRC and SRLN for the past 12 years hasn’t Parker the former VM – Mayor been in violation of benefiting from what he voted on?…

We heard that Parker has stated the subsidy was in the annexation agreement…

We heard the Town Manager said it is not…

What is really surprising is in the Feb 3, 1997 minutes …it is Parker himself, that does not want the subsidy or any hint of a willingness to aggregate the sewer cost included stating it will cause a problem if this went to court…(see above)….so why state it was in the agreement?

The Town now needs to go back and find out what was in the Pompano/SRC fixed/long term contract Mr. Cherof said he did not have with him on Feb 3rd, 1997 stated…

If Mr. Cherof went to Pompano to change the terms…

If Mr. Cherof was directed to begin a declaratory judgment by the Commission…

Why in all these years those contracts did not run out? …

Why there was no renegotiation as sewer fees increased?…

What impact did the 2001 annexation have and what happened with their rates?…

Do they pay as residents or non-residents with a surcharge?…

It appears from the above what LBTS has been paying is the surcharge discussed from Pompano Beach while SRC has been paying the sewer bill rate that LBTS residents pay….

And of course who knew what ….when…and for how long?…

Did Parker know?….

What if any legal problems does this pose for the two former Town Managers…Baldwin and Colon?…

In conclusion though…as we get to the bottom of all this …it is the hope of this writer that it does not pit neighbor against neighbor…because there is no doubt in my mind the residents of SRC/SRLN and PClub were all acting in good faith and were all kept in the dark when it came to the behind the scenes antics and actions taken by certain people in our Town on all levels…

Here’s The Scoop …. Scene And Heard Around Town … “Bad Eggs”…

THE EASTER BUNNY’S CAR EGGED APRIL 2, 2010 …

Dear Readers … While life is moving on in LBTS and from what most report back to this writer, the general atmosphere in town is upbeat and positive …with one local newspaper out of commission? (pun intended) …. one local newspaper about to go monthly…and a lull of sorts due to the mess-up with the swearing- in date …the mess-up with the 1st Round Table  date and time … (prev. posts)…and the holidays along with Commissioners being out of town until they can meet on Monday April 12th at 6pm to start playing catchup with the overloaded Round Table agenda (due to staff overloading the 1st Reg. Comm. meeting on March 23rd)…Some “dye-hard bad eggs” are still acting “rotten”!…

This writer received not long ago a nasty e-mail from Hannah Hempstead trying to say I did not hear what I heard from her “galpal” , Silverstone Treasurer-wife of former Mayor Wardlaw-BFF of the Furths-and CIC board member Maryann Wardlaw … at the swearing-in last month…I did not respond to Ms. Hempstead…Why would I? ..I stand by my post…I turned as someone asked me about the small group sitting together to support Silverstone …and I absolutely heard Mrs Wardlaw make her most unkind statement about the new commission…no if, ands or buts!……In her nasty e-mail Hannah Hempstead..who may need to answer some Fl. Election Commission questions in the future for how much she contributed to the campaign (the CIC website still incorrectly states $500)….and how it was possible for her postcards which were included in the CIC door-hangers for the CIC candidates to state they were paid for by her without the candidate’s (Silverstone) approval?..It did have his scanned signature… ….One last remark to Ms. Hempstead …working in Hollywood..(according the what the Wardlaws told me long ago) as a producer…I cannot imagine you cannot figure out what “She’s a nasty piece of work means”…Ask around…

Somehow, the By The Sea Future newspapers were again “dumped” at my condominium…Old habits?……A 2-1 loss in all 3 buildings?…. Let your neighbors read the paper …please….

The new commission has continued to receive memos despite asking from day one for scanned e-mails…(prev. posts)..In response…instead of carrying out that “directive”…last Friday they received even more than usual……by way of 7 pages of a memo 4 times  for each of 4 Commissioner (No Clottey?)…for 28 pages for each one  or a total 113 sheets of paper distributed….to inform the Commission that they and their fellow Commissioners (Minnet/Dodd/Sasser/Vincent) were the subjects of changes made due to their re-election/election/change of title…One swift scan could have been sent to inform them all on one page of the switch over …along with the salient pages of the memo…What was the memo that cost 113 pieces of paper to be distributed in their boxes…”Marta has contacted Broward County-Environmental Protection and Growth Management and has requested to have your name added to the mailing list”… and a copy of the Broward County Water Conservation Incentives Program”…113 pages used for an environmental conservation memo…We can’t make this stuff up…

The Commissioners are having a terrible time with their computers…and one Commissioner has tried repeatedly we hear, to inform the town that it is a simple re-certification that needs to be done by the vendor…So far …no such action has been done…and the problem continues…

Word is the Town Manager is “spitting bullets”…over the fact that this writer posted the McIntee Suicide “supplemental” on March 28, 2010… (prev. post scoops, VFD)..  The one that clearly shows McIntee did not offer aid to the victim when he broke the VFD-SOP and entered a house where there was a possible suicide and a gun….He enterd as a “first responder” from the VFD ..TM Colon did not yet have it …and for some reason felt it was for her to have first?..Why?… It was a Public Records Request …and it had nothing to do with her!… Or did it?… After all, it does cast a bad light on her for insisting another VFD member be sidelined from the VFD until he was cleared of any wrongdoing…That case was nothing compared to this one…when it comes to “public safety”…. in this writer’s opinion…GULP!…

And finally there is this …”Bad Egg”….. Apparently the CIC Chair did not read the column next to his own when throwing his ill-will out on their website…..

Former Comm. Jim Silverstone wrote to his CIC supporters and listed what he considered his and his supporters  “accomplishments”…on that CIC site…included was this line…”It is now time to support our new commission and to stay informed. An important fact is we had almost a 40% voter turn out. The average in Broward County was only 9%. We care and it showed.”…

CIC Chair Bob Roberts – To his left-over members ..(if there are any?)…

“The March 2010 election was a different story. The opposition “Old Guard” supporters managed to adopt the same positions advocated by the CIC and the candidates it endorsed, and to convince a majority of the voters that the CIC was the cause of the dissension in LBTS. All three of the well qualified CIC endorsed candidates lost to less qualified candidates selected and endorsed by the “Unite our Town” (UOT) organization. In hindsight the CIC was not sufficiently forceful in getting the word out and encouraging the residents to vote.
Now it is important that the CIC organization remain active as a watchdog over the new administration. If they attempt to undo the major accomplishments of the prior administration over the past two years we must be ready to respond via the petition and special election route to repeal any adverse ordinances. Our aim is to keep Lauderdale-by-the-Sea the charming seaside community we all came here to enjoy!”

COMMENTARY ….

As one “Avid Reader” pointed out….Shouldn’t the CIC be happy that this was the case?….

BC-It’s called evolving!…

Whatever happened to believing in the process?….

BC-…For the CIC to return to being the “watchdog” rather than the “cheerleaders” they were for the previous 2 years… that alone is a plus!… As for the Chair’s “fear-mongering”…”fear-mongering”  is what lost the race for the diminished CIC…and to continue it on afterward…shows why the CIC of long ago is no more….Perhaps with a new Chair… there’s a slight chance to revive it?….

Finally- Note to the LBTS-BSO…Please keep an eye on my house this week…I am not looking forward to “Bad Eggs”…and “Blue Easter Dye”…making an appearance after midnight!…

CANDIDATE JIM SILVERSTONE ….

No one can forget that even though Jerry McIntee is busy filling the “pod” in front of his house to make a move …Jimmy-boy is the heir apparent who has voted along with McIntee without fail…Jimmy was instrumental in following Jerry’s lead in every bad act…on and off the dais… And though he now stands by mute as his fellow running mate for Mayor “trashes” for a vote…no one should give Jim Silverstone a pass for his inept and insufficient 4 years on the dais…aiding and abetting McIntee….Colon….and Furth…

CANDIDATE MARJORIE EVANS …

Candidate Marjorie Evans reminds of that person who comes to the check-out counter and sees the long lines of people standing waiting their turn… Marjorie Evans suddenly spots an empty check -out counter and smugly walks toward it to claim it as hers…So proud that she, Marjorie Evans of her “find”… She has found the answer to those long lines!…Aha!…

Of course those standing in line shoot Marjorie Evans “that look”…because we all know that the counter is empty for a very good reason…. There is no one to checker!…

Now what do you say to a person who waltzes in and thinks she has “spotted” something no one else can see?…

Imagine, voters…we’re not talking about an empty check-out counter…we’re talking about a Commission seat and all those who have stood in line long before Marjorie Evans came to the front of the store!….

CANDIDATE JOE COURIEL …

Mayoral Candidate Joe Couriel is making lots of promises…a “chicken in every pot”… He’s no longer talking “McIntee is God” as he did when his opponent Mayor Minnet had him removed from the hall last year…Nope he’s a quick study…Joe is…McIntee doesn’t play well in front of the condo crowd…so Joe…is trashin’ McIntee…McIntee was good until he wasn’t…

The candidates came to SRClub to speak to the residents…without the candidates…and their tag team ( CIC Chair Bob Roberts, CIC Board member Renee’ O’Neal, CIC Secretary Carol Dickman and her husband Bob, CIC asst. Secretary Gail Albohn, CIC member Peanuts Wick) the turnout was approximately 20… The candidates brought catered food and bottles of wine (will they ever show up on their election reports?) ..They had the By The Sea Times…and handouts…Renee O’neal went to each person giving them the handout and saying to take a look at Marjorie Evans accomplishments (none within Town limits despite being a resident as the north annexed in)…Jim Silverstone went to a couple and told them his dais assertion that the administration has cut down its staff and cost…(not letting on…but knowing Jim perhaps he doesn’t even know the “staff” was moved from Administration to Community Standards in 07-08…and the Asst. TM is listed under that!… OOPS!…

A member of the audience said  “These politicians know ho to wine and dine”…

Peanuts introduced Commissioner Jim Silverstone…he said Jim had been a basketball as long as he was a little kid, as long as he could remember……then spoke of Jim being Dracula and Jim responded he gave him away (pshaw)… Jim thanked the Dickmans and said he looked forward to all the questions… He gave his VFD  resume.. did his commissioner comment spiel about giving back in a positive way…his tired old line of learning more from the kids…He spoke of what he brought in his 4 years…VFD, AMR and saving 2 million dollars (leaving out it was spent on the crappy hotel next door)…He spoke of the 15.5 million dollar budget and how it had  been cut down (leaving out it came from no sewers in the Palm Club and the non- negotiated $300,000 pre-penalty loan repayment)… He told the audience to read the brochures and said they (the commission) were the “followers”…that his “record is good”… (He left out the $160,000 severance to the Town Manager in her contract if terminated that he either knew about and lied about for 2 years or he did not know and voted without reading… He left out the warehouse not being sold and his “it will be a wash in the cost of the crappy hotel…that is now a “washout” and sits idle at 50% less in market value to sell…. He leaves out his identical vote record to McIntee…His vote for McIntee to be Dep. Fire Chief…and Fire Chief despite it breaking VFD By-laws…He leaves out his probable cause found for Ethics violation from Fl. Ethics Commission….He leaves out his vote to allow anonymous letters in Town Hall…to name a few)…

He further stated the following …as he talked about Marjorie Evans who has been involved with “the worst of the worst kid”…OOPS!… when talking of her non-profit organization…He spoke of her grants and her budget being the same as the Town’s…(a point being “driven” home much like the Olympics of the past when each and every time the announcer would point out Nancy Kerrigan the figure skater they would just have to add “who’s mother is legally blind”.)..

Mayoral Candidate Joe Couriel was next and stated he never expected to be standing there…after he gave his bio…CIC founding member…BOA vice Chair (no mention of his horrible participation when dealing with the single family owner who was getting a variance for the Courtyard Hotel…when Joe actually asked the applicant why he needed  such a large chandelier …why he needed wider stairs outside…whey he needed large rooms…prev. post and he conveniently left out the FACT that is is still the Vice Chair of the CIC which is a conflict according to the FL. Election laws.)… He speaks of his involvement in founding the CIC (CAC) …and gathering petitions for referendums…(He leaves out he was fully engaged in the fear-mongering of that time…and he was among the most vocal in the hall yelling crooks and thieves and being removed from the hall…At the Feb. 9, 2010 meeting he said he was proud to have done so!)… He called his activism and the height limits his “contribution to the town”… He said the town was divisive and he was going to change that and contribute (by not getting thrown out?)…

Candidate Marjorie Evans said she runs an organization that is totally funded by public funds (the government)…but unless I missed it a look on google shows $100,000 from Bank of America..Walmart…and other such private companies… Mrs. Evans gets a salary from these public funds of over $150,000 a year…She was false in her first statement coming right out of the box …She stated “Commissioner Clottey was able to get 1 million dollars and turn it into 2 million dollars”…in referring to the 2/17/10 Special Meeting (prev. post)…No one knows if this will happen it is part of the “Jobs Bill”… She spoke of the neighborhood stabilization plan she wants to bring  in…She spoke of getting $150,000 to redo a kitchen (free money in Marjorie Evans eyes)…She said she never went to the condos before this campaign and has had a good experience…so good in fact she knows how to run them all better and it only took a single visit (able to leap tall buildings in a single bound)…She said the condos don’t get the issues…but never fear she’s gonna bring Rep. Ellyn Bogdanoff and the the Broward Legislation to Jarvis Hall to tell the condos about how to deal with foreclosures…and she wants all the condos to have their presidents form an association… (She must not think much of the condo crowd to think they are not up to snuff on legislation…that is certainly not the crowds that I remember seeing at previous condo visits 2 years ago and especially not at SRC)…. She spoke of people in condos not having access to the Town Hall and are “tearing their hair out”..(Who?)… She spoke of a building in the north who was impacted when a building was built beside them and that new building made a “deal with Tallahassee” and took away their sun…(She left out or perhaps she did not know that it happened BEFORE annexation)…She spoke of a condo not allowing access to another and asking them to pay…(What she doesn’t say is 2 law firms in town said it is not a town issue it is between the properties)…She again spoke of a library a historical society …and she will get the zip code changed (She does not say that Congressman Klein, Ellyn Bogdanoff, Ken Keechl and others have all been well aware…as well as former Commissioner with just as many if not more “connections as Mrs. Evans) … She threw a few slanted vies of citizens caught in the middle and “preventing people from undermining people on the dais (was she looking at me?)… She did her Furth fear-mongering…

As previously posted the Furth-CIC endorsed candidates did not follow the rules…they put fliers in every door…The SRC board was livid and received phone calls of complaints…One board member told this writer she wanted to cancel the meeting…She rose to ask “What was the parameter of his meeting?”…She stated they were told 1 sign…Peanuts Wick stood and took the blame (he took the bullet was more like it…because this former CIC member clearly remembers how “proud” we were at the election 2 years ago when “Marvelous Marvin” and the Dickmans went and did the very same thing…look for it again with the Furth-CIC election paper right before the election…SRC Board …a heads-up)… She was booed and not treated too nicely from Mrs. Evans who said that was between Peanuts and the board and had nothing to do with the candidates…A resident asked a “substantive question” …and Couriel took to the floor to talk down McIntee that he did some good and he did ” a lot of bad”…McIntee was “out of line!”… A member of the audience said Couriel was known to have be “explosive”…Couriel never responded to it… A gentleman who sits on the board asked about the kites…

This writer was totally blown away when Comm. Jim Silverstone told the man he passed an Ordinance… (They did not!)… Silverstone even said they needed a license…a tag on the kite and  included many of the recommendations that never came to fruition…Couriel brought up that the experienced kite surfers brought it up (not so)…and they were for policing themselves (partly so)… He put them in the same category as the Tennis court members saying they “offered solutions” (Hmmm)… Silverstone after hearing this writer from the back inform him he was wrong said it was “tabled” (wrong again)…and he “will bring it back”…

Bob Dickman (a nasty piece of work…and Jerry McIntee pal) tuned around and told me to shut up…then said “It’s a good thing we have you” ..nastier still… until his wife made him move…

A resident did not let the Commissioner off  the hook …he asked the first resident when he brought the issue up…the resident responded it was last March…and the second resident said almost a year later… Marjorie Evans said “In my opinion it’s dangerous”…”no compromise in this issue”…She also insisted she herself has almost been hit by kite surfer (She seems to have a lot of things happen to her too…haven’t we seen this before in a commissioner?)…Comm. Silverstone woke up (he had the least to say of all 3 throughout) ..and “What I’m hearing here it, If elected I’ll take care of it!”…”Now I’m hearing it.”…Couriel said “this is why it’s important that people can talk” … Silverstone was totally disingenuous once again by saying “First time I’ve heard about it since last April.”… (Come on… It was removed by VM McIntee after a second day marathon meeting…and no one was there from the kite surfers to the residents…not tabled just dropped…

A resident asked about the fire engines coming with the ambulance…Couriel said that it’s “standard operating procedure”…(false)…and Silverstone said “the cost to the fire dept. is minimal”…”there’s no a lot for the guys to do” and said “they can’t ell from the call”…(Not true…the pager tells them…and the Fire Dept. only gets the page because they have asked to be included in the dispatch)…Couriel said they get $25 a call and Silverstone said it was $10…Couriel repeated the “if they need to knock the door down” ploy…Rare it would be called for and AMR would get them there in minutes (Neither one exposed the prior to returning the VFD to action statements of no need for this to happen with so many paramedics and ambulances available from AMR)… El Mar Drive was addressed and Silverstone talked up the free money in matching funds again as if it were a done deal… He id a John Kerry “First he was against the medians…before he was for the medians”… and now just like the kite surfing he hears it now…and the people didn’t want it…He also said the sidewalks will be dug up for new drainage… Couriel grabbed the “gold ring” of free money for the project as well saying with a million they’ll do the south and with 2 they’ll do the north as well (HUH?)… Paul Novak asked about Marjorie’s assertions for the funding asking if if was realistic… and she was very emphatic…then she went off on a disturbing junket off explaining it as if it correlated to LBTS being “specifically mentioned on a google for the “tidal surge” and that the Oriana build the 1st floor parking for this reason… She started to talk about New Orleans…when I shook my head …she asked to respond I stood and Peanuts Wick went wild…I said she asked …she said she asked and I sat back down…(Oriana info was off and I wondered if that meant she was for 3 over 1 on El Mar?…OOPS!)… Paul spoke about matching 1.5 and then Marjorie let it slip she was in “conference” with the Town Manger to get the low-down…she said the TM told her it was a million needed in cash to match the million …for leverage…(Fancy that…the TM could not come to the MPSC meeting or the Special Meeting…The TM could provide no backup for the Commission for that meeting …but the TM could be “Political” and inform 1 candidate over her Commission and the taxpayers…OUCH!”)… The west warehouse was asked about and Jim Silverstone again said the hotel was purchased to have room…(no more trailer illegal excuse as was used from the get- go) …He said he didn’t know why they bought the warehouse (off-site away from town for records in a hurricane)…He said we move the development trailer when we have to evacuate…(since when..never happened)… Tried the complex excuse as well (not true)… A resident asked if the candidates belonged to a party …Marjorie said the “only way to run is supported by the UOT or the CIC”…you “can’t run independently” and “I don’t think it’s a great idea.”…. Again with the library…and astonishment we have no “bookmobile”…when  a resident pointed out 2 libraries close by…Mrs. Evans showed she does not handle being taken to task all that well …”You think it’s a bad idea?”..”Here’s what I’m trying to say. I’m 67, do you think I never made a mistake.”… Couriel took off and said they will expand the Senior Center add a  library after school activities and save the “equivalent” of  $400 per child by not having to take them to activities over the bridge (HUH?)…An audience member leaned over to say The others [Sasser, Vincent, Minnet] were much more professional”…. A question of empty real estate and Marjorie’s got a way to get “free money” for that as well…the neighborhood stabilization …allows getting people to move into them…More “government money”… She again poke of Ellyn Bogdanoff…to give relief…(Do the Wardlaws know their candidate is talking up the Republican Rep….after all they boycotted her speaking at the CIC a few years back)… Couriel piped in “you’re the troops”…talking of a letter writing campaign they can all do together to Tallahassee  and Washington…and stating Jeff Atwater knows Ellyn Bogdanoff (YIKES!)… Marjorie spoke of the confusion with having 2 newspapers and saying her “Idea is to present people with analysis of both sides”…”Not from both papers!”…(Do the Furths know of their demise?)…..Back to the volunteers where a speaker incorrectly stated that the Mayor voted against the VFD…Mayor Minnet voted FOR the VFD contract in a 5-0 vote!… The candidates did not straighten out the mistake (that would have taken some sense of right and wrong)… Marjorie (she spoke the most)…said “half the people did not want the VFD “the VFD won “…”We got them and now everybody likes them”…Couriel added that folks liked the BSO and the south did not know the they liked them (HUH?)… He said “people thought our police were very good. BSO is now good. People are happy with the VFD.”…He wants to do a special mail in election to decide the vendor for supplying police protection… Waste management and Choice came up with Jim saying he was the 1st to want to bid out for Waste Management but was lied to and told no one would compete (Actually what happened is LHP did just that could not find any bidders and Waste ended up raising the fees)…He told the McIntee in Orlando story (without the $500,000 gala they attended put on by Waste which wowed them both!) …He again misrepresented the Waste and Choice contracts ..(Has ever read them?)… He incorrectly stated the TM words of saying some residents have been paying for others (nope)… He went on to add a “Marjorie-ism” by saying she will keep them out of jail…by seeing no gray area (HUH?)… Couriel tried to tie the problem into the codes (HUH?)…And Marjorie …again looking for free money said “I think I can assist”…she said she could “get them to give something”…Choice already has that in their contract (Did she read the contract?)…more discussion of the higher costs to the condos SRC included…Asked about the demographics Condos vs the houses…no one knew right away then took a guessed 50/50 …with Marjorie “lifting” from this writer that SRC has enough to sway the election…Silverstone talked districts…saying they are over in 2012…(Not so fast read the Charter)… Couriel agreed… Beautification came up and talk about the stores with Couriel calling the “Tacky stores”…”Seedy stores”…Silverstone did his turn of the “vision over the bridge when you enter LBTS”…(Must be an after Siesta lesson at Town Hall East)… He said they did not have the power to change the shops and talked parking…and also talked of Marjorie’s idea for sidewalk cafes and Bed & Breakfasts…she want s new ordinances…and said they are not allowed…(The Little Inn is listed as a B & B…and sidewalk cafes…when she met with the TM did she not learn that it was TM Colon who took everything off the sidewalks …such as the longtime bench in front of the ice cream shop? with a big assist from galpal Comm. Clottey?)…… Paul Novak countered on the validity and the taxes for land …and Paul addressed the parking requirement hindrances that keep these very businesses away … Never fear Marjorie had a “story”…(I’m getting McIntee vibes from this candidate and her “stories”)… She said on Super Bowl weekend she stayed at a hotel for $144 and it was “dier cheap” (Taco Bell Inn?)… she wants to upgrade the clientele… Couriel again talked old codes…outdated codes and spoke of bringing them into the 21st century (HUH?)…and this one’s for Sandra Booth…Couriel said he wants to bring that “New Urbanism, the latest fad in town”… (He must have missed the meeting when Sandra brought Elizabeth Plater- Zyberk here a few years back)… Couriel had his “Over the bridge” moment…wanting a brand like Boca Raton ( Up is down and down is up in the Furth-CIC campaign)… The Boardwalk was brought up and Jim could not recall it’s over and done… but to get a vote he said the resident had his “commitment” he would not support it…Marjorie has yet more up her sleeve..with talking of a new Master plan…she has an idea to have citizen input…(Now remember folks…this is the candidate that never attended a MPSC until last month when she cam after announcing and proceeded to insult the entire committee)…Joe had more up his sleeve as well on this “free money” train campaign… he spoke of “any money that doesn’t come out o our pockets”…(Federal money does not come from our pockets…HUH?)…said he heard from someone we should go for federal money for lifeguards…get or foot in the door…Paul Novak asked about borrowing money if the Town is “debt free”…..rates are low…. Marjorie (again)…said she was going to do things “exactly as Esther Cole is doing with her budget”(OOPS!) …(Piecemeal and in secrecy?) …She then mis- represented her opponent on his stance with the Senior Center funds..and decided for good measure to do the same and misrepresent Silverstone’s opponent as well…The question turned to Bert J. Harris and Marjorie told a story (see a pattern here?)..She said at her business she employed a Haitian and she fired him…he said it was because he was Haitian…She went to an attorney…She says the attorney told her t pay the Haitian…she said she did not fire him because he was a Haitian…but because he did a bad job…She said she found another attorney…then she said she wrote a letter herself…then she said she ended up not paying anything…She feels the Town will win in the long run…Joe Couriel agreed … Asked about port a potties…Silverstone decided to chime in…he spoke of restaurants in the original plans but it was a NIMBY for most…(leaving out it was his Fiancee’ restaurant.)… . He was for them ….somewhere…sometime…Music was next…and Silverstone told the “Athena Brothers story about coming to McIntee saying it wasn’t “fair for Dave Gadsby” and “we allowed it”…He spoke of the noise ordinance and his being “trashed lately”…He said “I probably spend more money than anyone else”…downtown on the weekend nights…He went on to his “balance spiel” ..Couriel want s more music…Sundays…he wants to make LBTS a “”entertainment mecca”…Destination”…(Isn’t it already…Quick somebody give Joe the Chamber Tourist Guide!)…Paul Novak spoke of the Chamber and the Commission not helping support it…Marjorie (yep, again…who knew she could out talk Couriel?)… She said she belongs the the Pompano Beach and the Fort Lauderdale Chambers…she had asked for the Chamber books for she was going to find a way for them to balance their budget…and was disturbed by who belongs and who does not in and outside of town…Paul took the opportunity to tell all of Taste of the Beach a way for the Chamber to get some revenue…and ever the hypocrite Jim said it was a great time…thanking Paul…(Jim voted down the full budgeted funds and backed the TM as she shorted them -prev. post)…Next up was a theater group and …you guessed it Marjorie has that too…(Just keep saying McIntee…McIntee…McIntee)…

I could take it no more…I stood and said what I have written…I told her where has she been for the last 9 years?…She is going to tell the Chamber what to do after a few weeks after saying she belongs to the Pompano Beach and Fort Lauderdale Chambers but not the one in her own town…She walked into Jarvis Hall for the very 1st time when she announced her candidacy…Why start as Commissioner?..

She responded that her husband was very ill and she survived cancer…she had a business to run and she was picking up the gauntlet..

I responded I knew her husband…He was the secretary on the CIC…when I was the Vice Chair…he was not a Commissioner…nor was he active to this extent…I meant no disrespect for her husband, but her reason was, in this writer’s opinion just another “story” (McIntee)…

She asked me (again, she does not take being called out well)…why didn’t I run…I said I would answer and explained…My daughter is expecting my 1st grandchild and is getting her PHD and I am going to go to help out and would not be able to serve…(cannot miss 3 meetings in a row)…A few of their pals in the audience were quite verbal saying that my reason was not valid (HUH?)…

We went on to parking…and the loss of the  non-metered spaces …Joe Couriel had a plan a $75 dollar sticker to fix it once and for all!…It was Peanuts who said we already have one for $21!..(Guess Joe forgot it was he who came to speak for the $21 beach parking)…Talk ensued about where to get one…and it was Joe who got perturbed when he spoke of non-metered parking “all over the place”…asked where he said Commercial and Bougainvilla…when countered he tersely replied “You don’t see them, I do”… (those spots are special permit spaces)… Paul Novak asked Marjorie about the Historical Society and the Chamber being considered…she sad “Perfect”… (does she have free government money for this as well?)….He added that the Town wants to put an aluminum roof on it (TM denies it although 2 roofers and Director Prince told the Chamber it was so)…….Marjorie said she already had a “Guy” who has all the stuff… (That can only be CIC-Furth Pal and advertiser Jerry Sehl)…

It ended…and a  couple sat down beside me and asked me to answer some questions …I did…I explained the 2 million dollar hotel…the warehouse that is sitting idle…the $160,000 termination severance to the Town Manger…and the problem I have with all three of these candidates… I gave them the info on my site and told them to check out the facts… and I do believe that anyone who checks them here and then checks the Town videos will see they are the same…

Not happy with the outcome?….

After the meeting Bob Dickman approached me…I asked him not to speak to me…I always wondered (as did many others in SRC) how he ended up a close pal to McIntee after I departed the CIC ..and tonight I found out…When it comes to being looney…telling outrageous stories of things that NEVER happened … Bob Dickman sure showed this writer…he can sure give Jerry McIntee a run for his money… Nasty…big mouthed and telling total fabrications…It was truly sad…truly, truly sad…But his guests… Comm. Silverstone, and Renee O’Neal drank it up…like Kool aid!… YUCK!…

Dear Readers … The e-mails and texts were fast and furious with news that a “pod” was outside on the driveway of the outgoing Vice Mayor’s house (March 9 & 15, 2010) …

We hear many have asked if a permit was obtained…could be just another one that slid through the cracks…(pun intended)…. We have also heard the cars that are left seem to head north when leaving the neighborhood…No one has seen hide nor hair of the VM and Mighty Moe…BUT a Truth Detector has told this writer they were sighted in a Pompano Beach pizzeria a few night ago….

Hi Barbara: I just returned from the corner store, and as I drove into my driveway I noticed something on my front lawn. Someone had obviously took a stack of By The Sea Future newspapers from one of the stores, and dumped them on my front lawn. Just how much lower can they get. I was surprised they did not steal the signs I have up.

I called BSO and they are going to come over and make a report. These people are just unbelievable.

BSO did come to my house, and wrote up a narrative report, with a case number. Not much they can do. I did take a couple of pictures which show the front page of the paper on the lawn.

Received last night about 11 pm….Now Ron has seen this many times before…in elections of the past….BUT…Readers first the BTSTimes felt threatened enough by the latest By The Sea Future coming hot on the heels of the first debate…and decided they needed to send a news blast to reaffirm their 2-part 2-paper propaganda to try and keep their heads above water… and it seems that it was not enough…so the scoundrels decided to pull a “mighty Moe” ala the MIA papers in the Village Grille a few years back….and take and dump the opposition’s  papers at the home of their distributor!…Desperate moves in the home stretch….

My wife and I stayed at the Blue Seas Courtyard for a four night stay in November. We made the selection after reading Tripadvisor reviews. Contrary to another post, the motel was exactly how it was protrayed in reviews. We had a suite which was a great value and very comfortable. Housekeeping was great and the staff/owners friendly and helpful…. more

This hotel is not representative of the beautiful Town of Lauderdale-By-The-Sea. The owners run a newspaper and it is obvious that is all they care about. No contact with the guest except to make comments about the paper. No beach access from this hotel. For this price, get something on the beach. There is much more to choose from in… more

Question #3- “Let’s talk about the height limits. The repetition of height limits that have been on the agenda when the referendum are clear and they should be enforced. How do you feel you will discuss what your opinion is on the height limit controversy. Where do you fall in on this issue?”..

COMMISSIONER SILVERSTONE’S RESPONSE- ” This is an extremely important issue that has BEEN TAKEN OUT OF THE HANDS OF OUR COMMISSIONERS AND PUT TO THE PEOPLE WHERE IT BELONGS. YOU HAVE THE POWER TO CHANGE THE “HEIGHTH”. WE DO NOT DO HAVE THAT. And that’s the way it should be. That’s a very important issue in this Town. …..”BUT THE POWER TO CHANGE THE “HEIGHTH”, THAT’S UP TO THE PEOPLE AS IT SHOULD BE.”…

We hear that the Commissioner’s opponents Minnet/ Sasser/ Vincent when calling on the voters throughout this election…from the start and continuing on to the present are still being told that Silverstone/Evans /Couriel are “fearmongering” contrary to Comm. Silverstone’s 2/16/10 debate response to question # 3!…OOPS!…

VOTED IN WHEN EXACTLY?….

On April 14, 2009 the FPL came to Jarvis Hall and discussion ensued about the turtle lights and shields… keep the lights on…or turn them off…(pg 2-3) the jurisdiction VM McIntee asked “whether any Towns under FPL jurisdiction had gone under Commissioner Clottey’s idea to light every 3rd light.” The Rep. said she had no knowledge of that “and that every 3rd light would be determined by the Wildlife commission.” …VM McIntee “questioned how the Town could be fined for not turning off the lights if there was no fine for non-compliance?” “Attorney Trevarthen said the decision would be up to the Commission” … The VM said safety of the people “was more important and supported leaving the lights on until it became affordable or a grant was available for light shields.”…”Manager Colon advised a code that there was a code in place that prohibited and mirrored the Broward County Administrative code. She believed the Town would be in violation of the Endangered Species Act.”…”Commissioner Dodd inquired how long it would take the Wildlife Commission to approve different lighting.” …The Rep “advised it was a long process.”… The Mayor thanked the Rep and said “She believed the Commission had to think about it.”…

On April 28, 2009 pg. 2-”Presentation regarding turtle lighting-Green Light Go (Commissioner Dodd)… Green Light Go gave LED lighting solutions…Commissioner Clottey about where lights were going up and costs … “Commissioner Clottey asked for clarification that the Town could not be fined if the lights were not off. Attorney Trevarthen said the language in the Florida Statute that referred to sea turtle lighting “should” and “not shall” and there was no fine attached”… “Commissioner Clottey asked again whether the Town could be fined and Mr. Capotosto said they could.” … She added” fines had been issued and were being paid.”"Mr. Capotosto believed a standard cobra head was $175 to $200. Commissioner Silverstone believed the Town should determine which lights did not affect the turtles and turn those lights on for minimal lighting and shield the remaining lights until more information was available on LED lighting.” “Commissioner Silverstone thought the town should focus on the current safety factor.” “Vice Mayor McIntee did not want to install lights on poles we do not own…Mayor Minnet asked about the Turtle Ord. in place..The Town Atty. said we have one but the State and County do NOT require it and it could be repealed…Mayor Minnet recommended a workshop…and and contacting the Wildlife Assoc to attend.”..

This writer previously posted Comm. Silverstone stating shields were going up on the lights on El Mar and “seeing the plans ” with Municipal Director Don Prince…They are up on some of the posts but I cannot from the minutes find where it was voted on by the Commission and again the Town Manager did NOT use her Town Manager report to address they were purchased and to be installed…Unilateral because it was under $15,000 not needing any Comm. vote?…Even so, it should have been discussed with the dais…

Must be big time politics, they are actually serving WINE, in addition to hors d’oeuvres (spelled wrong on invite), coffee and dessert! Very fine print says “Pd. Pol. Adv., etc.”
FUNNY ALERT THAT SAYS IT ALL… On the Flier …. Come and meet the Candidates…”THEY WILL TELL YOU EVERYTHING THEY WANT TO HEAR”…Finally something factual!…

SRC RESIDENTS….COME MEET THE CANDIDATES … WHO CAN MAKE A POSITIVE CHANGE ….

Dear Sea Ranch Club Readers … The time is finally here…2 years ago I came to many of you and told you I was backing candidates Wick, Clottey and Dodd…I had  literature distributed to you when you asked and talked them up in mailroom, the lobby and anywhere else I encountered many of my fellow SRC neighbors whether on the grounds…walking El Mar Drive or running into many of you at a weekend night special events downtown…I had their lawn signs on my car in the parking garage and I brought them to a meet and greet in the Ocean room for questions and answers… The response was a first for SRC…For it was SRC that decided the election and put candidates Clottey and Dodd into office…Wick was a close one as he lost by only 16 votes…

I was overwhelmed by the response from these 3 buildings…and of course very happy that all would be right in LBTS with a new majority on the dais…

Unfortunately, that euphoria was short-lived…Right out of the proverbial gate I was left with egg on my face when to my horror it became apparent that another agenda was in place that I was not privy to!… I felt like someone had kicked me right in the gut as I watched a series of votes on the dais that ran counter to the campaign promises made and the good faith messages I delivered to my SRC neighbors on behalf of the CIC and those incumbent commissioners who were now elevated to roles of seniority on the dais…There was alot of “splainin”‘ to do as I walked around our grounds …ran into you all in the garage…in the elevator and at SRC meetings…and I could not!…I hung my head as you all asked what’s up with the new compensation for the commissioners…the insurance…the cell phones and most importantly…why did “they” purchase “that building”…”That crappy hotel for $2 million?”…  With my head still hung low, I was apologetic in my replies, chagrined by my ignorance  of this “need to know Mc-Furth” agenda and quickly angered for being hoodwinked…I felt true remorse for going out and offering up to my neighbors assertions of what would be coming with a new majority in place ….assured fiscal responsibility and a willingness for inclusion from both politically opposed factions…finally…It could not have been farther from the truth!..

I made a vow that I would do whatever it took to rectify what I helped create in 2008…..Over the last 2 years I made it my mission so that my neighbors in SRC and the taxpayers and voters of LBTS would not walk into the election booth or send in their absentee ballot for the 2010 municipal election without having all the facts… I presented them on this site…each and every day…throughout the day …Those who were impacted by the postings quickly exposed… and they fought back with countless threats…a Mc-Furth nasty anti BCbythesea site…and constant mudslinging that never stuck…despite their best efforts…

SRC neighbors, over the past months you  have again asked me I who I am endorsing…You have looked at my cars (2 this year) with the lawn signs of those candidates in the building’s garage…You have inquired if they they will be coming to speak…. and the answer is yes…I hope you will come to the most important part of my “making amends” to make up for the last two years…Come and meet the 3 candidates I support for the LBTS Commission … Mayor Roseann Minnet…District 1 Candidate Scot Sasser ….District 2 Candidate Chris Vincent…in the Ocean Room at 7 pm…It is for SRC residents only…and offers you the opportunity to hear them…and to ask them questions on the issues…

Although I did not back nor vote for Mayor Minnet, I watched our Mayor grow into her role with each fiscally responsible vote, She did her job with her head held high no matter what was being orchestrated around her to demean her as our Mayor and as a person…Mayor Minnet was the only member of the dais who voted no to the extra compensation of insurance and cell phones for commissioners…..The only one who voted no to the $2 million dollar public safety building…Mayor Minnet, if you watch any video online from any commission meeting over the last 2 years was the only member of the dais who was short and succinct in her allotted time whether it was in her concise questioning on agenda items or her prepared Commissioner comments as she presided over the meetings…As I have often said to you, my neighbors in SRC …with each and every one one of Mayor Minnet’s fiscally responsible votes…”Her stock went up” in SRC with the voters and taxpayers alike!…

Her running mates Candidate Scot Sasser and Candidate Chris Vincent are cut from the same fiscally responsible cloth…Each is on record for saying they would have voted the same as the Mayor if they were on the dais when it came to those early 2008 votes…Both gentlemen are fully supportive of the VFD, AMR and the BSO Police as is the Mayor……. A look at public comments for the past few years shows that these two candidates were involved and engaged long before they decided to run for their respective seats on the dais on March 9, 2010…

As a voter and someone who knows the specifics of what is happening in this Town… I can tell you that Scot and Chris will provide you, the residents of SRC   the kind of representation, accessibility and accountability that has been missing over the last 2 years…

All three candidates have made it abundantly clear they fully support our Town Charter for height limits and will always look for ways to enhance LBTS in maintaining and retaining our ocean views and ocean access along with finding innovative ways to assist with our tourism and downtown businesses ….

Good evening, my name is Scot Sasser and I am running for Lauderdale-By-The-Sea Commissioner District 1. My wife, Teresa, and I are raising two children here and we want to retire here. We chose Lauderdale-By-The-Sea because of the charm and uniqueness we saw in this quaint beachside village. I am telling you this to say we are “all in” here and want to ensure that what we hold dear is preserved for all of us as well as for future generations.

I have been involved for quite some time, attending commission meetings, voicing my concerns, meeting with citizens in their homes and, most importantly, I’ve been listening. Through my involvement I have learned that you, like I, have the same concerns and that you think it is time for a change.

I want to return a sense of professionalism, honor, dignity and ethics to our local government.

The office of Commissioner is not one to take lightly and I assure you tonight that I am up to the task.

My experience in business has taught me the importance of respecting different opinions, cultural differences and the ability to find solutions through these differences.

“Good evening ladies and gentlemen and thank you for joining us. I would also like to thank the League Of Women Voters for putting this event together. My name is Chris Vincent and I am your candidate for commissioner for District 2.

My wife Christine and I have lived in Silver Shores for the past 8 years with our nine year old daughter Paige. We chose to live in Lauderdale By The Sea and raise our daughter here just like Christine’s family has for the past 35 years.

I have always followed our town politics by either attending meetings, or watching them at home. Over the last few years the decorum on the dais has been disappointing. I no longer could sit back and just watch. I began addressing the commission on issues and decisions that have been made in haste or due to personal agendas.

As I have gone door to door many of the residents and businesses that I have spoken with feel the same way. It has become obvious that certain commissioners have not listened and voted against the will of the people and the recommendations of our boards and committees.

I understand how important it is to listen and respect others. I’ve been doing just that for 30 years as a business owner… I’ve listened to my customers, my vendors and my employees, this has allowed all of us to reach our goals together. I know how to budget… cut costs… and make ends meet. These challenges build character, integrity and has taught me fiscal responsibility.

WALKING IN THE MEDIANS? ….

“Herding is the act of bringing individual animals together into a group (herd), maintaining the group and moving the group from place to place—or any combination of those.”

Dear Readers … The Sea Ranch Club walkers of El Mar are “horrified” … and will not be “herded” into the center of El Mar Drive to walk on the medians…They will continue to walk in the street and on the sidewalks just as they always have!…The walkers of El Mar do not feel they need to be “educated” to walk down the center of road from Pine to Palm as was suggested by Ocampo and Associates at the Round table meeting on Dec. 7th!… The walkers on El Mar have never complained about the lack of “shade ” …as Vice Mayor McIntee tried to lob onto as an excuse to use the Oriana million to start piecemeal in the south end medians… The walkers of El Mar are not “happy” with McIntee, Silverstone and Clottey and their vote to disregard the MPSC and go ahead with this project despite the overwhelming sentiment to abort it until the board and possibly a new commission can further look into the whole of El Mar Drive and get this one right!… McIntee saying this has been in the works for 2 years is full of his usual bull-y pulpit you know what!… He was not involved in the actual process at all…It was done by the students of the Art Institute in record time…a matter of weeks…not years (prev. posts under boards)…and then crassly ignored by the same majority on the commission who now are so quick to get this done …(also previously posted)…Vice Mayor McIntee disingenuously tried to say they needed get going on this for the MPSC and Vice Chair Sandra Booth…Sandra Booth came forward at the meeting on the 7th (along with Chair Paul Novak , and member Bob Eckblad) to say she too felt it should not go forward …. but McIntee did not want to pay heed to her…especially after he threw her a “bone”of “praise”……The residents who live at the south end of El Mar do not want this done…and this writer is unable to come upon anyone who does!… Just three commissioners who do not walk El Mar Drive…and do not live on El Mar Drive…but feel the need to spend 1 million dollars to have Chen and Associates start a project that will cost the Town until a new commission can come in to stop it!…

If Readers look at the archived minutes from 2007… they will find much earlier than this in the “lame duck” days of the previous commission it was then-Commissioner McIntee…Commissioner Silverstone and the commissioner- candidates for the upcoming election who routinely voted items of much less importance and with far less financial impact to the taxpayer to be tabled for the new commission to decide!…

Just Saturday there was a Sentinel news article about the Furth’s pals from “Cry of the Water” ( with no RFP from another group!) and the $20,000 for a “Marine Park” payed for by the Town (5-0 vote in Oct. prev. post) …It included the “plans for meetings for public input and form a group of citizens that will create the management for the park”…Hmmm…They’ll do it for a $20,000 investment… but for a million… it’s over…and done…kaput…time to move on… says McIntee..Silverstone and Clottey…after McIntee stood his ground in a back and forth dialogue with MPSC Chair Paul Novak who expressed the views of the Sea Ranch Club “walkers”…and said “You can’t make everyone happy.”… His “gang”promptly  joined in for the 3-2 vote…to throw out a million dollars on a few medians in the south…ready to see if the “sheep” can be “herded” to go to the center and walk from Palm to Pine!… Bahhhh …HUMBUG!…

Below are the excerpt comments made by candidates Scot Sasser and Chris Vincent at the Dec. 8, 2009 Commission meeting on the median expenditure….and a letter from a concerned taxpaying resident…who wishes to remain anonymous…

“Let me first thank the Commission for holding the round table discussion on the El Mar drive street-scape project. I found it to be informative and it helped me to understand just where we are in the process. With this in mind, I would like to take this time to put forth some questions and suggestions regarding this important project. Since it is obvious that we are in the very beginning stages, having not yet come to a final decision on overall look of the project, or whether or not the project will entail all of El Mar or a fraction thereof, might I suggest that we not rush into a decision to appropriate funds just yet? This is a very important project that does not need to be piecemealed together. This is our time to get it right. From the discussion last night it is clear that the project will cost more than the $980K which begs the question of where the other funds will come from. As several Commissioners pointed out, the projections point to a decline in tax revenue over the coming years due to the declining real estate market. Knowing this should place emphasis on the overall plan. We should realize that what we do not finish now could go unfinished for some time. There are also rudimentary questions that should be asked before moving forward.
• How would the proposed stamping of the asphalt affect the surrounding area since it will create noise as cars drive over it?
• Can we get a sample or see a sample of the proposed stamping to make sure it looks appropriate? Perhaps if we can see it in actual use somewhere it will help us answer the noise question as well.
• What is the long-term plan to tie in surrounding areas to create the look and feel we want downtown?
• Is there a way to begin all of El Mar and phase in instead of taking a fraction?
• How would spending this money affect our ability to complete infrastructure changes such as much needed sidewalk repair and torrential flooding at the pavilion?
• How will this dovetail into the budget in the coming years and is there a plan for any financial overruns?

I realize we are very early in the process and that many of these types of questions need to be flushed out but that is my point. Let’s “measure twice and cut once” as they say. There is no reason to rush into spending $1MM now just because we are still at the starting gate after a year has past.

“I would like to address two separate items this evening.

First regarding the Master Plan Workshop yesterday.

It was clear that the board was not in favor to move forward with the current plan on the table. They were given 3 new options to consider and we should allow them the time needed to do that. They have invested a tremendous amount of time and effort with this project and have a willingness to get it right the first time. Allow them that opportunity.

Please do not rush to spend the funds. There is no need to do that. The roundtable was a good start.

Many important issues were raised and should be addressed. Have additional roundtables until you get it right. The attitude of lets just get it started is really not having a well thought out plan.

You need to trust your boards recommendations, anything less would be disrespectful.”

“The Lauderdale-By-The-Sea Commission voted 3 to 2 on December 8, 2009 to proceed with the El Mar Drive project. During the discussion leading up to vote some comments were made that were misleading (or as they say in Washington D.C., disingenuous), and irresponsible.

At the Roundtable Workshop Meeting the prior night it was clearly the wishes and recommendations of the Master Plan Steering Committee (MSPC) that the entire project including the medians, drainage, lighting, sidewalks, paving, etc. be evaluated and developed into a total plan so that a determination could be made as to the total cost and future sources of funding. While the Town may only have approximately $1 Million available at present, it was brought up that there might be local, State, or Federal Grants available in the future, that debt service on loans might be affordable in the future, and that an overall long-term plan should be developed before proceeding.

That, clearly, was Commissioner Dodd’s and Mayor Minnet’s interpretation. It didn’t sound like it was the intent of the MPSC to move forward immediately with the median project south of Commercial before agreeing on an overall plan. It was irresponsible of the Vice-Mayor to support concentrating on spending the $1 Million now and then say, “hope for the best.”

The overall cost of the entire project was projected to be approximately $5 Million, and if the Town borrowed the $4 Million balance needed the annual debt service would probably be in the range of $500,000, certainly a possibility worth considering, and not just dismissed out of hand.

Our elected officials should take a proactive role in planning for the future and not govern by the seat of their pants, or dress as the case may be. Successful organizations all have strategic plans, plans that can be modified as time goes by and circumstances change.

The Master Plan Steering Committee is canceled for Tuesday evening (12/15/09) …… and so far there have been no RFPs advertised in the Sentinel…But if the Town Manager reacts to this 3-2 vote as this writer expects her to do…”directed” by her pal Vice Mayor McIntee ( ala the anonymous letter -prev. post) it will be in there well before the Jan 12, 2010 first commission meeting of the month…depleting the million…for something it seems only 3 people, presently with power on the dais want done…

Vote for a new majority on March 9, 2010….and let the CIC- Mc-Furth Gang know that the LBTS taxpayers know full well…….when people are herded it is often known as crowd control….

WHAT’S UP WITH THAT?….

We hear,  from an observant resident that the turtle eggs are being moved!…This resident said she saw it and asked and although it was stated at the recent LBTS Turtle Workshop, that this was no longer being advised…it is in fact happening here!…The response to this citizen on why…was it was due to the noise and the lights…The eggs are going back into the sand by Sea Ranch Club…HMMM…July 4th Fire Display from that area of the beach…thanks to the Mc-Furth Gang and the turtle eggs are suddenly being moved?…OOPS!…

We hear the VFD has been out two times this week spraying foam on the building at the SW corner of Commercial Blvd. and Bougainvilla…for bees…After visit number one they left it looking like Christmas …..with caution tape across the streets access onto Commercial…Day two brought them back for another round…and more foam…more caution tape around the front of the empty store….Questions being asked…what kind of foam was used…environmentally approved foam that will not cause problems for our water system?….OOPS!….

We hear the VFD once again chose to follow AMR on a medical call for a gentleman at the Beach Pavilion…who had chest pains…The firetruck was parked ion El Mar and crew was standing around…..We hear they were blocking the entry to the Pier parking lot and  were not too quick to move …that is until cameras starting clicking! OOPS!…We hear as first responders there is nothing the VFD could have done for this type medical call……So why take the truck out in the middle of the day to muck up traffic in the middle of town?…OOPS!

On that same day, last  Thursday the schools were out…the beach was packed and the water was choppy…this writer and daughter were at Aruba Beach Cafe’ for lunch and never observed any VFD- Beach Patrol on hand to cover such an active day…Despite reassurance from the VFD Fire Chief afterward upon picking up a public records request for the Beach Rescue incident reports (to be posted later) that they were out there…a look at the firehouse as we left showed the ATVs there…OOPS!…

The new canopy is now up for the firetrucks…and we hear now there is no room for the VFD boat that was stationed alongside?…OOPS!…

We hear there is to be a shade session at 6 pm on Tues. June 9th…in between the 5 pm budget workshop and the 7 pm Commission meeting…BUT…the Town is supposed to respond in filing a motion by June 8th!…So that means the Town is either filing a motion PRIOR to direction by the Commission or missing the deadline!…OOPS!…

Usually the Commission meeting backup is ready by 3 pm the Friday but yesterday, at 3 pm we were told they were just getting started due to an item being added late…HMMM…A big no no according to the agenda deadline rules…so no backup in Town Hall we were told…that afternoon before Town Hall closed at 4:30 pm……although it would be online shortly before or after close of business…(it was)…The item..it seems was Comm. Silverstone’s…new business…..while an item Comm. Dodd put on before the deadline was removed by the Manager without his consent……another  big no no…OOPS!…(Agenda/ commentary to be posted soon)…

The Hi-Riser this week (6/4/09) has an article about the “Totters” by Fallan Patterson…which looks at the “dismissed” item put back on the last agenda by Comm. Dodd looking for an Ordinance to prevent scavengers from taking the recyclables from the Right-Of-Ways thus keeping a certain element out of our neighborhoods..(leaving them able to “scout ou”t our homes) and keeping the recycle revenue percentages coming back to the Town…….The VP of Choice Environmental, Mike Savino said “LBTS is involved an Interlocal Agreement with 27 other cities in which the cities get a check for the recyclable materials they collect. The product [in the swale] belongs to the homeowners” ..(this was verified by the Town Atty. in the backup for the item)…”You can’t go rummaging through people’s stuff and making a mess, we try to deter it, report it if we see it.”…Comm. Sillverstone is quoted after these comments saying ‘he is not opposed to people collecting material from the recycling bins, but is concerned that if more people come around, their scavenging might affect the percentages the town receives.’ …”I can feel for those people. I’d rather them do this than less industrious things.”…UGHHH!…. Comm. Dodd said he wanted stop the risk right now by to ‘ give the police permission to tell “totters” who wish to pick up these materials “Not in this town. Why risk these types of people driving around our neighborhoods?”…(previous 5/26-27/09 Comm. meeting post)…An owner of a recycling center commented on collecting from the general public and the costs…saying ” In the last eight or nine months since things turned south, people are more aware they can be environmentally friendly and get a little money for it.”…OOPS!…

BC- From the article it clearly reaffirms the timliness and the necessity for the item Comm. Dodd put on, although it was hypocritically dismissed by the “Gang of 3″…OUCH!…

The work will include demolition of existing signage, removal and relocation of existing landscaping ,installation of  proposed uplighting, installation of proposed curbing, connection to existing electrical service, restoration of asphalt, concrete, landscape and irrigation conduit.All work performed shall ne in accordance with the contract/Town of LBTS…Interested parties may contact the Project Engineer Shaun Bamforth P.E. for information.
