HIGH HOPES ….

Dear Readers … I pay no attention to what is written by those who refuse to reveal who they are and own up to their opinions when they blog… I do hear about it from time to time when someone sends me a text or mention they scanned a look from time to time to see what the dwindling participants are ranting about …. I find it amusing and more often than not devoid of fact and validity… This time I am told I am being portrayed as being thrown out by the CIC as a traitor… Come on, I resigned due to it becoming a cheerleading group rather than a watchdog PAC as written in numerous posts from the start of this site… Now I am told it is being posted I was duped and used by UOT and have suddenly realized it …I have never belonged to UOT…I attended by invitation only and then came back a few times during the campaign to update the group on the election for the slate of candidates they were supporting and I was managing … Sometimes it is hardest for those “conspiracy pontificators” to wrap their heads around the simple truth which is much less interesting and lacks any footing in order to spin a wild tale to tell online or while making the rounds in town … I was the campaign manager and backed the Mayor because I felt she was doing a good job in her first term and deserved another 2 years..I was the campaign manager and backed the UOT supported candidates because I believed they could accomplish what I thought the previous CIC supported candidates I co-managed in 2007/2008 and backed did not … I made it clear early on to these new candidates …their supporters and the readers of this site that after the election my role changes… After taking some months off and it being well over a year since  the Mayor, Comm.Sasser and Comm. Vincent were sworn in and after watching the early hits and then miss after miss after miss made with the priorities set during the campaign and as well as after with the next municipal election most likely occurring a few months early in January…(could be on the 4th )… I made my opinion known that this time around based on the last year+ ……I do not believe Mayor Minnet deserves a third term …I do not believe Commissioner Clottey deserves a second term based on her first term and I do believe Vice Mayor Dodd deserves re-election as a Commissioner based as well on his first term…He made it clear he did not want to run for Mayor when asked to do so previously and maintains that stance still….I am hoping this election returns to the type I heard was the norm prior to my time of involvement with independents who run on their own ….Especially after watching the apathy inside of Jarvis Hall and from what I hear about both Town PACs …. UOT is received the usual core members only at their  meetings  …. The CIC meeting held Sunday night produced an even smaller response and the Surf & Yacht Club parking lot on Palm Ave. had a paltry 14 cars parked there about a half hour after the meeting was called… This was after a letter as well as phone calls were made to all those who were once members including many who have not re-upped in years and contacted me to say so …(The membership fee is now $20 and the meeting was to replace the entire board ) …

The reasons I am ready for yet another change on the dais keep mounting ….The latest reason was my surprise to see the recent RFPs on the Town website for the sewers in the south which went out last month and are to be opened on May 19, 2011 …The RFP states the studies can exceed $200,000 and the project can exceed $2 million…The decision on who get the evaluation,analysis and engineering services job will be made by the Town Manager or a selected committee..(who will that be comprised of?) … The other RFP went out at the beginning of the May for providing drainage improvements in the Right-Of-Way…for West Tradewinds  Ave. south of Commercial… There was a pre-bid conference on May 12th and bids are due by June 2, 2011…It is a 258 page RFP with drawings done by Chen in April 2011… What stops me in my tracks is this…The Commission met on May 10, 2010 …one year ago in a workshop to discuss the drainage issue in town as well as the Capital Improvements …(a strategic meeting was held on Nov. 15, 2010) ..At that time the worst areas were discussed for drainage …West Tradewinds Ave. was #12 on the list for cost estimates in the backup with an estimate of $250,754 in 2011 & $268,307 in 2012… The Commissioners were told there were 13 areas considered the worst and it was up to them to determine the order of importance according to the minutes …The next item on the agenda was the CIP and it was Mayor Minnet according to the minutes who stated residential streetscape was a low priority until the sewers and drainage problems were addressed … After that was discussion ranking priorities such as with a parking garage …The Mayor said low priority not needed no parking problem…others agreed…Town Hall expansion the the Mayor said the previous Commission did not want but seemed to ponder it and impact on extension for Senior Center …and so and so forth…Talk included a revision verses full Master Plan $50,00 vs. $175,000 …and so and so forth…( we will exceed that amount) …Yet within the last year we spent extensive time and money hiring consultants and having meetings up the wazoo to discuss all  three ad nauseum ….So as a result here we sit one year later and watch on May 10, 2010 the same Mayor saying we don’t need a referendum on some of these items … they are not on the radar and a vote could “sabotage” the plans for change ….It took a whole year for an RFP to go out for a drainage project for a road which was certainly not at the top of the list for worst area!… Here we are one year later “piecemealing” a 3 block area rather than a whole section or sections knowing there is a list that needs to be done…which according to the agenda at the May 10, 2010 meeting will require “pay as you go”/”debt” including revenue bonds  and grants …This long year of nothing but “window dressing”  happened under her lack of leadership…as well as a shift in the majority on the dais that leaves this writer thinking it’s time for someone else to be sitting in that center seat… who is fiscally responsible in actions not just words spewed for cover or as a fallback left over from electioneering…

Yesterday Rahm Emanual was sworn in and his speech included these four questions…

‘Crucial to Emanuel’s solution, he said Monday, is to relentlessly ask four questions about everything City Hall does:

• “Do we need it?

• “Is it worth it?

• “Can we afford it?

• “Is there a better deal?”

Each time the answer is “no,” and that often needs to be the answer, some payroller or contractor or alderman or formerly protected constituency will squawk. The expectation that Emanuel won’t be frightened by those squawks is one reason, we suspect, why Chicagoans elected him in a landslide.’

ASK US BEFORE YOU START THE COUNT DOWN & TAKE OFF …..

Dear Readers… I always maintained that 65% of the voters voted for this new majority because they knew what they did not want ….. Again, I believe we had what we were looking for in place for the first 4-5 months after they won … I am not sure exactly when the divide came and the majority on the dais shifted but a few people tell me it was when the parking exemption idea was put forth and lobbying became fast and furious behind the scenes from inside of Town Hall and from those who thought it was time to pick up where they left off with the need for a parking garage to stop it…

With where we are now due to the full Master Plan redevelopment detour taken and with the next election most likely being moved up to January 2012 rather than in March we certainly expect that those we have long seen involved in town politics as well as a few newcomers are pondering a run for the three open seats on the dais… This Commission chose to go in this direction … The drainage downtown which many including this writer believed would begin breaking ground around this time was pushed back for possible undergrounding of the utilitie$ …The neighborhoods are not being improved with lighting and street repairs instead they received a universal neighborhood sign program with an allotted $30,000 per limit that was an unnecessary move at best…There is still a lack of streamlining the day- to- day running of this little town with less paid/pensioned Town employees  … Instead we have additional consultant$ added on for “projects” and work this staff is not qualified or unable to do we are told … It’s for these reasons I tend to think voters will vote the same way once again…for the opponents of most of those seeking re-election…knowing what they don’t want…

Below are excerpts from the Jan 20, 2010 City Council Meeting in Davie Florida …This writer found this quite by accident while looking into undergrounding projects and costs online …The agenda items jumped out at me due to the comments made by the Mayor and others about financing big ticket items up for redevelopment in LBTS and comments that a referendum in January was “very”, “too” “a little” to “a little bit premature”… depending on which Commissioner was speaking…(see prev. post below) …

My take is as it’s always been … Let the voters tell you if they are ready for any such major plans happening any time soon before spending alot of money on numerous consultants supplying more studies including whether it’s feasible to do… Cha ching!… If the voters vote it down …that’s not “sabotage” as the Mayor argued was a reason to not allow a vote given to the taxpayers …. That’s having your ducks in a row ….knowing what direction your constituents want you to go in…2 years later put another referendum on at the next municipal election and see if the time is correct and so on and so forth…This makes the priorities set at the start of each new Commission much easier to set….

One of the interesting participants in the Davie “plan” for the CRA purchase of Davie’s Town Hall property to lease back to the Town below…(yep,  a”plan”) was the attorney…Sue Delegal!… Avid Readers will recall that name from Oriana days as well as this writer’s ouster from the P & Z (prev. posts)… Another item on that same agenda shows the CRA in Davie also paid for undergrounding utilities…. Another interesting person involved was former Davie TM Gary Shimun who was ousted last year ala Colon style by the Commission and is currently a paid consultant hired by TM Hoffmann for our building permit fee schedule to the tune of $65 an hr. for one month’s work not to exceed $6,500 …. (see  Consultant/Professional Services list below)….

For this writer we have already put the proverbial cart before the rocket ship… and so far no one has been willing to scrub this launch from inside the control room… Without a referendum …it’s all systems go!….

Mayor Minnet- 5/10/11 speech excerpts on choosing to say no to referendums on the ballot for 2012- (prev. post) …

“Let’s look at history. If President Kennedy had asked the people in 1960 do you want to go to the moon? The majority would have said no. But Kennedy inspired a nation. I hope as Commissioners we can inspire our town to move forward and not shirking our duties as leaders do our due diligence by defining our goals and stand strong to the decisions that are made. I have always said you may not agree with my decision but you will know the reasons why and they will be fiscally responsible and fair. There is an order to follow and if order is not followed failure is not far behind. So maybe this is the real question. Are we saying, are you saying you don’t want change? Because these measures will truly sabotage any plan before us before it is even developed.”

” Parking garage, this Commission has already voted that this is a low priority so why are we even discussing it. And the hall complex, if this is even a viable idea it is a concept for future years and should be addressed in the capital improvement budget if necessary so we we can identify matching grants and partnerships. The Town is not again responsible for the entire revenue expenditure.”

REPORT IN BRIEF: This is a contract between the Town of Davie and the Davie
Community Redevelopment Agency which sets out the terms of a sale of Town Hall by
the Town to the CRA. The contract sets out the terms and conditions of the sale by the
Town and the purchase by the CRA. The primary purchase of land is the 3.779 acre site
on which the existing Town Hall and a portion of the adjoining parking lot are now
located. The purchase price for this land and other rights-of-way to serve Town Hall and
a permanent easement for land to serve as a storm water retention area and park is $4.2
million. It should be noted that for future comparable prices the value of $1,825,000 is
being placed on the purchase of the 3.779 acre parcel. The funding for this purchase will
be encumbered by the CRA at the time of purchase. The purchase price is to be paid with
a $1 million payment at closing, another $1 million when the architectural design is
completed, and $2.2 million at the time the certificate of occupancy is granted. The CRA
will lease the existing Town Hall back to the Town while the construction of the new
Town Hall is being done at a rate of $1 per year. The Town will complete a new Town
Hall within three years. The new Town Hall will be primarily at least a three story
building and there are requirements for the style of the building and a requirement for
architectural features and for a public space The CRA will construct a parking garage
and redevelop the adjoing site. It is agreed the parking garage will be done concurrently
with the construction of the new Town Hall. The Town will grant all necessary
improvements to permit the installation of roads, and infrastructure such as storm sewers
and a storm water retention area. It should be noted that there was a joint meeting of the
Town Council and Davie Redevelopment Agency on June 11, 2009 to discuss this matter.
It should be noted that the plans were changed to provide a 150′ setback from Orange
Drive to the CRA redevelopment area and the parking garage was placed nearer to the
new Town Hall structure.

“CRA”).
R E C I T A L S:

for the Existing Town Hall and Bergeron Rodeo Arena and located to the north

residential uses, and attendant public and private parking; and

The CRA shall approve the architectural design development
drawings which shall be consistent at all times with Exhibit “H” and the provisions
of this subparagraph C. The CRA recognizes that such drawings may be amended
from time to time during the design development phase for the New Town Hall;
however, the CRA shall have the right to review and comment at all stages upon
the design of the New Town Hall, including schematic design and design
development drawings, prior to their final approval by the TOWN, to ensure the
compatibility of the design of the New Town Hall with the vision of the CRA for
the community redevelopment area. To the extent possible, the TOWN agrees to
incorporate the recommendations of the CRA into the design of the New Town
Hall.
The TOWN shall appoint no less than two (2) representatives
recommended by the CRA to any committee to select or negotiate with design
professionals, bid specification committees or committees to select construction or
design/build contractors in connection with the development or construction of the
New Town Hall.

20. Agreement of the CRA. The CRA agrees to construct at CRA expense
a parking garage of up to 400 parking spaces. The parking garage will be owned
by the CRA; however, the CRA will provide parking spaces on a non exclusive
basis, and at such locations to be determined by the CRA in its sole discretion, to
the Town to provide parking for the New Town Hall. The number of spaces
allocated to the Town to provide parking for the New Town Hall shall be
determined in accordance with the requirements of the Town’s Code of Ordinances
in effect at the time of development of the New Town Hall. The CRA reserves the
right to assign parking spaces in the garage for the exclusive use of the
Redevelopment Project. The TOWN and the CRA shall agree upon an interim plan
for parking to serve the Existing Town Hall at the Bergeron Rodeo Grounds during
the period of construction of the parking

communications required or permitted under this Contract shall be in writing and

MAYOR ROSEANN MINNET 5/10/2011 EXCERPT FOR CHOOSING TO SAY NO TO HAVING A REFERENDUM IN 2012 FOR VOTERS TO VOTE ON MAJOR LBTS REDEVELOPMENT ITEMS…. “LET’S LOOK AT HISTORY. IF PRESIDENT KENNEDY HAD ASKED THE PEOPLE IN 1960 DO YOU WANT TO GO TO THE MOON THE MAJORITY PROBABLY WOULD HAVE SAID NO. “….

Dear Readers … I now find myself of the opinion that Mayor Minnet should not have a third term in office as Mayor of LBTS …. after watching her lack of direction as our Mayor sitting in the middle seat for some months now and watching a new Commission that is no better than the one they replaced when it comes to what the real priorities are in town that need to be dealt with and having to backtrack on many of the decisions they did make due to lack of information provided or researched ….(ords/resos) …. As bad as it has been to watch all that it was her prepared speech for no redevelopment referendum items on the 2012 ballot (see below) …and her rewriting history concerning what she ran on and was asked to do by the voters …that sealed the deal for me…

It is clear to me that after a second time running a local campaign in politics you can fall under the “Fool me once shame on me .. Fool me twice shame on you” scenario very easily once the candidates are sworn in!… Yep, I was the campaign manager for the slate that ran and won which included Mayor Minnet, Chris Vincent and Scot Sasser …and no…. there won’t be a “How The Sausage Was Made ” sequel…  That being said… Mayor Minnet stated “But during the last election I ran on a strong message and that message was to create a defined plan for the Town of Lauderdale-By-The-Sea.”…As the writer and/or editor of all printed materials in the campaign as well as being a coach for the Mayor and the other candidates as they campaigned throughout the town and entered into the Town debates never was there a message given or received to “create a defined plan for the Town of Lauderdale-By-The-Sea” … The message was to take care of the drainage problem ..Lake Colon …as well as deal with a future economic plan …emphasis on the future …and get rid of the Town Manager and her staff….by getting the  CIC majority out…  This is why I continue to ask and to post on who it was who decided to go all out for a full Master Plan Redevelopment in LBTS this year?… A look back at the meetings in the first months of office show direction that came from meetings that took place prior to the election and sunshine law taking effect of the two new commission candidates who met separately with Mayor Minnet and with then- Commissioner Dodd …These meetings were done as well with the winning CIC candidates in 2008 ….Neither Mayor Minnet or then- Comm. Dodd knew what the other was doing or planning to do in the future…This writer and others attended those meetings and took notes…creating a defined plan for the Town was not on the table for discussion at either… As an aside I will divulge just a little insight to where this full-scale redevelopment which excludes voters from voting is coming from ….In my opinion it’s from past majority players and backers… who throughout the campaign would interject themselves with comments of returning to the past…pre- 2008 … This writer told them face- to- face if they thought I was doing what I was doing to go back there they were sorely mistaken and that was certainly not what the voters wanted… I still believe it was not what the 65% wanted or want for the future…They were looking for a middle ground ..real fiscal responsibility and to see organized decisions made from the top down done in condensed and concise meetings ….We had that for a while but it all went haywire after the first 4-5 months in office!… Why in the world would those same voters who voted in part because of the Colon payout in her contract be ok with spending $200,000+ on consultants…and studies…for a total redevelopment plan?… They aren’t!… So maybe the third time will be a charm.. not for Minnet but for the voters …..with yet a different majority on the dais…independent candidates from neither PAC taking the seats for Mayor and Commissioner from the north… VM Dodd who is for the referendum is already an independent candidate this time around after he resigned from the CIC shortly after he was elected in 2008 …He was tar and feathered for it even though he made it clear he would be doing so during the campaign (see prev. posts)  …He should be re-elected for another four years …Comm. Clottey made it clear to me when she reluctantly stepped up to run from the north and began her first term it was a one term deal and I hope she has not changed her mind…If she has…she should not get a second term….Mayor Minnet made it known to this writer some months back she decided to run for a third term to finish what she started …You can read alot into that …and also you can read alot into her decision to use John F. Kennedy’s decision to go to the moon in her reasoning to prevent voters from having a say with a referendum…The full text of Kennedy’s speech is below this post ..Some interesting excerpts address the steps leading up to the moon decision…such as costs …timing and this portion in particular stood out to me in light of the Mayor’s reason for wanting a third term…

“We choose to go to the moon. We choose to go to the moon in this decade and do the other things, not because they are easy, but because they are hard, because that goal will serve to organize and measure the best of our energies and skills, because that challenge is one that we are willing to accept, one we are unwilling to postpone, and one which we intend to win, and the others, too.

It is for these reasons that I regard the decision last year to shift our efforts in space from low to high gear as among the most important decisions that will be made during my incumbency in the office of the Presidency.”

BC-Re-read the second paragraph… to shift decision from low gear to high gear…that’s what I believe will be the result if the Mayor wins another 2 years …Redevelopment will shift into high gear well before another referendum can be put on a ballot… If there is any doubt go to the Town website and listen to those who are her confidants and have her ear as they make these sentiments known during public comments over the past few months… Just as I heard during the campaign from those who thought it was time to pick up where they left off pre- 2008… Now it’s up to the voters to decide if they will succeed ….

I will not be running anyone’s campaign this go round due to not being in town … I will be writing about it though … that you can count on…

The Referendum Agenda Item comments made on May 10,2011 …Most is verbatim… with my commentary ….and as always that combination is what gets them in the end… Why? …It makes them accountable for their actions in their own words! …

The Mayor read the agenda item put on by Vice Mayor Dodd and turned it over to him… “I campaigned on letting the voters decide on major issues. We’re elected to take care of the routine issues that face the town. Drainage, sewage rates, trash collection etc. The decision to underground half or El Mar, of all of El Mar in my opinion should be made by the voters of this town in a referendum and I am very concerned with the burden we’ll be placing on a number of residents and businesses when it comes to the cost of reconnection of electric, TV and phone cables since many of them are already struggling.”.. He went on to talk about inviting all of those affected to meet after the real costs are received.He spoke about the aesthetics which are used as a primary reason by proponents pointing out one variable they avoid and that is the plethora of utility boxes that will be located in the medians …unsightly …when compared to the wires not seen unless one looks up … He held up a report found on Google by putting in overhead to underground utilities quanta technology .. which looked into the situation in Florida and elsewhere including municipalities that spent and spent for studies that ended up with those re-connections costing approx. $11,000 as early as 2002 …He addressed assistance in financing for those who would need it… That always frosts this writer …it’s akin to those politicians and supporters who make grants from Federal, State and County sound like taxpayers don’t still cover the cost… ugh!…Vice Mayor Dodd did say he would be in favor of underground perhaps in the downtown area which will be opened up (eventually) for drainage issues and restructured parking and sidewalks …due to the aesthetics … He tried mightily to make the others understand there is a timeline to deal with for the referendum items to make it on the ballot which included in the backup made it imperative they proceed … (August is the time for 1st reading …2nd reading Sept …and early October required to be at the Supervisor of Elections … He spoke of how it may be easy to say “just do it” for those who won’t be monetarily affected… He ended by stating what we were told about reliability in the past … This writer recall that as well… After Wilma we were told other municipalities who were undergrounded were off line longer than we were… Considering the “pecking order” of importance after a storm…no doubt we would be low on the list to get up and running… That too fell on deaf ears.. The Mayor chuckled in response to the real reports of undergrounding providing little benefit other than aesthetics  with this comment …”I’m sure we can always find an argument for the other side as well”… What she chose as an argument reminded this writer of the argument for paying for sewers on private property in the Palm Club …and we know how voters felt about that once it was known… The TAtty. concurred with the Vice Mayor that given direction to have items placed on the ballot she “heartily agreed” they should start early …

Instead of going around the table as is the Mayor’s usual course of action at roundtable meetings she said “Alright, I’m just gonna jump right into it!” and again she chuckled … “Alright, thank you Stuart cause there are, there are definitions here and each one of us define them differently. But during the last election I ran on a strong message and that message was create a defined plan for the Town of Lauderdale-By-The-Sea. We criticized our predecessors for not having proper planning. This Commission is prioritizing and developing a long range plan that is consistent with positive change. We’re keeping the height limits and unique identity that defines our home and currently we’re doing just that. We have had resident input, business input and this month the University of Miami is coming in to study and offer a feasibility plan for A1A and Commercial that will again take our town into a constructive direction to developing this plan. Not only have we been developing this plan but the Commission has been ranking projects and we have even discussed the feasibilities (the Mayor said it plural) of one of the items under discussion tonight as a low priority. So what are we really doing here?”

BC- Again, never was the message to create a defined plan for the town…Yes the Commission made priorities… and did not follow those priorities…so they made more priorities and again did not follow them until the TM came to them last month to get back on track …which still seems to be wobbly at best after looking at the Mayor’s own agenda item for Terra Mar … The study by UM as well as RMA once done in June can totally change the low priority to a higher priority … There must have been a majority of this Commission that gave the nod for the Administration to go forth with the two appraisals to buy the apartment building that sits beside the Bougainvilla lot for $3,200 … The Mayor later on made it known she wants to keep the parking debt …The Administration explanation in the backup was to retain the debt to serve capital improvements and further parking in our town…. hmmmm….

The Mayor continued to read from her prepared speech…” Weren’t we elected to make these decisions and aren’t we in a fiscally responsible manner? We’re working on an RFP that will get us costs for undergrounding utilities in the downtown El Mar area only. By undergrounding this core area, this is where we may differ, the town will have created an area that is safer utilities, will be more reliable and the area will be aesthetically more attractive. Can you truly guesstimate the costs on safety, reliability and aesthetics and how can you get that into 75 words or less in a referendum?”…

BC- The first part was on point with some of those who came to speak at the podium… Marie Chiarello, Mark Brown and Ron Piersante … Totally in lockstep… The second portion was what I referred to above …the same safety issues this group and other supporters used for the Palm Club sewers…The Mayor was for the sewers during her first campaign…thinking that usurped the cost to the taxpayers… The above ground utilities have long been up on El Mar Drive and there has been no safety problem this writer has ever heard of coming to light…This is just as outrageous as the concerns over bikers and walkers using a possible bike lane  or the sidewalk near the back-out parking on El Mar Drive and getting hit…As far as the 75 words … they were not supposed to cover safety, reliability or aesthetics…they were to cover the items and the cost period…We are smart voters in LBTS …make no mistake… The RFP she said they were working on though directed a few months back has not been sent out to the Commission to see nor has it been put out per the Town Manager who later surprised this writer by saying they were conferring with other municipalities for costs and further asked the Commission if they wanted accurate costs or rough estimates…The first one to go for the rough estimate due to a $7,500 cost from FPL the TM stated would arise among other costs…Mayor MInnet!… Sounds like a “guesstimate” to me!…

Mayor Minnet-” Yes we agreed to move forward with the Master Plan Steering Committee recommendations but I understood that undergrounding to be the responsibility of the Town. Presently two developments have occurred. Orianna and Minto. Through site plan approval they were required to pay for their undergrounding in the Town’s right- of- way. This doesn’t need to change. The residents should not be on the hook for this expense. Yes it may take longer but the burden is on the landowner, not the Town.”

BC- First of all the Commission when did the Commission approve undergrounding recommended by the MPSC?… Second the developments Oriana and Minto while they were to underground utilities a look at Oriana as well as the redeveloped White Cap show the undergrounding did not go all the way in the ROW and a question arose after the overlay districts were dismantled on whether that also disbanded the utilities being buried as well…. The Mayor was unable to wrap her head around the VM’s contention that current property owners would be on the hook to hook-up when the lines are buried …pun intended… We saw the outrage and the dates extended for those in the north who had to hook up for the sewers …They had a fit over the costs which were from approx. $600-$2000 depending… This will bring more of the same ++++ ….

Mayor Minnet- ” Parking garage, this Commission has already voted that this is a low priority so why are we even discussing it. And the hall complex, if this is even a viable idea it is a concept for future years and should be addressed in the capital improvement budget if necessary so we we can identify matching grants and partnerships. The Town is not again responsible for the entire revenue expenditure.”

BC- Huh?… I have already covered my view on the parking garage situation…The hall complex…if it is not a “viable idea” and is a “concept for future years” why did we go down this path now with capital project coordinators as well as the consultants hired for these big ticket items and the feasibility studies… A referendum vote would have told the Commission if these items were “feasible” to the taxpayers for far less cost …The statement “The Town is not again responsible for the entire revenue expenditure.”…speaking of grants and partnerships shows someone’s in denial!…

Mayor Minnet-” In conclusion I am saddened that policy decisions, decisions that people elected us to make, decisions I was elected to make truly transparent and fiscally responsible are turning into political issues.”…

BC- A few of her supporters may have her ear and must be telling her this was the case…most of the 65% voted in this new majority to not have the previous majority and Town Manager…It was certainly not a mandate to redevelop the town …Transparency and fiscal responsibility certainly were not seen until after the fact with the consultants hired and revealed at a roundtable as the Commission certainly put forth they were in the dark…and that $200,000 cost misses the fiscal responsibility mark in my book especially if the whole exercise is for “far in the future”…

Mayor Minnet-” Let’s look at history. If President Kennedy had asked the people in 1960 do you want to go to the moon? The majority would have said no. But Kennedy inspired a nation. I hope as Commissioners we can inspire our town to move forward and not shirking our duties as leaders do our due diligence by defining our goals and stand strong to the decisions that are made. I have always said you may not agree with my decision but you will know the reasons why and they will be fiscally responsible and fair. There is an order to follow and if order is not followed failure is not far behind. So maybe this is the real question. Are we saying, are you saying you don’t want change? Because these measures will truly sabotage any plan before us before it is even developed.”

BC- WOW!… The Mayor compares herself and this Commission and taxpayer funded redevelopment in town to President Kennedy and going to the moon!… They should inspire us?… How by disregarding our right to vote on change…stating voting by referendum “will truly sabotage any plan before us before it is even developed.”… Perhaps it would have made more sense to follow through with the first set of priorities in place and follow through on a simple revision of the Master Plan as directed and then to put an economic development committee together to put forth any large redevelopment specifically for the 2012 election and a referendum vote which would spell out if major change is wanted at this time or for the immediate futures…

Mayor Minnet-” That’s really where I stand on these referendums. I think they’re very premature. I think that we need to look at the overall plan. I think we need to truly understand what the costs are. Whether they be costs that can truly identify or whether they’re costs that we have to guesstimate through the safety issue, the aesthetic look, the aesthetic value of them. But again, I do feel this is too premature. We need to do our due diligence on this particular matter. Truly put together the plan that the residents have asked us to do. Work through it and work together as a Commission. That we have been doing. “…

BC- The costs would be available before the early Oct. required submission date to the Supervisor of Elections … The safety issue is a ruse for undergrounding at best…and just who are these residents that have asked them to put together the plan?…Premature…If anything is premature …it was the full blown redevelopment of the Master Plan that was and is premature!…

Mayor Minnet-” I’m interested in hearing what my other Commissioners say. We worked together on this in many ways and if this Commission moves forward to do a referendum then we will. If not, theses are my arguments and how I feel about it. But again, we’ve worked as a group and I look forward to hearing what my other fellow Commissioners have to say. So thank you.”

BC- Two terms and out… it’s not personal it’s politics…

Commissioner Vincent was next and true to form he said the following …”Point of information, I think it was Ralph Kramden that said that!” as he chuckled about the Kennedy going to the moon analogy the Mayor made… The Mayor was amused and laughed as she said “and away we go!”…

Commissioner Vincent- “Away and here we go again. Uh, I can’t agree with you more Roseann on that. I have some bullet points pretty much that speak your words. I think it’s premature. We’re still waiting for the outcome for cost projections on this. To try and rush and jam down the throats of the voters a referendum like this in such a short period of time I think would be irresponsible without having all the facts and all the figures in front of us. Again, and now that the election is moved up to January.”…. The Mayor interjected and said “We don’t know yet”…

BC- One thing Vincent is good at is winging a turnabout to try and correct himself …on a dime…and usually not quite on the mark ….It’s a trait I found out early on during the campaign among other troublesome traits that require no ingredients to be revealed as those traits are quite apparent every time he speaks on the dais and at the roundtable…case in point stating “I have some bullet points pretty much that speak your words.”…Either is bullshitting or there has been a breach of sunshine … Then to state “To try and rush and jam down the throats of the voters a referendum like this in such a short period of time I think would be irresponsible without having all the facts and all the figures in front of us.” proves he did not do his homework on referendums done in the past or look at the time-frame in the backup or listen to VM Dodd …It gets worse the longer he speaks…

He continued…”That’s obviously not yet approved. You know we’re losing valuable time there as well and thank you Susan (TAtty.) for saying yeah if you start drafting it now yeah you could do it but I don’t think the town’s ready for that. I don’t think this Commission’s ready for that. Um, we have alot of homework to do on that and there’s just no rush for this right now because none of these items I should say well Town Hall Plaza that’s down the road. Ah, the parking garage is not even a twinkle. Ah, it is but it isn’t. Um, and again and I want to say this. When I campaigned I know we talk about the wonderful residents of our town and we also talk about the taxpayers of this town. The taxpayers and I talk about the people that can’t vote, the people that come into our town and invest alot of money in real estate, in businesses and I want their voices to be heard just as well before any referendum is out because they can’t vote. So we have alot of work to do and I respect their idea and their point of view as much I do the residents of this town that can vote and I ran on that. I ran on the residents and I ran on the taxpayers and I will represent everyone resident,voter or not. And uh, I need some time to really digest all the information that’s gonna come forward to us for this time is just totally out of the question.”..

BC- all I can add to Comm. Vincent’s own ridiculous words is this… at the time he was presented to me to run from the south and throughout the campaign difficulties I had with him….I held on to the fact that  he was still better than his opponent who would have kept the former Town Manager in her position and who made no sense on the dais more often than not… in my opinion… I was correct on the first part and see no difference on the second sad to say… Hopefully he will follow his predecessor and only have one term…

Commissioner Clottey-” Ok, I guess it’s my turn. Um, I agree this is premature because we will have other items that probably, that people want to talk about and we need to know how much it’s going to cost and until we have those numbers why are we talkin about a referendum? Why are we wasting Town money for an attorney to draw this up when there’s still alot of unknown variables for all of us? Now I do support the Mayor, excuse me the Vice Mayor and if you recall some time ago I did bring something to you saying that perhaps we should come up with a dollar amount over which we should not go without the tax ah, insurance expenditures or additional expenditures for current services before asking people if that’s what they want to go and there was dead silence up here. So, um, I thank you for bringing it up but I do agree that it is ah, it’s a little premature. There are too many missing details that are extremely important and let’s not forget that the previous dais did try to get the El Mar Drive project done and people came out in droves because they didn’t want what was about a million dollars spent and I believe that some of you my fellow colleagues you campaigned against that. (She chuckled ) So I do find it a little bit strange that now what I see is a little backing off from that. (she was looking straight at Comm. Vincent) Maybe I, but anyway that’s kinda how I feel. I agree with you it’s premature. We have too much work to do.”…

BC- Comm. Clottey was correct about how some of these Commissioners ran and are backing off from their stance now in office as stated above… I am surprised though at her for thinking this is premature …Let’s see if she reconsiders after the CIC meeting on Sunday night …Again, she should stick to one term…

Comm. Sasser- ” I agree with all of you and none of you. (laughter came from the table and the hall) Actually I think they’re all good points. I will say I am the closest with my opinion with Commissioner Clottey in that I think it’s important for the people to voice their opinion and to say that we as elected officials should do something other than listen to them is quite undemocratic. But at the same time I think that it is premature what we have here and I don’t necessarily think that all the issues that are here or all the issues that may come up need to be referendum items. I think the important parts certainly to me that are missing and some of you have said this are the costs. How can you determine if you want to move forward with anything or even make a decision us or the public if we don’t have the costs. But I take it one step further, we don’t even know yet what financial measures or tools or instruments we need in order to pay for these. Now that would be a good referendum item as far as I’m concerned. Let us decided on what the plan is and then let the public decided on which financial tool or instrument that they would like to use. And I know we still have RMA out there doing some of this work. That’s why I say it’s a little bit premature. I’d like to keep this in mind, in other words I don’t think the Town Attorney needs to be working on this at this time. But I think that this is an important issue that we need to keep in mind and once we have all the information the decide. One last thing and that is as we put this plan together with financial questions and everything else there are to be projects that we have the money for and we’re gonna have to decided which ones those monies go to and maybe that’s a way that we can get to where we need to be which is place these things which are important first and we can pay for them. And then quite frankly things like Town Hall my son can put a referendum on the ballot when he gets old enough and sits on the dais because things don’t move that quickly. We’re gonna be many commissions away before we get to something like that. And we’ve already agreed about the parking lot. So there are things, that’s why I take a little bit off what each one of you says because all of those things are important. But the conclusion for me is I’d still like to discuss it once we get the information back. But if a referendum item is placed I want to make sure that it’s very detailed in the seventy some-odd words but it includes costs and it’s really whittled down to what’s really important and to me one of those things is how we pay for it not just what we’re payin for it.”

BC- Comm. Sasser was a gem as a candidate and has continued to be so on the dais… He gets most of why there is a need for a referendum but did miss out on the need for the TAtty. to definitely be preparing them now… The costs could be added in at 2nd reading in Sept. as the time-line shows… The point of how to finance can be included and definitely should… He should also have been informed that the referendum time required by the TAtty. should not be extensive as they do this all the time and would “whittle down” the details given to them from the Commissioners …As far as his closing statement about Town Hall not coming fruition until his son sits on the dais…then why are we going through the motions in 2011?… As for his statement about monies we have in the Town’s coffer for other projects we need to address and pay for …that is where this all began … before the train left the station full speed ahead and derailed!…

Commissioner Vincent could be heard to say “Great stuff.”…

VM Dodd sighed and stated he was now in the minority 4-1 ..and spoke again about the impact …and imposing these projects on the residents… and the real cost of approx. $10,000 on the businesses  adding just to do downtown could be in excess of $5 million for very little security when all is said and done ..He added “Am I wishing to jam it down the throats of the voters as I’ve been accused of (by Comm. Vincent) the answer is no. I’m just saying to you if you want to get this item on a referendum we have to pass ordinances first and I want you to be mindful of the time scales and I want you to think as to does it make a difference whether we prepare the ordinance now as to how many dollars it is. Is it four million, five million. Is it six million. That is the figure that can be put into an ordinance down the line. Are we imposing on the resident $2,500, $5,000 or $7,500 for reconnecting to the network. That is a little box we can put in. But I’m simply saying I have experience up here when it comes to doing an ordinance. There’s such argument. Such a public outcry at the last minute that it doesn’t get done and I’m just asking you to be mindful of that.”…

BC- VM Dodd is correct on all his points but unfortunately the rest of the Commission did not grasp what he was saying and he was still alone in calling for the process to begin…

Comm. Sasser did ask if he was mostly interested in the undergrounding as an item without the other two…VM Dodd replied perhaps hoping for a open door to re-address all instead of closing the door completely answered absolutely adding the 5-10 year mantra on the Town Hall/Parking Garage items… It did not work though… The Mayor chimed in asking the Town Manager to explain the ordinance we have on site plan requirements for undergrounding new and redeveloped properties again showing her ignorance on the reconnection that will impact anyone who wants to continue to have electricity, phone and cable after the wiring is buried…. The Mayor explained that fact yet again…Comm. Vincent responded as an interpreter to get through to the Mayor on the Vice Mayor’s point …He repeated what Dodd said and asked about offering those impacted a hardship grant ..He again stated this is why a referendum is premature…due to the “conversation” (inability of the Mayor to understand ) the Commission was embroiled in on the topic… The Mayor again asked the TM to read the ordinance that deals with site plans which she did … code 20-92 under utilities …She read the redevelopment portion and stated new development was above it and the same conditions applied…Comm. Vincent asked about a fund ..He called it a “slush fund”…producing a laugh at him not with him for using such a term…The TM after Jeff Bowman came over and pointed out a section in the code 20-93 stated there was a waiver for a property that could not underground and the process required to prove it could not take place…It includes a dollar amount that could be required by the Town Commission to go into a fund equal to the costs of undergrounding…an underground utility trust fund… The Mayor asked if they wanted to continue on this item and addressed Comm. Sasser as he was asking about one item for the referendum…She said again she feels this is premature and “could see a referendum down the line as Scot was talking about cause that would be important.”…She again said they cannot do it “currently” because they do not have all the numbers together… “As for rushing to do anything (referendum) ah, I don’t see the need for that right now.” She wants to allow the process to take place and put it together then when everything is complete go to the people and present it to the residents and business owners in a true concise plan…The Vice Mayor interjected and asked the TM when those experts will have the figures…This is when Town Manager Hoffmann threw as curve ball and said they were looking at what other cities have spent and trying to get the 3 utilities into a meeting together…The RFP has not gone out and it will be mid to late summer before estimates come … The RFQ responses need to come back first … She spoke of rough estimates vs a special quote from FPL that requires a $7,500 deposit and a survey… She said after getting the ballpark estimates the Commission may decide this was all for naught!… The Mayor told her to get the other cities costs and if they were not sufficient then go to FPL and pay the $7,500… VM Dodd asked that whatever route is used the costs are all encompassing and not based on just copper as was the case  when numbers were provided at the outset of this exercise by Municipal Dir. Don Prince at the podium months ago…

BC- The comments …discussion ….conversation and revelations above make referendum items on the January 2012 ballot anything but premature… In this writer’s opinion it makes them imperative …Vice Mayor Dodd and/or Comm. Sasser should put the items back on the agenda along with Comm. Sasser’s choice of funding to keep the time-line required on track … I just do not trust what will happen post election 2012 without the voter’s input…

One final comment…concerning the Mayors choice of going to the moon …..the difference in who is front and center going into space now vs in the 1960’s…it’s private companies and billionaires!…Ha!….

President Pitzer, Mr. Vice President, Governor, Congressman Thomas, Senator Wiley, and Congressman Miller, Mr. Webb, Mr. Bell, scientists, distinguished guests, and ladies and gentlemen:

I appreciate your president having made me an honorary visiting professor, and I will assure you that my first lecture will be very brief.

I am delighted to be here and I’m particularly delighted to be here on this occasion.

We meet at a college noted for knowledge, in a city noted for progress, in a State noted for strength, and we stand in need of all all three, for we meet in an hour of change and challenge, in a decade of hope and fear, in an age of both knowledge and ignorance. The greater our knowledge increases, the greater our ignorance unfolds.

Despite the striking fact that most of the scientists that the world has ever known are alive and working today, despite the fact that this Nation¹s own scientific manpower is doubling every 12 years in a rate of growth more than three times that of our population as a whole, despite that, the vast stretches of the unknown and the unanswered and the unfinished still far outstrip our collective comprehension.

No man can fully grasp how far and how fast we have come, but condense, if you will, the 50,000 years of man¹s recorded history in a time span of but a half-century. Stated in these terms, we know very little about the first 40 years, except at the end of them advanced man had learned to use the skins of animals to cover them. Then about 10 years ago, under this standard, man emerged from his caves to construct other kinds of shelter. Only five years ago man learned to write and use a cart with wheels. Christianity began less than two years ago. The printing press came this year, and then less than two months ago, during this whole 50-year span of human history, the steam engine provided a new source of power.

Newton explored the meaning of gravity. Last month electric lights and telephones and automobiles and airplanes became available. Only last week did we develop penicillin and television and nuclear power, and now if America’s new spacecraft succeeds in reaching Venus, we will have literally reached the stars before midnight tonight.

This is a breathtaking pace, and such a pace cannot help but create new ills as it dispels old, new ignorance, new problems, new dangers. Surely the opening vistas of space promise high costs and hardships, as well as high reward.

So it is not surprising that some would have us stay where we are a little longer to rest, to wait. But this city of Houston, this State of Texas, this country of the United States was not built by those who waited and rested and wished to look behind them. This country was conquered by those who moved forward–and so will space.

William Bradford, speaking in 1630 of the founding of the Plymouth Bay Colony, said that all great and honorable actions are accompanied with great difficulties, and both must be enterprised and overcome with answerable courage.

If this capsule history of our progress teaches us anything, it is that man, in his quest for knowledge and progress, is determined and cannot be deterred. The exploration of space will go ahead, whether we join in it or not, and it is one of the great adventures of all time, and no nation which expects to be the leader of other nations can expect to stay behind in the race for space.

Those who came before us made certain that this country rode the first waves of the industrial revolutions, the first waves of modern invention, and the first wave of nuclear power, and this generation does not intend to founder in the backwash of the coming age of space. We mean to be a part of it–we mean to lead it. For the eyes of the world now look into space, to the moon and to the planets beyond, and we have vowed that we shall not see it governed by a hostile flag of conquest, but by a banner of freedom and peace. We have vowed that we shall not see space filled with weapons of mass destruction, but with instruments of knowledge and understanding.

Yet the vows of this Nation can only be fulfilled if we in this Nation are first, and, therefore, we intend to be first. In short, our leadership in science and in industry, our hopes for peace and security, our obligations to ourselves as well as others, all require us to make this effort, to solve these mysteries, to solve them for the good of all men, and to become the world’s leading space-faring nation.

We set sail on this new sea because there is new knowledge to be gained, and new rights to be won, and they must be won and used for the progress of all people. For space science, like nuclear science and all technology, has no conscience of its own. Whether it will become a force for good or ill depends on man, and only if the United States occupies a position of pre-eminence can we help decide whether this new ocean will be a sea of peace or a new terrifying theater of war. I do not say the we should or will go unprotected against the hostile misuse of space any more than we go unprotected against the hostile use of land or sea, but I do say that space can be explored and mastered without feeding the fires of war, without repeating the mistakes that man has made in extending his writ around this globe of ours.

There is no strife, no prejudice, no national conflict in outer space as yet. Its hazards are hostile to us all. Its conquest deserves the best of all mankind, and its opportunity for peaceful cooperation many never come again. But why, some say, the moon? Why choose this as our goal? And they may well ask why climb the highest mountain? Why, 35 years ago, fly the Atlantic? Why does Rice play Texas?

We choose to go to the moon. We choose to go to the moon in this decade and do the other things, not because they are easy, but because they are hard, because that goal will serve to organize and measure the best of our energies and skills, because that challenge is one that we are willing to accept, one we are unwilling to postpone, and one which we intend to win, and the others, too.

It is for these reasons that I regard the decision last year to shift our efforts in space from low to high gear as among the most important decisions that will be made during my incumbency in the office of the Presidency.

In the last 24 hours we have seen facilities now being created for the greatest and most complex exploration in man’s history. We have felt the ground shake and the air shattered by the testing of a Saturn C-1 booster rocket, many times as powerful as the Atlas which launched John Glenn, generating power equivalent to 10,000 automobiles with their accelerators on the floor. We have seen the site where the F-1 rocket engines, each one as powerful as all eight engines of the Saturn combined, will be clustered together to make the advanced Saturn missile, assembled in a new building to be built at Cape Canaveral as tall as a 48 story structure, as wide as a city block, and as long as two lengths of this field.

Within these last 19 months at least 45 satellites have circled the earth. Some 40 of them were “made in the United States of America” and they were far more sophisticated and supplied far more knowledge to the people of the world than those of the Soviet Union.

The Mariner spacecraft now on its way to Venus is the most intricate instrument in the history of space science. The accuracy of that shot is comparable to firing a missile from Cape Canaveral and dropping it in this stadium between the the 40-yard lines.

Transit satellites are helping our ships at sea to steer a safer course. Tiros satellites have given us unprecedented warnings of hurricanes and storms, and will do the same for forest fires and icebergs.

We have had our failures, but so have others, even if they do not admit them. And they may be less public.

To be sure, we are behind, and will be behind for some time in manned flight. But we do not intend to stay behind, and in this decade, we shall make up and move ahead.

The growth of our science and education will be enriched by new knowledge of our universe and environment, by new techniques of learning and mapping and observation, by new tools and computers for industry, medicine, the home as well as the school. Technical institutions, such as Rice, will reap the harvest of these gains.

And finally, the space effort itself, while still in its infancy, has already created a great number of new companies, and tens of thousands of new jobs. Space and related industries are generating new demands in investment and skilled personnel, and this city and this State, and this region, will share greatly in this growth. What was once the furthest outpost on the old frontier of the West will be the furthest outpost on the new frontier of science and space. Houston, your City of Houston, with its Manned Spacecraft Center, will become the heart of a large scientific and engineering community. During the next 5 years the National Aeronautics and Space Administration expects to double the number of scientists and engineers in this area, to increase its outlays for salaries and expenses to $60 million a year; to invest some $200 million in plant and laboratory facilities; and to direct or contract for new space efforts over $1 billion from this Center in this City.

To be sure, all this costs us all a good deal of money. This year¹s space budget is three times what it was in January 1961, and it is greater than the space budget of the previous eight years combined. That budget now stands at $5,400 million a year–a staggering sum, though somewhat less than we pay for cigarettes and cigars every year. Space expenditures will soon rise some more, from 40 cents per person per week to more than 50 cents a week for every man, woman and child in the United Stated, for we have given this program a high national priority–even though I realize that this is in some measure an act of faith and vision, for we do not now know what benefits await us.

But if I were to say, my fellow citizens, that we shall send to the moon, 240,000 miles away from the control station in Houston, a giant rocket more than 300 feet tall, the length of this football field, made of new metal alloys, some of which have not yet been invented, capable of standing heat and stresses several times more than have ever been experienced, fitted together with a precision better than the finest watch, carrying all the equipment needed for propulsion, guidance, control, communications, food and survival, on an untried mission, to an unknown celestial body, and then return it safely to earth, re-entering the atmosphere at speeds of over 25,000 miles per hour, causing heat about half that of the temperature of the sun–almost as hot as it is here today–and do all this, and do it right, and do it first before this decade is out–then we must be bold.

I’m the one who is doing all the work, so we just want you to stay cool for a minute. [laughter]

However, I think we’re going to do it, and I think that we must pay what needs to be paid. I don’t think we ought to waste any money, but I think we ought to do the job. And this will be done in the decade of the sixties. It may be done while some of you are still here at school at this college and university. It will be done during the term of office of some of the people who sit here on this platform. But it will be done. And it will be done before the end of this decade.

I am delighted that this university is playing a part in putting a man on the moon as part of a great national effort of the United States of America.

Many years ago the great British explorer George Mallory, who was to die on Mount Everest, was asked why did he want to climb it. He said, “Because it is there.”

Well, space is there, and we’re going to climb it, and the moon and the planets are there, and new hopes for knowledge and peace are there. And, therefore, as we set sail we ask God’s blessing on the most hazardous and dangerous and greatest adventure on which man has ever embarked.

IT’S “PREMATURE” FOR VOTERS TO DECIDE ON LBTS REDEVELOPMENT FUNDING IN 2012 …

Dear Readers …this will be really interesting to see what the voters in the south and Sea Ranch Club do at the next LBTS Municipal election …Will they believe that “big ticket” redevelopment projects will not be approved by the same dais members right after the election now that two out of three of those possibly seeking re-election made the decision it is “premature” for the voters to do so … Three members of the audience came to speak against it …BTSFuture Editor Mark Brown, Edmund Malkoon and Ron Piersante… Mark Brown doesn’t want them on saying it makes it becomes “political” ….”don’t dump it on the public” that they “trust” this commission to make the “tough decisions”…”vote it up or down” …”don’t waste time and money “…….  Ron Piersante facetiously added to put the police and the sewers on a referendum as well …further adding it is for the Commission to make these decisions…He asked “Do you think they would pass?”….”What happens if they all vote no? ….The Mayor read a prepared speech stating the same criteria of making these hard decisions as what she ran on and why she was elected… That’s not how I recall it at all and that’s certainly not this writer’s opinion! … The mantra was they do not know the costs (all three undergrounding El Mar Dr./Town Hall Complex & Plaza/Parking Garage(s)will be over 10 million each ) and besides they all said they do not believe these items will happen for at least 5-10 years … WHAT! ….If that’s so why are we spending all this time and all this money for costs and designs this year?… That time frame would would mean the Town’s Master Plan would be up for revision once (or twice) again…and that begs for the answer once more from this writer…just who directed this full-scale redevelopment plan instead of a simple revision especially if the majority at the table tonight are being honest about the reason not to have these referendum items on the next ballot?… One more surprise came when the Town Manager stated she is getting costs of undergrounding from other municipalities and asked the Mayor and Commission if they wanted  rough estimates or to spend approximately $7,500 on FPL giving us accurate costs… HUH?… The direction from this Commission was given some months back for an RFP to go out …(it should have been out already) … This should have been done at the beginning …Comm. Sasser asked for ballpark figures and spoke of the costs of studies and RFPs just to find out the costs…His comments fell on deaf ears….The referendum is dead now unless a PAC picks it up and gets a petition going to put it on …That would be the CIC and it remains to be seen if they even have enough members and/or the drive to carry it out….Now we’ll have to see how many other voters wanted to have a say in what happens after the January 2012 election by who will be sitting on the dais when the votes are counted…. The results of this election will speak volumes in just how quickly that 5-10 year plan for these three items become the #1 priority to carry out!….Kudos to Vice Mayor Dodd who tried very hard to remind all about the timetable required to have these items on … as well as his history of wanting the voters to decide such major issues as they have in the past…after all it is the voters..the taxpayers who pay for it…. in the end…

PARKING DEBT …. NO ACTION ….

The Parking Debt for the parking lot will not be addressed until September and budget time…

The majority on the dais Mayor Minnet…Commissioner Vincent and Commissioner Clottey believe we should keep this loan on the books coming up with reasons this writer finds to be a bunch a malarkey… The Mayor started by  saying it’s self funding and we will need the money that could pay it off for other capital improvements… Commissioner Vincent who has become increasingly annoying with his pot shots at VM Dodd and his all over the place agreeing with one commissioner only to say he did not say he agreed  a moment later… as he held onto the belief we would have trouble getting another loan and there is no need to expedite this…Commissioner Clottey said while she agrees with Comm. Sasser on paying the loan down  …we need the money because we are a “hurricane prone area”…Perhaps she forgot the emergency fund that is well above what we need and that FEMA will come in after that… Any bigger catastrophe from a hurricane …there cannot be enough reserves to cover…Funny to watch Mayor Minnet agree with Clottey on this one… She went on to speak of something breaking and not having the money…VM Dodd tried to ask  Finance Director Doug Haag what he would do if this was his own loan to pay off or not… The answer came back as this is a “liquidity” issue…and borrowing from Comm. Sasser who earlier stated while addressing the referendum issue “I agree with of you and none of you” on the points made to pay or not pay off the loan and said we might need these funds for capital improvements… To go for a loan later we were told by the TM and Finance Director would leave us open to not knowing what the rates will be in the future ….We do know the rate now on the one we have and it’s 3.95% which is well above market for the time we are in.as the Finance Director included in his backup …..Comm. Sasser tried as well to talk about not having to pay interest and having more money in the General Fund… yet again he was met with less than plausible reasons for holding on to it … in my opinion… The lowest point for this writer was watching the old Colon-era shenanigans of acting as if we have no money in the coffer … until the TM made it clear they were only referring to the “undesignated” General Funds… Comm. Sasser pointed out as well how flush we are with funds… The Mayor again spoke of waiting until budget time to make sure we have money for projects… She also took Comm. Clottey’s point made at the previous Commission meeting about paying off a portion of the debt and perhaps having no penalty attached… Comm. Clottey surprisingly remained mum on the subject… Comm. Clottey did ask the TM how having this debt or paying it off affected our bond rating…The TM said we don’t have a bond rating…When the VM said to continue to push on the penalty charges with Sun Trust Comm. Vincent snapped at him once again… Between the bad jokes and the bad behavior it’s definitely bad form on his part …. The TM after Mayor Minnet picked up where both the Vice Mayor and Comm. Sasser left off on dealing with the penalty costs and said the Town could continue to negotiate the pre-payment penalty with SunTrust between now and Sept. was first told by TM Hoffmann they would negotiate when they knew what they were going to do… but then seemed to back away from that statement…

When it came to the assembly line of ordinances that came before the Commission at their last commission meeting for first reading and second reading along with the plethora of resolutions…thirteen in all …..the above song came to this writer’s mind as each one was read by the Town Attorney….. “If the words sound queer and funny to your ear, A little bit jumbled and jivey.”… “Oh, mairzy doats and dozy doats and little lambsy divey A kiddle divey, too. Wouldn’t you?”…   All those ords and resos brought forth very little Commission discussion save one item that removed signage due to the Master Plan redevelopment plans in the works (after being approved prior in lengthy P +Z discussion as well as this Comm. and being written up by the TAtty.)  with no public comment on 12 of the items … This writer really wanted at least one of the Commission members to put the onus on the Town Atty. that these 13 ords and resos actually contained what had been agreed to and actually no longer contained what was directed to be no longer included because there is no way they all read through the 13 items before approving them especially after receiving them on the evening of the previous Friday or later depending on when they picked up their fob with the backup and actually opened it up before Wednesday night’s vote… There is reason for such a request being on the record in my opinion…We have seen in the past votes for ords and resos which did not contain either in the final approved product only to find out later on while facing a situation that came before them … I further wonder the cost for all these ords and resos from the Town’s contracted law firm as some of those newly passed this evening are still not correct and will need to be amended or totally redone after the Master Plan as well as the Comprehensive Plan and the Charter next year… According to the April TM Progress Report “costs running ahead of budget” with out attorney costs at this point in the fiscal year … in the Mid-Year Budget Report there was a current monthly charge that was included that included “Administration 52,730.03/ Legal Expense 44,859.00 with more resos wanted by Mayor Minnet at each Commission/Roundtable meeting to make the County/State know where we as a Town stand on different issues…The question is what does a reso cost?…What does such a reso do once it is received by the County or State? …(filed and forgotten?) …. Is it really necessary?… One such issue coming back on the next Roundtable Tues night besides the signs is conditional use parking program …It appears that it was not made clear to the Commission that conditional use was already in our code …which means for those who want to continue to use their parking lots for beach parking …. parking not needed to meet their parking requirements … “shared parking” … they must follow the steps in place which include a $900 application fee and they must appear in front of the P & Z …Hmmm… Again we are going to “stick it” to our two major tourist attractions in town Aruba Beach Cafe and the Pier … Shades of the fees former TM Colon collected in her administration…I don’t believe it was done in the same manner by any means by this Administration …but due to a lack of full information being presented to the Commission of the impact to add this parking program to the conditional use code which has now led to this most unfortunate outcome … “If the words sound queer and funny to your ear, A little bit jumbled and jivey. Now to more from the pile …

The BSO contract is on tomorrow night’s Roundtable and contained in the backup on the Town website …As previously posted Comm. Sasser asked the question of going out for RFP after he stated he had been asked and assumed other Commissioners had as well… I have asked at least one other who has not been asked for an alternative to the BSO and when I have asked the question of others from both sides of the political divide in town …I too hear no desire for an alternative public safety provider nor our own department… The Commission after some lengthy disjointed discussion on the dais called for a workshop first per the Mayor but changed it to the Roundtable after the Town Manager stated they did not have much on the agenda … According to the backup 3e BSO informed the Town that the State Attorney General in an opinion concerning Hallandale Beach found that no public safety provider can cross over to another municipality to supply service except by mutual aid…The TAtty. concurred …That leaves one option…our own police force …That option was a loser in the last election…big time!… In the meantime further numbers came to  the negotiations last week as the TM said they would…According to the backup from a May 5,2011 meme the TAtty. states the increase will be $545,000 more than last year …which avid readers will recall this writer posted previously would be the case…I have been hearing this since last fall …. a line item budget has been requested …. The regional costs are not included in that price as we were told would be the case going forth with services such as the call center ..The TM added the cost for that was $132,000 not $125,000 as stated at the 4/27/11 meeting… There are grant programs that would possibly allow some aid for a police staff position as well as using some of the LETF …(not sure how that one works?) … Also the backup states the cost for the crime lab being tacked on separately to municipalities has not arisen to date… This writer is still of the opinion that the current BSO Police are our town police department …Public Safety is always the largest piece of the budget pie in any municipality and the actual cost now known in black and white when compared to what we were expecting we would be hit with is half or a quarter of what was long believed to be coming our way after our “subsidy” ran out! … Commissioners should now move forward with the BSO …working with them to deal with the County… “If the words sound queer and funny to your ear, A little bit jumbled and jivey. Looks like the Municipal Election will come a few months early next year just as it did in 2008.. Backup 3ai states it is an option just as it was then and will save the Town $11,412 …If Mayor Minnet, Vice Mayor Dodd and Comm. Clottey decide to make another run as all are allowed to do under the term limits… they have to go along with the earlier election… not only due to a precedent set but for fiscal responsibility… The date could be January 3 or 31, 2012 … qualifying date for candidates mid-Nov. (no set date as of yet) … That leads to the next item on the agenda put on by VM Dodd …item 3aii Referendum Ballot items on the big ticket items that will result from the Master Plan Redevelopment Plan in progress… Included in the above item 3ai was the timeline to make that happen…

When covering this item it is imperative due to the expected change in the date of the election for the Commission to move ahead and get the referendum items on …for financing the undergrounding of El Mar Drive/ Town Hall Complex and Plaza Redevelopment (El Prado parking lot) /public parking garages …It is this writer’s opinion that any elected official running for another term and chooses not vote to allow for these referendum items to be on the ballot in January should seriously reconsider running again… This writer has heard from many in the south end of town as well as SRC and they will seal the fate of 2-4 more years based on that decision… These taxpayers are not stupid…They do vote with their pocketbooks and do not believe these items are moot after the 2012 election unless they the voters make it clear they are moot… SRC  year after year has overwhelmingly voted no to reserves wanting to hold onto their own money and then be assessed at the time additional funds are required and votes are required on the projects …Building B which is my building has a new assessment of $4000+ based on my apartment size for this year … Add to that the fees that have increased for sewer…water…and other utilities as well as gas going up…groceries going up and those who have seen their savings take a hit… Others who missed the “hit” personally last time are feeling it now… They want to vote on the redevelopment…These return candidates know they cannot win without SRC and the voters in the south end of town…  VM Dodd should not close out this item until he has consensus one way or the either with each member on the record… Add to that the Mayor has an item 3b to address whether to have an Aug. meeting as VM Dodd wants to stop the avalanche that arises each year in September when the Comm. forgoes Aug. altogether …More important now would be the required 1st ord. reading for the ballot items in Jan!… “If the words sound queer and funny to your ear, A little bit jumbled and jivey. Item 3f is the Parking System Debt … and paying it off… The Town as expected wants to keep it… We  borrowed $2 million dollars at 3.95% in 2005  compounded monthly from Sun Trust … Annual principal payments are $146,000 with annual interest payments at $31,000 … The Parking Fund pays the costs… as of May 3, 2012 …

The Finance Director answered the question of the pre-payment penalty reiterating what he stated on April 27, 2011 that it was standard language in these type of contracts offering protection to the bank… He went on to give some ways to pay off the loan after saying he had spoken to Sun Trust about the penalty cost and they are looking into it (Comm. Sasser asked that be done) .. adding the penalty cost is too high at the present time for prime rate interest rates are at the lowest we have seen them in “modern times”… He said if we pay off the loan it will take 2-2&1/2 years to recover the pre-penalty costs (if not reduced) by avoiding the int. payments we would make… He again stated the Parking Fund does not have the funds to pay off the debt …adding the Gen Fund has $3 million and to take it from there would cut into projects …(Hmmm…how much was transferred to CDs in the last few months for 12-18 mos.at a really low return rate?) … Finally Mr Haag states we could refinance the loan… which may or may not cost us depending on the bank we deal with (requires an RFP or SunTrust negotiations) … This item ends with the desire to have the funds to expand the parking …signage …location and pay stations  over the next 3-5 years… This writer says…pay off the debt…What does it cost for the Parking Dept. vs. what we get back? .. Is LBTS growing government… Is patronage a word that’s very familiar in Chicago becoming the norm in LBTS?… We have a list consultants …some with ties to our Town Manager in her capacity as a headhunter for Town Manager positions as previously posted with the hiring for one month at $6,500 of ousted Davie TM Gary Shimun (similar to LBTS Colon ouster) …simplify the permit fee schedule and keep permit fees for small jobs reasonable… Now we hear a consultant Pat Himelberger has been placed into the budgeted position of Asst Municipal Services Director for the remainder of the fiscal year. …working 25-30 hours a week on an interim basis in this position. …(maxed out under the $15,000 TM no Comm. required allowance?) ….She is taking over some projects such as the new telephone system, parking operations RFP and will help to review all of the responses we will be getting to various RFPS and RFQs. …TM Hoffmann knows her through work she did at the City of Oakland Park where she progressed through the ranks from Special Projects Coordinator to Assistant to the City Manager, and Assistant City Manager. Pat is a certified Project Manager….Perhaps this is a “stepping stone”…for the Master Plan Redevelopment position coordinator to come?… To this writer it seems a strange title for work being done… budgeted position or not…  I believe in the past that position showed up in front of the individual who is now the  head of Community Standards… In the TM April Report Ms. Hoffmann stated she was not going to replace the part time position of a finance employee who resigned …and was increasing the salary for further employment of a new Finance Director… Now we have a new part time employee…no mention of the salary…  An RFQ  for a variety of professional services is set to go out as early as the 18th …most covers services that we would need for redevelopment projects …(studies/designs/redesigns and coordinating companies used) …”If the words sound queer and funny to your ear, A little bit jumbled and jivey. The Halloween investigation has ended with nada!… We heard the BSO took their investigation report to the States Atty. and was turned down by more than one due to the insufficient evidence of the items… Also it appears that the person with the answers of what was in the warehouse and what was removed…Marc Furth would not be interviewed saying it was only to give him “grief” and any further information would have to be done through his attorney.. That appears to have been the extent of that portion of the investigation… There was a “hand-off” of blame through the ranks of the previous Administration when asked about the contents missing and who gave the go ahead for Furth to remove his items from the west warehouse… We hear  former TM Colon responded that she asked Municipal Dir. Prince to personally assist the move with Furth of only Furth’s items…Prince passed the job on and does not state he was told not to… The employee who went with Furth saw Furth discard items into a dumpster stating they were ruined from the bad weather at the previous Halloween…He took a “mummy” with him… That employee and another employee said they were not bothered by the items going in the dumpster believing they belonged to Furth… They said they passed that information up through the ranks after the fact… Others in town were interviewed on the weather and the items..They discounted bad weather ..No weather report was included in the report to clear that up…(This writer was there that year and posted…no bad weather is correct)… The receipts for the Furths added up to approx. $500 and total of items is said to be well above that… The outcome for the Town…we now keep a current inventory…which is good…The outcome for the former Haunted House / Special Event Coordinators Furth … is bad…leaving a bad taste in the mouth of anyone who reads the actions and the outcome of this report …Hmmm… will that come up on May 15th as the CIC meets to vote in new board members?…”If the words sound queer and funny to your ear, A little bit jumbled and jivey. Speaking of Furth… takes me to the coral reef project still not in the water after all these years and monies spent… The Town Manager informed the Commission a few months ago about trying to get a grant for the project and signage… Last week the Town learned it would most likely not get any funding… After asking for feedback one reason that came back for no funding we hear was due to the feasibility of Biorock technology…This writer posted about that long ago when we were at odds with the vendor and I Googled to research the issue… The outcome though …this Commission chose to go ahead and provide further funding for future maintenance…”If the words sound queer and funny to your ear, A little bit jumbled and jivey. This writer was sent some pics of the new benches and Adirondack chairs the Town Manager purchased for the pavilion and El Prado Park …colorful pinks, yellows etc …with a Key West feel … Like em? … Cost not disclosed ..yet …

The Town consultant for traffic engineering looked into our contract with Broward County after they turned us down for re-striping some roads in the south end of town…She told us to appeal and after doing so the County is going to that and more …saving us approx. $5,000 if we had to do it ourselves… Hopefully the Town will look townwide for other areas in need of work as well …

A few months ago it was the return of the issue of speedbumps on south Seagrape a subject hashed out long ago by the Town …Now it is the issue of Terra Mar and beach access … 100 signatures were given from residents wanting access… The Mayor put it on the Roundtable… The Mayor should have already been well acquainted with the answer the TAtty. gave on the issue once again… There is no statute requiring access to the beach …The problem for Terra mar is still the same one …only a portion of Terra Mar homes have access through a beach private access entryway that goes along with the property… Tera Mar is certainly asking for a lot these days… ala Bel Air pre- 2010 …

The County has saved millions to fight redistricting which will impact our County Comm. Chip LaMarca the most… upwards of $30 million …Funny how money is saved for items that impact future elected positions… This writer is not for redistricting … Broward County’s new Ethics Ord. is on the Roundtable for tomorrow night.. It is quite “enhanced” and overwhelming to municipalities …Question is can they adhere to it themselves? …

THANKS TO ALL FOR THE QUICK HEADS UP ….

Dear Readers… I appreciate all the texts and phone calls after someone hacked into my Yahoo account a few hours ago and decided to send anyone I have ever sent or received an email from an emergency email saying I was in Spain…lost my wallet and needed money… It was sent out misspelling  barbara by using 2 rs… Needless to say I am not in Spain …haven’t lost my wallet and do not need anyone to send any money!… I was made aware as I was feeding Lilly here in Chicago … dealing with toddler food…toddler mess and this computer mess … .

Again …thanks to all who took the time to forewarn me and to those who receive it… hit delete!…

On a positive note…I did hear from people I have not talked to in some time …who are well and happy …and a dear friend who I have been remiss in keeping up with who shared some wonderful and amazing news concerning his health that was worth the hack to hear it first hand!..

SOME THINGS ARE HARD TO SWALLOW ….

Dear Readers … the Town Manager monthly report was moved up in the agenda …It was moved to the end after the new Commission took over …Over the last 4 months though the TM continuously took take a pass along with the Commission on discussing the content due to the late hour placement …Unfortunately this earlier placement did not fix that ongoing problem after the Commission went off the reservation following a question asked by Comm. Sasser after the TM spoke about the first item in her report concerning the BSO contract negotiations…

The Town Manager began her report after the Mid-Year Budget Report (see prev. post) …and she would “run through these items really quickly.”… She stated she knew everybody was most interested in the BSO negotiations and proceeded to describe having the first meeting with the BSO (and the  “Interim” Finance Director according to the backup) … She went through what was contained in the backup explaining “The BSO is going to a very standardized contract with all the cities they renegotiate with.” …She went on to say she agrees with this type of contract as do most city managers which she further explained stops what had happened in the past when “people were basically looking at other people’s contracts and saying I want that, I don’t want this.”…She said it made alot more sense ….adding it is much more transparent contract where we know what is the costs to provide police services in your town and that is what BSO is charging you… She said they identified what services are considered regional and should not be charged to the contract cities and so far the County has agreed to that…She anticipated questioning of why the County is involved and informed all that it is the County that funds the Sheriff’s office ( The Sheriff’s audit was given to the County Comm. last month) …The County has been approving contracts like ours …TM Hoffmann stated she had suggested some changes to the contract but did not expand on what those changes were and was never asked by the Commission throughout their discussion to address those changes that the TM stated would be brought back with a formal response at the next meeting to take place this week …In the backup the TM wrote they had ‘informal agreement on most of those suggestions’….After that TM Hoffmann said the big question was what will it cost and she did not give a figure (again, we have been told it would be around $500,000+) but said that figure was promised “or at least what they are going to propose as the cost to continue services at the same level” …BSO Chief Llerena came to the podium to state it was slated to be released on May 1st for all municipalities after the County and the Sheriff get together on the proposed budget…The Mayor asked him to remain at the podium to answer any further questions… The TM went on to state that she would take a look at the numbers and that they had talked about a line item budget which was not received in the past negotiations…She did make a point to say that the Chief had been sharing such a report with her on a monthly basis…as well as to state “I have to say I have sat in negotiations with BSO on municipal contracts in another city in the past and it has been such a pleasure. Things have changed dramatically in the way BSO sits down and negotiates. It’s very transparent and it’s very friendly.”…She said she would be back with the numbers after she looks at them and then they will see how they it fits into the new budget… TM Hoffmann said the BSO is only interested in recouping their direct costs from the cities they contract with and if a city determines that cost is not affordable then the city sits down with the BSO to talk about adjustments in staffing in order to reduce the costs… She stated those are discussions the Commission/Administration will be having at a policy level as they go through the budget process…

BC-This is when the proverbial wrench came in and started to turn the nuts and bolts of this LBTS-BSO re-negotiation for the new contract slated according to the TM report backup to be completed no later than June 30th counter clockwise …

Comm. Sasser started out with a joke as BSO Chief Oscar Llerena stood at the podium ..”I first wanted to dispel the rumor we were trading Lt. Cedeno with one one of the police women of Broward County!”… It received a warm chuckle from all…and this writer wishes Comm. Sasser would have left it at that…He went on to ask the Town Manager a question he said he had been asked …”Are we not getting any other bids other than negotiating with BSO?”… The TM responded she “has no direction to do so.”… There was an uncomfortably long silence that followed that response and for some reason the TM chose to fill it… in my opinion …. as the nuts and bolts began to loosen … “If the Commission chooses to send me down that course we can do that.”…She continued on to inform them that if they were thinking of going to contract with Fort Lauderdale or Pompano Beach (PB is BSO so that leaves Fort Lauderdale) the Sheriff has to approve it because he would have to deputize the new police officers to work outside their municipality  (I do not recall that from the current contract or addendum) …as she added “Then there is obviously another option to form our own police department.”…She reiterated her direction thus far was to negotiate with BSO…

BC- The wrench…the nuts and the bolts…. We had many such discussions about other options prior to the 2010 LBTS Municipal election and this writer posted all of it… The highest priority this writer and the candidates heard out on the campaign trail after former Town Manager Colon and her contract was to retain the BSO police in LBTS!…  To go down this road at this juncture is mind boggling to say the least …

Commissioner Sasser stated again he just wanted to “get it out there”…and he said he would leave it to the Mayor on how “handle that”… He said “If everyone is ok whatever”…reiterating it was a question he gets and was sure other Commissioners had been asked as well.. From there he asked about the “writeup” and as they look at the budget each or use it as a budget item he wondered if they cannot afford it would they have the right to terminate at that point and asked about our rights… The TM there would be no agreement on a budget or the Town determines costs to be too expensive…confirming the contract provides us the option not to proceed and the notice time was not long to get out of it… Comm. Sasser said his concern was if we enacted the termination would we still have time under old costs to find another solution…The Town Manager said the contract anticipates that kind of situation and the Sheriff in the contract affirms he will provide services for as long as it takes the Town to start with a new provider or own force… Comm. Sasser asked it that would be under the new or old price … TM Hoffmann said it would be negotiated…

BC- From what I remember the contract says a price will be negotiated I believe month to month and the Sheriff will stay on until he is sure they are leaving us with the same level of service they provide…I also believe that would mean we are going to pay two police departments…. for an uncertain length of time…Also I recall that we found out after a long period of being led to believe we own all the police vehicles that we only own one or two…Add to that the equipment we supplied at the time BSO took over will be given back to the Town but I do not think the contract states it needs to be anything other than what they started out with all those years ago…not any new equipment replacements…

Vice Mayor Dodd was up next and he thanked the TM for “an absolutely terrific report”…and said he appreciated how much work goes into it… This writer will delve more into that report and must respectfully disagree with the VM) … He went on to say he questioned the regional services portion of the contract saying he could see “the thin end of the wedge here” for our town as he went on to describe the costs for the call center (911) and other such services which will now split off just like airlines who charge for bag service …The TM said that absolutely is going to happen and we’ve been put on notice from the County that they will no longer fund cities receiving emergency call service…She said the Sheriff doesn’t agree with it and the Town as well as as all municipalities in Broward County in the same situation do not agree …She said the County Manager sent out letters to every city saying this is what your costs will be next year and ours is around $125,000…She said  the Broward City Managers Assoc. put together a task force last fall and studied this issue of the call centers and concluded they should be consolidated down to four that can serve the entire county leading to a substantial savings… While that was the conclusion she added no one is pushing for it…She said the Mayor sent her a copy of a letter from the Mayor of Sunrise to have the Broward League of Cities take this issue on …The VM asked “So we can expect some increases coming down the line?”… The TM responded that starting Oct. 1st we can expect to be charged $125,000 for emergency call services …adding that’s not a BSO charge that it’s a County charge …VM Dodd asked if we are “Obliged to go with that call service “..asking if there other options for municipalities… The TM responded yes and many cities have there own call centers which led to the problem and why the County doesn’t want to keep doing it after those cities complained about those contracted with BSO receiving the services…She mentioned Fort Lauderdale and Hollywood as two that run their own at huge cost and went to the County about LBTS and Pompano Beach… VM Dodd asked if we could go to Fort Lauderdale to see if we could do it for less than $125,000 …The TM said yes…VM Dodd said we should do so and send Broward a message …The TM backed off a little and asked Chief Llerena about Pompano Beach having their own call center …He responded that BSO communications is used for both and that Pompano Beach has BSO for police services ..The TM asked if cities are paying the capital costs and BSO is paying for the staffing…The Chief did not know …The Town Manager said if the Commission wanted her to look into this they would and also explore consolidating the centers as well..

The Mayor asked the TAtty. to give the history of the County’s past stance on wanting to provide this service and that it was not to charge the municipalities …She added she knew she was catching the TAtty. off guard…Town Atty. Trevarthen responded she didn’t have the details but had the same recollection ….The Mayor went to say  these are fees we pay through Broward County and that everyone should call their Broward County elected officials which for us would be Comm. Chip LaMarca to say we are not for this change…adding the Sheriff is not for it either …She went on to say that before she recognized Comms. Clottey and Vincent she wanted to “follow up Commissioner Sasser’s discussion that would would take us in a whole other direction. He had asked a question does this Commission and we had not discussed this prior, we asked the Town Manager to go into negotiations with the Sheriff.That was then direction you received from this Commission is that correct”…asking the TM…The TM replied yes and that was what she has on her priority list…The Mayor reiterated it and TM Hoffmann said yes again…The Mayor went to say “Are we changing our mind? I think that’s what we need to determine right now because if we do we need to, I think have a workshop so that we understand what direction we’re going in. Are we going to change direction and therefore go out and try and contract with another municipality or start our, if it is the intention of this Commission to look for, get an RFP out to the city of Fort Lauderdale or start our own police department. I think before we continue we need to hear what this Commission’s decision is”… She threw it over to Comm. Sasser who she said made the initial  “request”  asking him if he wanted to request a workshop to discuss those three measures…

BC- Before Comm. Sasser’s response this writer asks the all important question…What happened to the Mayor showing some leadership and nipping this in the bud by stating the obvious that this is not the right direction to go in… That avenue was open to her when Comm. Sasser originally ended his first bite at the apple and said he would leave it for her to “handle that”…

Comm. Sasser said he would like a workshop to discuss it “sure”..He added he thought it should be “vetted”…He went on to say he thinks in any situation or negotiation it’s always better to have competition and he would like to know what the options are and whether it is Fort Lauderdale or someone else …He quickly added “I’m not keen on building our own” police department but he “wanted to at least judge the interest of other police departments that could do the job and possibly help us with out negotiations, yes.”…

BC- I respectfully disagree with Comm. Sasser and do hope the prior Commission backup on other options is supplied to all to quickly be able to see it will …in this writer’s opinion…. not help the negotiations with BSO who are our Town Police Department in most of his constituent’s opinion …but just slow down the process unnecessarily …

The Mayor asked for consensus and threw it over to the Vice Mayor  if he wanted a workshop scheduled…  The VM said he just wanted the public to be aware of BSO taking one part of the new contract and saying that was what they are negotiating as their new price while Broward is going to be “saddling us with extra fees for an area that used to be part of BSO’s contract”…He added we don’t have alot of options …He wanted to be “on the record” for saying BSO is doing a terrific job and there are absolutely no complaints..But he added he has to be responsible to the taxpayers and try to “educate them how negotiations are going at the moment is that BSO will do policing but Broward has the regional component.”…The Mayor tried to cut him off… The VM continued saying he has “a big problem with it. We are paying a certain figure all encompassing but was sure BSO figure has not gone down with all the regional figures Broward is now providing. It’s a way of inflating every municipality and I’m pretty much against it.”…The Mayor said her question was if there should be a workshop for other options for police service in town… The Vice mayor responded “No, I’m very happy with BSO but we should look at other options for the stuff that BSO don’t want to do to send a message to Broward.”.. The Mayor said she agreed with him completely …

Comm. Vincent was asked next but said he had other comments and would wait his turn..

The Mayor acknowledged Comm. Clottey who said “I agree with Commissioner Sasser that we have an obligation to the taxpayers of this town to explore all avenues. I have my own personal choice. I wold like to stay with BSO but if they price themselves out of the market then we have to think about the taxpayers also.”…She then asked the Town Manager about the “lab fees” as part of the “regional stuff”…She was speaking of the criminal lab fees being passed on as well…(This too was brought up by the prior Comm. by former VM McIntee) …The TM said they had not talked about this and she did not recall  where that “sat on the list”..She would get the answer and asked Chief Llerena if he knew… The Chief responded no but added it is a major budget issue with the County Commissioners as well and “the Sheriff obviously feels it’s a terrible mistake to close the lab down.”..He said he was not sure where it stands as of now… Comm. Clottey asked what kind of additional fees there would be to BSO’s fixed charges…The TM asked if she was inquiring about BSO’s direct services…Comm. Clottey replied that up til now there was a fixed charge which is the County is now “unbundling” and said that when the TM is negotiating it will be that “flat rate plus whatever additional fees the Town is going to be stuck paying.”…The Town Manager again stated the only addition know right now is for the communications center …Comm. Clottey added the criminal lab fees to which the TM said that had not come down to her at this time for us to pay… we haven’t been told that and she reminded all that the Sheriff fought against it last year and prevailed …although it is not known if he will prevail again… She said they all need to consider as well that the Sheriff’s budget has to be approved by the County Commission..all agreements say the County has to approve them….

Comm. Vincent asked the Chief a question …”on the 125,000 additional fee is that proportionate charge that is figured for services for our town in respect to other sizes of cities?”… The Chief said he couldn’t definitively answer that but he could tell him that all cities are paying  different fees and it seems they may be based on population or maybe based on calls for service..He was not sure what criteria it is but did know there was not one set fee for every municipality… Comm. Vincent said that made sense and would like to know that information and was sure “Connie can get that.”… He went on to ask if the services we received prior to this change were a benefit this town was getting that other municipalities may have been paying for in the past… (This too was covered by the previous Commission and in the Sentinel ) … The Chief responded in terms of a “subsidy” there was one with LBTS saying it meant it cost more to operate the district than the Sheriff was collecting from us..He said unlike the private sector those costs were passed on to the County taxpayers which was why the County Commission started cracking down on the Sheriff to organize the new contracts making them more balanced…He said it was due to prior administrations ..He added that other municipalities have monetary issues..LBTS does not an has paid “every penny they were obligated to. The issue is just the balance of revenue post expenditures.”… Comm. Vincent said “There’ve been some inequities at some time with different municipalities for those services basically.”…The Chief said yes…

The Mayor asked again for the need to “clarify the direction to the Town Manager because we’re entering budget time. If we look at getting out RFPs …so we need to…There’s been a recommendation by Commissioner Sasser to put a workshop together to see what other opportunities we have for police services her in the town of Lauderdale-By-The-Sea.” …

BC- It was the Mayor who first said said they needed a workshop (see above) …

The Mayor said to the VM that he said “the workshop would be more to an understanding of the costs that Broward County is now adding on, would that workshop be also to determine whether we would look to our own police department or other services as well”… The VM said no he didn’t want to go in that direction and reiterated wanting inform the public of the add ons coming from the County with more to come such for any extra services provided over and beyond local protection provided by BSO although he would be happy to have a workshop to talk about that and try and put pressure on Broward “… The Mayor said they could put together a resolution as Sunrise has to let the County Commission know our displeasure and discuss it at a workshop “along with what Commissioner Sasser wants to do”…saying they should set the meeting up…

Comm. Vincent wanted to weigh in again and said “I’m just thinking back in recent history that I appreciate what Pompano Beach did for us as they went out and looked into and investigated the possibility of either going to another municipality, another department, I’m sorry I think starting their own and they spent alot on that in the millions I believe and it just panned out and they’re a bigger city than we are with alot more money and they didn’t think it would be financially sound for them to do that especially at this time and I believe they put a stop to that and continued to contract with services of BSO. So with that and Pompano doing the homework for us to go down that road at this time so I’m not in favor of the Roundtable discussion”… The Mayor informed him it was for a workshop to discuss giving the TM direction … True to form for Comm. Vincent he then said the following “Correct, unless there are some issues that we need to address within the contract if we can do so legally have a separation from other cities so yeah, I mean, I think we need to look at that.”…

Comm. Clottey said she believed Pompano Beach found they would save alot of money (she is correct) and that it was the people that did not want the city to change from BSO (correct again) ….She again stated her preference for BSO (quite a turn around after everything she said about them early in her term..prev. posts 2008-2009) … But she still thought they needed to consider other options because she understood we would be paying $434,000 more due to not paying our “fair share”… She asked the TM to respond…TM Hoffmann said there was a study done and LBTS was the most subsidized city ion Broward County and the cost increase would be “$400 and something thousand dollars a year”…

Comm. Vincent never knowing when to remain silent addressed Comm. Clottey to say he believed Pompano’s conclusion was the start-up costs for their own department would take 7 years to “break even with the initial startup and the savings on that and the setup on that was so high that would come out of pocket for that I don’t think this town could afford it.”…

The Mayor said it “sounds like a workshop “..as well as “what level the County will charge us”…. “plus the other options” thanking Comm. Sasser… The TM said the Commission had a light Roundtable scheduled and they could have the discussion then…It was agreed upon to have it at that time…

BC- this writer chalks this up to too many meetings on the Master Plan and the Master Plan redo taking all of the members up on the dais way off track on the priorities they were elected to address over the first 2 years of the new majority’s term and the priorities they started out with in 2010 and gave direction to the Town Manager to go forward with… The BSO contract was at the top with the drainage downtown and the drainage in the residential areas  as well as the sewers in the south … For certain Commissioners and members of the staff to speak of money woes when it comes to retaining the BSO police is unacceptable!… We were under the impression that a new contract could be a million + and still the overwhelming response from voters was keep them…Now we know it will be nowhere near that amount… To question our ability when we have spent well over $150,000 which most likely will be close to $200,000 on consultants is embarrassing… The Town Manager made it clear the regional costs will be coming our way no matter who we use for public safety in LBTS… Last but not least as the TM has stated along with this writer and so many others …the BSO of LBTS is our own Town police department under Chief Llerena and Lt. Cedeno (as it was under former Chief Scott Gooding) and that final point along with remembering it was not so long ago each Commissioner and the TM went on the offensive to keep Lt. Cedeno here in order to maintain the unique partnership we have with BSO!…

My opinion, Commissioners… at the next Roundtable ….. with the expected discussion taking place…do your homework ahead of time and then drop any direction at this time to look elsewhere and choose to work with the Sheriff to counter the County Commission’s regional fee plans along with other municipalities… To the TM and the Mayor there are times when it is time to step in on topics on the dais…this was one of them….

After that the Mayor asked for any other questions for the TM…Comm. Sasser was the only one to respond and asked about the Coral Reef project that was written up to start in late April as they were now just a few days away from May… The TM said she included they told the permitting agency they “hoped” to start in late April and had indicated it would be “in place” in late May…With that the TM report was passed 5-0 after a motion was made by VM Dodd and seconded by Comm. Vincent…

BC- here is what was not discussed in the report… The very next item in the report after BSO stated the TM had hire yet another consultant..This time it is the former Davie City Manager, Gary Shimun who was recently fired by the Commission of Davie and walked out before the full vote was completed…Mr Shimun according to Google searches eerily mirrored our ousted former TM Colon in the reasons for his dismissal …. in this writer’s opinion…. and walked away with a severance package after 4 years that mirrored it as well… According to the backup he will receive $6,500 dollars for one month’s worth of work to “develop a new building permit fee schedule” to use for an RFP for building services… TM Hoffmann vetted Mr Shimun for the Pompano Beach Manager position according to articles … I’m all for hiring and thinking outside the box for certain jobs but come on…why wouldn’t we look online at what smaller towns of similar size charge (I believe this was done not long ago by the previous Commission) as well as taking advantage of the many retired residents we have in out small town who could volunteer to do the same in far less time for far less money… That’s why we are known as a Town and not as a City… small town ways … MIA in the report an update of the consultant costs to date as well as listing what they have done and are doing at the present time…

Up next and not addressed was the Finance Director “Recruitment” which the TM said was advertised online at the Florida League of Cities in their “Datagram”..This writer repeatedly looked due to it being a bone of contention with the prev. TM not using it for positions…I never saw it online…A Google only produced the 2007 LBTS  position (I have seen one before)..A search on the FLOCiities site produced “no data” …The TM wrote in her report the starting salary of $80,000-$90,000 was a “fairly strenuous process” they used including multiple tests and lengthy interview to narrow the field o qualified applicants to two…One did not pass and the other did not want to move from Ohio… The Town Auditor and Doug Haag assisted Ms. Hoffmann and offered the opinion that our salary range is to low and “hindering” the ability to recruit “stronger candidates”… The suggested increasing it to $100,000 to “attract the caliber of person”  she wants to hire..She said the position was budgeted for $85,000 based on the former Dir. (King) but that the Town’s salary range for that position is $82,028-$123,044 and that former Finance Director Colon was earning $104,576 before she became TM …TM Hoffmann reiterated that she was eliminating one position in the department of a recent employee that resigned and would reassign that work to 2 part-time employees thus freeing up “some savings that can be used to offer a higher starting salary to the Director.”…She stated unless the Comm. objected she would go ahead and re advertise…There was no discussion and no direction given at this meeting…

Next item not discussed was he attached Cash & Investment Quarterly Report which ended on March 31st …In it she informed them that another $1.5 million had been moved into 20 month CDs ($1 million  in one CD/$500,00 in a second CD) “at BB&T Bank at an interest rate 3x higher than we were receiving at Sun Trust …(THe Manager of BB & T Bank is the new LBTS Chamber of Commerce President) …The attached showed it was at 75 basis points  (.75%) … The good news is they can be liquidated all or part for any reason with only the loss of interest not principal…This is what an Avid Reader was  talking to me about in terms of getting rid of the $1.4or $1.5 million parking lot debt we have that will cost us an additional $200,000+ if we do not pay it off… What is the difference in what we get for this latest move of Town monies as compared to keeping that loan on the books until 2020?…. (prev. post)…

After that item was the code inspection and the shut down of the Little Inn Too on April 18th…Again no discussion… save kudos to the VFD Chief and Town Fire Marshall from Comm. Vincent at the VFD monthly report earlier in the evening (prev. post) …

The TM stated she had brought the assignment status list to date and color coded it (perhaps this was what the VM was giving high marks to?)…

I believe that the Commissioners are all (with one exception?) meeting with the Town Manager before every scheduled Roundtable/Commission meeting and may be going over all these items on the report and more… At least that is my hope… If so I suggest that at Commissioner comments the dais members take that time to address any discussion and give their take on it as well as anything they do for constituents in the time between meetings…  That way we will all know in a condensed amount of time who has done their homework and who has served their constituents leaving no doubt that both the Commission and the Administration is in sync so direction or a lack thereof is not seen on the dais at the 11th hour as we saw at this meeting under the Town Manager’s report…
