Subject: Status Report on 5421-23 NE- 14th Avenue- LBTS Property For Sale

“Following is a list of work in progress regarding the potential sale of the above Town property beginning with the most current date:

01/11/09-07/10/09 >Within the prior 180 days. One (1) showing scheduled despite efforts made to show interested prospects.

> Local Brokers have been attempting to locate buyers as well.

>Several calls were received from prior prospects inquitring about any list price reduction.

> Prospect discussions revealed that their estimated maximum offers would be less than 50% of the asking proice.

> Efforts were made to follow up with other prior prospects but were unsuccessful in promoting any offers. Several prospects referenced that a difficulty in obtaining financing would hinder their ability to purchase at this time.

10/11/08-01/10/09 > Five (5) inquiries were received in January. Most p[rospects still have the same concern regarding what to do excess unneeded space.

> A few prospects have called back about a reduction in listing price. Creative attempts have been made to team prospects together for joint purchase or to encourage those waiting for a price reduction to make an offer but these have been unsuccessful to date.

> The current listing price is at the higher of the two appraisals, $2,075,000 and the lower is at $1,850,000. It is recommended that the Town consider listing reduction closer tho the lower appraisal perhaps at $1,900,000.

> A significant number of prospects have called or have been shown the property and only one unrealistic low offer has been received to date.

9/11/08- 10/10/08 > Over the last 30 days the property has been shown three (3) times.

> Several calls have been received for more information and everyone has been provided with details on the property.

>The prevailing response from interested parties has been that the space is too large for their intended use.

> We have attempted to combine prospects together to encourage one party to purchase with another party to sign a long term lease, and have not found the right two parties to date.

> We will continue to seek a buyer through follow-up, advertising and mail-outs.

09/11/08> T/C with Sandy Dunn, rep for Jack Abda. Mr. Dunn stated that his client thought the building would need to be a tear down and that the maximum he would pay for the property would be $750k.

> Discussion value issues and Mr. Dunn stated their purchase and use would require redevelopment of the site, and therefore, the acquisition cost was a maximum of 750k.

08/10/08 > Met LBTS staff on site and showed property to prospective buyer. Boat sales and repair use. Buyer thought the price was in line with other properties he had looked at and liked the location.

> T/C with regarding Chapman purchase. Chapman hopes to have an answer on Monday, whether to move forward. Current concern over too large of a building and would need to look into leasing 10,000 sq. ft. of space out. May agree to partner with other buyer in same predicament.

09/09/09 > Met with LBTS staff on site and showed property to prospective buyer (Jack Abdo, Representd by Sandy Dunn)

08/28/08 > T/C with heavy equipment contractor, (Big T Group) faxed property information.

08/26/08 > T/C and faxed property info out, neighboring property owner.

08/21/08 > T/C with Bob’s T-Birds neighboring property owner and discussed building. Met with Bob and went over details of propery in person. Met with LBTS staff on site and showed property to perspective buyer (Teery).

08/12/08> Met LBTS staff on site and showed property to prospective buyer.

08/05/08> T/C with prospective buyer, Frank Chapman.

07/31/08> Emailed and faxed property info to contact list of potential buyers.

07/24/08 > Met on site with LBTS and Holy Cross, tenant, to preview property and take photographs for brochure.

07/21/08> T/C with interested party and faxed info.

07/18/08 > For sale sign was installed on property.

> T/C with tenant (Holy Cross) and discussed showing unit and phone contacts.

> Tenant passed along complaint for AC units in warehouse.

> T/C with  Marta, LBTS and Don Prince re: tenant issues.

>07/16/08> Received executed agreement from Town of Lauderdale-By-The-Sea for listing Parcel.

There you have it LBTS Readers and Taxpayers…the warehouse out west…the one that Town Manager Esther Colon…Commissioner Jim Silverstone and Vice Mayor Jerry McIntee  said would “be a wash” and pay for the public safety building was a WASHOUT”!…

The Town Manager has shown once again she is unqualified for her position…and has again kept the Commission out of the loop acting unilaterally ….

The warehouse as previously posted was passed 5-0 on July 8, 2008 for a 6 month contract….and here we are on February 21, 2010 with a languishing building…no prospects …worth less than 50%  as of 8 months ago….

Each and every month the Municipal backup shows hours of salaried time spent there…we pay taxes on it…Holy Cross moved out long ago…and we are still listed with a broker who it appears never listed it as it on the MLS as it was contracted  …per the Mayor at that July 8, 2008 meeting!…

This is just one more big ticket item the Town Manager has blown big time…The Commercial Blvd.Pavilion…The Public Safety Building…. The warehouse… The garbage contract…. Her cover-up of her contract’s severance pay…The firing of Chief Scott Gooding…The firing of the Fire Marshal Alex Stevenson  and then going after his benefits…and appealing the ruling two times…The all out war on the Director of the Senior Center… The verbal disrespect of the Mayor and Commissioner Dodd…The attack from the dais on a local newspaper and LBTS taxpayers who edit, write  and own it……The attack on the Chamber of Commerce and the Welcome Center… No RFP on the El Mar Drive Project… The Interference and possible sending in of a question to the League of Women Voters for the first Meet the Candidates Night… The false assertion of racism at the Feb. 9, 2010 Commission Meeting… The fighting not to be reviewed annually as required in her contract……The no oversight of Vice Mayor McIntee when he was accused by Patrick Pointu….The no oversight of the VFD as Vice Mayor McIntee spent on extensive VFD  apparatus …. The end of RFPs being read aloud….The public records being overcharged and not being received… The stalling on releasing bank statements…The pre-penalty loans and the non- negotiating with Sun-Trust Bank…The no oversight of Vice Mayor McIntee deleting 3 1/2 of Town related email…The going after businesses with Broward County…The badmouthing of taxpayers in Town Hall when they were not there to defend themselves… The hiring under-qualified staff instead of advertising for qualified department heads… The unilateral Town-wide survey that was copied from Wilton Manors… The code sweeps in neighborhoods and businesses… The less than 1 full year for 5% increase on fees….The unprofessional behavior towards vendors… The leading the BSO on for improvements done at the hotel… The interference of keeping a VFD firefighter from rejoining the department while not asking the same of VM McIntee in his suicide investigation… The 3 yr. $200,000+ Audit contract done without Commission approval…….Unilaterally getting shields on the lights on El Mar Drive…Unilaterally not getting the right lights for El Prado Parking lot…Unilaterally getting the wrong kind of parking ticket kiosk in El Prado… Unilaterally sending out letters and ending the boards before the Commission could decide… Unilaterally deciding to use a metal roof on the Chamber and then feigning ignorance…. And that’s just off the top of my head from memory…over the past 2+ years…..and ….unfortunately….one more  biggie to come….It will be revealed tomorrow….

Dear Voters…Dear Taxpayers…can we really afford 4 more years of Town mismanagement by Town Manager Esther Colon …with Silverstone/ Evans/ Couriel…she will have carte blanch to carry on with their support and  their blessing…YIKES!…

Dear Readers … The e-mails and texts were fast and furious with news that a “pod” was outside on the driveway of the outgoing Vice Mayor’s house (March 9 & 15, 2010) …

We hear many have asked if a permit was obtained…could be just another one that slid through the cracks…(pun intended)…. We have also heard the cars that are left seem to head north when leaving the neighborhood…No one has seen hide nor hair of the VM and Mighty Moe…BUT a Truth Detector has told this writer they were sighted in a Pompano Beach pizzeria a few night ago….

Hi Barbara: I just returned from the corner store, and as I drove into my driveway I noticed something on my front lawn. Someone had obviously took a stack of By The Sea Future newspapers from one of the stores, and dumped them on my front lawn. Just how much lower can they get. I was surprised they did not steal the signs I have up.

I called BSO and they are going to come over and make a report. These people are just unbelievable.

BSO did come to my house, and wrote up a narrative report, with a case number. Not much they can do. I did take a couple of pictures which show the front page of the paper on the lawn.

Received last night about 11 pm….Now Ron has seen this many times before…in elections of the past….BUT…Readers first the BTSTimes felt threatened enough by the latest By The Sea Future coming hot on the heels of the first debate…and decided they needed to send a news blast to reaffirm their 2-part 2-paper propaganda to try and keep their heads above water… and it seems that it was not enough…so the scoundrels decided to pull a “mighty Moe” ala the MIA papers in the Village Grille a few years back….and take and dump the opposition’s  papers at the home of their distributor!…Desperate moves in the home stretch….

My wife and I stayed at the Blue Seas Courtyard for a four night stay in November. We made the selection after reading Tripadvisor reviews. Contrary to another post, the motel was exactly how it was protrayed in reviews. We had a suite which was a great value and very comfortable. Housekeeping was great and the staff/owners friendly and helpful…. more

This hotel is not representative of the beautiful Town of Lauderdale-By-The-Sea. The owners run a newspaper and it is obvious that is all they care about. No contact with the guest except to make comments about the paper. No beach access from this hotel. For this price, get something on the beach. There is much more to choose from in… more

Question #3- “Let’s talk about the height limits. The repetition of height limits that have been on the agenda when the referendum are clear and they should be enforced. How do you feel you will discuss what your opinion is on the height limit controversy. Where do you fall in on this issue?”..

COMMISSIONER SILVERSTONE’S RESPONSE- ” This is an extremely important issue that has BEEN TAKEN OUT OF THE HANDS OF OUR COMMISSIONERS AND PUT TO THE PEOPLE WHERE IT BELONGS. YOU HAVE THE POWER TO CHANGE THE “HEIGHTH”. WE DO NOT DO HAVE THAT. And that’s the way it should be. That’s a very important issue in this Town. …..”BUT THE POWER TO CHANGE THE “HEIGHTH”, THAT’S UP TO THE PEOPLE AS IT SHOULD BE.”…

We hear that the Commissioner’s opponents Minnet/ Sasser/ Vincent when calling on the voters throughout this election…from the start and continuing on to the present are still being told that Silverstone/Evans /Couriel are “fearmongering” contrary to Comm. Silverstone’s 2/16/10 debate response to question # 3!…OOPS!…

VOTED IN WHEN EXACTLY?….

On April 14, 2009 the FPL came to Jarvis Hall and discussion ensued about the turtle lights and shields… keep the lights on…or turn them off…(pg 2-3) the jurisdiction VM McIntee asked “whether any Towns under FPL jurisdiction had gone under Commissioner Clottey’s idea to light every 3rd light.” The Rep. said she had no knowledge of that “and that every 3rd light would be determined by the Wildlife commission.” …VM McIntee “questioned how the Town could be fined for not turning off the lights if there was no fine for non-compliance?” “Attorney Trevarthen said the decision would be up to the Commission” … The VM said safety of the people “was more important and supported leaving the lights on until it became affordable or a grant was available for light shields.”…”Manager Colon advised a code that there was a code in place that prohibited and mirrored the Broward County Administrative code. She believed the Town would be in violation of the Endangered Species Act.”…”Commissioner Dodd inquired how long it would take the Wildlife Commission to approve different lighting.” …The Rep “advised it was a long process.”… The Mayor thanked the Rep and said “She believed the Commission had to think about it.”…

On April 28, 2009 pg. 2-”Presentation regarding turtle lighting-Green Light Go (Commissioner Dodd)… Green Light Go gave LED lighting solutions…Commissioner Clottey about where lights were going up and costs … “Commissioner Clottey asked for clarification that the Town could not be fined if the lights were not off. Attorney Trevarthen said the language in the Florida Statute that referred to sea turtle lighting “should” and “not shall” and there was no fine attached”… “Commissioner Clottey asked again whether the Town could be fined and Mr. Capotosto said they could.” … She added” fines had been issued and were being paid.”"Mr. Capotosto believed a standard cobra head was $175 to $200. Commissioner Silverstone believed the Town should determine which lights did not affect the turtles and turn those lights on for minimal lighting and shield the remaining lights until more information was available on LED lighting.” “Commissioner Silverstone thought the town should focus on the current safety factor.” “Vice Mayor McIntee did not want to install lights on poles we do not own…Mayor Minnet asked about the Turtle Ord. in place..The Town Atty. said we have one but the State and County do NOT require it and it could be repealed…Mayor Minnet recommended a workshop…and and contacting the Wildlife Assoc to attend.”..

This writer previously posted Comm. Silverstone stating shields were going up on the lights on El Mar and “seeing the plans ” with Municipal Director Don Prince…They are up on some of the posts but I cannot from the minutes find where it was voted on by the Commission and again the Town Manager did NOT use her Town Manager report to address they were purchased and to be installed…Unilateral because it was under $15,000 not needing any Comm. vote?…Even so, it should have been discussed with the dais…

Feb. 16, 2010…Although I will get to some more of the highlights for the best overview around by Editor Cindy Geesey!……Also the Editorial by Mark Brown where he gets to answer to the diatribe he was subjected to on Feb 9th by Town Manager Colon ….An abundance of Letters to the Editor from concerned citizens….Election info…Candidate points of view…Commissioner Comments by Mayor Minnet and Commissioner Dodd….Old time and longtime Chamber members answering the Town Manager’s Feb. 9th “attack” on the Chamber….A human interest story of an LBTS resident and doctor who provides relief in Haiti….Editor Brown going after the hypocrisy of the By The Sea Times and their “Yellow” journalism  concerning UOT and the State…while pointing out their own paper, endorsed candidates and PAC are in violation of many election rules ….Photos from scenes around town…community events…community calendar….and ads…. ads …ads…Get a copy of the newly distributed By The Sea Future ASAP… ….It is right outside your home…in your mailrooms …(unless the opposition has hidden or thrown it away that is)….throughout the town at stores…and in Town Hall….

LET’S RECALL TOGETHER, MADAM TOWN MANAGER …

Dear Readers … above are recent photos of the “Off-site” “Dixie” “West” Warehouse… The Town Manager was asked by Mayor Minnet on Feb 9th during her Town Manager report the status of the warehouse sale…This writer has posted often over the last 2 years that this too fell off the radar and was never brought back to the dais by the Manager for the Commission to address and direct her on…It has long been a major bone of contention to me as a taxpayer that this Town Manager does not use her Town Manager Report time to update and address these type of issues….She has consistently done this…She did it with the Commercial Blvd. Pavilion…and she is doing it with the warehouse…

At the Commission meeting on Feb 9th she still did not address it and said an update would be coming..

She sent a memo to the Commission on Feb 11,2010 that said the following…

“Subject: 5421-23 NE 14th Ave. -LBTS Property”

“If you recall at the July 8, 2008 Commission meeting the Commission decided not to pay a Commission to a Realtor to sell the above property.

If the Commission now has a desire to contract with a Realtor and list the property staff will prepare an RFP upon Commission approval.

I have attached a twelve month status report and will update accordingly.

Memorandum from June 27,2008 FRP -Real Estate Marketing Service from John Olinzock to TM Ester Colon

“As requested by the Town Commission, I solicited an RFP to twenty-four (24) real estate agents within the 2008 Lauderdale-By-The Sea Visito’s guide. Below is a summary of the four (4) proposals received:

1. Earthrise Realty, Shirley Rossotti 6% Commission

2. By-The-Sea- Realty, Inc. , John MacMillan 5% Commission

3. Coldwell Banker Commercial NRT, Steven Weil No Commission provided/Marketing Plan Provided

4. Distinctive Realty, Cindi Morgano No Commission Provided/ Requesting Appointment

There are two appraisal that have been prepared for the property, and place market value at $1,850,000.00 and $2,075.000.00. As the Town would not accept less than the minimum appraisal value, 5% and 6% commissions would be $92,500.00 and $111,000.00 respectively.

The minutes from July 8, 2008 state the following on pg. 13

15L.

“Discussion and or Action by Commission on use of Agency for Real Estate Marketing and Sale of Town Off-Site Works Facility, 5423 NE 14 Ave. Fort Lauderdale.”(Assistant Olinzock)

Assistant Olinzock explained the steps he took to obtain letters or response and noted the commission rate requested for each response.

The Commission discussed the length of time for the contract with a preference of the Commission for a 6 month contract.

Vice Mayor McIntee made a motion to accept the lowest figure submitted by Advance Asset Management for a term of six (6) months. Commissioner Silverstone seconded the motion. In a roll call, the motion passed 5-0.”

A look at the Town video on July 8, 2008 show the following on item 15L. 4 :12:58 in…

The Mayor reads the item…The Town Manager  states “That’s the off-site building”…Asst. TM Olonzock repeats the memo from June 27,2008 (above) ..He adds “And I also included in the packet a proposal from Advanced Asset Management which is a company used by many municipalities in the process of selling real estate”Vice Mayor McIntee asks again about only 2 giving figures and says he will make a motion to go with the lowest figure. The Mayor asks if that is Advanced Asset Management. The Town Manager is heard too state “That’s Advanced Management”…Olinzock “Yes, it would be.”…The TM “And that’s a savings of how much from the lowest quote? 5% or something that you received?” Olinzock “The two proposals I received are based on a sales commission. 5% of the lowest price received on appraisals. $1,850,000 that would be $92,500. 6% 11,000.00 This proposal by Advanced Asset Management is for $18,750″ Mayor Minnet asked him to repeat who the lowest was and Olinzock said “The lowest is Advanced Asset Management Inc.” The Mayo asks the Vice Mayor if his motion to accept the lowest….The VM “It just seems almost too good. Can a Real estate person go that low on a sales? That’s not even 1%…The Town Manager “Well, because they’re a seller broker and they work for municipalities and this is how they work.”…The VM says “who’s ever the cheapest we have to go with that’s my motion.” TM Colon “They’ve worked with other municipalities. How they do it I’m assuming they work with the seller. Clottey said she was just asking…The Town Manager “Oh no, I don’t know” …Olinzock “You only need one buyer, how long it takes for you to get that buyer is the unknown.”…TM Colon ” But you have to deal with them, whoever. They’re going to market the building and they’re going to do all the work. Nobody will be contacting me. Nobody will be contacting the Town Attorney. Everybody will be contacting the company Asset Management.”… Mayor Minnet then said “Right now in the the proposal it does say that it will list the property in local media, print, website MLS. Will review the terms of lease and purchase agreements and negotiates with the attorney per negotiations with the client’s goals. So they are a company that are familiar with Real estate needs of municipalities.”…The VM said “I guess I have to ask the question, although the cheapest is obviously the one I would go for but how long do they have to do this? We give them a contract, they get 5 years?”…Comm. Clottey could be heard “That’s what I just asked.” TM Colon ” No, well how, what kind of a guarantee are you gonna get from a Realtor that they’re gonna sell the building in?”…The VM “I’m gonna sell the building with a Realtor, 3 months or 6 months, hasn’t done it, go to another Real estate person. Are we locked into this person forever?”…TM “No, No! We just finished askin’ do you want it for 3 months? Do you want it for 6 months? What do you want it for?”…The VM “6 months. My motion is for the lowest with a 6 month contract. Cause Shirley (Russotti) says that’s the best way to go.”…Comm. Dodd “Second.” (The minutes incorrectly have Silverstone as 2nd) …Comm. Clottey then asked “Are they gonna accept a 6 month contract because I’ve had some dealings with Commercial property and they usually want something longer if they invest money to advertise and everything else.”…TM Colon “Um, we’ll ask Commissioner.”.. The Mayor repeated the motion…a roll call was taken and it passed 5-0…

Here’s what was missing from the Town Manager and the Assistant Manager at the July 8, 2008 meeting …that reminds this writer of so many other time this Town Manager has not been forthcoming with her full disclosure to the Commission and the residents…

In the video she and Olinzock state Advance Asset Management works for OTHER municipalities…She gives the appearance she does not know them…and Asst. TM Olinzock never says why he “added” Advanced Asset Management to the package of proposal….(unless it was in the backup)…

SRC RESIDENTS….COME MEET THE CANDIDATES … WHO CAN MAKE A POSITIVE CHANGE ….

Dear Sea Ranch Club Readers … The time is finally here…2 years ago I came to many of you and told you I was backing candidates Wick, Clottey and Dodd…I had  literature distributed to you when you asked and talked them up in mailroom, the lobby and anywhere else I encountered many of my fellow SRC neighbors whether on the grounds…walking El Mar Drive or running into many of you at a weekend night special events downtown…I had their lawn signs on my car in the parking garage and I brought them to a meet and greet in the Ocean room for questions and answers… The response was a first for SRC…For it was SRC that decided the election and put candidates Clottey and Dodd into office…Wick was a close one as he lost by only 16 votes…

I was overwhelmed by the response from these 3 buildings…and of course very happy that all would be right in LBTS with a new majority on the dais…

Unfortunately, that euphoria was short-lived…Right out of the proverbial gate I was left with egg on my face when to my horror it became apparent that another agenda was in place that I was not privy to!… I felt like someone had kicked me right in the gut as I watched a series of votes on the dais that ran counter to the campaign promises made and the good faith messages I delivered to my SRC neighbors on behalf of the CIC and those incumbent commissioners who were now elevated to roles of seniority on the dais…There was alot of “splainin”‘ to do as I walked around our grounds …ran into you all in the garage…in the elevator and at SRC meetings…and I could not!…I hung my head as you all asked what’s up with the new compensation for the commissioners…the insurance…the cell phones and most importantly…why did “they” purchase “that building”…”That crappy hotel for $2 million?”…  With my head still hung low, I was apologetic in my replies, chagrined by my ignorance  of this “need to know Mc-Furth” agenda and quickly angered for being hoodwinked…I felt true remorse for going out and offering up to my neighbors assertions of what would be coming with a new majority in place ….assured fiscal responsibility and a willingness for inclusion from both politically opposed factions…finally…It could not have been farther from the truth!..

I made a vow that I would do whatever it took to rectify what I helped create in 2008…..Over the last 2 years I made it my mission so that my neighbors in SRC and the taxpayers and voters of LBTS would not walk into the election booth or send in their absentee ballot for the 2010 municipal election without having all the facts… I presented them on this site…each and every day…throughout the day …Those who were impacted by the postings quickly exposed… and they fought back with countless threats…a Mc-Furth nasty anti BCbythesea site…and constant mudslinging that never stuck…despite their best efforts…

SRC neighbors, over the past months you  have again asked me I who I am endorsing…You have looked at my cars (2 this year) with the lawn signs of those candidates in the building’s garage…You have inquired if they they will be coming to speak…. and the answer is yes…I hope you will come to the most important part of my “making amends” to make up for the last two years…Come and meet the 3 candidates I support for the LBTS Commission … Mayor Roseann Minnet…District 1 Candidate Scot Sasser ….District 2 Candidate Chris Vincent…in the Ocean Room at 7 pm…It is for SRC residents only…and offers you the opportunity to hear them…and to ask them questions on the issues…

Although I did not back nor vote for Mayor Minnet, I watched our Mayor grow into her role with each fiscally responsible vote, She did her job with her head held high no matter what was being orchestrated around her to demean her as our Mayor and as a person…Mayor Minnet was the only member of the dais who voted no to the extra compensation of insurance and cell phones for commissioners…..The only one who voted no to the $2 million dollar public safety building…Mayor Minnet, if you watch any video online from any commission meeting over the last 2 years was the only member of the dais who was short and succinct in her allotted time whether it was in her concise questioning on agenda items or her prepared Commissioner comments as she presided over the meetings…As I have often said to you, my neighbors in SRC …with each and every one one of Mayor Minnet’s fiscally responsible votes…”Her stock went up” in SRC with the voters and taxpayers alike!…

Her running mates Candidate Scot Sasser and Candidate Chris Vincent are cut from the same fiscally responsible cloth…Each is on record for saying they would have voted the same as the Mayor if they were on the dais when it came to those early 2008 votes…Both gentlemen are fully supportive of the VFD, AMR and the BSO Police as is the Mayor……. A look at public comments for the past few years shows that these two candidates were involved and engaged long before they decided to run for their respective seats on the dais on March 9, 2010…

As a voter and someone who knows the specifics of what is happening in this Town… I can tell you that Scot and Chris will provide you, the residents of SRC   the kind of representation, accessibility and accountability that has been missing over the last 2 years…

All three candidates have made it abundantly clear they fully support our Town Charter for height limits and will always look for ways to enhance LBTS in maintaining and retaining our ocean views and ocean access along with finding innovative ways to assist with our tourism and downtown businesses ….

I will tell you now, a vote for Mayor Roseann Minnet, District 1 Candidate Scot Sasser and District 2 Candidate Chris Vincent will absolutely rectify what I helped to create in 2008!…

Good evening, my name is Scot Sasser and I am running for Lauderdale-By-The-Sea Commissioner District 1. My wife, Teresa, and I are raising two children here and we want to retire here. We chose Lauderdale-By-The-Sea because of the charm and uniqueness we saw in this quaint beachside village. I am telling you this to say we are “all in” here and want to ensure that what we hold dear is preserved for all of us as well as for future generations.

I have been involved for quite some time, attending commission meetings, voicing my concerns, meeting with citizens in their homes and, most importantly, I’ve been listening. Through my involvement I have learned that you, like I, have the same concerns and that you think it is time for a change.

I want to return a sense of professionalism, honor, dignity and ethics to our local government.

The office of Commissioner is not one to take lightly and I assure you tonight that I am up to the task.

“Good evening ladies and gentlemen and thank you for joining us. I would also like to thank the League Of Women Voters for putting this event together. My name is Chris Vincent and I am your candidate for commissioner for District 2.

My wife Christine and I have lived in Silver Shores for the past 8 years with our nine year old daughter Paige. We chose to live in Lauderdale By The Sea and raise our daughter here just like Christine’s family has for the past 35 years.

I have always followed our town politics by either attending meetings, or watching them at home. Over the last few years the decorum on the dais has been disappointing. I no longer could sit back and just watch. I began addressing the commission on issues and decisions that have been made in haste or due to personal agendas.

As I have gone door to door many of the residents and businesses that I have spoken with feel the same way. It has become obvious that certain commissioners have not listened and voted against the will of the people and the recommendations of our boards and committees.

I understand how important it is to listen and respect others. I’ve been doing just that for 30 years as a business owner… I’ve listened to my customers, my vendors and my employees, this has allowed all of us to reach our goals together. I know how to budget… cut costs… and make ends meet. These challenges build character, integrity and has taught me fiscal responsibility.

YOUR TIME HAS RUN OUT ….

Dear Readers …On a Wednesday night the Master Plan Steering Committee and the Planning and Zoning Board met to discuss the El Mar Drive Project…You know one of the meetings they were supposed to have before the rug was pulled out from under them by a 3-2 vote on the dais a few months back… The MPSC asked for time to discuss the million dollar project after an 11th hour disclosure that the “Oriana Million” was for the beautification of the whole length of El Mar Drive …not just the southern end…The committee was promised that time and then outgoing Vice Mayor McIntee and his “gang” under the direction of Cristie Furth…did an abrupt about face and voted for walkways in the medians…An avalanche of outrage ensued and after a quite while the “Mc-Furth Gang” could no longer turn a blind eye to their misread of the walkers and stakeholders …who made it clear they were not going to be “educated” to walk down the center of El Mar Drive!…

This evening was a two-fer…a double meeting…that almost wasn’t …due to lack of scheduling…and lack of proper posting of the meeting…It was called for 7 pm…and while the Town has come a long way from when this MPSC was first appointed in 2008…when the hall was locked …dark and unprepared…(prev. 2008 post)…followed by many meetings with a change in members… no direction from the Commission for anything to work on…then finally the El Mar Project …which led to the Art Institute debacle… which included students who were treated badly…a project that turned out to be just an “exercise” with the change in the extent of use of the funds…and today’s last meeting for this group!…

At the end of the 2 years…there were some striking similarities…with the exception of P & Z Chair Peanuts Wick…no other members were in attendance…due to no one contacting them from Town!… Some things never change!…

At the meeting it also looked and sounded like countless other MPSC meetings this writer attended since 2008…Chair Paul Novak began the discussion with a synopsis of what they were there to accomplish…the facts now known that despite the vote of the Commission…the people had spoken and the median walkways were scratched…He went on to speak of the monies involved and how far that $975,000 would go… Paul  referenced to the previous meeting and said “We has a lot of people in the audience last time”…OOPS!…Guess that  statement disproves the accuracy of the BTSTimes article concerning this writer and the El Mar Drive Project stating the MPSC  had only 7 people in attendance!….Paul brought into the mix Commissioner Clottey and her Special Meeting called for 9 pm…following this meeting…Comm. Clottey we heard was going to introduce Stimulus Funds through her new galpal Cand. Marjorie Evans…But at this MPSC Evans was conspicuously absent…Perhaps Ms. Evans did not want to appear at the MPSC meeting especially after insulting them at the one the month before?…(prev. post)…Comm. Clottey stood and spoke as she always does in a disjointed hard to follow manner…She made quirky comments about the Broward NPO and getting their “Broward ducks lined up”…with talk of the $600,000 for the A1A project..(We are responsible for a matching $600,000)…She went on to describe a grant project that was due this Friday,…and needed to be “shovel ready”..to do that she said “I know people really don’t like me” but she wanted us all to come together and get this “shovel ready tonight”…Of course there was quite a lot of  murmuring and confusion after her comments… She said she felt it was an opportunity to get “available Fed money”…and it would require engineering plans… She was aided by the Town Manager who got “Campo on the phone”…More confusing was the way this was to be “leveraged” with new jobs and jobs retained…points for that and for not using cars…walking, bike riding and trains…It was not for infrastructure…it was for infrastructure…and we are one of the few cities that had money freed up to use…a real plus…she said…Paul had questions for Ocampo about the project without the sidewalks…Ocampo spoke of landscaping lights and crosswalks… Ocampo knows about what Clottey wanted and had some ideas how to get it done…Ernie Ojito spoke of the crosswalks and  lighting options ..Paul asked about irrigation and Marilyn Carr brought forward sculptures …pelicans, sea shells and they light up!…. Ocampo spoke of the costs involved commissioning an artist unless they were from “off the shelf” and the requirements to build them …It would be more money and more engineering… Clottey spoke of it being $2 million dollars put up “by the Feds”…Paul spoke about how far the $2 million would go…Ocampo said it could be done to 70% and still have an impact while a plan would need to be put in place to incorporate and tie into Minto’s medians etc… Bob Eckblad addressed the phases and moving toward option 3 (The whole enchilada)… Ernie Ojito spoke of “different components”…”pedestrian vs vehicular”…He spoke of El Mar Drive being one lane…This writer awaited a run into the hall from BTSTimes Owner-Publisher-Editor -P & Z Vice Chair and Campaign Manager for Silverstone, Evans and Couriel…Crisite Furth…but she was also conspicuously absent…along with her husband. MPSC member Marc Furth…It is well know Ms. Furth is for keeoing El Mar Drive 2 lanes…Ernie spoke of the hazards of back out parking  as well…Paul Novak threw a “zinger” at Comm. Jim Silverstone asking hi about his comment the evening before (Meet the Candidate’s night)…and his claim LBTS ids “debt free”…with that in mind Paul wanted to know if we had money for the project…Jimmy answered “I can’t go into that here!”…Paul asked for Mayor to provide some lighting advice…but the Mayor, acquiesced to the Ocampo lighting expert in the Hall…He spent some time going over LED, solar and conventional…FPL, shields and how the lighting fixtures worked for the areas effected…He spoke of the future and the costs… windmills …and more…Joe Couriel asked about retrofitting and Peanuts asked about the turtles…a repeat of past commentary was discussed on what is allowed and what is questionable…in the ever changing turtle rules of lighting… shields brought forth Comm. Silverstone to say the Town Manager told him “shields for every pole “were in the works and Don Prince had “shown him plans”…Comm. Dodd and the Mayor along with longtime commission meeting regulars were taken aback by Comm. Silvertone’s comments… If memory served…it was not voted on in the past due to a cost of $600 each…and even with doing every other FPL light…it was a cost on a shield that could be deemed unacceptable soon after they were installed…which we were told happened in neighboring municipalities… This one sounded much like the claims last month that permits were in the works for a metal roof for the Chamber…with the Manager acting as if it were a fairy tale…(The Chamber stands by the comments made by Don Prince they ere going out for permits and the visit by 2 roofing companies who were told the same!)…Diane Boutin spoke about the portals…the lack of maintenance and the greening…lighting and crosswalks…Ocampo again spoke of being “shovel ready by Friday…removing the pathways…and the building dept. “saying they gave us a review number” …He said they would then have 90 days to get the permits once they receive the grant…a short time …but it could be accomplished… He would only want to work with on company and on General contractor…Comm. Clottey had to admit she knew nothing about the grant…no information… Sandra Booth agreed with Diane Boutin and said while she thinks LBTS Public Works is terrific we need to have a large chunk of money to contract out for maintenance of the portals and the medians…Scot Sasser wanted to know “what strings were attached” to the grant…Comm. Clottey callously remarked “No it’s not like the Senior Center.”… Diane Boutin said there was no guarantee of getting the funds and Clottey responded “No.”….Chair Peanuts Wick made some derogatory remarks in response to Ms. Boutin…A resident stood to speak of wanting to maintain 2 lanes…a comprehensive plan and the lack of lighting in the north end compared to the south of El Mar Drive…He awas for going for the grant… A motion was made to agree to go for the grant money …the landscaping, lighting and irrigation…

This writer had no idea until after the second meeting why Diane Boutin stood to give accolades to the MPSC and all they accomplished…this board and the prior ones for 8 years of service…presenting them with a token of appreciation…a flower in a pot…(more on this below)…

There was a 45 minute intermission as we awaited the Commissioner Clottey called 2nd meeting for the grant… No one had any backup…or information…Commissioner Clottey was making statements of no strings attached to anyone who would listen…and The Mayor went to speak to booth the Town Clerk and the Asst. Town Manager Olinzock sitting in for the out of the office til Monday Town Manager…Both told the Mayor quite emphatically they had no further information…no backup to help in this quick decision…Hmmmm…

Also MIA was Vice Mayor Jerry McIntee… Once again after the Mayor gave her the floor, Comm. Clottey reiterated what was aid at the 7 pm meeting…this “recent discovery” and the “shovel ready” stimulus money from”the feds”…with no strings attached…due this Friday…

The Mayor allowed comments from the audience…Mayoral Candidate Joe Couriel said “Hi Friends”…and wanted to take a look at increasing to the “whole enchilada”…and spending the full “$3.5 million” to do all of El Mar Drive…

Resident Yann Brandt said this Wed. night 9 pm meeting was called with no back-up ..no name of the grant…..leaving us between a rock and a hard place…it was less than transparent…He said this grant does not come without strings attached and warned from his extensive experience that a Federal grant comes with stringent RFPs…auditors and Federal guidelines…

Resident Bill Vitola spoke also of this last minute meeting…and felt if we can pull out with no penalty it was a go…but no sidewalks in the medians…

I asked Commissioner Clottey to explain her jobs requirements for the grant…retaining jobs…She tried to respond coherently…and failed…the Mayor began to straighten it out when she was rudely interrupted  from the front row by her opponent Joe Couriel…The mayor said “excuse me”…and Joe just shot her a look!…

MPSC Chair Paul Novak came to say go for it as well and if we do not get it LBTS should come up either the matching funds to the “tune of a million dollars”…

Comm. Silverstone began the commissioner comments with asking if the cost would be less with no walkways…Mr.Ocampo said he did not know…after going back and forth he ended up saying he believed it would be a reduction..how much he “could not quantify”… Ocampo went into detail with Comm. Dodd on the percentage of his charges if the plans moved up in cost…back and forth until it was finally settled among Ocampo and the commission that extra plans…extra changes meant extra charges and income for Ocampo…Yes!…The Mayor asked what the cost was at now and Ocampo said he believed it was $56,000 …a bill was presented to the town after the project was stopped… There was talk of the drainage…it is not included in the cost…for anywhere but in the medians..and more discussion ensued on “green components” to make our project look more enticing… The Mayor asked Asst. TM Olinzock if the Town had ever done a Fed. grant before…He named the A1A project and another that was done before he was hired…He has done Fed. grants elsewhere… Diane Boutin spoke of the scope being clarified before the vote…not having seen the plans…and reiterated her earlier maintenance issues…along with budgetary restraints… I came to the podium to address the longtime and overwhelming response of walkers and stakeholders for green areas…landscaping…and to say how amusing it was that the same people who put the kibosh on the Pelican Entry sculptures were now talking them up or sculptures of seashells in the medians…lit up as well!…I asked them to  listen and include the people… Again there was talk about the increase in funds…the process of getting the grant application in…the cost…the plans…and the time frame… former Commissioner Dave Wessels spoke of doing it the right way…doing drainage first…so we do not have a problem 3 years later…”do it right” he said ,… it’s a “jewel”…let’s “get our foot in the door” and go for it…

The Asst. TM was less than truthful in the intermission as he now spoke up to say he had looked into this…and it turned out to be the jobs grant…that resident Yann Brandt was so sure it was!…And with that it was apparent…that this night was a total waste of our time!…It has been sidelined and Mr. Brandt said it most likely will be not come up until next summer…

Comm. Silverstone thanked Comm. Clottey for “opening a door that was not opened before”…HUH?…

Windjammer Manager Diane Boutin again addressed items not being addressed …the cart before the horse…underground utilities …additional parking at the medians…

Mr Brandt addressed the Asst. Town Manager for owning up to what this grant was and proceeded to describe what was what with this jobs bill…

Ocampo spoke of the plans…the changes the people wanted…

Candidate Marjorie Evans who has a habit of holding her head in her hands and appearing to sleep…came to the podium to again speak of her non- profit organization and telling the commission to worry about the details later…get the million…and explained she just got $30,000 for her organization…

Candidate Chris Vincent asked why we did not go up to $1.5 so we would be able to do the whole thing…asking why we are stuck on $2 million…

Comm. Silverstone said because it will coat us more …

Ocampo said we could apply for the grant with the work being done in phases…

The Mayor asked about the budget…the Capital Improvement fund…and the Asst. Tm responded “I can’t answer that one”…It was for the Town Manager …Shades of the pre- waste RFP meeting… (prev. post)…

Candidate Marjorie Evans was frustrated and did not stay seated…she came to the podium and said “Just take the money”…she “felt handicapped” by not having the information “Is it on the internet?”…Again she stood and asked if it was on the internet…then said “put us on the list!”…. Time to wake up earlier Ms. Evans…preferably before you decide to run for office…She said she was “confused” at the Meet the Candidates Night…Perfect…we could end up have “Clueless” Clottey and “Confused”Evans….if we aren’t careful on March 9th!…

The Asst. TM again said he did additional research into this bill….

The Mayor said these types of grants are always available… after hearing his statements and those of Mr. Brandt…

Commissioner Clottey was clueless in her comment that we should have many “projects” ready to go up on the shelves so when these grants come along we are ready with more that fit the criteria…

Comm. Dodd said he had some reservations about a plan unseen…and that he also had reservations about crosswalks…and discussed the swales…increasing the greenery and stamped swales…

The Mayor reiterated the plan have no walkways in the medians…

The Asst. TM spoke about the process once more…no plans submitted until accepted and then they have 90 days…until then everything is on hold…

The Town Attorney finally did what this writer has been asking for for so long…she actually said she wanted to completely summarize what was being decided!… THANK YOU!…

The Asst. TM went over it all…Comm. Clottey wanted the MPSC to continue working on it as agreed for the next few months…and that was added to the motion…Comm. Silvserstone admonished the Mayor for making the motion as it was Comm. Clotteys’ baby…and she made it …”no strings..no penalties”…It passed on a roll call 4-0!…

One small problem though…

Not only did this turn out to be a total waste of everyone’s time…a waste of overtime hours for staff… a waste of taxpayer funds for Ocampo to be there all night… but the MPSC that Comm. Clottey made sure to add into the 4-0 vote…well, the reason Ms. Boutin gave them the accolades earlier…this writer found out in the parking lot after the meeting… was due to the MPSC/ P & Z/ BOA all receiving  a letter (it is said)from the Town Manager thanking them for their time on their respective boards and telling them their service was no longer required and they could re-apply after the March elections…

With that …which we hear has been done in the past….and the process for appointing new board members to start after the next commission is in at the end of next month…there is NO MPSC  to do anything on the El Mar Project for the 2 months the Commission just  voted for!… OOPS!…

IT WILL BE A 2 SHOVEL MEETING …. BUT, WHAT WILL THEY BE SHOVELING ….

Dear Readers…Yes, the Master Plan Steering Committee and the Planning + Zoning Board are meeting in Jarvis Hall tonight to discuss El Mar Drive…an Engineer is to be in attendance this time to assist the boards ….There was great confusion with this meeting …it was called for Thur. Feb 18, 2010…The Mayor and Comm. Dodd asked for it to be changed…The Town Manager would not budge…even though there was no P +Z meeting set for today the 17th…It took the MPSC and P+Z Chairs to change her mind…..It was then approved by the Commission on the 9th…Last night at the Meet the candidates Night …on the Jarvis Hall door was the post that the P+Z was canceled on Feb 17, 2010…and on the outside board MPSC was still posted for the 18th…Town Clerk White was made aware of it and it was to be fixed today…Just another slip up by June White…

We hear the second meeting called by Comm. Clottey is to promote Candidate Evans …for helping with stimulus funds for El Mar Drive….Many say, especially after Evans poor performance at the first candidate meeting (post to come).. Ms. Evans should have offered her “connections” for funding a long, long time ago with her declarations of love of this Town “for over 40 years” …Looks to many like she is trying to buy a seat on the dais…Perhaps with her self proclaimed “confusion” statement …what she really is saying  …and it was said last night by a resident after hearing Ms. Evans …”In other words, she’s saying Esther Colon has not done her job!”… OUCH! ……. We also hear the proposed “Gold shovel” plan… has snags in the timing..ala the proposed Palm Club one put forth by outgoing Vice Mayor McIntee…Speaking of the outgoing Vice Mayor…We hear his house is under contract and closing day is March 22nd!…

DID SHE SUBMIT THE “CUBAN” QUESTION?….

Dear Readers…in the previous post this writer wrote about the fear-mongering that was introduced at the Feb. 16, 2010 Meet The Candidates Night meeting when a a question asked by the moderator from the League of Women Voters…As I awaited her response (see below) …little did I expect that the person who submitted that inflammatory question may have been the Town Manager herself!…

I saw today a memo Town Manager Esther Colon sent to the Commissioners dated on the very day of the MTCNight meeting …Feb 16, 2010…The verbage used in this memo which was a response to an “Open Letter” Commissioner Dodd sent to his fellow Commissioners and the Town Manager on Feb. 9, 2010 was identical!…WOW!…How was that possible?  You can judge for yourselves…

Also included was a diatribe …yep another one…that feeds into the belief from many “insiders” in Town Hall that the Manager wants to be fired… She is still in this writer’s opinion trying to justify actions made by her that cannot be justified…Again you be the judge (as one Yellow- paper wrote in their last edition)…

While you are reading this..know this….today we hear the Town Manager hot on the heels of Commissioner Jim “He’s NOT a nice guy” Silverstone’s false statements last night concerning wrongdoing by the Director of the Senior Center has tried to “strong-arm” him with going to Broward County to do an audit he will not be allowed to participate in…and stopping any payment to him at this time without the knowledge of all the Commissioners!… This rings true to me, due to the FACT that this very same “Public Servant” who states in her memo (below)  “In my immediate family, there are four Public Servants and my family’s combined years of public service are in excess of 80 years.” has repeatedly gone after the former Town Fire Marshal to first stop his unemployment benefits (he was entitled to them)…She appealed them…She lost and is trying to appeal them again…OUCH!…

The question now…When and if this stops…with a new commission in March?…

“Letter to all Commissioners, Mayor, Vice Mayor and Town Manager

I was appalled by the lack of respect and decorum shown by various members on the Dias including the town manager. I would respectfully suggest that the manager carefully reads the ICMA ( International City/Council Manager’s Association) tenets and code of ethics in full. Pay particular attention to tenets 5, 6 and 7. How can you claim that you were not getting involved in politics and then carry out a full scale attack on one of the local newspapers with whom you have a difference of opinion?

Secondly: I wish to point out that the commission voted on the rules of decorum and it was to be only one warning and the vice mayor brought to our attention that this also applied to members of the dais. After only one warning then anyone in the audience or on the dais including the manager can be removed.

Thirdly – I want you all to pay close attention to the difference between a “personal attack” and a “personal opinion”. We have laid down very broad parameters that allow members of the audience the right to address us by name and then criticize the way we carry out our duties as elected officials. It is unpleasant to have to sit through comments such as “Commissioner Dodd you are clueless and have no idea how to conduct the town’s business – why don’t you pack up and go back to England”. This is a personal opinion nothing more. The reference to another country such as England or Cuba is allowed and can not be considered as a “personal attack”. If someone calls you a “liar” or a “thief” or “of doubtful parentage” then these definitions come within the realms of “personal attacks” and the speaker should receive an immediate warning. At last nights meeting in my opinion there were no public comments that were “personal attacks” within our very broad guidelines. The mayor was elected to be the one with the gavel – let her decide whether the speaker crossed the line.

I hope our last two meetings can be conducted with some vestiges of respect towards each other and an understanding of our roles within the municipality and the reasons why we were elected. We are there to serve the people and the manager is there to guide and assist us in every aspect of carrying out our duties (tenets 8, 9 and 10).

This memorandum is in direct response to a letter dated 02/10/2010, authored by the Honorable Commissioner Stuart Dodd, Town of Lauderdale by the Sea, and addressed to “All Commissioners, Mayor, Vice Mayor and Town Manager.”

Since this letter is addressed to me. I see it as only fitting and proper I respond.

We are currently in the midst of a very nasty political campaign that sees to bring out the worst in peple resulting in unsubstantiated, misguided and uniformed expressions that are publicly reported as facts, when the truth remains untold.

I need not remind you that I am not a politician running for office. I am not participating in any political campaign, and I have not publicly endorsed anyone running for office,

I am a professional contractual employee of the Town of Lauderdale by the Sea. I was contracted as the Town Manager, and pursuant to Florida Law and the Town’s Charter, I am obliged to comply and insure compliance with existing laws and ordinances. My actions are not guided or motivated by any underlying political motive, as I am not an elected official, nor do I want to be. I am an appointed employee of the Town. I was appointed by a majority of a sitting commission, made up of five elected officials.

Lately, an item contention has been the claim that I have an employment contract for life. That could not be further from the truth. The truth is that I serve art the pleasure of the five sitting member commission. If you do the math, it takes one swing vote on the commission to terminate my lifetime contract. If at any time, three sitting commissioners decide that my services are no longer needed or desired you need only to speak up and vote your conscience.

Having said that, after more than 30 years of public service and countless accomplishments and recognitions, I refuse to apologize for a contract that I negotiated in god faith,in a public forum that was approved by five elected officials. If you disapprove of my performance, all it takes is that one swing vote. In the meantime I intend to carry out and fulfill my duties as Town Manager until otherwise decided by a majority of the Town’s Commission.

Now, I would like to address the issue of freedom of speech and the freedom of the press. I do understand that publications in this country have the absolute constitutional right to express and print their opinions. This is an immense power that can be used to mislead the public into believing information as factual when in reality it is information expressing one biased political viewpoint. Let me remind you that every story has three sides, two opposing opinions and the truth somewhere in the middle. It is also my constitutional right and responsibility when it relates to facts I know not to be true.

Freedom of speech does not give a person license to be disrespectful and or discriminatory. Although commissioner Dodd opines otherwise, a comment “Why don’t you pack up and go back to England” when directed at a person of English ethnicity, or a comment such as the one recently made at the February 09, 2010 Commission meeting. “Cuba, get out of this country, get back in your boat, go find your paddles, go back to you dictator”, is very much offensive, insulting,disrespectful, unprofessional, disgusting, demeaning, annoying, discriminatory…. need I say more? No, this is not an expression of an opinion; far from it. In fact, it is foul conduct that constitutes disorderly conduct. I can not more strongly express my disagreement with Commissioner Dodd’s opinion that these comments are not personal attacks. If they were not personal, please explaining to whom these comments were directed to?

As for going back to Cuba. I should not dignify the comment with a response, but let me say my father was born in the US and served honorably in the US Navy and my mother was Cuban born and worked her entire life in New York retiring from her job and realizing the American dream of owning her own home with a white picket fence. In my immediate family, there are four Public Servants and my family’s combined years of public service are in excess of 80 years. And last but not least, I was born in the State of New York, in the United States of America. The Cuban comment was not an opinion; it was an utterance of complete disrespect. It goes without saying that even though I am not one myself, we are a country of immigrants, a fact that I am proud of.

The biggest insult though is Commissioner Dodd’s admonition of my conduct as it I were his direct subordinate (God forbid). Commissioner Dodd, not only are your opinions misguided, but I for one, am not certainly bound by them. What in heaven’s name wee you trying to accomplish with your letter?

THE FACTS AND PUBLIC COMMENTS MADE FEBRUARY 9, 2010…(prev. post)

This writer wrote a post on Commissioner Jim Silverstones “Whopper” of a $3 million dollar deal (prev. posts) that included an excerpt from a story I wrote for the BTSTimes in 2007…

“BC-FUNNY STUFF- “The audience was incensed and one resident screamed out in disgust, accusing the Mayor, the attorneys and the developers of being thieves! ( This resident is from Cuba and could not contain his anger towards this happening in his country.)… Yep, it’s him…Mayoral candidate Joe Couriel!…”

At public comments resident Bob Schuyler spoke about that article and included the following statement “Then a local resident from Cuba called all involved thieves. How about the one dealing from his personal office?” Meaning Comm. Silverstone and his statement on Jan. 26, 2010 that he made a deal in his office on Commercial Blvd…

Joe Couriel the Furth-CIC-endorsed candidate for Mayor came to speak and he said this as he ended his comments…” Um, thank you very much and ah, by the way I did call out thief. I was pro, very proudly removed from the audience at that time because those that made that deal gave away two million dollars of our money and ah, we could’ve had more. But what happened to that other two million who knows? Maybe one day we’ll find out. Thank you.”

Right after Joe Couriel, resident Chuck Gress was called to the podium to make his public comments which ended with this ” We’re a democracy and not a dictatorship. You want your  like run by a Dictator move to Cuba. Ask yourself this, ask this, how many people are on the nightly news with stories being reported about them making rafts out of coconuts and plywood trying to paddle to Cuba?”

First  LBTS Resident Bob Schuylar referenced it in his comments directed to Comm. Jim Silverstone and not to Town Manager Colon …

Second Mayor Candidate Mr Couriel said the 2007 article was truthful…and he did yell out and was removed from the hall…and was proud of it…

Third LBTS Resident Mr. Gress made his comments that have been said often by politicians and immigrants from Cuba and those comments in this writers opinion were “used” by the Town Manager, the Vice Mayor and several backers of Candidates Silverstone, Evans and Couriel to rile up the hall!….

As far as the contract the Town Manager speaks up “Lifetime contract” she knows full well is used due to the FACTS that she has no term in her contract, something this writer is told was in her initial contract agreement…and if she is terminated she walks away with one full years salary to the tune of $160,000 + …and no matter how many times this Town Manager, Commissioner Silverstone, Vice Mayor McIntee or her backers try to make the taxpayers look elsewhere …this “truth” is contained in her own words…the words of Commissioner Silverstone and Vice Mayor McIntee from 2007 to 2009 when all three repeatedly told the taxpayers her contract was the “SAME” as her predecessor with the exception of not having 10 weeks paid leave…It was this writer who found she had put in a one years salary that former Town Manager Bodb Baldwin never had…also found by this writer!…

Here’s the kicker, Madam Manager.. I recall and Readers can see for themselves the video of the two meetings in May of 2007 when you were hired and your contract approved…If at that time you asked publicly for a years salary to be included…judging from the Commission, who were falling all over themselves to give you this “permanent” (Then-Comm. McIntee’s motion)…no on would have said “BOO!”…It’s the 2 years of continuing to assert a falsehood that is thew root of the problem…truth can always be found when armed with the contract, the former TM contract…the minutes and the video!…

As for the Town Manager not being political…and not wanting to be an elected official…I ask the Commission on February 23, 2010 to ask the Town Manager to leave the center seat of the dais and sit with her staff in the hall. She should come to the podium when the Commission needs her report or her input as is the precedent in many municipalities and will surely comply with her desire not to be perceived as a commissioner!…

And finally, I did  receive a reply from Ms. Smith the moderator from the LOWV…it was even more disturbing and gives this writer pause in my opinion of the Broward LOWV and their method of conducting such forums… I replied and that is below as well….

Dear Ms. Cole,
I did not write the questions–I merely read what was submitted. Even the Sun Sentinel in its article on Lauderdale by the Sea identified the rude behavior during some Town meetings. Where the problem lies, I do not know. It is up to the candidates to address the question as presented. That particular question will not be asked on the 25th–it’s already been answered. It is not up to me to check the facts in the question. Someone thought the question important enough to be asked.

The voters will make their choices on March 9.

Ms. Smith, I am disturbed by your response. The Sentinel article was also the recipient of many responses from some of the candidates and LBTS citizens for false statements made.
I feel you inflamed a situation by using that “Cuban” question. I also think the writer of that letter needs to be made public.
I say this due to a memo I have posted this afternoon from our Town Manager to the LBTS Commissioners that contains the very same verbage used in your question. The memo was distributed on Feb 16, 2010.
How is it possible that the verbage was identical?
Either the question was submitted by the Town Manager, or the Town Manager was in possession of it and used the letter submitted for this meeting prior to the meeting.
Both scenarios are cause for concern.
I still feel the LOWV owes the voters and residents of LBTS an apology at the Feb 25, 2010 meeting.

PRESENTING FALSE QUESTION…. AND ANSWER …

Dear Readers…How sad it was that the Broward League of Women Voters chose to add to the fear-mongering Furth-campaign of Candidates Silverstone, Evans and Couriel…It came when the moderator Carol Smith presented Candidates from District 1 Scot Sasser and Marjorie Evans question number 3…Below is an e-mail this writer sent to Ms. Smith upon arriving home…I was very upset and disturbed that the question was asked without any prior investigation …In my opinion, Ms.Smith has given the Town of LBTS a black eye in the first Meet the Candidates Night meeting with introducing it and Candidate Marjorie Evans has shown that she will perpetuate a falsehood and run on fear-mongering to win a seat on the dais…. She was not alone in her plan, her fellow running-mates District 2 Candidate Comm. Jim Silverstone and Mayoral Candidate Joe Couriel also took time in their allotted 30 minutes on the dais to further assert fear of attacks and bullying and false statements…

I have asked for Ms. Smith to do now what she should have done prior to last night’s event and  look at what really transpired on Feb.9, 2010 (prev.post) … When and if I receive a reply I will post it…

Dear Ms. Smith,
While I appreciate that the Broward League of Women Voters came to LBTS last night to assist with our Meet The Candidates, I must voice my great displeasure at the third question you presented to candidates Scot Sasser and Marjorie Evans.
The question you asked was based on erroneous information and aided in the fear-mongering campaign being run by the campaign managers for Candidates Silverstone, Evans and Couriel.
The question you asked was this-
“This is a question on decorum on the dais. Freedom of speech in the United States is protected by the First Amendment to the Unite States Constitution and by many State Constitutions etc.considering our protection on freedom of speech.
However, being educated enough to know when racism is being brought into Town meetings, how do you view the issue of recent public comments made in Town meetings such as Banana Republic. get out of this country, get back in your boat, go, I’m reading this, go find your paddles, go back to your Dictator. As a member of the Town council will you continue to allow this type of speech as freedom of speech or do you think it should be considered proper.”
Unfortunately Ms. Smith, you did not check out the validity of the question before asking it from the dais.
It was factually incorrect. The situation did not take place as you described and yet by your posing it, you further added to the propaganda being used to win an election by one side that cannot win on their record.
It was further troubling that Candidate Marjorie Evans who was in attendance on Feb. 9, 2010 chose to answer and further add fuel to the fire.
Ms. Evans answer last night-
“I believe the problem is not only on the dais. I believe it’s in both places. Unfortunately, Americans and it’s really sad that it has filtered down to this Town that freedom involves responsibility, responsibility involves listening to other people. When you shut off comment ah, public comment with words like “The Cuban” which was just used the other night um, what you’re doing is slandering those people and if you read your history that is the seed of totalitarianism. When people under the guise of freedom of speech say things about other people and intimidate people from appearing in a town meeting. My, the people that I’ve met on the streets, half of them won’t even come here because they’re afraid to come to this meeting. I was actually strong-armed myself once.”
This statement made by Candidate Evans is not supported by the video of the meeting on Feb.9, 2010 . I am providing you with a link to the Town website video (you will find this exchange under Public Comments) as well as a post I wrote containing the verbatim exchanges that took place that evening.
You will see for yourself that the Town Manager took a public comment out of context and the Vice Mayor who chose to assist in riling up the audience.
The Candidates opposing Candidates Evans, Siverstone and Couriel have also been going throughout the Town and have found that people in this town are not coming to the meetings because they feel their voices are not being heard by the current majority.
The hall was full last night, overwhelmingly it was citizens looking to change that. It was apparent from the sea of Sasser, Minnet and Vincent T-Shirts worn.
I hope to hear from you after you have looked at the incident and ask that you address this at the Feb 25, 2010 Meet The Candidates Night, to clear up the black eye this question has given our Town.

Last night we were a close second with the instigation coming from Town Manager Esther Colon…Vice Mayor Jerry McIntee and Commissioner Jim Silverstone!… As you read this full account…the first such account of perhaps the worst commission meeting we have seen in the last 2 years…ask yourselves…are you willing to assist with your vote to retain them or will you make it known that enough is enough and it is time for Commissioner Jim Silverstone-Vice Mayor McIntee- Town Manager Esther Colon- Marc + Cristie Furth to go!…
