“THIS IS A TOWN MANAGER FORM OF GOVERNMENT “….Town Manager Esther Colon Jan. 21, 2010…

Dear Readers… It started to catch on big time when BSO Chief Scott Gooding was terminated by Town Manager Colon……Commissioner Clottey sent an e-mail to a constituent stating “This is a Town Manager form of government”……and it grew at a record pace……Commissioner Silverstone would start by explaining after any actions made by Town Manager Colon were questioned by Commissioner Dodd, a resident or a vendor…”This is a Town Manager form of government”… Vice Mayor McIntee would throw it in often as well “This is a Town Manager form of government” …in order to deter questions on the pavilion …an annual manager review, questions about the debt or any unilateral decisions Esther made…The BTSTimes wrote “This is a Town Manager form of government” when doing damage control  P.R . …And what they all meant each and every time the Mc-Furth Gang  said or wrote it was… Hands- off Esther …Carte blanche Esther…Have at it Esther…No holds barred …. and eventually all the “lemmings” believed it …..It became so ingrained in the dais commentary from the majority that the people who live in town believed it was so and never questioned its validity ….Even the Town Manager perpetuated it…for she made use of it most of all ….including at the special meeting held to address the special events in Town on January 21st….At that meeting, Town Manager Colon stood and walked over to two gentlemen to ask them to stop speaking out to those speaking at the podium …She received a negative reaction from the highly charged audience in Jarvis Hall …Afterward she went to the podium and made the following statement “This is a Town Manager form of government” and then went on to say that meant she would give a warning to anyone who had an outburst and then ask them to leave the meeting…. (prev. post)…WOW!… The rules of Jarvis Hall have long been for the Mayor to give a warning first and then the person would be asked to leave ….But never did we hear these Jarvis Hall rules were due to LBTS being a “Town Manager form of government!”…

This writer was caught off guard and rather disturbed by Town Manager’s assertion made that day and I wanted to see  what else was contained under our “Town Manager form of government”….in our Charter…

I had to wait though, since the Town’s website was down….and after being down for 2+ days (the 1/26/10 agenda and backup are still M.I.A.)… I checked it out ….Imagine my surprise when I found the following….

“ARTICLE III. ADMINISTRATION AND LEGISLATION

Sec. 3.1. Commission-manager form of government.
The form of government of the Town of Lauderdale-By-The-Sea, provided for under this Charter, shall be known as the “commission-manager” form of government.

Sec. 3.2. Creation of Town Commission.
There is hereby created a Town Commission consisting of five (5) Commissioners, each of whom shall be elected at-large in the manner provided in this Charter. The Mayor-Commissioner and each Town Commissioner shall take and hold office for the term(s) provided in this Town Charter.

Sec. 3.3. Qualifications of members.
Only qualified electors who have resided in the Town of Lauderdale-By-The-Sea for at least six (6) months immediately prior to qualifying for office and who shall have attained the age of eighteen (18) years of age on or before the date the candidate files and qualifies in accordance with this Charter as a candidate for office, shall be eligible to hold the office of Commissioner.
Each Commissioner and candidate for Commissioner shall be elected from the election district in which he or she is domiciled for at least six (6) months immediately prior to qualifying for such office by the greatest number of votes of all registered electors residing within the Town. Once elected, a Commissioner from an election district shall remain a domiciliary of the election district during his or her term of office. Any Commissioner who shall cease to possess the qualifications required herein shall forthwith forfeit his or her office, except a Commissioner holding office will not have his/her term cut short by the establishment of or subsequent change of district boundary lines.

Sec. 3.4. Standards of conduct; code of ethics.
In addition to the ethical standards of conduct established by general law for elected officials, appointed officials, and employees, the Town Commission may, by ordinance, establish ethical conduct standards for elected officials, appointed officials, and employees of the Town.

Sec. 3.5. Legislative powers.
The legislative powers of the Town shall be vested in and exercised by the Town Commission, consistent with the provisions of the Constitution of the United States of America, the Constitution and statutes of the State of Florida, this Charter, and the laws and ordinances of the Town of Lauderdale-By-The-Sea. Except as otherwise provided in Article IV or elsewhere in this Charter, or by the Constitution or statutes of the State of Florida, the Town Commission may by ordinance or resolution prescribe the manner in which any powers of the said Town shall be exercised.

Sec. 3.6. Non-interference in Town Administration.
The Town Commission or its members shall not give orders to any Town officer or employees who are subject to the direction and supervision of the Town Manager, either publicly or privately. Nothing in the foregoing is to be construed to prohibit individual members of the Town Commission from examining by question and personal observation all aspects of Town government operations so as to obtain independent information to assist the members in the formulation of policies to be considered by the Commission and assure the implementation of such policies as have been adopted. It is the express intent of this provision, however, that such inquiry shall not interfere directly with the regular municipal operations of the Town and that recommendations for change or improvements in Town government operations be made to and through the Town Manager.”

NOTHING IN THE FORGOING  IS TO BE CONSTRUED TO PROHIBIT INDIVIDUAL MEMBERS OF THE TOWN COMMISSION FROM EXAMINING  BY QUESTION AND PERSONAL OBSERVATION ALL ASPECTS OF TOWN GOVERNMENT OPERATIONS SO AS TO OBTAIN  INDEPENDENT  OBSERVATIONS TO ASSIST THE MEMBERS IN THE FORMULATION OF POLICIES  TO BE CONSIDERED  BY THE COMMISSION  AND ASSURE THE IMPLEMENTATIONS  OF SUCH POLICIES  AS HAVE BEEN ADOPTED. It is the express intent of this provision, however, that such inquiry shall not interfere directly with the regular municipal operations of the Town and that recommendations for change or improvements in Town government operations be made to and through the Town Manager.

For all those times over the last two years  Commissioner Dodd made inquiries to obtain “independent observations to assist ” him in “the formulation of policies to be considered by the commission”…it turns out he was doing what was expressly written into the Charter and not interfering as the Town Manager, Commissioner Silverstone, Commissioner Clottey and Vice Mayor McIntee said he was!……These Commissioners owe Commissioner Dodd an apology…. and we owe him our thanks for carrying on!…

Shame on Commissioner Silverstone, Commissioner Clottey, Vice Mayor McIntee, The Furth-BTS- TImes and Town Manager Esther Colon for purposely misleading us all on the role the Town Manager plays in our “COMMISSION-MANAGER FORM OF GOVERNMENT”…..

Vote March 9, 2010 ……for Mayor Roseann Minnet, Candidate Scot Sasser and Candidate Chris Vincent … Commissioners we can trust!…

A FAILURE TO COMMUNICATE….

DAY 3…..No computer communication still to Town Hall…An informed and knowledgeable reader says this is highly unusual for government to be down so long…This writer’s public records request made on Friday came back today as mailer failure as did others who made important requests to their Town government….Essentially Town Hall in LBTS is shut down!… No back-up for the meeting on Tuesday night…So where is the administration on this?…OUCH!…

Last night LBTS Pacific Blues the business who brought us all together for the Town Manager’s choice of an “appropriate meeting” (per her statement at the 1/12/10 Commission meeting) …did not turn on their sign’s lights!…We hear the managers did not take any of the businesses on their offers to assist in the store’s lack of business they contend results from the Saturday night special event put on by Athena and 101 Ocean!… Too bad, the Town was filled to capacity with those united in support of weekend special events in LBTS!…

NO SIGN OF THE TIMES …….

BTS-TIMES M.I. A. on driveways…in condos….downtown businesses…and in front of the BTSTimes headquarters/Town Hall East…….Hmmmm….Perhaps the publishers are feeling a little bit shaky after putting out their introduction edition to their CIC-endorsed candidates full of election violations…False voting records for Mayor Minnet that will require them to retract them in the following issue….and of course Editor Christie Furth’s page 3 editorial making claims that the Executive Director of the Florida Elections Commission, Simone Marstiller found probable cause BEFORE a full  investigation and BEFORE a hearing of the full commission….which if accurate amounts to the Florida Elections Commission violating their own procedures… (prev. post)…GULP!…

WOULD CANDIDATE MARJORIE EVANS VOTE FOR CANDIDATE MARJORIE EVANS?….

Would LBTS Candidate Marjorie Evans vote for Candidate Marjorie Evans?…. Would Marjorie vote for a candidate who never walked into Jarvis Hall until she came to announce for commissioner?…..Would Marjorie vote for a  candidate who did not know what the Master Plan Steering Committee’s function was and then insult them?….Would Marjorie vote for a candidate who never did any community work in the town she has lived in for  her 40 years?…Would Marjorie vote for a  candidate who was picked at the 11th hour to run by the CIC because they could find no one else?…….Voters want to know because if Marjorie Evans says yes….what does that say about her?…. OUCH!…

Day 2 …with no computers in Town Hall and no Town website…No back-up for the 1/26/10 Commission meeting…Hmmmm….Many in town wonder if those employees with one foot out the door after March 9th…are doing a VM McIntee and deleting 4 years of  public records!… Remember, the Town’s Information Technology vendor was recommended by the Town Manager despite the higher cost because of the reliability and quick response time for solving problems ASAP!…OOPS!…

IT ALL EMANATES FROM HERE ….

Dear Readers …. Follow the “yellow” brick road …to the Town Hall East aka BTSTimes  aka Campaign Headquarters for Comm. Jim “He’s not a nice guy or a gentleman” Silverstone – Candidate Marjorie “Clueless #2 ” Evans- Candidate Joe “McIntee is God” Couriel …and you will find the  Fearmongering  Furths who are spreading falsehoods and not abiding by the rules…all in their ” No holds barred’(Idiom Definitions-If there are no holds barred, there are no rules of conduct; you can do anything.) campaign to retain their power in LBTS…

First there was the door to door style fearmongering being made by the Furth-endorsed candidates and their small contingency of misinformed minions…It is said they have gone around with falsehoods of the Mayor’s contributions…actions and voting record… They are using scare tactics  purposely misrepresenting the occupations of the Candidates Sasser and Vincent and tying them to actions made by previous opponents ….from the Furth’s past…

The Furths and the CIC  followed this up with their invitation and letter to their mailing list (many on the list have long been non-members who have not re-upped their yearly dues)…In the letter they wrote “A big THANK YOU to the many CIC members that showed up for the January 12th Commission Meeting. It was a standing room only crowd and it must have impressed Mayor Minnet since she actually cur off Public Comment speakers that were politicking. Of course the intention was to prevent Joe Couriel and Marjorie Evans from announcing their candidacy.”

BC- Let’s be factual- Jarvis Hall was full- standing room only on Jan. 12th because of the Senior Center- not the CIC!… The true amount of CIC supporters was minimal at best and non-existent after public comments including new Candidate Evans…. You cannot have it both ways…to say the Mayor stopped the “politicking”…but then say she did not allow it for the Furth- endorsed candidates…OOPS!…Candidates were told they could not announce by Silverstone-McIntee long ago ….and the NO Guard Candidates Scot Sasser and Chris Vincent NEVER declared their candidacy at the podium…Never!…OOPS!…

FLASHBACK!… At Cristie and Marc Furth’s place on El Mar…..there are shelves of old campaign stuff…and they pull em’ off those shelves every couple of years…This year is no exception… “The Old Guard/Unite Our Town folks will spare no expense to regain power and control LBTS once again as they did for 14 years. WE NEED YOUR SUPPORT NOW if we are to preserve what years of efforts by citizens have accomplished toward preserving our small- town charm and special quality of life. “.. YIKES!….

BC- Saw that one.. They used that one…and it worked…EXCEPT…Candidates Sasser and Vincent were not here 14 years ago…Candidates Sasser and Vincent are No Guard…and Candidates Minnet, Sasser and Vincent are also for keeping the small-town charm …as the voters voted for …OOPS!….

Yesterday they put out their latest “psycho-delic” edition  of the “Local News You Can’t Trust”……1 week behind schedule…and chalk full of Furth Fractured Fairytales….. and some election time no-nos…

OPENING UP PANDORA’S BOX? …..

1. On the cover the Furths are stating the Candidates are- “Marjorie Evans Commissioner/ Joe Couriel Mayor”…M.I. A. the required “FOR” ….OOPS!… The Candidates did the same on their signs…OOPS!…

2. Christie Furth FALSELY writes the “Unite our Town Political Committee – (UOT) Under Investigation”… She writes “A complaint was filed and probable cause was found- so the State is now proceeding with a full investigation”…

BC- Christie ought to know by now after watching Silverstone and McIntee go through quite a few “Full investigations” over the last 4 years where Jimmy and Jerry were the recipients of probable cause found for each……She knows that probable cause can only be found AFTER a hearing of the full Fl. Elections Committee in Tallahassee AFTER the investigation is finished…OOPS!…

BC- If there is an investigation those who are under investigation are prevented from speaking about it…Therefore for Cristie Furth to have any information and publish it for political purposes….shows that it is either the Furths and/or their BFFs who have made the complaint…OOPS!…

BC- The Florida Elections Commission does not take kindly to complainants who thwart their inquiries in print for political purposes and usually find a way to go after those who make such a leap!…OOPS!…

BC- According to Christie… the “more legally sufficient ALLEGATIONS” Section 106.022(1) -The complaint alleges that Unite Our Town, a political committee, failed to file with the department of state, Division of Elections, a statement of appointment for the appointment for the registered office and registered agent: and Section 106.022(3) The complaint that Unite Our Town, a political committee, made expenditures and accepted contributions without having filed with the Department of State Divisions of Elections a written statement of change of registered agent.”…It goes on to state  “an online search failed to produce any record of Unite Our Town ever being registered with the State of Florida even during the 2008 municipal elections when they first became politically active.”… Christie ends with stating “the State may investigate each individual transaction for legal sufficiency including all contributions received and all expenditures paid by UOT”…

BC- How low the Mc-Furths have sunk!…It must be a joint effort  from the looks of it….. The truth “deflector/ slapp -staff writer has always had problem seeing the forest through the trees…. and this one…may boomerang to the Mc-Furths and the CIC…bigtime….OOPS!….

1. UOT  is registered with the Town of LBTS because UOT only deals with politics within the Town of LBTS

2. According to a source the CIC is registered with the Town of LBTS because the CIC only deals with politics in LBTS

3. According to this same source if a political organization does not deal with politics outside of the Town there is no requirement to register with the county or state…OOPS!…

4. We hear UOT is not registered with the County or the State as a political organization because UOT does not deal with County or State politics …

5. According to this same source the CIC is not registered with the County or the State as a political organization EITHER!… OOPS!….

6. According to this same source the CIC  aka LBTS Citizens Innitiative Committee Inc. is only registered with the State as an non- profit corporation…and that Inc. registered agent is not always the same as the Town registered agent (see 2008-2007-2006)…

7. I am told that when the president (registered agent) of UOT stepped down he went to the Town and filled out the required paperwork.

FUDGING THE FACTS …..

The “Staff Writer” writes that Candidates Minnet, Sasser and Vincent were all in favor of shutting down our VFD election night, 2006 and taking over our town.”… Get real!…This writer was there!… The Furth’s have slandered the candidates…who were not involved…and the Mc-Furths know it!… OOPS!…

The Furths write that Mayor Minner voted NO to awarding the Fire suppression services to the VFD…FALSE!… Mayor Minnet voted YES!….OOPS!….

Comm. Silverstone … a  VFD member and his pal Vice Mayor McIntee recused themselves for the transition budget for the VFD for $86,000 BUT…voted YES for the VFD for $900,000 !…OOPS!…

The Furths write Mayor Minnet voted NO against the Buoys ….FALSE!….Mayor Minnet vote YES to the buoys!…OOPS!….

Commissioner Silverstone is still  the “registered agent” for the VFD…a contracted vendor for the Town…and as such he was and is responsible for the VFD not having the correct status to allow for VFD supporters who deducted their donations legally…OOPS!…

The Staff writer says the UOT is the “minority” activists…the numbers who attend the UOT/ Jarvis Hall meetings …say otherwise…OOPS!….

The BTSTimes endorse…….for Mayor…Joe Couriel is a long winded hot head who yells at women, has been removed from Jarvis Hall countless times over the years……Joe Couriel who calls McIntee “God”, “Hero”…Joe Couriel who talks out of both sides of his mouth…Joe Couriel who supports everything the Manager  has done from acquisitions…to terminations…to fees and her $$$$ contract….If it walks like a duck….part 2….

For Commissioner ….Marjorie Evans is only a plus to Comm. Clottey…because Ms. Evans makes Clottey look a little less clueless…Marjorie Evans who had never been in Jarvis Hall before Jan 12th…Marjorie Evans who did not know what the MPSC did….Marjorie Evans who said she did not know where the Corniche was located….

For Commissioner …. the Furth’s lap-dog…. Jimmy (He is not a nice guy) Silverstone….

Jim Silverstone voted for the Manager’s $250,000 + if terminated -no term contract and lied about it for 2 years….

Jim Silverstone wanted to give her a raise…

Jim Silverstone voted for his pre-2008 election agenda item $2 million dollar crappy motel…

Jim Silverstone  wanted to purchase the $800,000 motel behind it…

Dear Readers …. The above meeting was held in Jarvis Hall to an packed house of angry and concerned residents…businesses ….In the center of the controversy were 2 businessmen and their attorney who must of felt like they arrived at a lynching…because it certainly wasn’t the LBTS Welcome Wagon!….

At the Jan. 12. 2010 Commission meeting an attorney came forward to address the special events permits for Village Grille’s Jazz on the Square and Athena/101 Ocean’s Elvis on Friday and Saturday nights continuing for another three months… The attorney spoke of her clients and their assertions that the events were harming their business in a reduction of revenue… The Commission, Administration and applicants were all caught off guard by the claims and there was much discussion back and forth …in the end the Commission approved the events for another 3 months and Comm. Dodd asked for a meeting with the businesses concerned  and Town staff….Comm. Silverstone said he would be there as well and Vice Mayor McIntee said it needed to be posted …The Manger said she would send notices and there would be a meeting…Nobody expected it so fast…and caught off guard were not only the businesses in town but the attorney for the affected businesses and the affected businesses themselves…

The notice was first seen by this writer in Town Hall on Jan. 14th taped to the front counter …and posted.. It was sent to the businesses and then a second copy was distributed with businesses signing for it…Word spread quickly and fliers were sent out, posted downtown and on this site….thus producing the filled to capacity, non-televised meeting last night….

I arrived around 25 minutes early to a locked Jarvis Hall and slowly the driveway began to fill up as we awaited the door to be opened….The attorney arrived and told this writer that she received a voice mail on Tuesday and was not only surprised of this taking place so fast, but concerned because she had a conflicting meeting in Fort Lauderdale…She was in the process of getting the figures asked for at the commission meeting to show a revenue loss impacted by the special events …and she and her clients were expecting to meet with staff and the applicants to iron things out…not this… I said “Welcome to Lauderdale- By- The- Sea!”…. As the room filled up…she and her clients looked as if they were being fed to the lions…I have never seen the such a setting …a room full of tables…with a head table  comprised of Asst. Town Manger Olinzock, Deputy Town Clerk Nikki Smith and Town Manager Colon…Commissioner Dodd, Commissioner Silverstone, Commissioner Clottey, Mayor Minnet, Candidate Chris Vincent, Candidate Joe Couriel, and Candidate Marjorie Evans were in the hall…(Candidate Sasser was away on business)…. There was a sign -up sheet …and the attorney signed in first and then signed in her two clients…who I later found out said they were informed this afternoon of the meeting taking place…The attorney, Courtney Crush went to the podium after Dep. Town Clerk Nikki Smith introduced Asst. TM Olinzock who explained that the commission asked for a public meeting at the previous commission meeting and that the comments from the meeting would be used at the Jan. 26, 2010 commission meeting ….Ms. Crush spoke and said she did not expect this public meeting and reiterated what she had told me prior, that she thought she and her clients would sit down and work with staff…and that she instructed her clients to get the information …in order to get some helpful consensus without this…There seemed to be a problem with 13 spaces , the impact, a noon set-up time and the code required fencing keeping patrons from going into Pacific Blues and U.S. Vintage …. Asst. Olinzock stood to speak about the permit process for a special event and how it required a majority of the commission to approve it ….The Manager from one of the shops stood to speak and said he felt this was not a special event  for the Town but an event that only benefited the restaurant  (Athena) …He contended he had a loss of 60% of the register on these nights and again mentioned the fencing off of the median as a deterrent… The attorney  approached the podium to speak again and Asst. Olinzock tried to stop her…She explained that she wanted to apologize to the attendees for her short stay, due to being unaware of the meeting an her prior commitment…Next up was this writer who spoke that I had never seen such a meeting, with such a set-up, in such  a short time…and I was sorry it was taking place…that something needed to be worked out and this should not have taken place….

Mark Brown a resident and Editor of the By The Sea Future newspaper spoke next…and summed it up so well….

“I don’t understand why you are holding this special meeting this evening. The commission had asked the businesses involved in this complaint to submit some data to document their losses. Has this data been received? Does it justify a special commission meeting? There are over 100 businesses in Lauderdale-By-The-Sea. They are all hurting in this economy. Are you going to hold a special meeting for every other business in town if they decide to file a complaint?

Why is this town commission so anti-business? Every other governmental body in the county and the country is bending over backwards to try to work with their business community during these difficult economic times. Remember. It’s the businesses which take the risk, not the government. It’s the businesses which provide the jobs in this town, not the government. It’s the businesses which generate the tax revenues in this town, not the government. All the government does is spend money, not make it.

If you follow through on your plans to shut down the music, and drive the local restaurants and bars out of business, where are the jobs going to come from? Where are the tax revenues going to come from? If you decimate the business community, and destroy our reputation as an international tourist destination, what is going to bring visitors into town? Don’t you even think about the consequences of what you do up there? Don’t you realize that if you lose tax revenues from the business community, you will have to make them up by raising taxes on individuals in order to sustain the operations of the town government. I don’t want my taxes going up, and I doubt that anyone else in town does either, just because a few people have a personal vendetta against some of the businesses in town, and because they are willing to go to any length to destroy them.

I like living in a community which is mixed use residential and business. I like being able to go downtown and spend my money to support our local businesses, not someone else’s. I like being able to stay in town for entertainment, rather than go somewhere else. I’ve said this before and I’ll say it again. If the commission can’t find something productive to do for the town, don’t do anything at all. Thank you.”

After that there were many more who spoke in support of the restaurants…the music and the events…and how they bring so much to the Town …A gentleman spoke of being a customer of both the stores in question and the restaurants in question and appreciating them both…The next gentleman stood and said he was a Canadian and received a round of applause …he said the issue was not the music, it was the parking…Dave Gadsby spoke of the 98% positive feedback he has received over the last 6 years and this can be a win-win situation for everybody…Bob Schuyler said he didn’t “want to take sides but if you take away the music you might as well roll up the sidewalks” …and stated there was plenty of parking 100 feet away from the business offering some solutions to offset the cost including chipping in himself!…  Candidate Joe Couriel showed us again why he would be the wrong choice as Mayor in March….. He said he “didn’t know how this had deteriorated into the music “…that “somebody complaining about not going to shop”…and began to do some  full-blown politicking…with his “vision” for “outdoor tables where the parking is”…and “leasing it from the Town”…and “having it on Fridays, Saturday and Sundays”……He went on to say “everybody loves the music, nobody’s anti-music”…”closing the street is affecting one store”…He thought there would be a “round table and this was not what the commission asked for”… …Hmmm…..Asst. Olinzock stepped to the podium to say it was done this way in order to accommodate the need to post for the Commissioners….Aruba Manager Guy Contrada spoke to the businessmen in question and said “nobody  wants to hurt your business”…offering up some ideas of coupons and ways to offer assistance…Chuck Gress said this town was acting like it is stuck in the 1950s when it is 2010 and spoke of the need to stay alive and adjust to competitors…A gentleman came forward to say it was “no reasonable rationalization” in the assertion that “13 parking spaces eliminated” impacted more than 500 people walking…As he spoke the business manager spoke up and Town Manager Colon walked over to him to ask that he hold his comments as he had his turn…The speaker felt he was being interrupted by the Manager and told her so ….The crowd in the back misunderstood her actions and became quite loud …This writer tried to tell them she was trying to avert any further interruptions…but to no avail…All were on edge due to this meeting talking place…The Manager walked to the podium which further angered the speaker and a BSO Deputy came up to stand alongside as the speaker finished…TM Colon spoke and said she wanted to clarify what that she asked the manager to please not interrupt…She said this was a “hearing”…that this is a “Town Manager form of government”…and “if this happened again there would be a warning and then you will be asked to leave the meeting”…(What does a Town Manager form of government have to do with it?… WOW!…)…The gentleman who was angered was followed by his wife…she said she saw no “downside” to closing the streets on Friday and Saturday…that there is parking available…we’re a quaint seaside village…The next woman spoke also to keep the streets open and leave it the way it is…Her husband said “don’t screw it up”…The next gentleman said he loves the music “Let’’s keep the music!”…(The 2 businessmen who hired the attorney just kept saying to each other and to me…”We do not want to get rid of the music!’….A new resident said he chose LBTS to live in because of the Friday and Saturday events and the town “would be dead without it”…Frank Herrman came to add his written out comedy material…and show his support of Elvis  and both nights of music…The owner of Kilwins also spoke of what the events bring to the businesses and offered up that the businesses in question “may need to make some business plan adjustments”…adding he was happy the people who come “Thank God, they eat ice cream!”… Louis Marchelos informed the attorney the road was closed at 4 pm not noon and spoke of Athena emulating the Village Grille in creating their Saturday night event…and said the parking used by both is approximately the same number…Louis told the businessmen if they had a problem they should have come to them…Athena would have offered coupons, some P.R. at breaks in the music to assist their stores …and informed the Sat. night event was an Athena and 101 Ocean event……and spoke of the costs were incurred by them to benefit the Town…Diane Boutin spoke of apples and oranges…valid concerns….a history of how we came to start the Jazz on the Square to encourage business and to make “sangria” …Cindy Geesey said she wished they had come forth before going to an attorney and having the attorney come to the meeting…She spoke of all Aruba. Village Grille and Athena do to donate back to the Town events while the complaining business does nothing…She offered up an idea to promote some of their cute outfits… Bill Vitola said this shows everybody wants music …and he spoke of Oakland Park closing down streets  for the music…He said we should try something for a couple of weeks to see if it will make a difference …like the fencing…and if it doesn’t try something else…The businesses need help…..The wife of a Village Grille employee came to say she brings people here to hear the music and parks sometimes near and sometimes far…A hostess fro Village Grille came to say when she gets to work a 4 pm the phone never stops ringing for music info on Friday an Saturday night!…Paul Novak spoke and said he was wearing “2 hats”…as President of the Chamber of Commerce who voted  for music… and as a hotelier, with property closest to the events and said his guest “love it!”….He said the problem  was not the music, it was the parking and revealed he was also the landlord for one of the businesses that hired the attorney…U.S. Vintage…He went on to speak as a landlord and tough times for landlords…lowering the rents ..He spoke of a cross walk trial basis …valet parking to be addressed again…and a committee to work things out…He said T-shirt shops work in this town…and there will be no Las Olas  type shops coming into town as long as we maintain our parking requirements (see MPSC under the board category…when Paul covered his take on repealing the requirements)… He spoke of mayoral candidate Joe Couriel’s restaurant idea…saying without a change in the parking rules it will never happen!…(Couriel’s running mate Comm. Jim Silverstone is against it)… The last gentleman that spoke said he knew what Dave from Village Grill and Athena must have lowered revenues as well as the affected businesses in question and said he took a poll for the music on Friday night…132 yes…ZERO no!…

Asst. John Olinzock thanked the audience for coming and listening… and with that it was over…

The men who came were now without their attorney and they pleaded to make those around them understand they did not want to stop the music…They just want to get rid of the orange fencing and allow the people to walk from the dining and dancing to their stores!… Business owners walked up to them and offered their assistance…and the crowd moved outdoor where the conversations continued and the consensus was clear…While the meeting itself was uncalled for…The call was loud and clear from the people……. In LBTS …..Special events with music are here to stay on Friday and Saturday nights!…

Now, it’s time for the Commission and the Administration to stop making the businesses who provide us with these events jump through hoops every 3 months …. To return to annual special event permits…and give the south side businesses a few crosswalks in the median….

WAR OF THE SIGNS ….

There is a war going on in LBTS this election season…The war of the signs for candidates for Town commission… Some are giving equal time…by putting up all 6…and some are playing tricks on one side …Feeling strong-armed and not up to drama… drama-queens…or cheerleaders showing up on their doorsteps…..they are putting signs up…that do not reflect their allegiance  to certain candidates!…OUCH!… Neighbors vs neighbors…We hear one such incident happened yesterday…when a neighbor with the CIC-Furth- Guard endorsed candidates went into the yard of supporters of the  No-Guard candidates and BSO was called it to smooth things out!…So what trumps what in the commercial areas with opposing signs on or around businesses in town?… Guess the Town’s code enforcement was told to stand down….now that the CIC- Furth- Guard endorsed candidates have put so many signs out in violation of the Town code!… Someone is still throwing out signs and moving signs after hours in the dead of night…Sad…to see the ongoing attempts to thwart a fair election process!…..

Here’s The Scoop … MPSC Meeting Puts The Spotlight On The Candidates For Commission In March 2010 …

A PREVIEW OF WHAT’S IN STORE …. ON THE DAIS IN MARCH 2010….

Dear Readers …Last night was a preview of what’s in store for all of us for the next 2-4 years on the dais….The Master Plan Steering Committee met for their regular monthly meeting in Jarvis Hall …The hall was pretty full for one of these committee meetings that is usually attended by this writer alone…with a smattering from time to time of a local news editor whose husband is on the board or a regular local comic at the commission meeting podium as well as a one or two commissioners who came a few times over the last couple of years…

Tonight’s hall was filled due to the MPSC agenda which was to address the El Mar Drive “McIntee Median Walkways” (prev. post) …which amounts to approximately 3 medians in the south end of El Mar Drive at a cost of the “Oriana Million”…

Before the meeting began Chair Paul Novak informed this writer that Asst. Town Manage John Olinzock called him at 3 pm to inform him Ernie Ojito Project Manager, from Ocampo and assoc. would not be in attendance even though Paul had set it up with him the week before. John Oloinzock said it was not part of Ocampo’s contract and the Commission needed to approve it!… After that Paul sat at the table with Maryann Wardlaw  and Bob Eckblad and each agreed as they had at the last meeting they had a few months back that they saw a major change in what was decided originally due to the finding (finally a year and a half in) the Oriana Million could be used for the entire length of El Mar Drive…and concurred that they did ask for time before the majority on the commission (Silverstone-Clottey and McIntee ) voted to go ahead ignoring the consensus they came to at the roundtable the prior evening…

The meeting began and Paul said he would call the roll and “see why you’re all here”…clearly disgusted with the change in his plans to have a professional attend to address the situation… Paul spoke of  ” a lot of calls” he had received from citizens that did not like what they saw or heard about the walkways in the median plans…Paul again described how the rountable ended and then how the commission voted…He went on to discuss their role this night and what if anything they should come up with…Paul said he was of the opinion the money should go for landscaping and lighting…Bob Eckblad reiterated his previous roundtable statements of an overall plan and the finding a way to fund it and offered up the project should wait until March… Marilyn Carr spoke of how everything changed 3-4 times, the beginning plans to beautify El Mar Drive and also added that with the changed they should wait until they have a plan…Mike San Miguel spoke of what the commission asked of them and did not feel the funding was a part of their duties…Paul spoke of the students and the understanding that they even had hat some concepts would come from each entry not just the winner and that “walkways” were never the “intent”…they just happened to be part of the winner’s design and morphed into the focal point somehow… Marc Furth did not know why the committee was even meeting…what the objective was…and said the committee perhaps failed to obtain more input from the people…He did not feel a handful of people present in the hall were enough to change anything and it was probably a “moot point” anyhow with the commission’s vote…He mentioned waiting until after the election and a new commission was seated…saying he “was not in favor of any particular plan”…reminding the committee he brought up sidewalks but received no support …Louis Devorak  came in late and said the biggest challenge was to use the million dollars and said “life is what happens while you are waiting for something to happen”…

New CIC-endorsed Candidate from the north Marjorie Evans decided to come to Jarvis Hall for the 2nd time in her 40 years of residency (she made her 1st visit on Jan. 12, 2010 and left right after public comment stating she was sorry she came)… sitting next to her CIC- endorsed slate Comm. Silverstone and Joe Couriel… She said “I’d like to say something.”…Paul Novak said he wanted the commissioner to speak first… .. After some guidance from Comm. Comm. Silverstone spoke…” Well, then I’ll speak about this. My contention has always been from the get go we have this money um, we do something with it. You guys has a lot of meetings. You brought these students in. I think we’ve had every possible input that we could possibly have and the idea towards the way the commission did vote and that is the as Louis says to do something with it. And I think that is a start and if there’s changes along the way so be it. Ah, I think you even said Mr. Novak that once this is done we would start working on the second half of the project because a million dollars is, is as was said is not gonna be a lot of money to really do too much. But we can start it. And I think the RFP cycles are already started and I think that we voted on it. That’s already gone forth to ah, to pick some RFPs on this thing, proposals to, to accomplish it. Um, the intent of the money was to beautify El Mar Drive. The biggest problem we have on El Mar Drive is drainage. That’s being answered in another area. Um, so I think this meets that goal. This is something that does beautify it and I think we should go forward with this. But it can be stopped if there’s enough pressure to say wait a minute, hold on this is not a good idea. I’m always looking for that. I’m only speaking for myself. If somebody  comes along with a better idea, a better way of doing this. But I think we’ve had time to ponder this and go over this and I haven’t heard anything that meets that goal as good as we could come up with that the students came up with and again as the pavilion we came up with  different ideas to come together to handle its changes made to it and that still opened on time in the process of doing this. So, I mean I’m speaking for myself that’s the way I see it going. We’re doing something and I think that’s a good thing.”

Paul asked Comm. Clottey to speak but she wanted to hear the residents before commenting…Comm. Dodd spoke next to say he thanked the MPSC for their work on the project, and understood their frustration with the commission not following the consensus to give the MPSC some time…He said he voted against the million for the medians…He heard from many people “It’s a stupid waste of money”…and felt it should still go back to the committee to spend the money “in a better fashion”…

Cristie Furth -Campaign Manager/ BTSTimes Editor/ P&Z Vice-Chair and El Mar Drive owner of Town Hall East (Blue Seas) …stated she “talked to a lot of my neighbors who live there who actually love the idea.”…She said they ares “sick of looking at the medians with Sable Palm tree sticks, like sticks with brooms on it.”…She went on to state “El Mar Drive median is so destitute”…”Seems that people are changing their minds”….”More campaign than anything else, campaign issue”…”We have one million dollars and that does not go very far”…”A walkway in the median is what I’m looking forward to as a resident of El Mar Drive and walking everyday trying to hide from the sun ok?”…She went on to speak of the Holiday Inn and the Villa Caprice being in foreclosure and if the medians were not done no one would come and buy the hotels to refurbish them…”It looks decrepit, it needs a shot in the arm, it needs something.” “You can’t wait. You agreed, It’s been a year and a half on it. It needs beautification”…”Walkways down the middle is a wonderful thing!”…”As a stakeholder on El Mar Drive I’m all for it and a lot of my neighbors and friends are. I don’t know who’s talking to you but my people that I know love the idea!”…

Diane Boutin spoke next trying to put things into perspective with what is really needed in the south end of El Mar Drive and the problems with the portals…living with a budget…in the real world…she said “Her neighbors are vehemently against it!”…She spoke of the trucks by the medians…the fumes and how fiscally irresponsible it is to spend a million this way…She received loud applause!…

El Mar resident David Nixon who lives in the south end spoke of the taking away of green space for pavement …the lack of size of the median (20 ft. wide)…the safety issues …and stated he spoke to 2 engineering firms that said never would they put a walkway down the middle of the street  this way with so little footage …

Candidate Scot Sasser spoke ” Mr. Novak, I couldn’t have said it better than these people have. I’ll just let you know that in my journey’s all across town and talking with people, tonight is just a microcosm of what I’m hearing personally. and a few people are for it, many are against it.Me personally, I would just like to see an overall plan as many of the Maser Plan Steering Committee have already stated before we move forward with anything. I just think it’s prudent after hearing tonight and what we are hearing through the town is to let you guys go back and have a couple of meetings and then come back with an overall plan. Obviously, you’ll have to have meetings with experts like you’ve stated so on ad so forth. But an overall plan and then you can get into whether or not you phase this in which is probably a viable approach to this whole thing. It doesn’t mean that you have to do it all at once, but at least having an overall goal as well as an overall idea how much it’s going to cost. I think that’s the only prudent thing. I would be interested to hear if indeed it has gone out to RFP and then if you so choose tonight what is the next step from here? How do we go back and allow you to do your diligence on that? That’s it.”…

Scot’s opponent CIC-endorsed Marjorie Evans ” Here’s as a citizen, here’s my frustration. It’s not so much whether there’s a walkway down El Mar Drive. It’s the fact that all this time has gone by there’s a million dollars, nothing has been done with it and I don’t understand. Like if you go back to the drawing board again nobody’s ever going to be 100% happy with this. But somebody’s got to make a decision and where I come from a million dollars is a lot of money. It may not be a lot of money to you guys but it’s one eight of the budget I have to run a non-profit agency. If somebody gave me a million dollars I could spend it! And I think that’s what the problem is. And if you go back to the drawing board again there needs to be a time line, a vote and move forward. That’s just my opinion.” …Only Cristie Furth applauded…..

Next came CIC- endorsed Joe Couriel for Mayor, who spoke 4 times this evening.” Ah, I’d like to ask a question. does anybody remember Sea Grape Drive? Ah, Does anybody object to how Sea Grape Drive looks now? I don’t know if you remember the battles for Sea Grape, but they were epic battles. They were the Hatfield and McCoy’s. We on the west side of Sea Grape Drive wanted the sidewalk on the east side and the people on the east side wanted it on the west side. And we fought tooth and nail to try and put it on the other guys side alright? I happen to be on the losing side, alright? They decided against our position. We thought it would be safer but we lost and I went home to lick my wounds and wait for the construction to begin and it began and it ended and it looks beautiful and it’s because someone made an executive decision to do what needed to be done and not keep talking about it. We would still be talking about Sea Grape Drive as what to do about it. And I can tell you folks if you’re afraid of the city not being able to maintain that beautiful landscaping that we we have I think they’re overdoing. I counted four trucks the other day and about eight people working on it and they do it every two weeks and they do a wonderful job. So don’t be afraid about the city keeping up with whatever they put in there It just needs to get done! Now quit talking about it otherwise nothing will ever happen, thank you.”…

This writer spoke of attending the meetings…my neighbors who say they will not walk the medians…the million burning a hole in the majority commissioner’s pockets and the history of how we got to this place which readers can find under the board category over the last 2 years…

Joe Couriel took the microphone for the 2nd time…” Ah, it seems to me that the bone of contention here is that the sidewalk down the middle, ok? You don’t like it Mr. Nixon doesn’t like. Some people don’t. I really don’t have an opinion one way or another. I think the most constructive thing we can do here today is come up with a, with a, ah, ,um a recommendations to the board to reconsider spending the money that is going to be spent on a sidewalk down the middle may be better spent doing other things. In other words go forward and let’s revisit the design of the median and see if there is a better way to do it. If we can come up with a plan and present it. You vote on it but we think it can be improved. Maybe we can achieve something. Let’s come up with a plan not just shoot it down and start all over because we are not going to do it. I guarantee you that. But maybe you could influence the outcome of it. Then it might be worthwhile pursuing. Thank you.”…

David Nixon spoke of using the money to hire a landscape architect and to plant…to forget “walkways and gazebos and fountains and Ferris wheels”… keep it green…

Diane Boutin spoke again about the lack of a professional coming to assist and warned the commission about wasting a million dollars…

Candidate Chris Vincent spoke ” I want to get back to the Sea Grape project with sidewalks. I live on Corsair Avenue that intersects Sea Grape where the sidewalks are and what Mr. Couriel said about the infighting whether it be east or west. What he failed to mention is we all agreed we wanted the sidewalks. It was just whether it was going to be east or west. The consensus came down obviously it would be the west because the east had the majority of the back-out parking on that side. But the point here is that it was agreed on. We all knew we wanted sidewalks. What side did we want it on that was the contention. Bottom line, it was west side. Rightfully so. It’s a beautiful sidewalk and it was done for safety reasons. A lot of pedestrian traffic on Sea Grape, with that sidewalk in now we have a safe walking environment. Getting to El Mar with the sidewalk in the middle of the median is a project that the majority of the people don’t want for safety reasons. It’s not a good safety idea, a sidewalk down 1320 feet of El Mar Drive. So people can walk on the street, on the sidewalks, cross over and say hey there’s 1320 feet of sidewalk lets’ go walk that, get to the end and walk back over on the other sidewalk. If you think that’s going to entice people to come into our town because we’re going to spend a million dollars for 1320 lineal feet of a new sidewalk, you’re dreaming! That’s not helping the town, that’s polarizing the town by spending a million dollars on a sidewalk in the middle of the median on the south end of El Mar where the majority of the residents do not want it. Thank you.”…

Joe Couriel 3rd time… “One could make an argument about anything or any point and I ask you to consider how many back-out parking spots are there in El Mar Drive now 90%, ok? Every time I go by there I have to be very careful when I’m backing out of that I don’t run  over somebody, alright?. And I’m  always having to either wait for them to pass or they have to wait for me to get out. So that is a fact you have to consider. It’s not just the ah, whether the sidewalk is in the middle or not, it’s what’s safe is for the people that are walking down Elk Mar Drive. If you don’t have to fight ah, back-out drivers you have probably eliminated a big um, ah, safety concern that exists right now in town. So that’s just something to consider. I’m not saying not to. Just consider everything, ok?”…

David Nixon countered Joe Couriel and Cristie Furth about 2mph back-out cars vs 35mph street traffic…on the safety comparisons…

Commissioner Clottey not feeling well did not comment…

Cristie Furth went for round two…saying the design was “lovely”…and saying stop the “stalling”..spend the million!…

Maryann Wardlaw spoke of getting off on a tangent and the loss of focus with the intention of the medians…Paul asked for consensus and preferred to wait until after the election…asking for prudence and to not be rushed…he brought up the pavilion and the changes encountered with it… saying change is good….He again asked for 2 or 3 meetings…

Suddenly Candidate Marjorie Evans spoke up again…Candidate Evans…(in Jarvis hall for the 2nd time in 40 years of residency)…addressed the MPSC ” May I ask what is your function?Are you a workshop with a number of plans to bring back to the town and then they, what exactly do you do?”

Paul ” We take our orders from the commission. That’s what we do.”

Cand. Evans” But what do they tell you to do?”

Marc Furth ” We’re an advisory board.”

Cand. Evans ” What are you supposed to, what is your product you are supposed to come up with at the end of your, what is your product?”

Paul ” Our product for the last year has been working on El Mar Drive.”

Cand. Evans ” But what would you say working on it are you supposed to come up with a plan? Are you supposed to…”

Paul” Let’s put it this way, you could probably look at us as being a think tank to come up with ideas to present to the commission.

Cand. Evans ” Do you have like I want you to come up with 3 ideas of how to handle El Mar Drive by January xxx”

Paul ” How long have you lived in town? Have you been aware….”

Cand. Evans ” I’ve been in town for 40 years.”

Paul ” Are you aware of the whole process we went through with the students designing El Mar?”

Cand. Evans ” But I’m also aware that time was for nobody and my frustration living in this town is that we have an asset here that we supposedly have been given a mission that this supposedly the end of this mission is to beautify El Mar Drive.”

Paul ” Correct.”

Cand. Evans “That’s supposed the end of the mission the current mission and I when I have people who work for me and I say ok in January I want to open a new program and this is what I expect from you in November , this is what I expect from you in December. I can see what my options are and then make the decision. But it seems like there’s not a defined mission that you guys have that the commission has sent to you. This is what I want from you. This is when I want it and so you’re spinning your wheels because according to Jim (Silverstone) you got professional help and (Paul disagreed) well he [Jim] said you go professional help.”

Paul ” They looked at it Jimmy but come on, I man how much help did we get? Look at the World Trade Center, it’s been going on and look at all the professional help they probably had.”

Cand. Evan ” Well I’ll tell ya, I think I have worked with the government a long time and it is frustrating to work with government because they don’t move and decisions are made and time is you know I mean the merchants the people who live on El Mar Drive. I’m sure that for them that means business that’s means money coming in here. That means tourists. You don’t want the place lookin’ crappy!”

Paul ” Believe me I have a lot at stake on El Mar Drive and I don’t want the place to look crappy and I have some opinions about alot of things on El Mar Drive but I’m not going to bring them up at this meeting because I don’t think it’s the time to bring them up. I think this board has done what it was asked to do as far as the El Mar project.”

Marc Furth “That’s right”

Paul ” We met the schedule in 5 or 6 weeks.”

Cand. Evans ” Then why are we still debating it?”

Marilyn Carr ” Because the commission didn’t make up their minds.”

Paul ” I don’t want to debate anybody all night in the audience here.”

The board then felt the need to defend themselves after Candidate Evan’s comments…Marilyn Carr,was pretty P.O’d and slammed those who never came and participated as the meeting were advertised… Louis Dvorak mentioned that only this writer was coming to the meetings throughout and said of those who had not,”suddenly everybody’s an amazing expert on El Mar Drive” …and blaming their sudden appearance in the hall to it being “an election year”…Paul spoke again of the previous roundtable meeting asking for more MPSC meetings…

Comm. Silverstone spoke again ” Obviously there’s some tension which way we should go here. Why don’t we ask the people out there to call the commissioner sand give us some feedback because you know it’s hard to say what the people of this town feel from a small group siting here and as was said out there I think we have plenty of time to get feedback from the people. But as Marc Furth said it always seems when the decision’s made  we get you know, people saying it’s the wrong thing to do. Well, maybe that’s true maybe people haven’t been paying attention. Hopefully we are now as a commission. I hope the other commissioners will agree to do this if we get a lot of calls. I think one of us can put it back on the agenda. Maybe review this or look at this again. I think that’s fair but until I hear from people out there, um, I’m gonna pretty much say what the vote of the, the  commission.” …

Marc Furth said to put it in Town Topics and Marilyn Carr said also channel 78…

Joe Couriel spoke for the 4th time ” I just wanted to suggest that you come up with a plan of action today to present to the commission at the next meeting, ok? Not wait 2 or 3 meetings. Debate it today, ok? And come up with something, something that says to the effect that there is trepidation about the paving of the median, ok? And you as a board suggest they were approved and maybe come up with the contracts aren’t signed , nothing is concrete. It can still be debated as to the final product. But don’t delay the product but try to influence the final outcome but do it this meting and maybe suggest that maybe more input from ah, from the town between now and then from the citizens. But do have a proposal to present to the committee to, to,  to the board  at the next meeting. In other words don’t ask for a postponement. Just say let’s look for a revision, ok? Because there is some concern about less green. I’m all for more green and less concrete. More flowers, green over black anytime. So I don’t disagree with that but let’s not postpone everything. Let’s not reinvent the wheel. Le’s come up with a plan B. Let’s tweak it, ok?”…

Commissioner Dodd stood to say he had already put this on the agenda…and Paul then sais he would ask for the MPSC to have more meetings and have direction at the commission meting..

Marc Furth ended by saying he sees nothing wrong with “piece-mealing”…

Dear Readers…Why verbatim?…Why so long? ….For LBTS voters to see and compare these opposing Candidates for commission on March 9, 2010!… District 2 Candidate Commissioner Silverstone is his usual uniformed- self… Dist. 1 Candidate Marjorie Evans did not even know the function of the MPSC and had no idea what they had done…insulting them big time …(2 for 2 with her visits to Jarvis Hall in insulting others!)…and Mayoral Candidate Joe Couriel…his long winded talking out of both sides of his mouth dissertations should scare the bejesus out of any voter that wanted to cut down the length of the commission meetings!…

A look at Dist. 1 candidate Scot Sasser and Dist. 2 Candidate Chris Vincent shows the glaring difference when comparing th above candidates to these fine candidates who are well spoken, well informed and concise ….

The choice is up to you…4 more years of sub-standard representation on the dais by a CIC-Furth led majority or a new beginning with  a “NO Guard” commission made up of qualified officials who can represent us all proudly?…

BUY A BRICK  CAMPAIGN  TO REMEMBER JERRY ON EL MAR DRIVE ….

Dear Readers….Perhaps Commissioner Jim Silverstone, Commissioner Clottey and the Furths are so adamant about installing the El Mar Drive Median Walkways because they have plans to re-name them “The McIntee Medians”…in remembrance of their pal Jerry McIntee as he departs town limits with the selling of his home ? (prev. post)…

Tomorrow night, Tues. Jan. 19th, 2010…. the Master Plan Steering Committee meets in Jarvis Hall at 7 pm to discuss the medians that no one but Jerry’s pals want!…

With the dormant donations for deferring the cost of the granite wall to honor elected officials (13 down on the right hand side of the Town’s home page )…http://www.lauderdalebythesea-fl.gov/

….the “Gang” may have decided it was only fitting to use the “Oriana Million” to honor their departing detective …Hmmmm…
