ATTACK OF THE 33 FOOT  CRAZED WOMAN …

Dear Readers… Well here we go..tomorrow night by the seat of their pants… the commission will vote on the ethics and height ordinances for 1st reading… to put on the March 9, 2010 ballot…

Let’s address the heights first….. With all the stalling done by this Furth- led majority since they won in January 2008 on heights… we are truly down to the wire…really down to the the wire…with first and second ordinances being addressed and voted on only one short week apart…clearly going against the commission’s normal set practice of spreading the readings  a month apart…..It’s being done with a “lame duck commission”…..and by two commissioners that badly need an issue in order to have something to run on besides their records …

This 33 foot height “townwide” drumbeat began alongside the other “insider” planning done at Town Hall east on El Mar Drive  prior to the election ..It was sitting right there with the “purchase of adjacent property”…the $2 million dollar Public Safety Building, the health insurance and the cell phones…This writer never heard of any of these being instituted while battling for the CIC-endorsed candidates to win…foolishly believing I was working hard to return the Town’s commission to fair and balanced…fiscally responsible and open for all to actively put down their differences and work together!…Hah!…

The first time this 33′ “townwide” revisionist history issue came forth…was when the majority knee-jerk action was taken to remove the overlay districts, ASAP…..It was a move that a learned and ousted short lived “Town Historian” warned should not be done in haste…Following up this orchestrated action to ensure it stuck, was the plan to torpedo the Town boards from addressing the fallout from this action by turning a deaf ear to any and all requests for direction from Commissioner Dodd or Paul Novak the Chair of the  Master Plan Steering Committee …Add to that  the few and far between meetings of the Planning and Zoning board…….They successfully held the height issue at bay for almost 2 years…just waiting for the opportune moment to use it for an election platform in order to run on once again in the the same old CIC-Furth led campaign…campaigning against “evil developers”…and “a LBTS Galt Ocean Mile”…with a dash of anti-VFD thrown in for good measure…sort of the 6 degrees of  VFD separation…

Ms. Furth who may have succeeded in this election in getting the nod to run for commission in the south end of town…by cajoling Comm. Silverstone into the mayoral spot…has been driving this train from day one……including pushing via this  group, a Town Manager via the Assist. Town Manager via the based on Wilton Manors “townwide” survey that included the falsely stated question 13… “Do you support the current maximum height limit of 33′0 in Town?”…It produced the hoped for response from less than 4% of the residents in the affirmative…and with that in place…it was full speed ahead to become the focal point of the Mc-Furth-CIC campaign over the next 3+ months… No epiphany at the beach required for this one!…

We saw the Furth “siesta -soldiers” on the dais hop on board this psychedelic “Love the height issue” train……especially in the aftermath commission directions of drafting the first ordinance given to the Town Atty. last month….They were  given  “marching orders” from their oft visited late night “El Mar” command post…”clarify”…the LBTS voters need to “clarify the heights”…once and for all…Take a look how often the word “clarify” is used in the ballot question… Who else is visiting Town Hall East?……Hmmm…..

We have been given two versions of the the new height limit referendum from the Town Attorney…Ordinance 2009-33 and Ordinance 2009-34…

Page 1-2009-33 is to approve an amendment to 7.1 of the Town Charter pending a referendum election providing for a maximum building height of forty-four (44)  for all buildings within the Town located to the north of Pine Ave: providing for a maximum of thirty-three (33) feet for all buildings located south of Pine Avenue ….It goes on to say “providing for a modification in the calculation used to determine maximum building height”…Basically the word “modifying” means LOWERING the maximum building height in the south end of town from 3 over 1 or 44′ to 33′…..continuing on … “further providing for clarification on the restrictions on the creation of new zoning categories and amendments to residential zoning zoning district regulations”…

On page 2- Sec. 2 Charter Amendment-7.1 (1)  … states that buildings north of Pine, as they existed on March 20, 2006 shall not be more than four stories high above grade and the maximum height of such buildings shall be 44 feet high above the grade, a horizontal plane eighteen inches above the crown of the roadway of the highest point adjoining the property on which the building is located….

What’s stricken-measuring the height” as defined in the Florida Building Code, or above” (the horizontal 18″ above the crown of the roadway)…and also stricken in the highest point determination “whichever of those 2 levels is higher”…

(2) NEW- “No building within the jurisdictional boundaries of the Town as they existed on March 20, 2006, located south of Pine Avenue, shall exceed a” ….attached to the prior section in place …”maximum height”…NEW- “of” ‘ thirty-three feet, …NEW -”which shall be measured from”a horizontal plane eighteen inches above the crown of the roadway of the highest point adjoining the property on which the building is located.”

What’s stricken- “Above grade, as defined in the Florida Building Code, or above (the horizontal 18″ above the crown of the roadway)…and also stricken …”Above the minimum elevation for a habitable, finished floor permitted under applicable federal or Florida state regulations, whichever of those three levels is highest.”

Page 3 -again stricken-the Florida Building Code for height …no longer allowing for roof apparatus such as air conditioners…elevator shafts and the like being in addition to the maximum height …those will now be included in the maximum height allowed…33′ or 44′..

Page 4 -still allows for those non- conforming buildings existing before and now non-conforming with the new LOWER 33′ maximum height in the south ( if voted on in referendum… we will have many more that will now be non-conforming) destroyed by fire/natural disaster or other act of God…to be rebuilt to height and setbacks as recently passed in the land development codes..

Page 6 -NEW-  adds-the following for rezoning “The Town may not rezone property that was zoned in one of the residential zoning districts as of March 20, 2006 to a different zoning district and”… (may not )NEW-” revise any regulations applicable to these residential zoning districts to allow additional uses without approval by similar referendum vote.” …also NEW- “The Town may not “( create without approval by referendum ) NEW-”overlay districts.”…

page 1- The same in content …with the exception of adding “In specified areas” to include certain areas in the south allowing 44 ‘…

Page 2- Sec. 2 -Sec. 7.1 is the same for the 44 ‘ north of pine……until you see the inclusion of certain areas south of Pine Ave..to also be 44′…

NEW …(1) “South of Basin Drive and north of Hibiscus Avenue, south or east of Silver Shores Waterway and west of the mid-block line between Seagrape Drive and Bougainvilla Drive.

Page 3- (2) “South of Pine Avenue, east of Bougainvilla Drive, and north of Palm Ave and

(3) Frontage along Commercial Boulevard east of the Intracoastal Waterway.”

The rest of the additions in 2009-34 …… are as above in 2009-33… stricken also the same with an OOPS!… MIA in leaving out the stricken “The Town” in (9) line 237 …same text used with the Florida Building Code and grade from the crown … zoning etc…

The 1st and 2nd versions of the first ordinances for the ballot 2009-33 /2009-34 do not specify that the maximum height in the south end of town will be lowered…which will again lead to, in yet another LBTS Height Referendum election, many voters voting on these referendum questions to walk away voting against the way they intended!..

Going against the Florida Building Code will cause much confusion from those coming into our already substandard Development office… The office that has repeatedly been called out over the past 2 years for inconsistent, and incorrect information…Taking out the Florida Building Code in the ordinance could also take away a layer of protection in a dispute …

Referendum on zoning…for every”residential”  area …what about all the talk of the need for a “Hospitality Overlay District” to retain the town’s tourism vitality…

This is a giant mistake and unnecessary for this election…What’s the rush?…

It’s only been a few months since the Town Manager terminated the Town Fire Marshal saying she could not justify his $100,000 salary (which was never $100,000) due to lack of permits for building…She was backed up by Comm. Clottey …who repeatedly turned this writer’s stomach with her crass remarks each time the termination was discussed…”we can’t pay someone to sit in their office and twiddle their thumbs”… Vice Mayor McIntee and Comm. Silverstone heartily concurred and backed the Town manager due to lack of building in the Town….

Take a walk around…see any building going on?…Nope!… Minto has stopped and we hear has plans to come back with a revised plan…for somewhere down the line…years from now…As for other properties on El Mar Drive who have had their plans approved… ..not even a shovel has been put in the ground…We saw the Garden Court extension process….it’s treading water, with the assist of a state program……And the By The Sea Future has on its new edition’s back page 2 hotels for sale…The Coral Key who came up empty ….and did not get an extension…due to the owner and his paper…coming up against a hostile, biased dais…and the La Mer Hotel ….

Does anyone doubt for a minute if “Mr Oliver Parker ” now so strangely and suddenly revered by his former foes pulled such a stunt…the BTSTimes newsflashes would be out tonight!…

The  political shoe’s on the other foot here folks….. Tell this commission to do one thing the last commission did with 6 meetings to go…. leave this decision for the next commission!…A look at the minutes for 2007 /08 will show the commissioners did just that …led by McIntee and Silverstone)….

Those wishing to deny that LBTS voters have more than once specifically approved a 3-over-1 story height limit in Town might well be reminded that — according to its title — *Section (9) of the 2006 Charter Amendment on Height Limits and Voter Control of Rezoning….the 2006 Charter Amendment was one “REFINING AND STRENGTHENING THE 3-OVER-1 STORY HEIGHT LIMIT.”…

Stand up and run on your record…”Broom Boys”….This issue should be swept aside! …

Dear Readers… This next election is crucial…Take a look at the new edition of the By The Sea Future newspaper…It’s been delivered right outside on your driveway … in your condo mailroom, in Town Hall and at stores throughout the town…

Now listen folks, if anyone takes you aside and starts bending your ear that this is the “negative” paper in town… that it’s the”other” paper in town…don’t buy into what they are selling…

The news is the news …Positive news is reported on when there is positive news to report and in this edition of the Future it’s the choice we now have of electing new candidates Scot Sasser and Chris Vincent for the commission in 2010…

It is this writer’s opinion that the more negative newspaper impacting the town is the VFD Booster Club funded ..(do you know where your VFD Booster Funds went?) Mc-Furth By The Sea Times … For they are publishing pure Furth-fantasy…full of flashback fluff…. They’ve been doing it all along…and were increasingly deceptive in the issue put out before Halloween with their “Who Can You Trust” Goodyear Blimp cover hovering over the LBTS of the past….and in the issue one week ago…their “2010 political playbook” edition to run against the “Ghosts of the Old Guard” …… (prev. posts)…This paper has been resurrected from the MacMillans for one reason only…. MCINTEE & SILVERSTONE…”BROOM BOYS- PART 2″… and to keep voters eyes averted from the reality of their decisions and actions over the past 4 years on and off the dais and what they have planned for the future if the status quo remains the same after March 9th  in Lauderdale-By-The- Sea….

Dear Readers … in the Saturday Sentinel… The Development office is going mobile…The Town has put it out for a surplus ITB (Invitation To Bid) with a minimum bid price of $ 44,527.00….Really!… The bids will be open and yep, these will be read aloud …on Dec 18, 209 at Town or Jarvis Hall depending on the crowd…Hmmm…Is there a big market out there for a 1999 “as is” trailer?…Or will this “puppy” join the dented discarded municipal trucks that also were listed as surplus ITBs some months back…and are now  sitting outside the still unsold ..never talked about  warehouse west off off Dixie…Perhaps that’s where the Silverstone-Furth pavilion Clock is housed as well?..We’ve only been awaiting that Silverstone-Furth never talked about project since April…OOPS!…

So it look like an empty lot will be awaiting the guaranteed $3 million dollar “VFD-Fire Garage”….that according to the Town Manager will sleep the VFD firefighters…But insists it’s not a fire “House”… Take her word for it!…Nahhhh…Doesn’t matter though, if the status quo is in place after the election.. it’s a done deal!….

The “same “powers that be” until March 9th …..will continue with their “mantra”…it’s necessary to remove ASAP …due to no trailers being allowed in LBTS…Hmmm…. Not so fast…We still have the trailers right across the road from this one..Minto’s construction trailers, the construction site with the magical dirt that doesn’t fly around…(as compared to the Garden Ct. variety due west!)…. and the double wide sales center on the oceanfront…time table for those…no end in site!…  pun intended!…..OUCH!…

Here’s The Scoop … Believe It Or Not …

HE’S NOT HERE …. YET! ….

Dear Readers … This writer was dragged in to see the “Rip-Off” -Believe it! Museum yesterday by the BCbythesea family … and during the endless display of weird, disturbing and even more disturbing Ripley collected “are- they-facts”…… a text came from a LBTS “Roving Reporter”…It was a sighting ….the VFD arrived at an AMR medical call …with a fire truck and the Vice Mayor/Dep. Chief  in his shiney red command car……Yep, they’re still going on too many medical calls…..the fire truck and the Dep. Chief sat outside…not needed by the EMS… We hear that the Dep. Chief took the opportunity to call the children to come across the road and get on the truck…..

What’s wrong with this picture?…Either the firetruck is on a call and therefore not stationed for a little political P.R. or it has ceased being on scene and therefore should have returned to the station. We agree with those observers who thought this was just another case bad judgment from the current man in charge McIntee!..

As this writer finally hit the end of the Ripley tour…landing in the inevitable gift shop stationed before the double doors to exit….. the caller asked “Did you see the man with the World’s Biggest Ego?”…and without missing a beat…I replied…”Nope, he’s in Lauderdale-By-The-Sea, and he just asked the kids on board the fire truck!”…

Hey, just think, there is a place for that ego to go after March 9th…on the 3rd floor stationed right between the World’s tallest Man, the World’s heaviest man, and  Skeleton Man…or better yet …across the hall next to the man with the shrunken head!….

Sorry folks, “Little Chief” Perkins will see this  McIntee move…within “the Chief’s discretion”…and give his Deputy Chief a pass!…. The VFD elects their Big and Little Chiefs next month… fingers crossed… Believe it or not!…

The Town Commission shall not grant relief unless it finds that was an error of law or fact in the Town Manager’s decision on the encroachment permit.”..Comm. Dodd acknowledged this at 1st reading…received no dais traction…STOP …and give the Town Commission the right to overturn the unilateral decision of the Town Manager!…

Dear Readers ….the VFD put together a new Booster Fund Drive…A Furth photo-filled letter was sent out Wednesday….As vendors to LBTS, this time around the VFD  cannot actively campaign for the McIntee-Silverstone and (possibly) Furth CIC- endorsed  slate or give them donations…But with this fund drive, they will cleverly provide the CIC-slate access to important election information…They will put together a list of the VFD  Booster Fund Drive respondents and then the CIC and their endorsed candidates will contact them to vote much like they did when using the Oliver Parker Recall Petition signers in 2008!… Included in the plea for funds is a request for respondents to volunteer for the the Halloween Haunted House and 4th of July events….Why would the VFD, “contractor” put this on the Booster letter to ask for volunteers for Town sponsored events except for it too is to be used politically……But the real problem I have with this “Fund Drive” in 2009, is this, while the VFD is a long time tradition in LBTS…it is no longer the small town fire department of the past in need of funds!…The new VFD receives almost a million dollars in funding from the taxpayers courtesy of our fire assessment for  60+ members …They have well over one hundred thousand dollars in a town account for vehicles, another separate account for the Beach Patrol payments for service…and a very lucrative fire inspection income from annual inspections throughout the town both residential and businesses.. …50% they keep upfront and the other 50% goes into savings in an account for more fire department related purchases!..

So the only reason for this 2009 VFD Booster Fund Drive…is political, plain and straight… I know, there will be “outrage” from the Town Hall East “usual suspects”… for taking this stand…calling  it “evil” while beating the drum…saying it is an “attack” aimed  at these selfless volunteers participating in something for the good of this town…

But I’m prepared for it……Prepared for the feigned lashing to come from the Mc-Furths….Maybe it will look like sour grapes on the face of it to those still unaware of the big bucks the VFD has gone through in the past year and will receive per their contract this year with 3 more years to follow…..I fully expect a politically orchestrated response on and off the dais…I expect more Commissioner Silverstone “It’s anti-American, it’s anti-Town” declarations like the one he made in November…again during his Commissioner Comments in December, January and February……But that will undoubtedly be tame when compared to his BFF- VFD Deputy Chief /Vice Mayor McIntee, who will  pull out his government access cable TV  “Look folks”  style commentary to appease and appeal to those voters still in the dark……He will use any questioning  or negativity concerning the Booster Fund Drive as a starting block …He will declare that such actions are only the beginning of the end of the VFD if he and Jimmy-boy  Silverstone and Furths are still not in charge in 2010! …

Those who listen to him should know this ….In the first year after returning as the sole fire service provider to this town this 60+  member VFD acquired 3 more fire trucks…bringing up the total to 5 for a single fire station centrally located within a two and half mile town …..This despite the ISO  stating that for a town this size 2 is enough… (prev.post)…When the 1st truck was purchased with no RFP or input from the Town, the Town Manager said the Town must buy it from the VFD…because the Town needed to own all our public safety apparatus…When in short order, the 2nd truck was bought by the VFD again without an RFP or Town input..she changed her mind about the Town’s position of ownership… …It didn’t matter to McIntee though, because the VFD had their bloated Booster Funds…Most of those funds it is said, came from the Vice Mayor’s deep pocketed friend from the Fountainhead. Condominium in the south end of town….McIntee used to brag about the man..McIntee said his benefactor only wanted rides in the truck in return for a McIntee visit resulting in another generous VFD donation…This includes that big 72′ flat screen the VFD was given when they rented the storefront during their ouster on Commercial Blvd….which it is said, the same man with deep pockets also provided to the VFD by paying the rent for a year….Many say he was also the guy that gave the VFD money toward a new firehouse in the Sheriff Ken Jenne days……and covered their legal fees when the VFD was suing the BSO and for a short time suing the Town of LBTS after they were terminated……He was  real gravy train for McIntee before he passed away…So, with all those donations sitting in the VFD Booster Fund, the shopping spree continued monthly, sometimes weekly and perhaps even daily from the Oct. 1st 2008 contract starting date with trucks, a new Command car for McIntee, a souped up and detailed fire boat sitting pretty at the new dock…… maxed out ATVs….and lights and sirens on the SeaDoo as well …..It was like having a hot fudge sundae everyday…with sprinkles and a big fat cherry on the top….The cherry was the last fire truck, a $150,000  102′ foot 1989 ladder truck found once again by McIntee  himself (flying in the face of his Dec. 2008 letter to the Fl. Ethics stating as Deputy Chief he would have no purchasing duties) …McIntee  has admitted his purchasing role …In fact he was rather proud and obstinate on the dais concerning this and other  VFD purchases made prior to his 102′ “cherry” in 2008-2009 …One thing about McIntee, this writer observed…he’s a gambler…likes to play the slot machine…and he will pull that lever without a second thought …. In his world there will always be more quarters to play with….He gambled once again by buying this 20 year old $150,000 ladder truck…thinking that even though yet again the VFD purchased it with no Town input and no RFP, he could get the Town to buy it after using Booster Funds to purchase it… (prev. post)… They cut a check for $150,000!…When this writer posted the VFD was going to ask for the Town to pay, after getting the tip off…suddenly the “Little Chief” Perkins pulled it off the agenda…Later it was put on again, and again it was posted right here prompting  its removal from the agenda for a second time, but this time the Town Manager revealed Chief Perkins was going to offer it to the Town for a reduced price of $100,000!… That too is an all too familiar McIntee move!… With no reimbursement coming from the Town and his biggest benefactor no long up the road, perhaps the Booster Fund has run dry?… We will never know though, because as this writer found out some time back, the VFD Booster Fund is a separate fund operated under the non-profit VFD and they will not disclose the funds, individual donations (recently they did add a lump collected for 2008 on their website to try and appease) They also will not disclose any Booster Fund expenditures … The 2008 VFD monthly business meeting minutes disclosed the decision to use the Booster Fund to pay for the ads in the Mc-Furth By The Sea Times… Each issue contains a full back page color VFD ad …In the first three VFD income/expense reports I have received and posted there is no inclusion in the reports for payments for the ads in the paper!… So it’s easy to see that by  donating to this VFD Booster Fund Drive, McIntee will have carte blanche to whip that VFD credit card out to spend …spend…spend!..

The future election also brings forth one more reason the current leadership of the VFD would want to help the CIC-endorsed candidates in any way they can…You see the $2 million dollar McIntee-Silverstone -Colon driven purchase of the crappy hotel next door for use as a public safety building cannot sleep the firefighters … This was touted as one of the big reasons to push this acquisition through… and a McIntee-Silverstone-Furth-Colon win…means they can try again with a brand new $3 million dollar “fire garage” that sleeps firefighters…grant or no grant…to house all these new trucks…and the many  that are sure to follow  if this same VFD leadership remains and continues to purchase trucks with no RFPs or input from the Town ….

So folks, as you make this important decision on whether to give to the 2009 VFD Booster Fund Drive, and decide to do so please send a message along with your donation to the VFD members….Inform them you do not want your name passed on to any political organization…and that with your donation you insist the VFD disclose their use of Booster Funds in 2010!…

THANKFUL FOR CONCERNED CITIZENS /CANDIDATES FOR COMMISSION …

Candidates Scot Sasser and Chris Vincent … for Commission March 2010 …

Dear Readers … This writer and many other residents are truly thankful this Thanksgiving to have these two fine men step forward to enter the LBTS 2010 municipal election…

It shows how things are changing in this town… No “ghosts” of elections past…this time around…

Nope, Scot and Chris actively support the VFD members… knowing about the rich history of the VFD…

While those in the majority  at the present time with much to lose, must throw anything and everything against the wall to see what sticks, out of pure desperation such as asking where these two have been before they chose to walk into Jarvis Hall for the Commission meeting and then regularly coming back until each carefully decided now was the time to do something about what they each saw on the 2nd and 4th Tuesday of each month….It won’t stick….not in this election…

In the present LBTS political environment especially after the last 4 years…it’s a definite plus that they come forward with a new set of eyes and a fresh perspective…

Scot and Chris will be knocking on doors throughout the town beginning right after Thanksgiving weekend …

Scot and Chris are eager to meet the residents, find out what’s on their mind, listen to what matters to them most… to earn their trust and their votes …

I encourage readers to take the opportunity to welcome them as they and their families and their supporters knock on your doors over the next three and a half months … When you see what so many of these early supporters have already seen in them, the excitement…the anticipation….and the opportunity for a real chance to have  a positive change for the future of LBTS …. please jump on board and offer your help…and support…

Get the word out…tell 5 or 10 fellow neighbors and friends ..and tell them to do the same….band together…from one end of town to the other ….and on March 9th, 2010 you will be able to say you knew this was going to happen and you were a part of it when Scot and Chris knocked on your door!…
