Dear Readers …. It’s true ! …The rumblings are true!….The “2-Hats”-Colon Gang is planning for a new VFD Firehouse!….

This writer has heard it for some time….but could not believe it! ….Not after all we have seen with the ill-fated purchase of the hotel….. the Manager’s attempt to make a silk purse out sow’s ear……


AMR is stuck in the south corner in dismal quarters….It was found out after the purchase that the VFD were not allowed to use the upstairs for sleeping accommodations….The BSO is still not in and we now know were against the move from the start ….They spent countless hours and funds to make it work…only to have the orchestrated rug pulled out from under them…and have one of their finest disparaged and dismissed as some sort of pay-back…(The LETF is not even allowed for the use the Manager “strung them along on”…prev. post)…. and the “”It will be a wash” of funds coming from the sale of the warehouse in the west never happened!……Again, 2+ million was spent….but a look at the August-September  Town Topics (more appropriately called the LBTS Taxpayer funded version of the Mc-Furth Times )…page 4 spouts the present majority’s propaganda …

“The Town was able to save almost $2 million a year ago by switching from BSO Fire Rescue to the Volunteer Fire Department (fire suppression) and American Medical Response (EMS services).”…Hmmmm…..

You are shaking your heads….having a hard time swallowing…in  “UDDER” (Jimmy-boy verbage) disbelief!….

“THIS” is what the Mc-Furth/Colon Gang is planning for so soon after the ouster of Chief Gooding?… YIKES!!!!!

Please be careful!…….We implore you!….We want no onslaught of cases of whiplash townwide that might lead a certain brand new red command car to show up at your residence on that 911 call!….

On the list of reasons for the March 2010 removal of the “2-Hats” /Colon Gang…this one certainly jumps up to the top!…

Here’s The Scoop …. The PROOF Was …. In The Pudding ….

Dear Readers…. those up close to the scene yesterday….reported back to this writer just what was posted throughout the day…. ….The Town “saving face”….put out their  own P.R. version that should “chalk -up” one more reason on the ever growing list of reasons why March is the time to give marching orders to those who were in charge ….

The Town of Lauderdale-By-The-Sea removed a stranded sailboat from the beach on Tuesday (Aug. 25) just south of Anglin’s Pier at Commercial Boulevard .

The 24-foot sailboat washed ashore in Town at 9 AM after running out of gas. The vessel’s captain and owner said the mast on the vessel was broken. He could have avoided grounding the vessel had he dropped the boat’s anchor.

The vessel was traveling north from the Keys at the time of the incident. The captain told the Town he could not afford to have the vessel towed anywhere.

After the owner signed over the title of the vessel to Sal’s Towing, Sal Towing – in conjunction with the Town’s Municipal Services Department — used a backhoe and front-end loader to drag the vessel off the beach at about 4:30 PM Tuesday.

The Town extended its thanks to Sal’s Towing for its help in removing the vessel.

Firefighters with the Town’s Volunteer Fire Department and deputies from the Broward Sheriff’s Office responded to the scene of the vessel stranding Tuesday, which attracted curious beach-goers and camera crews from local TV stations.

The incident made the noonday news on Channel 4 and should be on Channel 10 at suppertime….

We hear the saga of the sailboat continues….as the boat is taking on more water and the poor guy in trouble was out of luck….No VFD boat arriving to tow it. when asked to do so………We hear they said they would need to check with the Town Attorney!…HUH?…What if the boat were on fire?…….. The word from bystanders was the VFD left and the Chief came back with a video camera and ready for his closeup!….YIKES!…..

Guess the VFD was only ready and willing to assist with the Manatees!…OUCH!

Big doings on the beach today in LBTS…from what we hear a man was out at sea for days and ended up dangerously close in his sailboat to the Pier….The BSO were first on the scene according to bystanders….and the VFD came out in big numbers after that……They observed and then they left….The Coast Guard was contacted ….Channel 10 news was there to cover it….and we hear the man on the boat may not have the funds to get the boat out…..and now it appears …..the boat is taking on water….And many questioned where the VFD Boat is……..The answer…it’s docked …..

Here’s The Scoop …. THE LBTS-VFD Beach Patrol … The “Devil” Is In The Details ….

Dear Readers …. At the Budget Fire Workshop in June Commissioner Dodd asked about the VFD and their medical calls/ Beach Patrol being allowed to be paid for from the fire assessment (prev. posts)…While we watched the “2-Hats” adamantly state there was no conflict (per an insurance agent’s say-so per Comm. Silverstone) shortly afterward we heard they scrambled behind the scenes and decided to call it “training” when they responded to medical calls (Town Manager Colon even jumped on that bandwagon on the dais) with the “2-Hats” within the department “leading” the members in deciding the last 6 months of beach patrol/ medical calls would be compensated through the elusive and bottomless pit flush with monies VFD Booster Fund… At the next Fire Workshop in July, the topic was addressed again by Comm. Dodd with Mr. Burton of Burton and Associates….and he disagreed with the premise that the VFD could not go on the medical calls…saying they would fall under “first responders” and as long as they did no medical assistance beyond basic acts and no transporting they were okay…Mr Burton added that calling it “training” (cover)  was not the description he would use… After that meeting a response came from the Town Manager to Comm. Dodd who had inquired about the Beach Patrol funding for the VFD, which she said was separate, due to the non-allowance of it being paid for by the fire assessment …She told Comm. Dodd prior to this memo that the funds were in an account and she was waiting for a bill from the VFD (this was curious due to the fact that it was now July with only a few months left until the 1st year contract was done)…The memorandum on July 29, 2009 had a cover letter “Subject:”Fire Assessment Balance” stating “As requested, attached please find the balance in the Fire Assessment account as of today.”…On the second page was a copy of a Sun Trust transaction activity for an acct. ending in “7588”…with the “Current Balance of $35,000.00″…”Collected Balance $35,000.00″…”Available Balance $35,000.00″…”Pending Transactions Activity on 07/29/09′ showing nothing…”Posted Transactions between o7/14/09 and 07/29/09 Date 07/14/09/ Transaction Description Credit image DEPOSIT/ Transaction Number D/ Credit $35,000.00/ Balance $35,000.00″…

So did this mean $35,000.00 was deposited into an account on 07/14/09? If so why did the cover page say it was the “Balance of the Fire Assessment account?”….Was it taken from a larger Fire Assessment account?… Comm. Dodd asked for a list of accounts and received a non- answer of “Response; Monthly bank statements are received by bank and reconciled”…(prev. post…OOPS! Of course it is the Town that reconciles the bank statements)…thereby not providing an answer of accounts the Town has….

Comm. Dodd followed up with an e-mail on 8/15/09 and received some responses in a memo on 8/20/09 (the memos with Mayor Minuet etc…prev. post)…Here is the questions with the responses from the Town Manager ..

1) The account for $35,000.00 for the beach patrol- will it be a line item in the final budget document?


2) From what account was this new account started- General Funds? Presumably this will be in next year’s figures.


3) Does the fire assessment money paid to the VFD as per the contract show a corresponding reduction of $35,000.00 now that the beach patrol is funded separately?


BC- The questions were due to discussion that the Beach Patrol could not be funded by the fire assessment funds…(prior to the exchange by Mr Burton dealing with medical calls at the July 28, 09 special meeting…and no discussion on his assertions including the Beach Patrol, as well as Comm. Dodd’s understanding from the Town Manager that the Beach Patrol was in a separate account awaiting a “bill” from the VFD”

It is all rather curious ….more “chasing tales”….zigging and zagging to accommodate whatever might be the correct determination of what is and is not allowed under the fire assessment fees…

A look at the VFD income and expense reports (3rd to be posted) from Oct. 2008- June 30, 2009 show that the VFD was in receipt of the full amount of their contract they receive quarterly…So unless the 4th report shows a deficit of $35,000.00 it would appear that something is askew…

The Beach patrol is included in the Sept 25,2008 agreement between the Town and the VFD…on page 2 “Article 2 General Operating Conditions”…

“2.2-Additional Services

2.2.5- The VFD shall provide a beach patrol division, operating on a part time basis to promote safety and fire prevention and provide surveillance of the public beaches of the Town. The VFD shall patrol the beach and water front for emergency situations according to schedule approved by the Town, during special events, or upon the request of the Town Administration. THE VFD BEACH PATROL SHALL PROVIDE EMERGENCY FIRST AID SERVICE AS NEEDED. The VFD beach patrol shall inform the public of dangerous swimming conditions. The VFD beach patrol division shall operate and maintain two (2) all terrain vehicles (ATVs) FOR THE EXPRESS PURPOSE OF PROVIDING EMERGENCY SERVICES upon all beaches within the Service Area.”

BC- So, with the inclusion of the beach patrol in the agreement (contract) and the only funding for the VFD being from the fire assessment it should mean the $35,000.00 is from the contracted price of $844,022.00 in 2008-09/ and again in 2009-10 …$877,783.00a ($73,148.57 per month)…So what was the Town Manager talking about a “bill ” from the VFD?…It would not make sense as the Beach patrol is part of the contract and the Manager has often said from the dais the Town/VFD abide by the contract (we also heard that when the Town/VFD thought there was indeed a problem with including the Beach patrol on the fire assessment there was talk of changing the contract)…Is it the correct terminology within that 2008 agreement to state the VFD  “shall provide emergency first aid service” and the ATVs will be used “for the express purpose of providing emergency services upon all beaches within the Service Area”?…That should be another question that requires yet another definitive determination….

Dear Readers….When hiring personnel to staff the Town Hall…it seems to this writer that first order of business would be to make sure they know the correct names of the elected officials in town and that of the Assistant Town Manager!

In a series of memos sent to the Commissioners and Administration on 8/20/09…the Town Manager signed off on some new names indeed!…OOPS!…

“Response: Monthly bank statements are received by BANK and reconciled.”…No wonder the figures are hard to get!….YIKES!

Dear Readers…When the Town of LBTS decided to go for the new “Vacation Rental” Ordinance 2009-19 recently, we wonder if the newly licensed abodes realize they will now be receiving a “Bed Tax” from Broward County to boot?…

According to the below information any type of “rental”property agreement for 6 months and less is subject to the tax….Are the newly licensed residences throughout town having their licenses “shared” with the County ala the recent Broward Business Tax Licenses (“Occupational licenses”) the Town said they searched out before they sent out citations for those in town who did not also have one in  LBTS ?…. OUCH!….


‘Q. What facilities are subject to the Tourist Development Tax?
A. Living quarters and accommodations in a hotel, apartment hotel, motel, resort motel, apartment, apartment motel, rooming house, mobile home park, recreational vehicle park, single family dwelling, beach house, cottage, condominium, or any other sleeping accommodations that are rented for a period of six months or less. Rentals longer than six months must have a bona fide written lease or they are also subject to the tax for the first six months.
Q. Who collects this tax and for how much?
A. All owners and/or dealers of the facilities listed above are subject to the Tourist Development Tax and must collect these taxes (5% of the rental charges) from their tenants or guests and remit them to the Broward County Revenue Collector.
Q. How often are these taxes remitted?
A. In accordance with Florida Statute 212.11, these taxes shall be remitted to the County monthly, quarterly, semi-annually or annually. Tax payments are due on the first of the month following the months of collection from their tenants or guests, and are considered delinquent if not postmarked by the 20th of that month. All owners/dealers must submit a tax return even if no taxes were collected for the month.
Q. What do owners/operators receive for collecting this tax?
A. To compensate owners/dealers for their collection of this tax from their tenants or guests, the owners/dealers are entitled to an allowance of 2.5% of the first $1,200.00 in taxes collected (not to exceed $30.00), provided the tax is remitted on time.
Q. What are the penalties for noncompliance?
A. In accordance with Florida Statute 212.12, if a tax return is delinquent:
• There will be no collection allowance and a minimum penalty of $50.00 will be assessed for filing a late tax return.
• There will be a penalty of 10% of the total tax due if not more than 30 days late. An additional 10% will be added for each additional 30 day period, or fraction thereof, during which the failure continues, not to exceed a total penalty of 50% of the total tax due for each period.
• Interest will be computed based upon a variable rate adjusted semiannually by the State of Florida..

B. There is a returned check fee of $25 for any item not exceeding $50, $30 for items exceeding $50 but not exceeding $300 and $40 or 5% of the face value (whichever is greater) for items that exceed $300 if your check, draft or money order is returned by your bank or savings and loan. This is in accordance with Florida Statute 125.0105.
C . If an owner/dealer fails to pay the tax:
• The Revenue Collector may place a tax warrant lien on the property and issue a tax execution to enforce the collection.
• The Revenue Collector may request a writ of garnishment be issued to subject any indebtedness due to the delinquent owner/dealer by a third person.
• The owner/dealer is guilty of violating a County Ordinance which is punishable by a fine in an amount not to exceed $500.00 or imprisonment in the county jail not to exceed 60 days This is in accordance with Florida Statute 125.69(1).
D. If the owner/dealer fails or refuses to charge and collect the tax from the person paying any rental or lease, the owner/dealer is in addition to being personally liable for the payment of the tax, guilty of a misdemeanor of the first degree, punishable by a term of imprisonment not to exceed one year.

This is in accordance with Florida Statute 125.0104(8)(a).
Q. What is the procedure for an audit of my rental records?
A. The Broward County Revenue Collector will send written notification at least 60 days prior to any audit. All tax records must be made available for an audit and be retained for three years. These records shall include, but not be limited to, guest checks, general ledgers, sales tax returns, Federal income tax returns, financial statements, bank statements, and leases.
Q. A Tourist Development Tax Warrant Lien was placed on my property. How do I obtain a release of lien?
A. Tourist Development Tax Warrant Liens are recorded in Broward County Public Records. Delinquent tax, penalty and interest may be owed in addition to the amount stated on the lien. Requests for a current payoff amount must be made in writing by the property owner or authorized representative and sufficient time must be allowed for the calculation of amounts due. A release of lien will be recorded within 30 days of satisfaction of payment. Contact this office for additional information.
Q. Where can I find more information on the rental of transient accommodations?
A. The Florida Administrative Code, 12A-1.061 Rentals, Leases, and Licenses to Use Transient Accommodations.
The Tourist Development Tax is frequently called such names as Resort Tax, Bed Tax, Local Option Tourist Tax, Transient Rental Tax, etc. but in all cases it is still the 5% Tourist Development Tax added to the short term rentals.
