CALLING FOR A SPECIAL MEETING…..

Dear Readers…Who can call a special meeting?…The Mayor…or two Commissioners….or the Town Manager…

It does not have to be an emergency….Case in point…the last “Special Meeting” in LBTS was called by Commissioner Clottey for DECORUM…on Jan. 26,2009!…

So this time around…with the Manager’s actions on Friday to request for Chief Gooding to be “reassigned”…any of the above could call for a “special meeting”!…

We hear that the Commissioners have been inundated with phone calls and e-mails…with anger and disbelief over the Manager’s decision…We also hear that the outrage is from not only those that oppose the Mc-Furths and their Gang…but CIC members who want the BSO to remain the LBTS Police!…OOPS!…

We also hear that this action will not go down quietly…Jarvis Hall will be full on Tuesday (June 30th) at the 7 pm Round Table meeting….and if the residents who support the Chief and the BSO are not happy with the Commission ….it will result in an even larger show of support to take place soon afterward…HMMM….The CIC/VFD July 4th Volunteer meeting takes place the following evening (Wed. July 1st) in Jarvis Hall at 7 pm!…OUCH!….

Wouldn’t it be something…if in 2009 the 4th of July parade has people yelling support for BSO Police ….de ja vue for July 4th 2007 and the  VFD!…WOW!…

Will there be fireworks…or will it be a  dud?….It’s a test for March 2010!…

Sec. 2-18.  Special meetings.
The mayor, any two members of the Town Commission or the Town Manager may call special meetings of the Town Commission upon at least six hours’ written notice to each member, the Town Manager, Town Auditor and Clerk, Town Attorney and Chief of Police, served personally or left at his usual place of residence. The regularity or validity of any proceedings taken at any special meeting at which a majority of members of the Town Commission and the Town Clerk are present shall not be questioned because of any omission or irregularity in calling such special meeting.

Here’s The Scoop…HERE’S YOUR CHANCE TO SHOW YOUR SUPPORT….FOR CHIEF GOODING..

Dear Readers…Unless something dramatic happens…Our LBTS-BSO Police Chief Gooding will be packing up his office and leaving town…following the “reassignment” request by the Town Manager yesterday……(seems she did not like the BTSFutures article pointing out the Mc-Furth/Colon gameplan)….

We hear he will be in town this next week as a replacement is found from within or outside of the LBTS department….

Please take the time to stroll over to the LBTS-BSO Police Office and bring cards and flowers to show your support for him and the department…It will speak volumes to the Administration and the Commission!…

The Manager looks out her window…and a stream of supporters will make quite an impact….as she sees the residents arriving with cards and flowers ….

Also be aware you have another chance to show your support for the BSO Police and your displeasure and outrage towards the Town Manager’s actions at the June 30, 2009 Commission Round Table meeting…at 7pm in Jarvis Hall….it will be televised…and online…

This is the meeting on the Town Manager’s contract requirement for an annual review!….

We hear the “Gang of 3” are way off on their “timeline”…way off on their remarks to the many callers and doing a “piss poor” job explaining that their hands are tied and they see no “emergency”to call a meeting for… …..They are  fully  backing the Town Manager’s powers to enact the “reassignment”…and that will be their “tact” they must back and support THEIR Town Manager!….But must we back it…or them….and the road that leads to a McIntee Police Department?…

If the answer is a resounding no….see you at the station….and at Jarvis Hall!….

Here’s The Scoop….The Town Manager …OH, YES SHE CAN….AND YES SHE DID REMOVE BSO CHIEF GOODING…

IT MAY BE ALLOWED……….BUT IT WAS DEFINITELY A DOUBLE STANDARD!….

Dear Readers…many are asking could  LBTS Town Manager Colon really have LBTS -BSO Chief Gooding “reassigned”?…The answer is yes!…This writer obtained a copy of the LBTS-BSO contract a few months back…and in it (see below) she has that power!…BUT isn’t it something that she chose to exercise such powers pertaining to Chief Gooding…and has remained mute and taken no action on the many VFD infractions and insubordination she is aware of!….In this writer’s opinion…this action was personal!…Chief Gooding spoke up in public  at the 6/23/09 Commission meeting…http://lbts.granicus.com/MediaPlayer.php?view_id=2&clip_id=238…repeating what we hear he said to the Manager in private when she “pulled the rug out” on the BSO plans for their new digs at the 2 million dollar Public Safety Complex. It is said the Manager was all for the project …every step of the way…even assuring the BSO that any monies required over the $284,000 in the confiscation fund would be taken care of….Then instead of negotiating  she gave him her “ultimatum” of a cell and a Sally port…period!…There is no way she would make this move without the “blessing” of the Vice Mayor and his BFF…to think otherwise is unimaginable with the 2010 election looming!….We hear that it was planned with the full knowledge that the Mayor and Comm. Dodd would not be in town….Calls tonight to the “Gang of 3” (we hear) are bringing …from Comm. Clottey feigned ignorance until after the action …with flashes of anger …Comm. Silverstone (we hear) has shut off his phones…and the Vice Mayor (we hear) is saying he “didn’t vote for the action”…knowing full well no vote was required!…NONE HAVE CALLED FOR AN EMERGENCY MEETING!…That speak volumes!…

Remember Readers, this is the Manager who has balked at her contract requirement for an annual review…which she is already in breach of  having not had one in 2008 and now that we are in the 2009 budget season, when will it be done this year? … (Will the “Gang of 3” try and quash it at the June 30,2009 Round Table meeting?)…..as it states on page 6-15.0 “The Commission shall review and evaluate the performance or the Employee at least annually IN ADVANCE of the adoption of the annual operating budget.”..

Can you all imagine …a McIntee Police Department?…Just think about it…something is done to your property in the wee hours…and who are you going to make an incident report to…the person(s) that may have been the vandals?….Scary stuff….real scary stuff!….

DISTRICT COMMANDER /CHIEF

15.3 In the event the Town Manager becomes dissatisfied with the performance of the District Commander/ Chief, the Town Manager shall provide notification to BSO. Thereafter, representatives of  BSO and the Town Manager shall meet and discuss possible remedies of the problems experienced by the Town Manager. BSO agrees to act in good faith in resolving any problems experienced by the Town Manger. The Town Manager MAY REMOVE the District Commander/ Chief AT ANY TIME WITHOUT CAUSE.

ARTICLE V.  TOWN OFFICERS AND EMPLOYEES

Sec. 5.5.  Town Manager–Powers and duties.

The Town Manager shall be responsible to the Town Commission for the proper administration of all affairs of the Town coming under the Town Manager’s jurisdiction, and the Town Manager’s powers are and they shall be:
(1)   To see that the laws and ordinances of the Town are enforced.
(2)   To appoint or remove all subordinate officers and employees.
(3)   To exercise, control and direct supervision over all departments and divisions of the municipal government under the classified service, except where otherwise provided.
(4)   To see that all terms and conditions imposed in favor of the Town or its inhabitants in any public utility franchise are faithfully kept and performed; and upon knowledge of any violation thereof, to call the same to the attention of the Town Attorney, whose duty it is hereby made to take such legal steps as may be necessary to enforce the same.
(5)   To attend all meetings of the Town Commission, with right to take part in the discussions, but without having a vote.
(6)   To recommend to the Town Commission for adoption such measures as the Town Manager may deem necessary or expedient in the interest of the Town.
(7)   To keep the Town Commission fully advised as to the financial conditions and needs of the Town and at the proper time to submit to the Town Commission for its consideration an annual budget.
(8)   To advise and consult with all officers and official heads of the several departments of the Town relative to the affairs of such department, and to make recommendations to the Town Commission respecting such departments as the Town Manager may see fit.
(9)   To perform such other duties as may be prescribed under this Charter, or may be required of the Town Manager by motion, direction, ordinance or resolution of the Town Commission.
(10)   To prepare and submit to the Town Commission an annual financial audit of its accounts and records, completed no later than six (6) months after the end of its fiscal year by an independent certified public accountant retained by the Town Commission and paid from its public funds.
(11)   To sign all checks, warrants, bonds and agreements issued by the Town of Lauderdale-By-The-Sea.
(12)   To assist the Town Commission to develop long-term goals for the Town and strategies to implement these goals.
(13)   To encourage and provide staff support for regional and intergovernmental cooperation.
(14)   To promote partnerships among the Town Commission, staff, and citizens in developing public policy and building a sense of community.

HE’S BEEN ‘REASSIGNED”!!!!!!

This Writer has confirmed that LBTS Town Manager Esther Colon gave Chief Gooding the “BOOT”…asking for him to be “reassigned”…and so it begins!…

Any doubt of the “Gang of 3s”…intentions to remove the BSO Police and install the McIntee Police Department are now gone!.

The Mayor and Commissioner Dodd are out of town…and you can bet that none of these 3 McIntee…Silverstone and Clottey will call for an emergency meeting!…

HELL NO!  We hear  (hearsay) these 3 were “INSTRUMENTAL” in aiding Town Manager Colon in her actions…HELL WITH SUNSHINE?….

Residents of LBTS  must not allow such actions that jeopardize our safety for PAYBACK from the Town Manager and the the “Gang of 3″…for Chief Gooding standing up for his department!…

We are now in a Totalitarian Town….and no one is safe from the actions of these four!…

Town Manager Esther Colon….must be fired!…

Vice Mayor Jerry McIntee must step down!

Commissioner Jim Silverstone must step down!

Commission Birute Clottey must step down!…

They have acted in a manner that is NOT THE WILL OF THE PEOPLE!…

BLUE CONTAINERS….LOVE EM’ OR HATE EM’…..

What do Blue Garbage “Toters” and Michael Jackson have in common?…They’re a great political diversion!…

The topic du jour in LBTS is the blue cans…There are two stories in the background…those who think black was requested…and those who do not think that’s the case…In any event…the Manager at the 6/23/09 commission meeting informed Comm. Clottey (she of the “many” phone calls)…that it was up to Choice to decide…and she [Manager Colon] further added it was what Choice had in their warehouse…Two interesting points…First Comm. Clottey at this same commission meeting pointed out the negotiations made by the Manager with Choice giving the Manager two thumbs for those negotiations..(sans the color of the cans?) and second we hear the containers were not in the warehouse, but chosen because of the blue ocean…by the company…

Talking about the blue cans takes the focus off of the real problems in town…such as a possible conflict of the beach patrol/medical calls being done by the VFD paid for by the fire assessment fees…ala the illegality that brought forth the recall of the Former Mayor…just as Comm. Dodd brought forward at the first budget meeting on the 9th..(more to come on this )….

It takes the focus off the hypocrisy of the Vice Mayor in his Commissioner comments speaking of  July 4th not being “political” …. something he and his “Mc-Gang” say should be a town event of unity…HMMM….They know as this writer knows and those who were around know…that 2 years ago the very same then-Commissioner and co-horts called for a “boycott” of the Town event…We planned and  had a VFD cookout at the Community Church and stayed away from the tent in the front of Town Hall!…They know as this writer and those who were there know …that we marched in the parade yelling for the VFD to return….totally political!…They know as this writer and others are fully aware…that after purposefully  “decimating” every town board and committee at the beginning of this new majority on the dais…to be followed by every town event being run by the divisive and polarizing “Official” Town Event Coordinators Furth….inclusion was not even in their vocabulary!…They know that Marc Furth was the sole voice in this July 4th event…( a desire he made known last year) …and they know the  people who benefit the most from his decisions  are the Furths and their motel….They know that the “endless” hours for Marc Furth in front the computer (per the VM in his comm. comments) are due to the inability for both of the Furths to stop….resulting in endless hours are minutia …whether it is the “perfect shade of red”…or an extra 12 inches…The brazen attempts to take credit for “buying” the electric board…made by Cristie Furth in her public comments…are part and parcel to the way the “Gang” operates…taking credit at every turn at the microphone on and off the dais and in print….For she knows full well…it was Comm. Dodd who brought to their attention what foolishness it was for the Town to rent the board year after year…The same Comm. Dodd who found the bill from the longtime town electrician was way out of line…Thus the “micro-manager” Comm. Dodd took it upon himself to go to the Manager and say it was time to look elsewhere..Thus brought forward the RFPs for Town vendors…( and the grief he endured for insisting on  RFPs from the “gang” and Administration)….providing the town with a new electrical contractor that costs a third of the contractor that surely would have been retained yet again!…All done with an accent that most in this town without their own agendas…have learned to appreciate and admire!…(see previous post…Mrs. Furth’s “problem” with candidate Dodd’s accent)….

Talking blue garbage cans takes the attention off bad acts being done throughout the town…whether through vandalism done in the wee hours…..or through code citations given out after someone has spoken at the podium that might scare ( as an opposing candidate) or oppose the status quo…….

It takes the light off new unnecessary purchases such as a new car via the Town Manager’s help for the “2-Hats” Vice Mayor/Dep. Chief…and no oversight on the VFD…after they admit they are not abiding by their agreement with the town and their own bylaws…

It diverts attention from the Town Manager picking and choosing which Commissioners and residents she will deal with…(Yep, she does this!)…installing shutters on  Town Hall without a consent agenda vote….no RFP or questions raised about the $200,000  3 year audit services she procured without a proper approval from the commission …..( Yep …no review required says the “Gang of 3″…and the CIC…in a pre- July 4th “parade”!)…moving funds around …(Yep…from proprietary funds to the  general fund…and then who really knows)….and not having to answer questions on if the debt is under a pre-penalty clause for paying it off early…..(Yep, it  sure looks that way)….A supposed Mc-“plan” to rid the town of the BSO Police  …(reconfirmed by a Capt. in the VFD to a BSO Deputy per his Dep. Chief?)……such as giving them the “heave-ho” on their new Public Safety Complex offices…while at the same time she was all for hiring a tennis pro (Yep, we have a salaried tennis pro!)….for tennis lessons with the $60,000 …(increased from $25,000) 2008-09 recreational budget..per the VM’s desire last budget season…(the swimming program is still in limbo)….We hear there are plans to build a 2-bay firehouse on the property where the development trailer is…(Yep, it’s another McIntee toy)…….And look for the surface parking lots on El Mar Drive per Marc Furth’s desire..(MPSC prev. post)…..Readers will recall BFF Comm. Silverstone introduced the March referendum item for voters to make the decision to sell a town property (Public Safety Complex) over a certain dollar amountt…BUT will not add to the referendum the purchase of a Town property with a vote of the people……With the monies and majority on the dais to make it happen it’s only a matter of a 3-2 vote….ARGHHH….

Ahhh…those blue “toters”…..Talking  blue “toters”….certainly let’s the Mc-Furth Gang garbage pile up! … Talk about Furth recycling!…..YIKES!…

DIRECT FROM SUNRISE “EPIPHANIES” ON THE L-B-T-S BEACH….

Dear Readers….Today this writer heard from a new faithful reader who said she was going to pass on this site to many who live in the town and want to make a big change in March 2010!…

Among the “many” she speaks of just may be a few who want to put their hat into the ring….To run for  a seat on the next L-B-T-S Commission …So it seems to be the perfect time to post the “game plan” that is in process for the return of the “BROOM BOYS”…(Broom Boys 2)….

It is obvious to this writer that Campaign Manager/BFF/Editor of the Mc-Furth Times Cristie Furth must have given her “sweeping orders”  to the “2-HATS” already…

Do not be fooled by 1 Broom Boy feigning indecision from the dais……the “BROOM BOYS”  will run again……for who else can the CIC find to run?….

So make sure to read the plan…print it out…e-mail it to your friends and neighbors….and refer to it as we head towards the election …

Morning!  I already spoke to Stu this morning about beginning to compile campaign notebooks,

which should include meeting notes.  This way each meeting can easily build upon the last one and help keep us on track.  Check out the last category on “leadership tone”.  Does that work for you guys?

Notes from Campaign Strategy Meeting, August 16, 2007

General Information:

*  Ride on our successes, what we’re good at.

*  Running a slate…weaknesses drag you down and strength may not be enough to overcome.

*  “Complete the Sweep”  if we have 3 candidates to endorse

*  Let’s be realistic, we need one seat

*  “Time for a change”

Issues:

*  Is the VFD an issue we can win on?  Do we have 60% of the citizens on our side?

*  Term limits – help enforce what you voted for

*  Lower fire assessments/ storm water assessment for condos

*  Political corruption

*  Overlay district

*  Accountability

Slogans:

*  The last time we started to clean up the city, this time we’re going to get the job done!

*  Referring to the “Oliver Gang”…There they go again!

*  Term limits…you voted for it…help us enforce what you want on January 29th.

*  Let the sun shine in!  The Sunshine candidates! (this changes the tone)

*  Bring credibility to being the mayor.

*  Parker = elitist.  Don’t let him buy another race.  Backroom deals, Boss Hog

*  New Guard/New Dawn

*  Small town values not backroom deals

*  Change or maintain the status quo

*  After 14 years, the only thing crazier than keeping Oliver Parker is expecting him to change.

*  The only real bully is Oliver Parker and we’re finally standing up for you!

*  Yanni and Clark are Parker’s lockstep puppies

*  You voted for term limits, the Old Guard balked…you can fix it.

*  Parker has been pulling the strings for 14 years!

Candidates:

*  Birute…Pick 3 personal issues she can bring credibility on e.g. accountability, corruption.

Can run on fire assessment/she has credibility as an accountant.  Write one policy article on why

Why she’s running.

*  Stuart’s accent works against him…more mail…less public presentations

*  Candidates don’t say vote for or against.  Write articles in 600 words or less.  Focus on why we need

Change and new direction.

*  Example of candidate canvassing:  Hi, I’m Stuart and I’m standing for the Commission seat.  Do

You watch Commission meetings?  Yes.  Do you like how they are run?  I’m for change. If answer

Is no…Do you know what happened with term limits, overlay districts?

*  These are my observations, this is what needs to change

Campaign Strategy:

*  Rule #1…Never mention your opponents

*  Small towns are won at the door

*  The best way to get the VFD back is to win the election

*  Change the pitch to height restrictions, managed development, term limits

*  Spend 2/3 of our efforts in Old town 1/3 in New Town

*  Fundraising begins yesterday.  Call contributors and ask them to give same amount again.

*  Resurrect the CIC Report Card

*  Turn all the energy away from BSO and into Parker, Yanni, and Clark

*  If the other side is fighting over two candidates, it is best not to be divisive.  Let others fight

Among themselves.

*  CIC t-shirts with just a symbol, no words…stop sitting in front row.

*  Pull good voter #’s

*  CIC can spend unlimited amount on issues but not candidates.  CIC needs $15,000.

*  Mailing should be saved for high rises.  Don’t mail to anyone who doesn’t vote.

CIC / Volunteer Campaign Strategy

*  CIC endorsement = These are candidates that share our values rather than running a CIC slate.

Endorse our values as a community group, height restriction, term limits, VFD.  CIC issues not

Candidate issues.

*  CIC events, invite the whole community.  Hold at least 3 major event that bring people together..

Cookout… CIC/Fireman’s ball…New Years day ceremony?  Minimum tickets $10. Put up your

Hand who can give us $500 for the cause?  Silent auctions?  CIC holds events that support the issues

Have weekly coffee events.

*   Get CIC volunteers to deliver mail and flyers. Not as members of the organization but on candidates

Behalf.

Hello, my name is ______, I’m your neighbor and I like _____for Commissioner.  Give

Them a picture and a tagline of 3 issues and an invitation to an event.  “I’m voting for them, I hope

You will vote for them too.

These candidates are conscientious people with ideas I support.

Do you plan on voting?  If they like Yanni, etc…thank them for their time, leave literature and walk

Away.

No more than 50 seconds at the door if you’re a volunteer.

Two main intentions of canvassing.  To Leave information and to gain information e.g.  Did you

Vote for Yanni?  Yes…do you like his track record on BSO?  Yes…Term limits? No…I support

________.  Is this a persuadable voter?  Worth a call from a candidate?

*    Mailing to all who signed recall.  We need your support!

*   Need 9 weeks out from election for canvassing.  50 people knock 20 doors per week to support

Candidates.  Knock each door 3 times, handing out literature.  Knocking 2 times is good, knocking

Just one…loses.

Tone from Leadership

*  The “clean sweep” will be a viable strategy if our leaders are in touch with the needs of the group.

They need to be a part of what LBTS will be like when the New Guard is in leadership.

*  Leadership needs to shift from attacking BSO from the dais to “what LBTS will be like with the

VFD back.

*  Need to turn the tables more on Oliver and the Old Guard rather than BSO.  Mayor, you should hold

BSO accountable so I can stop asking the questions.

* Try to stay away from fire for 6 months.  Staying quiet, being less controversial, staying away

from minutia and being considered approachable and good leaders is what best support our

Candidates…which will get the VFD back in 6 months.

BC- The last “strategy” was aimed at then-Commissioner McIntee….He would not listen then…but now…judge for yourselves!…

BC- The questions being asked …Is proper procedure being followed…How many trucks do you send to a call coming from a known false alarm location?…If a call is cancelled…do you disregard…cancel….or send only one truck?….Who is in charge?…..Is the VFD looking at the alarm panel before proceeding to top floors?…Who decides which call requires hooking up to the standpipe?… In the VFD reports alarm panel/standpipe hookup are not written up in all reports…therefore it is not done as a standard practice or not being written up which would be necessary in an investigation or suit….Also when a  VFD report shows responding personnel a further check needs to be made of how many are under “Apparatus – STA12…for personnel responding to fire station but not going on scene…..

Also…According to the incident reports under each apparatus/position of personnel they state the following… “Amount 1: $0.oo/ Amount 2 $0.00″…according to their 3 month income and expense report (posted soon)…from Jan 1, 2009 -March 31,2009,  the Fire Call Incentive for personnel was $34,860.00…HMMM…

Incident #10…( June 17,2009) …DP12 (MCINTEE) “delayed ” at the bridge…in the CAD report…brings to mind another incident that the Dep. Chief/VM himself recently conveyed on the dais at a commission meeting…(prev. post )…He was responding to questions on his using the command vehicle out of town… He replied that the day being questioned he was not only going to a meeting…picking up foam to replace the supply of foam used for the “bee call”…but he said he was directing a beach patrol call from his vehicle while traveling off the island…YIKES!…

And finally, how will Royal Coast Condominium be charged for these calls…especially the ones that were a fire testing ( May4,2009)/ and cancelled ( May 11,2009)?…Perhaps all recipients of false alarm call bills need to request VFD incident reports to verify they really owe the fine?…

Here’s The Scoop…Monitoring The Monitors…

Dear Readers….you might recall the recent post of the Monday June 22,2009 July 4th Committee….open to the public…but purposefully posted discreetly and within the 24 hr. notice period to keep the public at bay  (not “volunteers”…the public )…Coordinator Marc Furth spoke of the contract he gave to the town for 2 people from the County to monitor the beach from 9-10 pm….This writer had inquires of the cost and who it was from the County…It was brought up again by the Vice Mayor at the 6/23/09 commission meeting…and so I sent in a request to PIO Steve d’Oliveira who is now (prev. posts) in charge of all public requests made to the Town…Below is his response….

“The Town is hiring two marine biologists with the Nova Southeastern University Oceanographic Center on July 4th to monitor the breakdown of the fireworks platform from 9 to 11 PM to ensure no nesting sea turtles are harmed. There is no contract. The cost for this is $216.20, according to the Town’s June 22 invoice to Nova.

Earlier in the day on July 4, as part of its daily inspection during sea turtle season of all the beaches in Broward, marine biologists with Nova are going to be checking to see if any nests are built in the Town. The Town can’t even begin to put up the fireworks platform at El Prado until we get an OK from the sea turtle biologists that the area is clear. This is not costing the Town anything, because it’s part of Nova’s duties to inspect the beach anyway for sea turtle nests. Nova has an annual contract with the county to operate the Broward County Sea Turtle Conservation Program.

If there are any nests in the El Prado area, the Town will need to shift the location of the fireworks platform so that the nests are not harmed in any way by the plywood platform or the temporary poles or fencing that will surround it.”

BC-The response from the Town is quite different than the statements made to the committee by Coordinator Marc Furth…which is quite interesting …especially after the glowing commentary presented by the Vice Mayor in his Commissioner comments….extolling Coordinator Furth for his  presentations…and for “crossing his t’s and dotting his i’s”…OOPS!…

Although I was quite baffled by the change of whom to contact for public records (It went from Town Clerk White to Senior Office Specialist Nikki Smith to PIO d’Olivera)…this was a great change made by the Town Manager…KUDOS!…

“I come before you in a different light. Those of you who know me, know that I am a calm individual who usually speaks about civic issues and not the politics of our community. Some may be upset over my comments, however it is my right to express my opinions. Like them or not.
I am here because I care deeply about our town. I am a lifelong resident of Bel-Air, 34 years.  I didn’t just become involved after annexation; I grew up and spent my childhood here.
What I see now Is constant bickering and lack of respect for fellow citizens. It is has reached a point where, even I, have become disgusted. I am here to say ENOUGH!
I was recently approached and told that certain individuals were upset that my mother and I volunteered for the Fourth. We decided out of civicness and not politics. My mother’s Grandchildren (my nephews and niece) come to the town to participate in the many events we have. Since we enjoy these events we feel we should also give back. Let me remind you, this is first and foremost a town event.
I do have to express personal dissatisfaction with the lack of public notice and citizen input ….even I was never told of volunteer meetings, now 3. A simple email or call, with the proper notice would have sufficed.
The source of the problem stems with how the  committee was formed. Instead of having a board appointed from various civic groups..and citizens, it was formed of commissioners and members of a single political organization. When this occurred the event became polarized. This makes some feel it was done on purpose to exclude this groups perceived opponents.  Watching this, the town administration, (who should be impartial to all) should have taken over or exerted much more authority.
I will refuse to succumb to any political pressure to stop me from doing my civic duty. I am not disillusioned to the fact we have issues, and that the rivers of discord run deep. I understand and sympathize with the feelings and the plight of our great local businesses. I am a proud and a very supportive member of the chamber. The fact is the business community feels threatened. If members of the dais truly feel this notion is wrong…why don’t you seek dialogue instead of continually making arbitrary decisions which are negatively perceived? In these times the town should be giving incentives rather than restrictions. If you truly support the businesses and care…prove it!
I am for a united, Strong , and a happy LBTS. I know in the near future this will occur. There are citizens out there who are sick and tired of what is going on. I encourage all to stop sitting on the sidelines, observing, hoping for change…Get involved, come to these meetings..express your opinions.. May the town be the “middle”, the unifying force. Only then will change become a reality. And only then will all the citizens feel welcome in their own town.

BC- Mr. Malkoon’s words were very specific…he explained his personal beliefs and his reasons for volunteering…but he also made it clear he had issues with the way the July 4th event has been handled from the joint sponsorship to the posting and the lack of notification for the public meetings thus far… He went on to describe the sentiments of the many with the discord seen stemming from the restrictions imposed rather than the incentives offered to local businesses…and imploring those who feel as he does not to sit on the sidelines but to be involved in the change…Unfortunately, he was the recipient of some major flawed interpretations of his public comments coming from the “2-Hats” during Commissioner Comments…As one well-known official in town told this writer recently…”He’s [McIntee] the best at sitting on the dais and saying somebody said something when that person is either not there or cannot answer back”……

BC- The Mayor asked about vacant homes…(previous post…after article in news per PIO Steve d’Oliveira)…Assist. TM Olinzock said we have maybe 5 homes that required code enforcement to send citations…but we’re in “great shape”…and the Vice Mayor asked Olinzock to provide them with a report of the number of vacant properties and violations…after reconfirming the town requires these properties to be seeded or sodded…Report passes 4-0

OF NOTE…a resident came in late…raised his hand and asked to speak..the Mayor recognized him and asked the commission if they wanted to allow him the time…Comm. Silverstone felt that due to the bad weather they should comply…there was  agreement from the dais and the Mayor asked him to come forward…He lives on pine Ave. and was upset that Waste Management had taken their trash containers but the Choice containers were not delivered as of this evening…He said he called Town Hall and said that he felt the new company was off to a bad start…

c.    Municipal Services Monthly Report – May 2009 (Assistant Town Manager Olinzock)

BC- Assist. TM Olinzock came to the podium to explain they were delayed due to the weather but would be received before the next scheduled trash pickup from Waste Management who would use the Choice containers until the official changeover on July 1st…He added after questioned by the Mayor that the switchover was included in the Town Topics and on Channel 78…Commissioner Clottey acknowledged the new containers being delivered elsewhere in town…adding that she “received phone calls” from people unhappy the containers were blue and not black…HUH?….The audience around this writer all shook their heads and said what’s wrong with blue?…Comm. Clottey said she wanted black…and the TM said the choice of color was up to Choice …who had blue already…but she [TM] would talk to them….No other commissioners spoke of phone calls…Keep the blue!…Report passes 4-0

d.    BSO Police Monthly Report – May 2009 (Chief Gooding)

BC- The Vice Mayor asked Chief Gooding about the red light citations study…Chief Gooding said it was in the backup, but the VM wanted it to be addressed for the public…The results off season were approx. 28 for A1A and Commervial Blvd….and only 4 for Seagrape Drive and Comm. Blvd….( So low a count for Seagrape that the Chief did a count himself to verify it, and found it to be accurate)…He added it should be done again when the police are not seen by the drivers and also done in season…If the Town wants to pursue the red light cameras…the companies will also do a study…right now the Chief was not too excited to go forward, but it was up to the commission.Report passes 4-0

BC- The Town Atty. read the Ord….no public comment…a motion was made to accept…but the Town Atty. wanted to acknowledge a few changes after hearing from AT&T…having to do with deleted text..and changing approval by the Town Mgr. prior to an emergency…to say TM will be notified with notice within 24 hrs after …The TM wanted it to be Town Manager or designee…It was passed with the changes …4-0

13.    RESOLUTION – “Public Comments”

a.    Resolution 2009-10: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LAUDERDALE-BY-THE-SEA, FLORIDA ESTABLISHING FEES FOR VACATION RENTALS

BC- This was a real hoot!…The Resolution was read by the Town Atty….Readers will recall that Comm. Dodd was instrumental in taking fees out of Ordinances so they could be changed without going through the involved ordinance change process to change the fees…No public comments…Comm. Clottey asked about it and specifically that it was the establishment of fees only…having no bearing on the vacation rental terms…The Mayor said it needed to be in place to do the 2nd reading of the Ordinance…the Vice Mayor really got it all wrong…when he said he could not support this because that would mean he supports the week rentals…and he does not…(Poor Edmund Malkoon…the VM used him as an example of not supporting the 7 days)…Comm. Silverstone was right…when he spoke of changing his mind after listening to the Town Atty. and her legal opinion of leaving the town open for lawsuits…adding he informed the Town manager that he  [Silverstone] wanted to know if the BSO ran into problem…which would lead to the Ord being amended…Comm. Clottey asked the Town Atty. to respond to the VM…The Town Atty. said we already have rentals on the books and if there was no resolution on the fees we would have a fee of 0….the VM said “If we don’t support this then the Ordinance is wallpaper.”…..A vote was taken Clottey/McIntee voted no…Silverstone/Mayor…voted yes…fails with a “draw”…The Town Manager chimed in to ask the Town Atty.  with the failure of the resolution could they follow their process without those fees…more discussion of now having no fees for rentals…Comm. Clottey woke up and wanted to change her vote..The Town Atty. said she could not…she was not on the prevailing side…The VM asked how there could be a prevailing side with a draw?…The TA said with Robert’s Rules she the affirmative side could move for reconsideration…Comm. Sillverstone made that motion…Comm. Clottey 2nd it…passed 3-1 (McIntee dissented)…the a vote was taken and this time the resolution passed 3-1 (McIntee dissenting)…

a.    Commission approval of amendment to existing agreement with Enforcement Technology, Inc. for Processing Parking Citations – $2,100.00 (Assistant Town Manager Olinzock) This item was deferred at the April 29, 2009 Commission meeting by Commissioner Dodd (Staff requesting deferment to the July 14, 2009 Commission meeting)

BC- This item was deferred at the start of the meeting until July 14,2009

b.    Commission direction on design of El Mar Drive improvements (Assistant Town Manager Olinzock)

BC- will post later…deferred to a combination workshop with MPSC…date to be decided July 14,2009…

c.    Discussion and/or action for improvements to public safety bldg. – 1st floor – Police Dept. – Approval of $10,000. O’Campo & Associates for professional services pertaining to the police facility improvement project (Manager Colon)

BC- will post later…after much discussion passes 4-0 for $10,000 for plans for the bare minimum…sad to say….There is a long way to go on this one… ……to make it right and fair…

16.    NEW BUSINESS

a.    Commission approval of a reduction Right-Of-Way Permit Performance Bond for the Villas by the Sea development, as requested by Minto Communities LLC (Assistant Town Manager Olinzock)

BC- will post later…but the VM looked like he was a combination of pro-development for Minto…and bending over backwards for the company that the night before his BFF Marc Furth said was giving the July 4th committee a “sizable donation”…as he played “dealer” offering dollar amts…of half of the orig. $800,000 bond amt..and then $ 100,000 bond and offering them to keep the white smaller sidewalks until they came back to develop their last 2 properties…(in 2+ years or longer)…No matter that the Rep. for Minto repeatedly said if they kept the $800,000 that Minto would go ahead and install the remaining pink sidewalks and replace them whenever they do develop because it will still be cheaper ARGHHH…deferred until July 14,2009 when the VM said the Rep. needed to come back with a date certain for completion of the sidewalks for the Town Manager…

b.    Commission approval of an application request for a ninety (90) day extension to complete the construction of a single-family residence located at 4 Sunset Lane.  Backup is included (Assistant Town Manager Olinzock)

BC- Comm. Silverstone asked Assist. TM Olinzock if he was for this extension…Olinzock said it was for the commission to decide…There was no 2nd…the Mayor handed the gavel to the VM (again inept with the gavel)…the vote was taken and it passed 4-0…Why no 2nd?…YIKES!…

c.    Commission approval of an application request for a ninety (90) day extension to complete the construction of two Town Homes located at 4432-4438 Bougainvilla Drive.  Backup is included (Assistant Town Manager Olinzock)

BC- same as the above…A rep came forward…the Vice Mayor asked a question about where they were in the process…(it is right by the VFD)…and then added he knew the building (so why the question?) and said the VFD had done drills there…passes 4-0…

d.    Florida League of Cities – designation of official to be voting delegate (Town Manager Colon)

BC- this was a combo with item 16 F…explained by the Town manger…the Mayor offered to be the Rep….Comm Clottey (while sporting a new “bobbed”  hairdo,still sported the same old a tone deaf response) nominated Comm. Silverstone! OUCH!…He was “Pacifically” for it…and of course his BFF VM was the 2nd…all 5 commissioners are covered with Town funds to attend…passes 4-0

e.    Discussion and/or action to change the September 8th Commission Meeting to another day (Mayor Minnet)

BC- This one went back and forth…with Comm. Clottey wanting to change a budget meeting …but was again informed by the Mayor you cannot change a budget meeting…and with Comm. Dodd not there…it deferred for a decision…if any to July 14.2009…passes 4-0

f.    Discussion and/or action to send representatives to the Florida League of Cities 83rd Annual Conference August 13-15, 2009, Orlando, Florida (Mayor Minnet)

Bc- see above item…d….

g.    Reconsideration of FWC application for parking permits at the beach (Commissioner Dodd)

Bc- This was deferred to July 14,2009 at the beginning of the meeting…..It was stated in the request from Comm. Dodd when submitted to the Town Clerk…

h.    Selection of a Pioneer for the 37th Annual Broward County Pioneer Day recognition ceremony (Mayor Minnet)

Bc- a new idea from the Mayor…and “if possible” they were looking for someone around in the 1940’s…The Mayor made 4 suggestions…the VM said “they want old people”….”senior, senoir citizens”…Comm. Silverstone said one of the Mayor’s choices fit the bill…and Comm. Clottey ( again off the wall) said this “opened up a can of worms”…would “hurt some people’s feelings”…HUH?…it was deferred until July 14,2009…passes 4-0

i.    Discussion and/or action 1 stop sign north and south bound El Mar Drive at park (Vice Mayor McIntee)

BC- The VM brought up the 4 stop signs now replaces with stop only if pedestrian walking signs…(prev. post)…discussion on going to 2…the Town Manager said Broward County makes the decision…will be coming the next day…for the 3rd time…she will inform them of the commission’s direction…and it will be up to them…Funny was the VM speaking of people “flying down El Mar”…and the audience said that would be him!…OOPS!…

j.    Discussion and/or action on newspaper boxes in Town (Vice Mayor McIntee)

BC- Turns out not to be for the Mc-Furth Times…(unless it was a “gotcha” or a “U-turn” move) as the VM called Assist. Olinzock up to complain about the newsstands needing some spiffing up…(WHERE?)….This writer spoke to address the extra newsstands around town…(in front of the Blue Seas and in front of Ham N’ Eggs) previously brought up but never dealt with…unfortunately the VM cut me off saying it was off topic…I replied “newsstands are newsstands”…no reply…

k.    Discussion and/or action to postpone the installation date for those residents affected by the required hookup to the new sewer lines.  Set a new hookup date (Commissioner Silverstone)

BC- Comm. Silverstone spoke of the date for allowable time to hook up being maxed out…adding that when a resident contacts a commissioner it is their job to get a resolution…(prev. post on why him?)…

17.    TOWN ATTORNEY REPORT

Bc- The Town Atty. spoke on the Town of Westin and challenge  legislation…per Comm. Clottey…The TA said she provided the info to the commission a week prior…but it was not included in the backup…why not?…Vice Mayor McIntee said “we don’t have a dog in this fight”…and did not want to use the taxpayer’s money for it…Comm. Clottey said it was for discussion only…The Town Atty. also said (ominously) she would be bringing proposals in … “things they[her firm] learned over time”…to “write into the codes”…”little tricks that prevent you [Town] against challenges”…HMMM….

BC- The meeting was over at 9:30…with no break taken…Many in the hall felt it would be fodder for those who feel Comm. Dodd “badgers” the Manager and asks too much from staff and has too many questions at the monthly  reports…But the same group in discussing this. likely scenario commented on how  shocking it was to see how unprepared the dais was this evening with the backup material..sans Comm. Dodd!…
