Here’s The Scoop…Scene And Heard Around Town…Places To Go…

December 28, 2008 by Barbara

WALKIES…Saturday…

Trainer Jay Holstad is now open in his new location…34th street in the Galt…new place…new equipment added… tall ceilings…great accoustics!…

He can be reached at the same number…954-784-4877….for personal …individualized training…

This writer missed the program…and took a long walk to get there…instead of across the road…but it was worth it!…

Along the way…some observations….the morning breakfast now offered at 101 Ocean…is in full swing…and Country Eggs and Ham…had a line waiting …patiently…cars were slowing down with out of state license plates…looking up at Oriana…pointing fingers…nodding heads…and observing the new sign up…”sales office on the 2nd floor”…HMMMM…

The Sea Lord is putting on the finishing touches of its overhaul renovations…it’s a beauty…well done…and a great addition to El Mar’s beautification……

What’s with the  “flossies”…(flossies are those plastic individual floss holders to floss your teeth)….suddenly like a trail of breadcrumbs…they seem to appear everywhere…on the sidewalks around town….Do people run around with them…or what?…Really weird….but better than cigarette butts…

Lots of people still scoping out the Pier restaurant…needing directions…it’s the other way now…new name…Diner By The Sea…although a new pier restaurant is in the works…we hear…

No wonder the Athena Boys want fair play for exiting their parking lot…

We had dinner last night at Aruba …and observed…while walking up El Mar Drive…the cars from Aruba valets…came out and went in the side alley…the just as usual…all the valeted patrons…stood in the middle of the parking lot…waiting for their cars…which like clockwork came from the alley…to face towards Commercial and a quick patron getaway…

With a new enclosed garbage area…there is no way..for a car to turn around within these parking confines…

Over the other way…the guys were right again…the night was not all that busy…but they were definitely blocked off more often than not…for entry and exit from their lot….

So with a restaurant coming…something needs to be done…

In this writer’s opinion…keep the alley open for Aruba…the alternative traffic back-up will be the bane  of everyone’s existence…carrying over to public safety…and enforcement…and give the guys the same right to exit through the alley ….New Year and all?….

The lights were on and people were stocking the shelves in Wings…but for all hose pressing their faces to the new front door glass…lots of shrugs…it is just the same as their Galt store..previously posted…and is definitely more of the same as in the oldie but goody…established stores around Pelican Square…

What a missed opportunity….for the Wings Company…for the town and for the tourists…hoping and missing Mack Groves….perhaps they think they are “Walmart” ready to put the little guys out of business…don’t think so…..

What’s with the cone covering a standing pipe on Seagrape Drive…by Corsair?…And that $56 thousand dollar extension on the north end…it needs some revisiting…looks like a small piece of street…that needs asphalt…no drainage…and the extending piece north…sure looks like a private driveway on private property….with Palm Club asking for 2000 pieces of Public Record to bring legal action against the Town……this project allowed on what seems private  property…should make for another request…and maybe give another precedent…ala Sunset Drive…for previous  taxpayer funds used for private property…OOPS!…

No fan of the Manager…but this time listen to her…try having the owners move the flow of their downspouts away from the street…and fix the public road only…for a fraction of the road expense and so it won’t come back to bite us in the litigation to come….

Missing?…we need another doggy station or 2 at the far north end of El Mar…the 1st one is too far up the road…and more are coming north with their dogs since Minto’s medians are not dog friendly…..

more to come….

Here’s The Scoop…The Manager Not Using This Site…To Hire…Was Only The Beginning…

December 27, 2008 by Barbara

LBTS STOPPED USING THIS SITE…FOR HIRING HEADS OF DEPARTMENTS….and so it began….

A look at this site shows that  at the same time we were looking for a new Town Attorney…Hollywood used this Florida League of Cities site and was bountiful in replies…while we had 2…

We did not repeat the Town Attorney RFP …( requested by new Commissioners Clottey/Dodd)….

It was the 1st “Executive” decision…allowed in this “Cop-like lock-step”..status quo…..letting the Town Manager call the shots…

In 2008…not once was this appropriate site used for putting the word out for the head of any department…thus we ended up with elevating  employees within the department…hearing there was no response to ads…

Where were the ads placed?…Not here!….

A look at the site shows all municipalities around us use this venue…so it is a given …this is where those qualified for these  top jobs would routinely look…

We did use it in 2007 and in 2006….

Some serious questions need to be asked with some serious response from the Town Manager….

It started with the Town Attorney being handpicked by Ms. Colon……the hiring practices being suspect… purchases being done solely on her say-so…..and here we are today with outbursts on the dais…(Nov-Dec. Commission meetings )…..”sections” of code citations…(we now hear …the administration will pin the change for the north end…on the recently approved Unified Land Development…which sadly most on the dais did not even read…relying on and leaving it all up to “Esther”…)….and now the latest…the pavilion’s major changes…done without consulting and informing the Commission or the residents of the 10/19/09  Broward County grant extension date…or the sole decision that led to……no walls…no plumbing…etc….( a far cry from banners…flagpoles…entry signs….even Public Safety Complex interiors/exteriors)

If this had all happened under the previous majority…with the previous Town Manager….the BTSTimes would be sending out  “Newsflashes”…and the “2 Hats” would be calling for a special meeting…with the CIC calling to pack Jarvis Hall!…

Different majority…different Town Manager…different response…you bet!……..

Here’s The Scoop…South Florida’s Best Lawyers … List 2009…Who’s In…Who’s Out…

December 27, 2008 by Barbara

2009 SOUTH FLORIDA BEST LAWYERS…

This is the latest insert…in the Miami Herald…a different publication…a different name…”Best”…not “Super”…and a different “top dog”…in Municipal Government…kinda like the Oscars…and the Golden Globes!…..

From the link…page 4 the methodology used..’.Published for more than  a quarter of a century’… ’78 specialties..representing all 50 states and District of Columbia’….these professional ‘have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers.’….It was published in Nov. 2008…’ based on 2.4 million evaluations of lawyers by other lawyers’…

‘The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago’….’Best lawyers remains the gold standard of reliability and integrity in lawyer rating.’….

‘The nomination pool for the 2009 edition consisted of lawyers whose name appeared in the previous edition of Best Lawyers….new nominees solicited from listed attorneys……Lawyers voted for lawyers within the same specialty….Lawyers in closely related specialties…were asked to cross specialties…(HMMMM)…and national/international specialties were asked to vote nationally and locally….by phone/fax or e-mail’….

‘Voting lawyers had general guidelines…for determining the best…if a close friend or relative needed a real estate lawyer…(an example)…and you could not handle it…whom would you refer them to?….Guaranteed confidentiality…they were included comments …but ultimately a lawyers inclusion is based on subjective judgment of his or her fellow attorney’..

BCbythesea…favorite part of this “lawyerly” methodology….really says it all…when said and done…

‘ While it is true that the lists may at times disproportionally reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases’…

BCbythesea…was told that the Town Manager when finally asked a long unanswered question concerning… where does she advertise for personnel…answered the Sentinel…(previous posts)…after hearing this response…this writer has checked the classifieds…and found consistently over the last weeks……that the ONLY government positions included in the paper were for non- department head positions……just as the Town used in this case for  a paid employee who serve under a department head……..

So we now know we have a resignation from the parking department…and we still do not know where the Town Manager places her ads for Town Department head personnel..still requires an answer……

Here’s The Scoop…Scene And Heard Around Town…Places To Go.. ….Local News…MPSC News…

December 26, 2008 by Barbara

12/26/08….

A late start on this the 1st Sunday of 3..thanks to Christmas being on Thursday…and providing that 3- day Sunday feel…of relaxation…for most…

Don’t ask…don’t ell…(except here)…a lucky Frisbee flying dog….on the beach…among the beachgoers…sitting on the sidelines..or strolling up and down…no alarming reactions……just looked like all enjoyed the entertainment..no harm…no foul…no ticket…

Also lots of ocean swimming enthusiasts…holidays tourist…all ages…all sizes…what is missing from this idyllic picture though…no VFD- ATVs…they are certainly called for non-stop…shifts…on a choppy sea day like today…along with jelly fish…galore!…

Walking into town…by the VFD station…4 members sitting on the back of the truck…their vehicles  parked up on the grass… plenty of parking around…no ATVs…in sight…

Assistant Manager Olinzock…was walking around…Town Hall…and a smattering of municipal workers…on duty…

Took in breakfast at By The Sea Diner…eggs…bacon…sausage…and conversation…both from the friendly staff…and those filling the seats and the booths…

None too pleased were many over  Christmas- By- The- Sea…being a non-event…they think it gave the town a black eye…and needs extra attention next year….that people would have paid for the hayrides…

Talk of some” lousy Commissioners”…some dirty politics…living in a “police state”…with codes that are un-neighborly…were brought up…(with no instigation from this writer)…just a handing out of my card after  hearing the consensus……and a nod of  being in agreement…

The food … along with the atmosphere are definitely worth a return visit…. especially since this time around…we did not order the special deep fried- french toast we hear is to die for……and the lively input heard…hearkened back to the “Louies” of old…where this writer  always heard…the movers and the shakers…sat  around talking  of politics and “lousy Commissioners!”…

Sad to say a peak inside the soon to open Wings…produced a slumping of the shoulders…no Macks Groves will this be…no upscale Wings version of what is on the Galt…much of the same already seen from competing stores neat to the circle….what a letdown!…

The restaurants were hopping…again…benches around the square were occupied…and the beach was packed!…

Again…as in the morning…no ATVs…and lots of swimmers…lots of jelly fish…and lots of questions about the Dec.16th assertions of the VFD taking on the beach …to oversee and assist…

We do need lifeguards …around the Pier…and those ATVs on a schedule that makes holidays weekends…a top priority…

From the Hi-Riser/Sentinel…by Fallon Patterson….http://www.sun-sentinel.com/community/news/lauderdale_by_the_sea/sfl-flhrbguards1225hrbdec25,0,5154409.story

Ran into Master Plan Steering Committee Chair…Paul Noak standing outside his hotel…business is good…and he confirmed what we had heard…the Fort Lauderdale Art Institute is going to make a return…with students getting involved with the El Mar medians…Sandra Booth must be thanked…big time…especially while we are still in the midst of the fallout of the major changes  made from the  Ft. Laud. A.I.-Forbes design winning  pavilion …tabs need to kept on any winning design…in this next go round…in no uncertain terms……

The scene walking back…home…north from the pier…a full crowd as far as the eye could see…the construction from the backside…Minto…Whitecap…and addresses on the most buildings…not difficult to read…while waiting for “improvements”…

I guess we are still waiting for the paint to dry on those  8 ft. wooden-posts?….

more to come…

Here’s The Scoop….Scene And Heard Around Town…

December 26, 2008 by Barbara

THE HOLIDAY….
Christmas Eve…101…dinner…The place was  full…the food was great…and Santa Silverstone… was out on the big red truck…surrounded by his merry VFD elves…making there way from Pelican Square…
No lights on the Menorah…this year…that just doesn’t seem right!…
Next year…lights by the Town…need an upgrade up and down Commercial…and extended farther down El Mar…
The Pavilion had a lot of attention…most was not good…just not good…for the timing of its construction…causing the dirt…and the dark…
The rendering itself…still brings forth  “scratching of the head” responses…for how…when… and why it turned out to be so much different than what was voted on…bid on and what we thought was going to be the “centerpiece” of this town…
Some say it may be nice in  the end…very different…but nice… but the chain of events…to the final result…… ” heads should roll”….in who took over the decision making…behind the scenes!…
It is certainly not tall enough….say most…height limit  or  no height limit…the line of sight  for the ocean is  too low…and the chosen roof colors…when did that come about…not in front of the Commission or MPSC…that’s for sure….seems for what we see  posted on the construction site fence…we could have gone with the  Yanni…produced…pre-fab…long  ago…previous post…(see variations of similar pavilions…scoops category)…

A full accounting of the finances needs further in-depth study…forgoing the underground plumbing…the walls…and the permit…yes there is a permit.. $70+ thousand less than the contract to Coastal Construction…Who’s pocketing the difference…due to the lack of walls and plumbing hook-up costs….that someone decided to ditch?…

BCbythesea hears …the Town administration is saying it did not need a permit…in the Right-Of Way…and the Commission voted to forgo it……BUT…the hired construction company went and got one on 12/1/08…so who paid the permit fees?…This one will not go away…
Christmas morning…the town was bustling…Yes….there is a Santa Clause!…The restaurants were hopping…the eggs / pancakes……and specials were being enjoyed….and everyone was happy to enjoy this glorious …Florida day….
Definitely more of these to come…for as we say here at the BCbythesea…homestead…3 more Sundays…this week to enjoy!…

NICE TO HAVE COMPANY….(See Jim This Is How It Works…Everyone Plays  a Role…..)

1….’About Us

We are fathers and mothers, brothers and sisters, husbands and wives, sons and daughters. We are residents, citizens, taxpayers. We love living in Deerfield Beach. In short, we are you. And like you, we are frustrated by our local government, our elected officials, and the influence that special interest groups have over them.

So, we have established our own special interest group. Our interests? Truth. Integrity. Taxpayer protection. We vow to shine a bright light on all the things that your representatives would prefer remain in the darkness. We will work hard to uncover the truth, as shown by their actions, and not be fooled by the words that come from their mouths.

Community leaders that exhibit the proper content of character that their constituents deserve and demand will benefit from our efforts, as they should.

Those who do not will be exposed, as they should.’

SOME BACKGROUND…….

2…..’Leaving behind a three-decade Capitol Hill career, a two-time Congressional chief of staff has returned to his journalism roots and quickly found success.

Mark Brown, chief of staff to then-Reps. Bill Hughes (D-N.J.) and Tim Roemer (D-Ind.) and past president of the House Chiefs of Staff Association, founded what has become the award-winning ByTheSeaFuture newspaper last year to serve residents of his new home in Lauderdale-By-The-Sea, Fla.

Prior to working as a staffer for 26 years, Brown was a reporter for four years at the Griffin-Larrabee News Bureau, covering Congress and the White House from 1973 to 1977 during the height of the Watergate scandal. While reporting on the Hill, Brown first met Hughes, who soon offered him a job.

Brown moved from Washington to the small oceanfront community in southern Florida after Roemer retired in 2003.

“I didn’t have the energy to start over and get another Congressman,” he said. “I decided if I wasn’t going to stay in the government and in the center of the real action, there was no reason for me to stay in Washington.”

But since his move, Brown has found ways to stay involved in politics’……

4…..’Did You Know… Lauderdale-by-the-Sea’

Did you know Lauderdale-by-the-Sea is 100 yards from the only living barrier reef system in North America? The first reef of a constantly growing 3-tiered reef system is a football field’s length from the town’s coast. This shoreline access has placed Lauderdale-by-the-Sea on the state-sanctioned snorkel trail, which extends down into the Florida Keys.

Subj: Notice of Intent Not to Renew Parking Permits

December 22, 2008
To Town Manager
Town of  Lauderdale By the Sea
Lauderdale By the Sea, Florida 33308

Notice of Intent Not to Renew

Dear Ms. Colon,

Due to the current atmosphere in the Town as created  by the actions of William Ciani and Commissioners Mcintee and Silverstone we have elected not to renew our parking contract with the Town.  In these trying times , L.B.T.S  can use its resources and energies in ways far more productive than  solving petty squabbles and turf battles.
While the trio mentioned above will surely consider this to be a surrender on our part, we do not consider it to be so. We consider our action to be our first step in helping to  return sanity to the governance of this Town. Our future energies will be devoted to helping the “adults” regain control of L.B.T.S.  In the past we, along with many others in this community, have made the mistake of  being involved only when our individual needs were at issue thus ignoring the many ethical and statutory issues that are plaguing our City. We have seen the “adult” members of the Commission and  the Community spend countless hours in  selfless  service . We intend to be a part of this effort and offer our services.
Please prepare a final accounting to reflect the diminishment of parking spaces during the term of the   contract.   Please give me a call if you have any questions.

My number is 954-465-7934 or [email protected]

Sincerely,

Louis Marchelos

So…….Faithful Readers….
‘Have yourself a merry little Christmas,
Let your heart be light                                              http://www.analogartsensemble.net/blog/garlandxmas.jpg
From now on,
our troubles will be out of sight

Have yourself a merry little Christmas,
Make the Yule-tide gay,
From now on,
our troubles will be miles away.

Here we are as in olden days,
Happy golden days of yore.
Faithful friends who are dear to us
Gather near to us once more.

Through the years
We all will be together,
If the Fates allow
Hang a shining star upon the highest bough.
And have yourself A merry little Christmas now’
