Selective in their take on Ms Geesey…her…ethics charges….while they found no probable cause for failing to report a contract to purchase a condominium on her CE Form 1, Statement of Financial Interests filed for Calendar year 2004 /2005…

‘The Commission further finds based on recommendation of the Commission’s Advocate that there IS probable cause to believe the Respondent violated Section 112.3145, Florida statutes, by failing to timely, and accurately file a CE Form 1F, Final Statement of Financial Interests within 60 days of leaving her public position for the period between Jan, 1 of the year in which she left and her last day of holding her office.’

However, because the Respondent was not timely notified of the filing requirement, and because she did not understand that income from the sale of her condominium was required to be reported, the Commission will take no further action on the alleged violation.

So there was probable cause….but they threw her a “bone” for not knowing the requirement…

BCbythesea….as a former board member….she is one lucky girl…because the paperwork is pretty clear on that requirement…and …

Did the Ethics Commission know she was a member of “Mensa”?….

OK… at the risk of further adding fuel to the fire of those in the CIC…. that this writer has taken a walk into the dark side…to the “other side “…. here goes…I agree with Editor Bown’s Editorial….not his description of the Commissioners…but his bottom line….on the taxes and the spending….

But alas….back to the great divide…the line in the middle….”Independent Row”…Brown and the Futures actually agree with the Commission in the opposition to the Calypso gas port.. this writer does not….previous posts…

on the Town Hall board… inside….at the present time…

1. Fire Marshall…requires a Bachelor of Science, Business, or Public Administration….3 years Fire Service Management skills….possess or able to obtain a fire code official certification from Broward County Board of Rules and Appeals….30-40 hours…weekly…. paid benefits….

Salary….$77,752.00- $97,150.00

2. Municipal Director….requires a BA in Business Administration,Civil Engineering, related field…5 years supervisory experience….paid retirement and health benefits…

Salary…$57,860.00- $60,860.00…

click on to Town employment….shows….’ No current job openings at this time’…HMMM….

How come?….

When this writer inquired where the ad for the Municipal Director position was being advertised… a few weeks back…Assitant to the Town Manager John Olinzock responded it remained only on the board for a period of time…in order to replace the position in- house…and would then be put out…

Since then this writer heard that LBTS employee Don Prince who was now acting as interim Municipal Director had taken the job…and everyone was pleased…previous post…

Curiously…days later in the town hall parking lot ….this writer inquired about his new position…in order to congratulate Mr Prince….he was “coy” in his response…saying they were “working on it”…so it was not a done deal….

BCbythesea…has heard that Don now has his office in the garage behind Town Hall …with a secretary…who was transfered from another department…

BCbythesea….the questions arise……..

why is the advertisement still on the board?….

Why is it not on the LBTS site?….

Has it been distributed elsewhere?…….

Does Mr. Prince have the required Bachelor degree….5 year supervisory experience …posted?….

The Fire Marshall position…also not on the site….

Where has that been advertised?….

Any responses?…It should have had a huge response….

Will the required qualifications be adhered to?…….

Upon looking at our Town website…and the Municipal Codes…also under www.municodes.com

Our Town Charter states the requirements for a Town Manager…(full text online….)

Town Manager shall be appointed solely on the basis of education and experience in accepted competencies and practices of local public management including, a graduate degree with a concentration in public administration, public affairs, public policy, public finance and two(2) years experience as an appointed city manager or county manager or four(4) years experience as an assistant city manager or assistant or deputy county manager.

BCbythesea…assumes our Town Manager met these requirements… as required by the LBTS Charter….

Not listed the educational/professional requirements of her staff…..

John Olinzock ….The Assistant to the Town Manager is stated this way …..why?….

Is there a different requirement for holding the more customary position…Assistant Town Manager?….

If not, why continue to refer to Mr Olinzock in this unusual manner?….it sure would be easier to say and write in the customary title…used by most municipalities….

What are the educational/professional requirements…of the Town Clerk?…..

Has a review been made to see all positions meet the “rules”…if there are “rules” and “regulations” required by the Charter and the state?…

Madam Manager has been quite adamant when she says …….she must “follow the rules”….when it comes to the forms being filled out for use of Jarvis Hall…..open container laws….etc….

BCbythesea…No accusations here….just wondering if the staff is meeting those requirements…and that LBTS is hiring those that are qualified….

Why does it feel like the Sentinel snubs LBTS?….even in their sister publications….

In this Thursday’s Hi- Riser… issue…page 4…a 1/2 page article  for our neighboring town to the south…. Fort Lauderdale….their schedule…their fireworks….proudly  authored by Alexia Campbell…Sun-Sentinel Staff Writer…

(The same Alexia Campbell that accommodated … the Future’s Editor a few weeks back with a spread in the Sentinel…about the USO…. LBTS  vacation weekend recipient….)

With the outstanding signs made by Town Photographer Marc Furth…now in place near most entries to Town…what will surely be the most extravagant event this Town has ever witnessed…….pulling out all the stops…with a new venue….El Prado Park/Parking Lot…. with classic cars…numbering over 50… the kiddie “playground” set to amaze the young ones… snow- cone machine…beer truck…. Peggy from Aruba…..overseeing the food….along music up to Aruba’s standards…a grand prize raffle of a 50 inch Plasma T.V…….the  “Sand Castle Sculpture” artist flown in thanks to an underwriter…that will surely be the show stopper ….leading up to the return of Jazz on the Square …and of course the fireworks…. JAM PACKED…. …WOW!….

It all follows a parade with more floats…more politicians…more digntaries…than this town has ever witnessed……

In the next few days…. people …..make a call…get Alexia Campbell on the phone…at 954-356-4513…or email her …[email protected]….tell her….

“Hey Alexia….give us some press…because on July 5th…the LBTS festivities…should be the local section…. front page story…. for being the best 4th of July event around!”….

BCbythesea….will be in Philadelphia…celebrating where it all began….so here’s hoping for a big success….that all enjoy….all “get along”…and when the Sentinel pops up on my computer screen the day after….

IS IT PAYBACK….. BEING FISCALLY RESPONSIBLE….. A BUSINESS LIFELINE?……

The expected responses about the possibility of the Chamber being relocated….to a Commercial Avenue storefront….

Will it be looked at…..like the “locking out” of the VFD by the BSO……..to many LBTS residents?

It needs to be handled….in the right manner….and not ahead of the budget…..

If it is truly to help with traffic to the businesses….why not try a “Satellite Chamber” to see if it makes that difference?….

A 3 month stint…. empty storefronts might “bite” for a trial month-to-month rental….just as the Town is doing with the warehouse….

What will be the real cost to the Chamber?….with the move…including the change of the address on everything….

What will be the actual savings?….

What will be done with the existing building?…..

A Post Office …needs the approval of the government…and should take quite some time…that is if it is even a viable option…. ….in these times of the Postal service losing business….and consolidating their facilities….

A Post Office Business….a gift shop/UPS Mail Station…would also be iffy……… could they afford the rent?…..

Can the “visitor” traffic to the Chamber be verified?

A reader recently emailed to say…he believes the numbers are inflated ……that he believes that everyone who walks in is counted….employees….residents…whether it’s for a meeting…or to pick up the local paper….YIKES?…

BCbythesea…. as one resident said….” It needs to be handled delicately.”……..

As this writer responded….”yes….and not like a bull in a china shop.”….

Commission Meeting…6/24/08

What was not covered in Scoops…#1-#11….categories…LBTS agenda/meeting & Scoops…

Invocation…Rev. Hunsaker returned to speak of discerning the betterment of all….”encourage us with thy wisdom”…

BCbythesea…nice to have the Town Chaplain back!….

Broward County Supervisor of Elections came to give a rundown on changes this year with the ballots…paper…returns…no additional time should hold up the results…and the media can back off the lack of a “paper trail” this time around…

A proclamation was …changed to a more low-key…”Thank You” to the USO recipient of the weekend in LBTS….in the future …the Mayor will offer it to the other recipients…when they are here …. off the dais..

Reports were made…all were passed….BSO police were commended for lowering the crime in town in 2007…as reported in the Sun-Sentinel… the Chief was asked about the 1st armed robbery in 2 years…in LBTS…at the former Clarion Hotel….last week…cameras will aid in this kind of apprehension …when installed in the coming weeks….

The Walk Around Committee Chair…Shirley Rusotti came to the podium for the 1st time…to ask for benches to be stripped…painted and cleaned….for “do not feed the bird” signs….and code enforcement to deal with illegal signs and signs improperly posted in town…..the benches are in the works and others will be done if they are within the budget…any items residents want addressed……call Shirley …954-205-8811….

The 1st part of the Town Manager Report was a little confusing….BCbythesea…thought from the agenda…we had cut back to 3 BSO Sergeants …but it seems we actually “earn more” by having 4 and working the “system” for when there is a vacancy?….. At least the Manager and the BSO Chief of understood….

The warehouse has been appraised…..$2.075 million….and $1.8 million…44 RFPs went out…waiting for bids….will then go on to marketing and selling…Holy Cross Hospital will be a month to month renter until sold…which will cover the property taxes…we own the building…no mortgage….

Town Attorney…items not covered in the Scoops….waiting to hear back from Oriana owners …per their Attorney Sue Delegal …to see if they are agreeable to amending the condition of the easement… also ….the million in escrow from Oriana is still with former Town Attorney Cherof as the agent….Mr Abbott was not concerned with this remaining the status quo…

Public Comments…

Not many to speak this evening…

Speaker 1……spoke of Truth, justice and the American way….the 1st Amendment …applauded the By The Sea Futures…and was still concerned about the back-up for if AMR went on strike…

Speaker 2…came as part of the 4th of July Committee to give residents the program of events for the day…and ask for participation and donations…

Speaker 3…Paul Novak…in Scoops…under Master Plan Steering Committee…

Speaker 4….came to give his regular …humorous repartee…

Speaker 5…took the opportunity to read the timely…”Old Glory Speaks”…for the 4th of July….

Unfortunately…there was a snafu…with the sign-up sheet not being out early enough… 2 speakers asked to still have an opportunity to speak….the Vice Mayor said no…although the dais should have been polled…

Ordinance 2nd reading …no required hook-up for Palm Club for sewers….was a slam-dunk…no one came forward to comment…no commission discussion…passes 4-1 Mayor Minnet dissenting…

Commissioner Comments….

Comm. Clottey…spoke o the 4th of July…gave the schedule…..asked for it to be a time “to build bridges”…”respect each other”…”talk to people”…asked for an update on the iguanas…John Olinzock responded the trapper will surveying the Town with him….spoke of AMR truck in Las Vegas…and addressed the AMR contingency plan if a strike occurs…with the Town Atty…doing some research…

Comm. Silverstone…also spoke of AMR strike scenario…responded the VFD paramedics would take over …spoke of “blue days” used by BSO…in place of a strike that would not be allowed by BSO…….and the unfortunate use of what he saw as fear-mongering….talked of the budget…thanked Shirley Rusotti…and gave Kudos to Marc Furth and the 4th of July committee…

Comm. Dodd…also spoke of the 4th…kids participation…the prizes…the Tues. 7/1/08…7:30 pm last meeting…for volunteers…acknowledged the VFD….the MPS Committee…and what monies have been saved by residents with the VFD/AMR…no sewers in Palm Club..

Vice Mayor…AMR…talked to their supervisors…they informed the Vice Mayor that replacements would be brought in immediately…the striking employees would be fired…and the supervisors themselves…all fully trained…would cover until their arrival….also the Town Manager could call on neighboring towns to step up….he then went into “his idea”…….of the Chamber moving into a storefront….which was posted on this site from a reader 3/5/08…. quite a “coincidence”…due to the fact BCbythesea…was informed afterwards during the break.. ….”they” do not read this “blog”….HMMM….also talked of the 4th….

Mayor….thanked Minto for the ribbon cutting ceremony that afternoon…followed by the luncheon….thanked those who participated in Ocean Walk clean-up….spoke of her role as leader in the Adopt-A-Street-Program….and the 4th of July event….

Consent Agenda….

We now are purchasing a lawn mower for $ 6,411.28/ a bucket truck for $51,565.00…approved parking permits…tabled the expensive LED dais lights…with Comm. Silverstone looking for a way to lower the cost with a company in California….Mayor Minnet…is pushing for fluorescent …which are cost effective…and “green”…4th of July expenditures …approved….

item f… POA to use Jarvis Hall….it probably cost more in the time it took up to discuss this…. than what it would cost to …GET RID OF THE USER FEES….the Manager all but begged for that direction…to eliminate them…they have never been used!….Also…. come on Commissioners…break away from the pack…and say…YES, STAFF SHOULD SET UP AND BREAK DOWN THE HALL….as it always has…. a deposit…maybe it should be required only if they are re-miss after using it 1 time….

BCbythesea…The POA gets $10 per member for dues…and the user fees amount will be more than all the dues collected for a 1 time use….plus…come on …you are going to ask these mostly senior residents to move and stack their chairs….re-address this one…

Old Business….

The Building Department was tabled by Comm. Dodd…although the Vice Mayor was all ready to vote it in….

BCbythesea…most do not want it this year….again…the Manager has warned …along with Broward County…a deep decline in permits…for the coming year…and most residents …say pass…

Underground wiring for Imperial/Coddrington…scratched….with the Manager saying she budgeted…0 dollars…for it!……

Boardwalks….tabled…..waiting for Town Attorney…response from Oriana…and again…most residents…say keep the “easements”…if no cost to the taxpayers…but again…pass….

New Business….Vice Mayor McIntee will be the voting delegate at the Tampa convention in Aug…for the Florida League of Cities…

The Broward Water Resource Task Force was explained by the Mayor…no vote taken….

BCbythesea hears that certain people are acting as if the Vice Mayor’s “replay”of a BCbythesea reader’s suggestion ..see previous post …(under suggestions category…March 5,2008.)…is in the works…as in…. it’s a “done deal”….. with the “scoping out” of a new Chamber storefront location….

Those doing the “scoping”…the “planning”….may want to put your finger up in the air to see… just which way the wind is really blowing?….

Before the “powers that be” leap forward and dismiss a “tradition” to some in the town….akin to those very “powers that be”…. prized “tradition”…..the VFD…..

BCbythesea…..Have that meeting Comm. Clottey had on the last agenda…ASAP…. ask the Chamber to bring their members and volunteers…… ask the hoteliers…..and the businesses…. and the residents….get their input before ….you leap!….

It just might save many from a further divide…

or make the move…… cohesive….

if that is the………. the resulting……CONCENSUS!….

DID THEY BLINK?…..

The Town Attorney’s report was once again moved up on the agenda…requested by the Vice Mayor…(is this becoming a habit?)….in order to make sure those out there in TV land…or online …were wide awake to hear the ongoing saga of The Vice Mayor VS The Future’s Editors….

BCbythesea…the live audience in Jarvis Hall was sparse to begin with….

So here you have it…right after the Town Manager’s report…the results…from the directed by the Commission….Town Attorney’s letter to the Futures…

Which included the following….

the Florida Statute 770.20….www.flsenate.gov

which asks for a full and fair correction,apology or retraction of defamatory statements…should appear in addition to a News Alert on the front page of your publication…..

BCbythesea…….anyone who left their TV on between the pre and regular commission meeting got the “heads up” by hearing the Vice Mayor telling Comm. Silverstone as he read it (the Future response letter)…on the dais…. they (the Future) were going to “publish” a “retraction”…..

The Town Attorney read the response from the Future’s legal counsel…… Attorney Dana J. McElroy of Gordon Hargrove and James…www.ghj.com

‘The Publisher carefully reviewed the letter (from the Town Atty.) with the Fl. Statue….770.20….

Although the News Alert published to online readers May22,2008 was published in good faith on information from credible sources the Publisher will publish a “Correction and Update” to online readers as the same fashion as the May 22,2008 News Alert originally was published . Additionally the Publisher will agree to publish a signed letter to the Editor from Mr McIntee or his designee responding to the May 22,2008 News Alert on the front page of the printed newspaper.’

‘As with all letters to the Editor the Publisher would reserve the right to edit defamatory and other inappropriate content and for length if necessary.’

The Vice Mayor….” I’m going to wait and see what the News Alert “retraction” looks like ….Clearly exonerates me completely and establishes that paper’s telling a bunch of lies.”

BCbythesea…..check out the previous Scoop with the Futures…”Correction and Update” as they said they would publish online… in the response letter to the Town Attorney….above….and see the definitions of “correction”/ “retraction” ………

The Vice Mayor…continued…”I hope we all learned a lesson here.”

“I’m not going to give up my rights for recovery, but I will no longer ask the Town to support an attorney to prosecute that recovery. The Town has done their fair share for me.”

He went on to say he would have to see the “retraction”….and as far as a letter to the paper….he would consult with his legal counsel….

“Under no circumstances is this over until I see their responses.”…..

BCbythesea….Called it correctly in a previous post…that the Futures would answer in the same venue as originally sent out the accusations….online with an email…..

BCbythesea….Called it correctly that those accusations were never made in the printed version of the paper…despite the Vice Mayor’s assertions and displaying of the paper on the dais…. when addressing them….which in turn had the rest of the Commission following suit…. causing confusion to those listening….

Is it over?…..

Only one way to know for sure……

If the Vice Mayor does or does not ask to move the Town Attorney Report up on the agenda …..yet again….at the July 8th Regular Commission meeting…..

CORRECTION AND UPDATE

On May 22, 2008, BY THE SEA FUTURE published a news alert to its online readership which reported that Vice Mayor Jerry McIntee has contacts with lobbyist Judith Stern on both the Calypso deepwater port project and the AMR ambulance service.

A subsequent investigation by the Town attorney has concluded that Stern placed a telephone call to McIntee in conversation with the Calypso project. In a very brief conversation, McIntee advised Stern that he did not deal with lobbyists and that any contact concerning the project should come directly from the company promoting it. McIntee had never spoken with Stern prior to this conversation.

Additionally, concerning the AMR project, the investigation concluded that while Stern generally was on retainer with AMR, she was not hired to, and did not, perform lobbying services in connection with Lauderdale-By-The-Sea’s emergency medical services procurement. Stern’s only contact with city officials concerning AMR was a brief conversation in Tallahassee with Mayor Roseann Minnet, which the investigation concluded was not “lobbying.”
