The Times is out….

BCbythesea…overview…

Bravo!… for the excellent article including the salient points pertaining to the floating gas port….

It asks the important questions …. those being lost within the movement of opposition….

the diagram…brings a visual that is… a must look…

Nice Editorial…

A way to make a more informative decision…at this point and not just jump on the bandwagon …with dire predictions that at times seem only for political purposes….political gain….

Excellent …timely article by John Thompson….should bring more to light in the looming budget…and what it really entails…beyond property taxes….

Enjoyed the addition of Jim Pollock and his 2 articles…especially the parking patrol…who were missing at the parking workshop…previous post…

He might give Bill Hubly a little competition…

Hubly is always a must read….

The expected …was included with 3 articles aimed at the Futures by the Vice Mayor… the Chair of the CIC… and a staff writer…

excellent…photos…

Aruba cover shot… VFD showing their numbers…age…. gender…

last but not least….

may we all look so fit and rearing to go as LBTS resident/CIC treasurer/VFD trainee… Tom Carr … in his photo-op….and letter ….filled with his usual “biting- edge” style …at 68 years young!

Nice issue….

not build up the many funds…. known only to the administration….

“we have the money for this”….”we do not have the money for that”….enough!

Bcbythesea …opinion….

Crane Crash

Crane crash in Manhattaan…

the equivalent of 2 Boeing jets crashing down….

Yet another random act of God?…a lack of oversight…..or Bush?

Just kidding….

but you have to admit…Bush must be smiling through the expected show of concern….

the cable news cycle…of Scott McClellen…is broken…. 5 days in….

for now….

BCbythesea NOTE:…in previous post ….wrote a post on Vanity Fair a while back…Scott’s father was written up as a “conspiracy theorist” who wrote a book about L J being responsible for JFK assassination….

Here’s The Scoop

May 30, 2008 by Barbara

What’s the deal with the purchase of the A1A property?…

There are real questions…that need real answers….

1. What fund were these “earmarked” funds in?

BCbythesea was told …from the $3.4 million fund…how so?…if that was the fund for the now defunct Palm Club sewers…that would not have left enough money to acquire the property…and…

we were told the monies in that account …were not specifically designated for the sewers…but capital improvements….

so what’s up?

2. Is the “plan” to tear down the hotel and build a brand new public safety building…or to fix it up to accommodate the VFD/AMR….similar to the “fix-up” that was put forth for Jarvis Hall and overwhelmingly rejected by the residents?

3. Does the commission and administration understand that down this way…outside of the “beltway”…those who voted with their pocketbooks…yes “those” people…who made the difference in this last election…are seeing the $ going out….at an alarming rate…

from the dais…$1.77 million for property…and  either thousands for updating the existing hotel or millions more for a public safety building…for firefighters…..4th firetruck….AMR….

and the “savings” of BSO being replaced….is rightly or wrongly…lost… or worse…..less than where we are heading….

This is the talk….besides the port….

Clarifications…need to be presented….

Questions need to be asked….and followed up on….

fast….

Commission Meeting ..cont…

May 29, 2008 by Barbara

resumed after recess…5/27/08 on 5/28/08 Jarvis Hall 3 pm..

15 New Business Cont…

c. Pre-agenda conference…Mayor Minnet…referred to Oakland Park using this forum…a review with citizens…

Comm. Dodd/Clottey had similar idea as campaign promise…Vice Mayor went into the downside from the pre- meetings with the “Old Guard”…Comm. Silverstone wondered if there was really a need…

finally a compromise of sorts to try before a meeting next month…with a possibility of trying an alternative…a few days…a week before…on a different day….passes 5-0…

d. meet your commissioners..Mayor Minnet…looking for a once a month version…

CIC board member Loyola Gray came to the podium to inform the commission an application is in process for an Aug.3/08 meeting with commissioners put on by the CIC …

e. LBTS local government academy…Mayor Minnet…gave info to Town Manager to review…

f. discussion and/or action to support resolution on floating gas port… Mayor Minnet

wanted it tabled at beginning of meeting……no second…it stayed on…wrongly written as ‘creation’…”support’ was correct item put forth…to Town Clerk for agenda…went head to head with the Vice Mayor on when she called V.P. of Suez …her dais position of being neutral…wanting debate vs her ‘package’ going out stating she is opposed to the port and will use her “full range of resources to not fund the project”…a gotcha…that did not bode well for the Mayor….the Mayor countered with her take that the Vice Mayor thwarted the invitation to this meeting when he spoke to the V.P. of Suez…telling him hew would not have the opportunity to speak at length and present his side…

g. LED lighting…Comm. Silverstone…talked of presentation made at last meeting’s public comments…Sandra Booth and her “green” education on the subject…his research…wants to test it on A1A…in Jarvis…The Mayor who is in the lighting business…disagreed ..saying the cost is prohibitive.. there was talk from Comm Dodd about solar power…Comm Clottey on light poles in Pompano…Assist. Olinzock on retro-fitting …and waiting for new lights in front of Sea Ranch Club… Vice Mayor wanted to give Comm. Silverstone what he was asking for…and a test will be done cost…$3000 max…in Jarvis with the Mayor’s direction and the Town Manager…

Vice Mayor wants a look into LBTS receiving rebates for lights not in use due to Sea Turtles…

h Master Steering appointments… Town Clerk…board appointment process…and moving up from alternate to member…..problems with applicants….

lots of discussion…Vice mayor went back to the “Old Guard”…their actions with boards…not using alternates to fill positions they removed board members from…Town Manager felt it was proper to move alternates up…Comm Dodd/ Clottey agreed….Vice Mayor reluctantly agreed…and it was passes 5-0…Robert Eckblad became new member and a second alternate was chosen… Vice Mayor expressed his opinion that many turned down joining boards due to financial disclosure requirements from state…for P&Z/BOA boards…2 new members are needed for Board of Adjustment board at next commission meeting…

i. special permit application process…Comm. Silverstone…brought up Guy …a manager from Aruba to explain the difficulties experienced recently in getting permits….Guy explained a 90 day time frame of applying for a permit…it sat on a staff member’s desk for 52 days…going into the development office 4-5 times…and getting valuable information the day of the last commission meeting that might have sped up the process if received prior…Town Manager/Assist. Olinzock were quite agitated at the account.of what took place…..and had explanation that the “helpful “info received the day of….was a “courtesy” that was not even meant to send out…

BCbythesea….opinion….the problems with the town administration…and local business was on display for all to see…if a business says the very paperwork held back by staff could have helped the process…why would it not be received as an item to implement change….to make it not just a “courtesy” but an important requirement…not the day of …but well in advance?….

Town Manager still throwing the “blame” of Jazz on the Square towards Dave Gadsby…when BCbythesea hears otherwise….

When Guy further inquired about the Sat. night music and the closing of Commercial…he was disturbingly warned by the Vice Mayor” I wouldn’t go there”…

so much for building a bridge between local business…and the administration….

j. Jarvis Hall temps…Comm. Dodd….the temp was increased to see if it would save energy and was tolerable…it was not…a readjustment will continue to find a compromise…

k. performing arts…in Jarvis Hall..Comm Dodd….a LBTS resident made presentation .. Sandi Galo- Mann representing her non- profit company…PML Studio….

all were informed by performing arts board member Loyola Gray that a board has been in existance for 9 years…town staff…commission were unaware also…

discussion after the presentation…Vice Mayor making some startling comments.. one was somewhat chauvinistic ..when throwing in some form of commission oversight to the 2 female commissioners stating…a feminine touch would be perfect on this….and a form of censorship in asking if the F word would be used…and content…stating “Middlebury town” is what we’re looking for…

a trial period of 3 months with renewal…was offered with details and liability etc…to be worked out with Town Manager…passes5-0

l. iguana control…Comm Clottey…finally as a commissioner…she was able to do what she could not as a resident…get a iguana control company to clean up the increasing town wide problem… $1000 to start in various north/south neighborhoods…Assist. Olinzock gave a website with info…www.iguanatrapper.com

passes 5-0…

m. issuance of parking permits 6/14/08…reef clean up.. Assist. Olinzock….passes 5-0

n. engineering services…emergency repair/and design, bid construction for replacement on lift station…Assist. Olinzock…passes….5-0…

16. Town Atty. Report

Bert J Harris ….Mr Abbott gave history of previous Town Atty….case was dismissed by judge who asked for an advisory claim…previous Town Atty…refiled…Mr Abbott felt to do so would bring the same dismissal…and waste taxpayers money for his services…asked to dismiss lawsuit….passes 5-0…

BCbythesea….Excellent call by the new Town Atty….sheds yet another suspicious light on the old counsel LBTS received…

adjourned…

Commission Meeting

May 29, 2008 by Barbara

LBTS 5/27/08…

different view…from home on cable…

1.Call to order

2. Pledge…

3. Invocation…LBTS resident Pauline McGinnis…gave a lovely invocation…presumably the first woman to do so…

titled …”Prayer For America”…

Mayor Minnet tried to table her item in New Business about floating gas port…in order to include Suez Rep. to participate…died for lack o a second…

BCbythesea…opinion….This would have been appropriate to second….new info came to light in her commissioner comments…see scoops category…

Vice Mayor requested his commission polled late addition to New Business…be moved up to come after presentations…

it was passed 5-0

BCbythesea….opinion…previous post…should not have been on as a late addition…under “public safety” header…should not have been moved up…should have been addressed in Comm. Comments…which it was …making this approved change all the more unnecessary…in previous posts…scoops category…

4. Presentations…RFP …Fire Services…

VFD only bidder…

Chief Perkins…Battalion Chief Pointu…

presented both a power point presentation and a large group of VFD members to the residents…

the numbers are all impressive…

1. 44 Regular members…meaning in-town members/ 38 Associate members…meaning out of town members

2. 15 Fire Fighter 1s/ 50 Fire Fighter 2s

16 presently not certified…in training/ 7 going for exam

3. 66% are 35 years of age

4. 7 minutes from dispatch to respond to a fire call

5. 9 minutes for fire engine…with minimum of crew of 3

6. 20 hrs. a week to start beach patrol

7. $25 for each fire response call

8. $20 for each attended drill/ 2 required each month

9.$844.022…with a 4% per year increase…

$375 thousand…..full/pt.time Fire.Fighters…

$394 thousand ….operation Division…

$43 thousand ….Fire prevention/Inspection…

$33 thousand…. Beach Patrol

10. The VFD is going to purchase without taxpayer monies…a 4th firetruck…

11. ISI…rating ..4..same as BSO…heading towards a 3…

The usual banter went on as in past questioning..with direct and strong …positive responses by these 2 chiefs…

Some grilling by commissioners were directed toward BSO Chief Sievers…who essentially admitted …to Comm. Dodd’s inquiries…about the report…being sub-standard …that no detailed reports would be forthcoming and are not required in the BSO/LBTS contract…along with the announcement that he too was not required in the current contract …and will be absent from LBTS as well…

Some of the above interaction was taken out of the soon to come BSO Fire Report item on the agenda…

The VFD also announced a gift of approx. $30 thousand dollars of “bumper gear” given to them by a New York Fire Dept….as a volunteer was brought forth to show all….

Vice Mayor McIntee wanted to vote in the VFD …due to no other applicants…and was advised it would be allowable by the Town Atty….

Comm. Clottey asked it for it to be voted on at the June 11th meeting as scheduled…to not add anymore fuel to the fire…the Vice Mayor agreed…

The Town Manager was directed to start on mutual aid inquiries…passed 2-1…Mayor Minnet dissenting…Vice Mayor/ Comm. Silverstone recused themselves…

New Business item…15 O was taken out of order…

Vice Mayor McIntee…as expected…in previous posts…went after the Futures…charging them with libelous acts…accusing him of criminal felonies…explaining his actions…reading letters from the Lobbyist in question…information he had from AMR President….Suez V.P….and his opinion of their intended actions against the Futures Editors….

Mayor Minnet was asked about her interactions with Lobbyist Judy Stern…previous post…and responded she did not recall meeting Ms, Stern in Tallahassee…with her adviser Terry Arthur..

Editor Mark Brown came to the podium…after being “prodded” by the Vice Mayor…

He said …if he was going to be sued …he would discuss it in court…

The Vice Mayor…told him to sit down…

BCbythesea …opinion…being no fan of either the Editor or the Vice Mayor…

Mark Brown was correct in his response… as any legal counsel would advise…and as the Vice Mayor surely knows from all his years in his profession…

The Vice Mayor was acting out to a member of the audience for the first of many times this evening in the same manner he has restricted the citizens from doing when they address the commission!

This was just the beginning of a long…grandstanding…. evening for all in attendance…

The vote for the investigation… passes…5-0…

BCbythesea opinion….never thought I would see the day I was in agreement with Diane Boutin…but this really is a day for major changes…I do…it’s an unnecessary role for the Town Atty…. to do investigate on  behalf of the whole commission….let the players involved follow through with their legal actions…and if the Vice Mayor needs legal representation separately…..provide that through Town Atty. or League of Cities……

5. Reports…

a. financial…no questions..passes ..5-0

b development…no questions…passes..5-0

c. municipal… question on parking…Minto/El Prado…Town Manager stated waiting for FPL…6 wk wait…no follow-up to when the 6 weeks started and ended……passes…5-0

d, BSO police….no questions…passes..5-0

e. BSO Fire …a continuation of grilling Chief Sievers …

he stated he missed the previous meeting …due to a family emergency…and had alerted the Town Manager …before that meeting…

BCbythesea opinion…if this took place…it should have been announced by her…if not true…it should have been corrected by her last evening…

Chief Sievers as posted above …stated he would not be around in the waning days of the BSO contracted to LBTS…no detailed reports would be submitted…and he would not send a replacement…which ..he stated is not required by contract…would not subject a fellow BSO employee to this dais…

Town Manager Colon stated she will make such a request to Sheriff Lamberti and Chieg Lello…

Report was not seconded for approval…no vote…

f. VFD…no questions…passes 5-0..

Town Manager will re-visit getting quotes for ATVs due to no RFP responses fpor ATVs which were for the outgoing BSO?…

BCbythesea ….question…why did RFPs go out for BSO Fire Rescue ATVs after their contract was not renewed…and after approval was given last month for ATV purchase of them for VFD beach patrol?…

6. Town Manager Report

a. current capital projects…

see previous post.. scoop category…

also Reef project….Sept….

Pavilion…in previous post…scoop category…

Manager sent in for 4th extension for grant…amt. was never asked by commission…

funds for project will come from General Fund…not Capital Improvement Fund…no questions asked….

b. capital balances…

spent… $2.3 million…

will have left…approx. $49 thousand…before anymore change orders etc…

asked by Comm. Silverstone…was our budget inadequate…answer from Town Manager…no…

c. Sea Colony Project…status…

Town Manager to send letter of support for project that was well within their rights to build with no LBTS height restrictions…site plan was submitted before cut off..

can now go forward if desired….see previous post…

will this take them off as a Bert J Harris claimant?

Town Atty. said it might be possible that they might be under LBTS height restriction if their present site plan sours…

d. replacement hurricane supply trailer supplies…

self explanatory…funds came from insurance company…

all of Mgr, reports… passes…5-0

7. Minutes

the Mayor caught 3 mistakes that needed to be rectified before approval..

8. Public Comments….

1. a woman came up and was angry about the kitchen being padlocked/the forms for Jarvis use/ the scheduled use of Jarvis after a commission meeting night…by the POA…

further angered… had a litany of questions for Town Atty…. commissioners belonging to same PAC/age and health of VFD trainee/job postings for town staff positions published…a requirement/Comm. allegedly asking for boycott of businesses…

2. Peanuts … went over items on agenda…liked 15D/15 E not effective in the past…parliamentary procedure adhered to was suggested….15G..liked light change…if saved/green….15 I..shorter time for permits…13D forget extra locations for surveillance network…..11G…wine and cheese permanent event…

3. a woman spoke of no signage and lights on El Mar…turtles vs humans…safety…thanked Dave Gadsby for .Jazz on the Square..

4. Vice Mayor’s wife…came to repeat…the points her husband made against charges in the Futures paper…

6. a woman spoke of town employee behavior /job performance…the comm. and the BSO Fire Chief…personal accusations…opposed the gas port…

9. Ordinances 1st reading

a, to exempt co-op from having to hook-up to sewer system as currently required…

after discussion…the Vice Mayor changed his mind.. Comm Silverstone and Mayor voted no…Dodd/ Clottey..yes… 3-2

BCbythesea opinion….this was the right ordinance to give relief to Palm Club…while they decide what to do now that no sewers will be put in by the town…no reason to kill a 1st reading…it will just cost $300+ for the town to re-publish…

b. amending music allowed from 9:30- 10:00 pm in town… passes 5-0

c. amending coconuts removal requirement…is it a missile or not?…not..passes 4-1 Mayor Minnet dissenting…

BCbythesea …opinion…let the Town do their trees…let homeowner do theirs also…or not…and what about all the “missiles:…in front of the BCbythesea Washingtonia home…the barricades…this hurricane season…or the missiles on Seagrape Drive…or the huge “missile” temporary sales trailer on Minto’s seaside lot?….

Ordinances 2nd reading

a. comprehensive plan…tabled per town planner…passes 5-0

BCbythesea …opinion…what town planner…again a cost of $300+ to re-publish

b. amending beach equipment on the beach each evening… tabled ..passes 5-0

BCbythesea…opinion…again $300+ for re- publish…seems it’s a bad time for longtime beach equipment providers…LBTS business owner …and Fort Lauderdale family business… are being removed from their livelihoods…by their commissions….

c. repeal of March elections…change…to keep municipal elections in March..passes 5-0

BCbythesea…opinion…no discussion by commission or residents……and no dissent by Mayor Minnet…a surprise…

10. Commissioner Comments

Vice Mayor… brought up Tom Carr…who was the VFD trainee brought up at public comments…defended him…his age, health…he will drive the truck…went over yet again the Futures charges…

Mayor Minnet…thanked Aruba…beach bash on Memorial day…the Chamber/USO weekend for enlisted person …thanked servicemen…women…talked of Hurricane Preparedness day 6/3 Jarvis Hall…adopt a street..addressed gas port…her position…the inaccuracy of the item on it written in the agenda..(it stated creation…Mayor put it on as support of the Resolution)…her side of talking to Suez V.P….the Vice Mayor…she was visibly upset…close-up on TV showed…angry…and talked of herself in the 3rd person….

Comm. Clottey….thanked Aruba…her take on gas port Resolution…not for it…said the commission have no control over the government…update on 4th of July…called for participation…complimented the VFD…answered the Futures …asked for correct votes to be shown…hers were tallied wrong…in previous paper…addressed the Jarvis kitchen and lights on El Mar..

Comm. Silverstone…asked for calls to him and others to disseminate any untruths published…etc…

Comm. Dodd…addressed Futures…also asked for accuracy in their vote tally…and facts…cast doubt on whole paper with such wrong assertions…4th of July update…participation…asked for P&Z board to be convened to address overlay and zoning after the recent repeal was enacted…will reserve points on gas port until June 11 meeting…

11. Consent Agenda

a. mapping tabled…passes 5-0

b. map for storm water drainage…passes 5-0

c. repair fire truck VFD…passes 5-0

BCbythesea…opinion…missed opportunity J Thompson has report showing $ BSO owes LBTS/ arbitrator requirement/ contract that states returned equipment must be in SAME condition upon return as in receipt of it..

This is what the Town Atty, should have been instructed to investigate…

d. piggybacked storm drainage maintenance…. passes 5-0

e. cerebral palsy event 6/6-8…..passes 5-0

f. A1A entry to” White Elephant” parking lot…passes 5-0

g+e…Athena Restaurant …wine and cheese event/Sat. night “Music By The Sea”…each week….passes 5-0

NOTE: BCbythesea mistake on agenda overview …a quick look at item e…was written up for Jazz on the square…saw Fri….and “glossed” over the “music of the sea”…OOPs…

BCbythesea …opinion…suspect that this flew in and was passed with no input from other businesses and after th Friday night Jazz fiasco…still not resolved…

12. Resolution

a. amending sewers to be installed in Palm Club…

Pres. of Palm Club came forth to repeat their position….passes…4-1..Mayor Minnet dissented…

13. Old Business

a, Jarvis Hall remodeling…Vice Mayor…discussion of using up to $125 thousand …withdrawn by the Vice Mayor after Mayor asked it be deferred until after budget …Town Manager will include it during budget workshops…

b. discussion of Chamber,,Comm. Dodd…reported on meeting with Chamber Pres. and requested for 2009 funding …the chamber building/other service be a part of the value …in addition to the $35 thousand …to give a correct figure of monies the town provides…Vice Mayor asked that a disc obtained by Comm. Dodd at the meeting be turned over to all commissioners/Manager as obligated to do … it now becoming a public record…Comm. Dodd…unaware of the requirement…upon his request …will turn it over to the Manager…who will make copies…

c. 4th of July budget request.. passes 4-0 Comm. Clottey recused herself…as co-chair…after the Town Atty. said it was her call…he saw no conflict…Comm. Dodd…Co-Chair voted yes…

14. public hearings…none…

15. New Business…covered A and B…then recessed until 5/28/08 3pm…

a. purchase for $1.776.5 Million the adjacent property to Town Hall…Villa Orleans…for public safety complex…

purchase price…. in between 2 appraisals that were done…with Town Manager/Town Atty. reviewing…

Town Manager reported that money borrowed from bank was “earmarked” for this purchase…

passes…. 4-1 ….Mayor Minnet dissenting

BCbythesea …opinion…

the pluses…

1. the knowledge that the warehouse has appraised higher than the purchase of property…

2. advertisement to go out this/next week…

3. money already in possession…no extra borrowing

the minuses…

1. where are these funds coming from?… which fund?…why we need info on all funds…..

2. only for public safety?

we need to get this right …lots of input from those that were involved in this in the past and present……and long range construction of the Town Complex to coordinate a plan with this purchase…

BCbythesea…has seen plans for Town Hall Complex…agree with Mayor Minnet…did show a complex including public safety…and the knowledge that certain criteria…met will allow many grants to be obtained…

b. approval of addendum to Pompano sanitary sewer agreement deleting Palm Club…passes 4-1 Mayor Minnet dissenting…

Recessed…

Today…

Gasworks off coast?. Residents not sure….Ken Kaye…

previous posts…floating gas port…1st stop on the public persuasion tour…

(Bad timing for Mayor Minnet and her first 110 day reception…that was set-up at the bank….last night…)

What a difference an election makes…

as previously posted …last election….. when Suez was having an open house …published in the sentinel at that time in Fort Lauderdale.. this was not even noticed….but now…

BCbythesea….opinion…both political parties will fight for …….

those votes….

fearing a repeat of the last presidential election….no one want angry seniors….condo owners…

no bus loads of organized groups with a cause…. as appeared at the first of these open houses last night……

so the floating gas port….to the politicians…it’s a winner for votes….for their respective sides….for now….

until….after the election in November….

This faithful readers…. is to BCbythesea….not unlike the fight to teach Intelligent Design in science classes at school….

the science is not there for teaching it…

The growing movement….with the “inferno” to “obliterate” scenarios being spouted….

the science is not there for spreading it…

Must be in the minority on this one…
